02-04-2003 - Regular Meeting - MinutesMINUTES REGULAR MEETING WEST COVINA CITY COUNCIL FEBRUARY 4, 2003 Mayor Pro Tern Herfert called to order the regular meeting of the West Covina City Council at 7:15 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. Pastor Kelly DuPee of Faith Community Church gave the invocation and Councilmember Sanderson led the Pledge of Allegiance. ROLL CALL Mayor Pro Tern Herfert, Councilmembers Miller, Sanderson, and Wong Absent: Mayor Touhey (ill) Others Present: Pasmant, Alvarez-Glasman, Freeland, Dewus, Durbin, Bachman, Hoppe, Johnson, Bommarito, McIsaac, Tedesco, Lee, Fields, Samaniego, Berry REPORTING OUT FROM CLOSED SESSION City Attorney Alvarez-Glasman reported that the City Council and Redevelopment Agency met in closed session at 6:12 pm as scheduled to discuss items previously and properly noticed. He stated that no final actions were taken and there was nothing further to report. Upon request by Councilmember Wong, City Manager Pasmant elaborated on the issue of unreported trash discovered at the landfill. Mr. Wong requested that the item be agendized for the next City Council meeting. APPROVAL OF MINUTES The following sets of minutes were approved as presented: Special meeting of January 7, 2003 Regular meeting of January 7, 2003 Special meeting of January 23, 2003 PRESENTATIONS Mayor Pro Tern Herfert stated that due to reapportionment the City of West Covina has new representatives and tonight the City wishes to present City tiles to the newly elected officials. Tiles were presented to the following field representatives: * Nidia Bautista for Congresswoman Hilda Solis * Ed Espinosa for State Senator Gloria Romero * Jorge Adame for State Assemblyman Ed Chavez * J. Gomez for County Supervisor Michael Antonovich Mayor Pro Tern Herfert recognized Reserve Officer Don Holtz, • who attends to just about every Council meeting. ORAL COMMUNICATIONS Phil Clayton Phil Clayton, 3298 E. Holt Avenue, chastised the Mayor for assisting with locating Wal-Mart in the City of Baldwin Park, a deal that will cost the City of West Covina approximately $400,000 in sales tax revenues. Council Minutes for 2/4/03 Corey Warshaw Corey Warshaw, 3330 E. Holt Avenue, presented the Mayor Pro Tem with a gift from the grand opening activities of the Active Health Care Medical Clinic in West Covina. Emma Fischbeck Emma Fischbeck, 130 Barranca Street, discussed her concerns regarding the Athens' bin survey (number of bins and various rates) that has not been submitted yet and the inequity in the charges, particularly for the condo complex she lives in. Council comments followed. Marian Purdy Marian Purdy, 242 N. Lang Avenue, complained about a noisy neighbor (band practicing in the garage) and asked for an ordinance that would impose a fine. Police Chief Wills responded there were ordinances on the books currently and would contact Mrs. Purdy. The City Council requested a report on the conclusion of the matter. Herb Redholtz Herb Redholtz, 2622 Altamira Drive, discussed a notice received in the mail today from Charter Communications raising the cable rates. He wondered about this if the company didn't have a current contract with the City. Mayor Pro Tern Herfert stated that the City has not had a contract with Charter for the last two years. The City is in dispute over the sale of the company to Paul Allen and would balance the payments of the sale on the backs of the ratepayers. It happens that the federal government regulates the cable companies - the City has control over very little. City Attorney Alvarez-Glasman stated that the City Council would be conducting a hearing on April I't regarding the revocation of the franchise with Charter. Mayor Pro Tern Herfert requested the subject matter of objecting to the rate increase be agendize for the next meeting. Don Carman Don Carman, 1238 Hollencrest Drive, discussed his objections with Charter Communications, from service to marketing techniques. Royal Brown Royal Brown, 2153 Aroma Drive, complained, about Covina candidates political signs located in the City of West Covina. County Household Hazardous Waste/ Electronic Waste Collections ("Roundup") in West Covina Recommendation is to authorize the Environmental Management Director to sign the County Household Hazardous Waste Collection Program Siting Liability Agreement with Los Angeles County. Miscellaneous — Community Services Reapplication for Older Americans Act Funds Recommendation is to adopt the following resolution: RESOLUTION NO. 2003-6 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AUTHORIZING THE SUBMITTAL OF THE PROPOSAL FOR COMPETITIVE GRANT FUNDS FOR THE SENIOR NUTRI- TION PROGRAM Motion by Herfert and seconded by Sanderson to waive further reading of the resolution and adopt, and to approve all other items except Item B-6a (2003 Investment Policy). Motion carried by roll call vote: AYES: Miller, Sanderson, Wong, Herfert NOES: None ABSENT: Touhey Item B-6a Relative to Item B-6a (2003 Investment Policy), Councilmember Miller requested the Finance Director to discuss the difference and similarities between the City's investment policy and the County's investment policy. Finance Director Bachman stated that he would be able to provide that by the next meeting. Motion by Miller and seconded by Sanderson to hold over until the next Council meeting. Motion carried 4-0. HEARINGS Mayor Pro Tern Herfert announced that he would be requesting RDA Item ILA to be held over until Mayor Touhey is able to attend. No hearings scheduled for this evening. COMMUNITY SERVICES INVITATION TO PARTICIPATE IN 2004 TOURNAMENT OF ROSES PARADE 2004 Rose Float Interim Community Services Director Samaniego presented the staff report. Councilmember Miller requested a clarification on the balance sheet of the Preliminary Financial Report presented by staff. Further discussion of the float funding led to questions by Councilmember Wong: Could the City arrange for a smaller float for less than $100,000 and is it too late to go out to bid for the 2004 float. Motion Motion by Herfert and seconded by Sanderson to advance the $2500 entry fee on behalf of the West Covina Rose Float Foundation and request reimbursement. Councilmember Miller recalled a pledge made by the City Council of raising $20,000 each towards the cost of the float. Dis- cussion followed regarding that recollection and Councilmember Sanderson requested a copy of the Council tape at which that pledge was made. Action Action on the motion to advance the $2500 entry fee carried 4-0. 3 Council Minutes for 2/4/03 • • REDEVELOPMENT AGENCY Vice Chairman Herfert called to order the Redevelopment Agency meeting at 8:26 pm. To consider the following item concurrently with a related RDA item, the City Council was reconvened. FINANCE DEPARTMENT MID -YEAR OPERATING BUDGET REVIEW Finance Director Bachman presented. the staff report, discussing the mid -year budget review for both the City and the Redevelop- ment Agency. He responded to questions and comments regarding both entities. Police Chief Wills responded to a question regarding the number of sworn personnel and vacant positions in the Police Department. Redevelopment Agency Director Chung responded to questions regarding legal costs concerning the BKK/Big League Dreams project. Corey Warshaw Corey Warshaw, 3330 E. Holt Avenue, also questioned the legal costs for the BKK/Big League Dreams project. Mayor Pro Tent Herfert asked about the reserve level. Finance Director Bachman responded $53.3 million. Mr. Herfert congratu- lated staff on the sizeable reserve level. Councilmember Miller asked for a breakdown of those reserves and Mayor Pro Tern Herfert requested that breakdown be agendized for the next Council meeting. Action Motion by Miller and seconded by Herfert to hold over this matter until the next City Council meeting. Motion carried 4-0. Mayor Pro Tern Herfert finished the remaining RDA items and at 9:01 pm the RDA was adjourned and the City Council continued with the remaining City Council agenda items. All Council - members were present, except Mayor Touhey. MAYOR'S REPORTS No reports for this meeting. COUNCILMEMBERS' REPORTS Councilmember Miller — SCAG — City Council Liaison Meetings Councilmember Miller presented an overview of the highlights of the SCAG meeting. Motion by Miller and seconded by Sanderson to receive and file the informational report. Motion carried 4-0. On another matter, Councilmember Wong expressed his support for the issue Emma Fischbeck has been discussing at the Council meetings. The rates charged by Athens Services versus the services provided are inequitable and he added that it is high time for the City Council to correct this. Councilmember Wong requested that the issue of Athens' rate structure be agendized for the next Council meeting. On another matter, Councilmember Sanderson reported that the County of Los Angeles has an anti -gang ordinance and requested that it be reviewed and agendized for the next Council meeting. Councilmember Miller — League of CA Cities — City Council Liaison Meetings Councilmember Miller summarized his report. 2 Council Minutes for 2/4/03 On another matter, Councilmember Miller requested that staff create a draft ordinance prohibiting political signs in the public right-of-way.
