Mayor Touhey called to order the regular meeting of the West Covina City Council at 7:00 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. Reverend John Foye of Christ Fellowship Church gave the invocation and Councilmember Wong led the Pledge of Allegiance. ROLL CALL Mayor Touhey, Mayor Pro Tem Herfert, Councilmembers Miller, Sanderson, Wong Others Present: Pasmant, Fields, Alvarez-Glasman, Tompkins, Yauchzee, Hatch, Orta, Freeland, Genovese, Morgan, Hoppe, Sahagun, Bommarito, Houston, Tedesco, De Zara, McIsaac, Wills, Bachman, Berry APPROVAL OF MINUTES Councilmember Wong submitted corrections to the City Clerk for the regular meeting of September 17, 2002. The following sets of minutes were approved with corrections to September 17: Special meeting of September 17, 2002 Regular meeting of September 17, 2002 Special meeting of October 1, 2002 Regular meeting of October 1, 2002 Special meeting of October 9, 2002 PRESENTATIONS Mayor Touhey presented a Resolution of Commendation to Joseph Iniguez, Jr. for being selected as West Covina Community Hero for his civic contributions. Mayor Touhey announced a reception in the Community Room, following the remaining presentations, in honor of Joseph's recognition. With the assistance of John Klena, Manager of the West Covina America Little League All -Stars District 19 Champions, 9-10 Year Olds, Mayor Touhey presented Certificates of Recognition to each member of the baseball team. With the assistance of Larry Carter, Manager of the West Covina American Little League All -Stars District 19 Champions, 11012 year Olds, Mayor Touhey presented Certificates of Recognition to each member of the baseball team. Mayor Touhey recognized Margo Perusse, the Executive Director of the Family Birth and Newborn Center at Citrus Valley Medical Center- Queen of the Valley Campus, and presented her with a Certificate of Recognition for the 30`s Anniversary of the Newborn Intensive Care Unit at the hospital. • Mayor Touhey recognized Candace de Zara, West Covina Fire Explorer, who received the Explorer of the Year Award. Carlos Thrasher announced the upcoming Veterans Day Ceremony to be held at the Civic Center and the golf tournament for the Toys for Tots Program. Council Minutes of 10/15/02 • 0 Recess Mayor Touhey called a recess at 7:25 pm to provide time for the audience to participate in the cake and punch in the Community Room, honoring West Covina's Community Hero, Joseph Iniguez, Jr. The City Council meeting reconvened at 7:38 pm with all members present. Mayor Touhey recognized Robert Zeller and presented him with a Resolution of Commendation for his work on the Personnel Com- mission. Mr. Zeller recently resigned from the commission. ORAL COMMUNICATIONS Corey Warshaw Corey Warshaw, 3330 E. Holt Avenue, spoke as a member of the CARE Loan Review Committee and gave a status report on the work completed. He requested Council to consider appropriating more funds for disbursement as this year's allotment of funds have been used. Emma Fischbeck Emma Fischbeck, 130 S. Barranca Street, discussed the inequities of the trash rates between commercial service and service provided to condominium complexes. She is the president of the Courtyard Home Owners Association. Chris Nuhfer Chris Nuhfer, 1614 Lark Ellen, spoke of his problems with the police in issuing traffic tickets to him unfairly. Phil Clayton Phil Clayton, 3298 E. Holt Avenue, addressed Mayor Touhey's campaign reports and asked questions regarding his contributions. Mayor Touhey responded. HEARINGS No hearings scheduled for this meeting. CONSENT CALENDAR Commissions/Summaries of Action (receive & file) Community Services 9/10/02 Personnel Commission 9/10/02 Planning Commission 10/8/02 Senior Citizens Commission 9/12/02 Waste Management/Environmental Quality 9/16/02 Claims Against the City (deny & notify claimant) On May 6, 2002 the City Clerk's Office received a claim from Frank Estrada for property damage in the amount of 3,370. Claimant is seeking to recover costs he incurred to replace the sewer lateral at his residence. On July 30, 2002 the City Clerk's Office received a claim from Jay J. Neal for property damage in the amount of $9,178.32. Claimant is seeking to recover cists to repair damage of his recreational vehicle. On April 1, 2002 the City Clerk's Office received a claim from Juan Higuera for personal injuries. The amount of claim had not been determined at time of presentation. Claimant is seeking monetary compensation for injury to his left wrist. On August 9, 2002 the City Clerk's office received a claim from Phyllis Gardner for monetary loss in the amount of $235. Claimant is seeking to recover costs she incurred for the release of her impounded vehicle. Council Minutes of 10/15/02 Award of Bids Five -Year Extension of the Landscape Maintenance Contracts for Maintenance Districts No. I. 2, and 4 Landscape Maintenance - Recommendation is to take the following actions: Azteca Landscape 1) Waive the formal bidding process per WCMC § 2-333(I)(2) and extend the existing contracts for an additional five • years with a ten percent decrease in the contract amount. 2) Authorize the Public Works Director/City Engineer and City Clerk to execute the agreement with Azteca Landscape of Pomona, CA. Purchase of Ford Expedition for Fire Department Senior Volunteer Program Utilizing Grant Funding_ Ford Expedition - Recommendation is to take the following actions: Villa Ford 1) Award the bid purchase to Villa Ford for a 2003 Ford Ex- pedition, according to specification in Bid No. 0702-A, purchase price $30,039.37. 2) Transfer the funds from the General Fund to Account No. 139-320-2182-7170 to purchase the senior volunteer vehicle. Self -Contained Breathing Apparatus Purchase Special T Fire Equipment Recommendation is to authorize the award of bid to replace outdated breathing apparatus with new ones to Special T Fire Equipment. Award of Bid for Lease/Purchase of Fire Engine Replace Fire Engine Recommendation is to take the following actions: Jay Bressler Fire & Rescue 1) Award the bid to Jay Bressler Fire and Rescue Apparatus Spartan -Saulsbury for the lease/purchase of one Spartan - Saulsbury fire engine according to specifications for Bid No. 2000-7. 2) Adopt the following resolution: Resolution 2002-110 RESOLUTION NO. 2002-110 — A RESOLUTION OF Approving lease agreement THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AUTHORIZING THE EXECUTION AND DELIVERY OF A MASTER LEASE AGREEMENT, EQUIP- MENT SCHEDULE NO. 01, AN ESCROW AGREEMENT, AND RELATED INSTRUMENTS, AND DETERMINING OTHER MATTERS IN CONNECTION TI4EREWITH Miscellaneous — Personnel Services Name Change of Personnel Services to Human Resources Human Resources Recommendation is to approve eliminating the name "Personnel Services Department" and adopt the recommended title of "Human Resources Department" and approve the classification name changes of "Director of Personnel' to "Director of Human Resources" and "Personnel Analyst" to "Human Resources Analyst." Personnel Commission Change in Meeting Time Recommendation is to adopt the following resolution: Resolution 2002-111 RESOLUTION NO. 2002-111 — A RESOLUTION OF THE . Change in meeting time CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, CHANGING THE MEETING TIME OF THE PER- SONNEL COMMISSION (from 7:30 pm to 6:30 pm) Miscellaneous — Environmental Management BKK Landfill Closure Plans Monthly Status Report Recommendation is to receive and file the status report. 3 Council Minutes of 10/15/02 Miscellaneous — Police Department OTS Seat Belt Compliance Grant Seat Belt Safety Program Recommendation is to take the following actions: 1) Accept the State Office of Traffic Safety CSBCC grant and appropriate the $12,073 as follows into the 198-320-2111 accounts: • * $9,192 into 5113 for traffic enforcement overtime; * $910 into 5151 for overtime Workers' Comp benefit; * $133 into 5155 for overtime Medicare benefit; * $1,838 into 5157 for overtime retirement benefit. New Grant to Fund Three Police Officers Grant for 3 Police Officers Recommendation is to take the following actions: 1) Accept the COPS UHP grant for $225,000 over three years, and appropriate the first year as follows: * $35,000 into 136-320-2110-5XXX * $35,000 into 136-320-2111-5XXX * $35,000-into 136-320-2112-5XXX 2) Appropriate the remaining 2001 SLESF grant of $151,557 to 155-320-2110-5XXXX from the fund balance, as part of the required cash match. 3) Accept and authorize appropriation the next SLESF grant (an estimated $216,706) into 155-320-2110-5XXX as the continued cash match. Miscellaneous — Fire Department Training Reimbursement Fund Agreement — Palo Verde Community College District Training Reimbursement Recommendation is to authorize the Fire Chief to enter into an agreement with Palo Verde Community College District for participation in the joint training program. Miscellaneous — City Clerk's Office Follow -Up to Biennial Review of the City's Conflict of Interest Code City Manager Pasmant pulled this item from the Consent Calendar and it was not considered by the City Council at this meeting. CONSENT CALENDAR ACTION Motion by Herfert and seconded by Miller to waive further reading of the resolutions and adopt, and to approve all other items listed except Item C-4a. Motion carried by roll call vote: AYES: Herfert, Miller, Sanderson, Wong, Touhey NOES: None Item C-4a In relation to Item C-4a (Changing the name of Personnel Services to Human Services), the following individual addressed Council: John Scheuplein John Scheuplein, 1800 Aroma Drive, noted his support and suggested that the commission also change names. City Manager Pasmant noted that the Personnel Commission is still deliberating • that issue. Motion by Herfert and seconded by Miller to approve the staff recommendation. Motion carried 5-0. END OF CONSENT CALENDAR Council Minutes of 10/15/02 PUBLIC WORKS CAPITAL IMPROVEMENT PROGRAM AND BUILDING ACTIVITY REPORT — THIRD QUARTER 2002 Public Works Director/City Engineer Yauchzee narrated a five- minute video on the improvements during this particular quarter. Councilmembers expressed their pleasure with the progress made by the Public Works Department. Councilmember Sanderson commended the Public Works Departmental personnel, as the City is looking great. Councilmember Wong requested a status report on the work that's been done on Vincent Avenue. Motion by Herfert and seconded by Miller to receive and file the report. Motion carried 5-0. PLANNING DEPARTMENT No reports for this meeting. PERSONNEL SERVICES 1) AMENDMENT TO MEMORANDUM OF UNDER- STANDING —FIREFIGHTERS' ASSOCIATION WC Firefighters MOU Personnel Director Tompkins presented the staff report. Recommendation is to take the following actions: * Approve the amendment to Section 9, Retiree Health Benefit, of the current MOU, to provide up to $400 per month to offset retiree medical premiums, subject to verification of premium payment amount, for all retirees effective December I, 2002. * Appropriate $23,100 to Account No. 110-320-2550- 5160. * Adopt the following resolution: Resolution 2002-112 RESOLUTION NO. 2002-112 — A RESOLUTION OF MOU Amendment THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION NO. 2002-22, RELATING TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND WEST COVINA FIREFIGHTERS' ASSOCIATION, I.A.F.F., LOCAL 3226 Motion by Herfert and seconded by Sanderson to waive further reading of the resolution and adopt, and to approve the preceding two recommendations. Councilmember Wong stated that he would not support the motion because he felt this item came up after the normal process of meet and confer. Councilmember Miller stated his objections as well. He stated that he would have no problem considering the benefit within the meeting and confer process. Motion carried 3-2 with Miller and Wong voting no. AMENDMENT TO PUBLIC EMPLOYEES' RETIRE- MENT SYSTEM RETIREE HEALTH BENEFIT CONTRIBUTION — FIRE SAFETY EMPLOYEES Council reviewed the staff report. City Clerk Berry presented: Resolution 2002-113 RESOLUTION NO. 2002-113 — A RESOLUTION OF Fire Safety Retirees THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION NO. 2000-42, FIXING THE EMPLOYER'S CONTRI- BUTION UNDER THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT Motion by Herfert and seconded by Sanderson to waive further reading of the resolution and adopt. Councilmember Wong Councilmember Wong requested a status report for the next meeting in relation to the accounting of the BLD project: which bills have been paid to which vendors, what amounts have been authorized but not expended, and anticipated budgeted items that have not yet come before the City Council. Mayor Touhey Mayor Touhey reported on the fire memorial at New York City at which he had the privilege of attending with repre- sentatives from the City's fire department.
