03-05-2002 - Special Meeting - Minutes• u MINUTES SPECIAL MEETING WEST COVINA CITY COUNCIL March 5, 2002 Mayor Wong called to order the special meeting of the West Covina City Council at 6:10 pm in the City Manager's Conference Room at City Hall, 1444 W. Garvey Avenue, West Covina. ROLL CALL Mayor Wong, Mayor Pro Tem, Councilmembers: Herfert, Miller, Sanderson Others Present: Pasmant, Fields, Alvarez-Glasman, Docemo, Adams PUBLIC COMMENT ON ITEMS ON THE AGENDA Frances Nelson Frances Nelson, 1049 E. Casad Avenue, spoke in support of "Moe the Chimp's" owners: La Donna and St. James Davis. She also complained that the Police was harassing her. Sal Yniguez Sal Yniguez, 616 N. Vincent Avenue, spoke in support of "Moe the Chimp" and stated the he visited the chimp every Tuesday. Moe's cage has been moved to the back of the compound where Moe is isolated from the other animals. He hoped the facility would move the cage toward the front of the compound. La Donna Davis' grandmother, Terry, also spoke in support of the Davis family. Marion Pettee Marian Pettee, Executive Director of the West Covina Chamber of Commerce, requested the City Council to continue the leasing arrangements with the Chamber. CLOSED SESSION Mayor Wong commenced the closed session at 6:25 pm to discuss the following matters: CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION Pursuant to Government Code § 54956.9(a] Davis vs City of West Covina CONFERENCE WITH REAL PROPERTY NEGOTIATORS Pursuant to Government Code § 54956.8 Property: 811 S. Sunset Avenue Agency Negotiators: Pasmant, Alvarez-Glasman Negotiating Party: Chamber of Commerce Under Negotiation: Price and/or terms of payment CONFERENCE WITH LABOR NEGOTIATOR: Adams Pursuant to Government Code § 54957.6 * Non -represented Groups * West Covina Police Management * West Covina Police Officers' Association Council Minutes of 3/5/02 Special Meeting CONFERENCE WITH LEGAL COUNSEL — POTENTIAL LITIGATION Pursuant to Government Code § 54956.9(b) Two cases • Recess Mayor Wong recessed the special meeting at 7:00 pm in order to conduct the regularly scheduled City Council meeting downstairs in the Council Chambers. At 9:27 pm the regular meeting was adjourned and the City Council reconvened in the conference room in the Council Chambers with all members present. Reporting Out City Attorney Alvarez-Glasman announced that the City Council had recessed to a closed session to discuss one of the potential litigation matters; that all five members of the Council were present; that by unanimous vote the City Council authorized the City Attorney's Office to file a lawsuit against the City of Covina relating to the IKEA project; that the lawsuit is being filed to challenge the Environmental Impact Report in order to protect the safety of its residents relative to traffic and other negative environ- mental impacts created by the IKEA project.
