07-01-2003 - Regular Meeting - Minutes• 11 MINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL JULY 1, 2003 Mayor Herfert called to order the regular meeting of the West Covina City Council at 7:09 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. Pastor Ernie Benavides of Faith Community Church gave the invocation and Councilmember Sanderson led the Pledge of Allegiance. ROLL CALL Mayor Herfert, Mayor Pro Tem Miller, Councilmembers: Hernandez, Sanderson, Wong Others Present: Pasmant, Alvarez-Glasman, Freeland, Dewus, Dominguez, Paul, Samaniego, Yauchzee, Greene, Durbin, Villegas, Myrick, Lee, Anderson, McDonald, Houston, Tedesco, Berry REPORTING OUT FROM CLOSED SESSION No report necessary this evening. CHANGES TO THE AGENDA City Manager Pasmant stated that there is an additional handout regarding fee schedule for Item B-4b (Environmental Legal Services Renewal). . PRESENTATIONS Mayor Herfert presented Resolutions of Commendations to out- going commissioners: * Frank Michaud, Community Services Commission * Frankie Baker, Senior Citizens Commission Mayor Herfert recognized Larry Crain, owner of Charisma Floats, who presented a large rendering of West Covina's 2004 Rose Float entitled "The Three Tenors." The Blue Star Video was aired and followed by a presentation of a Blue Star placard to April (age 11) and Kelly (age 6) Sassaman in honor of their father who is currently serving in the United States Army. Anita Ron and Bruce Sims of the West Covina Chamber of Com- merce presented checks to representatives of the West Covina Fire Department and the Police Department for participating in the Chamber's fundraiser "Shoots and Ladders." The departments choose their favorite charities to forward their checks to: Fire: Stepping Stones for Women Police: W.C. Police Department Explorers Mayor Herfert made the following announcement to the appreciative audience: Danny Haren, son of Public Safety Dispatcher Gladys Hazen, just pitched his first big league baseball game with the St. Louis Cardinals and he is only 22 years old! ORAL COMMUNICATIONS Cookie Nance, 1236 W. Eckerman Avenue, noted the importance of police helicopters and gave the example of its success in locating a missing eleven year -old. Miscellaneous — Risk Management Placement of General and Auto Liability Insurance Coverage and Approval of Membership in the Big Independent Cities Excess Pool(BICEP) Recommendation is to adopt the 'following resolution to provide placement of the FY 2003/04 General and Auto Liability Insurance Coverage at a premium of $295,000 and self -insured retention of $1 million: Resolution 2003-71 RESOLUTION NO.2003-71 — A RESOLUTION OF THE BICEP CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, APPROVING MEMBERSHIP IN THE BIG INDEPENDENT CITIES EXCESS POOL, APPROVING THE LIABILITY RISK "COVERAGE AGREEMENT AND APPOINTING SPECIFIC REPRESENTATIVES TO THE BIG INDEPENDENT CITIES EXCESS POOL ABC Grant Miscellaneous — Community Services Establishing the West Covina Community Services Foundation 501(c)(3 Recommendation is to approve the formation of a West Covina Community Services Foundation'50i(c)(3). Miscellaneous — Police Department Acceptance of ABC Grant Recommendation is to take the following actions: 1. Accept the ABC grant and authorize the addition of one additional sworn Police position (an "Alcohol Detective") during the life of the grant. 1'a Council Minutes of 7/l/03 2. Appropriate this $98,308 reimbursable grant as follows: • $66,852 in XXX-320-2110-5111 (salary of Alcohol Detective) • $20,056 in XXX-320-2110-5XXX (benefits) • $4,900 in XXX-320-2110-5113 (overtime for alcohol investigations & operations) • $2,000 in XXX-320-2110-6270 (supplies) • $2,000 in XXX-320-2110-7160 (equipment, including portable radios) • $2,500 in XXX-320-2110-6050 (travel & registration to mandatory ABC meetings) 3. Resolution 2003-72 RESOLUTION NO.2003-72 — A RESOLUTION OF THE ABC Grant CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, APPROVING THE ABC ALCOHOL ENFORCE- MENT GRANT, AND AUTHORIZING THE COMPLETION AND SUBMISSION OF SUBSEQUENT DOCUMENTATION Miscellaneous — Redevelopment Agency Auto Plaza Business Improvement District Recommendation is to adopt the following resolution: Resolution 2003-73 RESOLUTION NO.2003-73 — A RESOLUTION OF THE Auto Plaza Bus. Improve. Dist. CITY COUNCIL OF THE CITY OF WEST COVINA, TO LEVY ASSESSMENTS WITHIN THE WEST COVINA AUTO PLAZA BUSINESS IMPROVEMENT DISTRICT AREA FOR FISCAL YEAR 2003/04,AND` PROVIDING NOTICE OF PUBLIC HEARING THEREON TO BE CONDUCTED JULY 15, 2003 CONSENT CALENDAR ACTION Councilmember Wong asked if the five members to the West Covina Community Services Foundation would be appointed by the Councilmembers using the same procedures currently in place to appoint commissioners. City Manager Pasmant responded in the affirmative. Motion by Sanderson and seconded by Hernandez to waive further reading of the resolutions and adopt; and to approve all other items listed on the Consent Calendar. Motion carried by roll call vote: 'AYES: Hernandez, Miller, Sanderson, Wong, Herfert NOES: None Mayor Herfert stated that he forgot about the speaker cards and called Juan Reinoso to tlie podium regarding Item C-4a (Graffiti Removal Contract Renewal). , Juan Reinoso Juan Reinoso, 1623 E. Marbury and president of Urban Graffiti Enterprise (Graffiti Removal and Pressure Wash Services), believed that the City should not grant a contract extension to the Boys and Girls Club of San Gabriel Valley for graffiti removal. He said the current contraciors' didn't remove graffiti in 24 or 48 hours and didn't match the color of walls and fences very well. . His company has served many cities and counties, and he suggested that Council not grant the contract extension and rebid the contract. Motion by Sanderson and seconded by Hernandez to reconsider the matter. Motion carried 5-0. Herb Redholtz Herb Redholtz, 2622 Altamira Drive, said the current service is fine. K Council Minutes of 7/l/03 Royal Brown Royal Brown, 2153 Aroma Drive, commented on graffiti removal. Maria Gutierrez Maria Gutierrez, 1623 E. Marbury, opposed the contract extension and said that the Girls and Boys Club used youths working off community service hours. • Joanne Wilner Joanne Wilner, 2108 Casa Linda, expressed mixed feelings about the current graffiti removal program. Sometimes the graffiti is removed quickly and sometimes the paints don't match. Environmental Management Director Samaniego presented the staff report, discussing the limited opportunities for hydro -blasting, the current contract/invoicing arrangements, and that the current contractor has not asked for increases. Councilmember Sanderson asked about time frames should the City Council decide to authorize rebidding and Mr. Samaniego responded that the current contract could be extended on a monthly basis. Rebid Graffiti Removal Motion by Hernandez and seconded by Sanderson to strengthen the specs and rebid graffiti removal for the City. Motion carried 5-0. HEARING CODE AMENDMENT NO.02-03 — BODY PIERCING City Clerk Berry verified the affidavit of publication and Mayor Herfert opened the public hearing. Senior Planner Anderson pre- sented the staff report and noted that Mr. Claro Cartegena from the Los Angeles County Health Department was available to answer questions. Public Testimonv Mayor Herfert opened the public testimony portion of the hearing and asked for comments'regarding'the code amendment. John Scheuplein John Scheuplein, 1800 Aroma Drive #247, noted that adopting this code amendment would permit what is already been done in the community and would add regulations and enforcements to make it safer for citizens. Katherine Castucci Katherine Castucci, 430 S. Pima, spoke from her experience as a nurse. Her concerns encompassed the need for sterilization of the equipment and asked about any City liability in the event a customer contracted the HIV virus from a previous customer. City Attorney stated no. Mr. Cartegena, Manager of Body Art Program for Los Angeles County, explained the required training, safe guards, regulations for routine equipment monitoring, etc. Testimony closed Mayor Herfert closed the public testimony portion of the hearing and commenced Council discussion. • Councilmember Miller suggested that notification of this code amendment was vital and suggested the West Covina Discover, a Tribune article, and perhaps an insert with business license renewals. Councilmember .Sanderson suggested an article could also be placed in the Westfield Shopping Center newsletter. Motion by Hernandez and seconded by Sanderson to forward a letter supporting the adoption of the International Building Code as promulgated by the International Codes Council to the State of California Department of Housing and Community Development and our local legislators.
