11-20-2001 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL November 20, 2001 • Mayor Wong called to order the regular meeting of the West Covina City Council at 7:21 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. Pastor Ernie Benavides of Faith Community Church gave the invocation and Councilmember Miller led the Pledge of Allegiance. ROLL CALL Mayor Wong, Mayor Pro Tem Touhey, Councilmembers Herfert, Miller, Sanderson Others Present: Pasmant, Alvarez-Glasman, Fields, Freeland, Anderson, Keating, Urban, Morgan, Genovese, Greene, Schimanski, Yauchzee, Chung, McIsaac, Dominguez, Samaniego, Wills, Lee, Berry APPROVAL OF MINUTES Councilmember Miller offered corrections to pages 3 and 6 of the minutes for the October 16d' regular meeting. The following minutes were approved, as corrected by Mr. Miller: Special meeting of October 16, 2001 Regular meeting of October 16, 2001 Special meeting of October 30, 2001 Special meeting of November 6, 2001 Regular meeting of November 6, 2001 PRESENTATIONS Mayor Wong introduced Mary Eileen Geer, one of five California Teachers of the Year. She teaches at Merlinda Elementary School and received a Certificate of Recognition from the Mayor. Assisting him with honoring Mrs. Geer were W.C.U.S.D. Board of Trustees Carrie Poulos, Mike Spence, Steve Cox; Superintendent Dr. Fish; and Merlinda School Principal Cheryl DeNoi. Bob Borden, President of the Hurst Ranch Foundation, gave a ten- minute presentation on the status of Hurst Ranch. Councilmember Herfert commented further on the donation to the City. Chief Warrant Officer II Carlos Thrasher of the United States Marine Corps announced the City and Marine Corps' joint partnership in the annual Toys for Tots program. He noted that the last day to drop off a gift is December 14, Councilmember Herfert announced the annual Muscular Dystrophy Christmas Party for the kids at the Elks Lodge on December 2" d at 4:00 pm. For more information, please contact John Hughes • ORAL COMMUNICATIONS Bill Roe Bill Roe, 1510 Newcrest Drive, (Community Services Commis- sioner) thanked the City Council for adjourning a past Council meeting in memory of David Aoyama, who died on September 11, 2001, in the New York Trade Center disaster. He also welcomed the new City Manager to West Covina. Ed Casanova Ed Casanova, 809 Avington, gave thanks to the people who helped him in June when he suffered a brain aneurysm. Council Minutes 11/20/01 • • Don Best Don Best, 1945 Greenleaf Drive. He spoke as a member of the Woodside Village Homeowners' Association and related problems regarding traffic, cleanliness, and 18-wheelers parking at Amar and Azusa since the commercial center is falling by the wayside. He suggested a Woodside Village Area Coordinating Council to act as a clearinghouse for issues and problems between the southern end of the City and the City Council. St. James Davis St. James Davis, 616 N. Vincent Avenue, discussed the lack of adequate parking for the Department of Motor Vehicles, which is causing a lot of ticketing for illegal parking. On another matter, he suggested that the City equip its vehicles with fire extinguishers. HEARING CODE AMENDMENT NO. 300 — CANOPY STRUCTURES Mayor Wong stated that this hearing began on October 16 and was continued to this evening. Staff had been directed to make changes to the proposed ordinance. Canopy Structures City Manager Pasmant stated that the recommendation was to hold over the item to December 4`h to give staff additional time to check out one more item. Mayor Wong asked if there was anyone in the audience who wished to address the City Council on this item. No one spoke. City Attorney Alvarez-Glasman stated that a letter had been received from Ms. Verla Walker, dated November 20`h, in opposition to banning canopy structures and the letter would be added to the record. Motion by Touhey and seconded by Miller to hold over this matter until the next regular City Council meeting. Motion carried 5-0. HEARING WOODSIDE VILLAGE MASTER PLAN AMENDMENT NO. S Woodside Village Master Plan City Clerk Berry verified the affidavit of publication and Mayor Wong opened the hearing. Planning Director McIsaac presented the staff report. Public Testimony Mayor Wong opened the public testimony portion of the hearing and the following spoke in support of the proposal: Douglas Jacobsen Douglas Jacobsen of Realty Bancorp Equities, Woodland Hills, as the developer he discussed the chronology of the shopping center (Quail Ridge Shopping Center) and the development, as proposed. Scott Thomas Scott Thomas, proposed mini -storage facility representa- tive, discussed security issues, operational hours and procedures, and the intended clientele of the service. Jeff Timbers Jeff Timbers, representing Sav-On Drugs, spoke favorably of the proposal and his support for changing the location of Sav- On from within the strip area to the outside corner of the site. Herb Redholtz Herb Redholtz, 2622 Altamira Drive, clarified his support for the renovation of the commercial property but was not so sure of the mini -storage facility as an anchor for the site. Mayor Wong asked for comments in opposition of the proposal and no one in the audience addressed Council. He then closed the Testimony closed public testimony portion of the hearing. 74 Council Minutes 11/20/01 Council Discussion Mayor Pro Tern Touhey expressed his support for the proposal. He also said he would work on a moratorium on mini -storages in the future. Councilmember Sanderson concurred with him. She also praised the developer for seeking the opinions of the residents in the area as to what exactly they would like to see in the center. • Councilmember Miller noted that this is an amendment to the entire Woodside Village Master Plan, not just for Quail Ridge. He expressed some ambivalence for the project. Councilmember Herfert felt the real hook for the center was the Sav-on drugstore and the Stater Brothers market. Mayor Wong explained his support for the project, but not for the moratorium. He felt the market place should dictate the supply and demand for mini -storage facilities. City Clerk Berry presented Resolution 2001-89 RESOLUTION NO. 2001-89 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING WOODSIDE VILLAGE MASTER PLAN AMENDMENT NO. 8 Motion by Touhey and seconded by Herfert to waive further reading of the resolution and adopt. Motion carried 5-0. Recess Mayor Wong recessed the City Council meeting at 8:55 pm to convene the Redevelopment Agency meeting to conduct the RDA public hearing. The City Council reconvened at 9:00 pm with all members of the Council present. CONSENT CALENDAR Commission/Summary of Actions (receive & file) Community Services Commission 10/29/01 Planning Commission 11/13/01 Personnel Commission 09/12/01 Claims Against the City (deny & notify claimant) On June 14, 2001, the City Clerk's Office received a claim for property damage from Cesar & Elizabeth Solorza. The amount of claim had not been determined at time of presentation. Pursuant to Government code requirements, the claim was returned insufficient because it failed to state a specific date of accrual or date the loss was discovered. On July 12, 2001, the City Clerk's Office received a claim from Wilma Siebert for personal injuries relating to a trip and fall accident. Claimant is seeking reimbursement for medical costs she incurred in the amount of $3,925.65, and an additional $10,000 for pain and suffering. On May 29, 2001, the City Clerk's Office received an application for leave to present a late claim from Eduardo Herrera. The • amount of claim had not been determined at time of presentation. Claimant is seeking reimbursement for damage to a block wall, concrete patio, and the roof of his residence. Temporary Use Permit (receive & file) TUP 92682 was issued to First Financial Credit Union at 1600 W. Cameron Avenue for a used car sale from 11/3/01 — 11/4/01. 3 Council Minutes 11/20/01 Resolution 2001-91 Award of Bids PP 02203 — Award of Contract Structure Demolition by Volunteers at 421 S. Citrus Street Recommendation is to adopt the following resolution declaring that the project can be performed more economically by day labor, or the materials and supplies furnished at a lower price in the open market: RESOLUTION NO. 2001-91 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE PROPOSAL BY MARK BOOTH TO PERFORM DEMOLITION PROJECT AT 421 SOUTH CITRUS STREET Motion included accepting the proposal of Mark Booth in the amount of $23,000.00 and authorizing the Mayor and City Clerk to execute an agreement with Mr. Booth for the work to be done. Treasurer's Report (receive & file) Report for the month of September 2001. Miscellaneous - Environmental Management Electric Vehicle Charging Station License Agreement Amendment EV Charging Station Recommendation is to authorize the Environmental Management Director to enter into an agreement to amend the License Agreement for the public electric vehicle charging station located at the Westfield Shoppingtown West Covina to extend the current agreement for an unspecified period of time, with cancellation upon thirty days written notice by either party. Miscellaneous — Police Department Women's Locker Room Refurbishing Cogley & Son General Contractors Recommendation is to: 1) Find that Cogley & San General Contractors, San Dimas, is the lowest bidder for this task, and authorize the Police Department to utilize them for a total cost of $23,550. 2) Appropriate $25,000 of State asset forfeiture funds (Fund 116) to 116-320-2110-7160 for this purpose, including a $1,450 contingency. Results of Police Department's Domestic Violence Program Recommendation is to receive and file the staff report. Miscellaneous — Public Works Authorization for Funds to Continue the Preparation, Processing, and Recordation of the Parcel Map for the Ridge Riders/Maverick Ridge Riders/Maverick Field Recommendation is to authorize an additional payment of $9,681.54 from Account No. 110-320-3962-7700 to complete the parcel map for the reconfiguration of the properties for Valencia Heights Water Company and the City. Miscellaneous — Finance Department Hurst Ranch Funding and Status Report Hurst Ranch Appropriations Recommendation is to take the following actions: 11 Council Minutes 11/20/01 • C i Closing City Hall Resolution 2001-90 Tax Allocation Bonds CONSENT CALENDAR ACTION 1) Appropriate $43,000 from the Community Enhancement fund balance (Fund 114) to account number 114-320-3292-7500 for the Hurst Ranch project; 2) Direct staff to continue to pay the Los Angeles County property tax bill on the Hurst Ranch property from account number 110-320-2550-6494;and, 3) Receive and file the status report submitted by the Hurst Ranch Foundation. Miscellaneous — City Manager's Office Closure of City Hall, City Annex, and Senior Center to the Public on December 31" recommendation is to approve the closure of City Hall, City Annex and the Senior Center on December 31, 2001. Miscellaneous — Redevelopment Agency Housing Set -Aside Tax Allocation Revenue Bonds, Series 2001 Recommendation is to adopt the following resolution: RESOLUTION NO. 2001-90 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AUTHORIZING THE ISSUANCE, SALE AND DELIVERY BY THE REDE- VELOPMENT AGENCY OF THE CITY OF WEST COVINA OF HOUSING SET -ASIDE TAX ALLOCATION REVENUE BONDS, SERIES 2001 Motion by Herfert and seconded by Touhey to waive further reading of the resolutions and adopt; and to approve all other items except: Items C-lb, C-6d, and C-6g. Motion carried by roll call vote: AYES: Herfert, Miller, Sanderson, Touhey, Wong NOES: None Item C-lb In relation to Item C-lb (Planning Commission Summary of Actions), Mayor Pro Tern Touhey requested that the Planning Commission's approval of Administrative Use Permit No. 01-02 be appealed for consideration before the City Council. Motion by Touhey and seconded by Herfert to direct staff to set the appeal before the City Council and to receive and file the remaining items on the Summary of Actions. Motion carried 5-0. Item C-6d In relation to Item C-6d (Recordation of Ridge Riders/Maverick Field parcel map), both Councilmember Sanderson and Mayor Wong stated that they would abstain from the discussion and vote on this item due to conflict of interest laws (Wong owns one share of Valencia Heights Water Company mutual water fund and Sanderson resides within 300 feet of Ridge Riders/Maverick facility). Motion by Herfert and seconded by Miller to approve the staff recommendation. Motion carried 3-0-2 with Sanderson and Wong abstaining). Item C-6g In relation to Item C-6g (Housing Set -Aside Tax Allocation Revenue Bonds), Councilmember Miller stated that he would vote no on this issue because of the project this is funding. Mayor Wong asked several questions regarding the financing and bonding. City Clerk Berry read the title of Resolution No. 2001-90. Motion by Touhey and seconded by Herfert to waive further reading of the resolution and to adopt. The City Council reconvened at 11:30 pm with all members present. PUBLIC FINANCING AUTHORITY At 11:30 pm Mayor Wong conducted the Public Financing Authority meeting. COUNCILMEMBERS' REPORTS Councilmember Sanderson — Enhanced Landscaping at Maior Entrances to the City Councilmember Sanderson commenced a discussion on various improvements to the City, including landscaping on Azusa Avenue and erecting "Welcome to West Covina" signs. Don Best Don Best, 1945 Greenleaf, agreed with Councilmember Sanderson's desire to enhance the appearance at the entrances to West Covina. He suggested several signs were needed at the south side of the City because most citizens don't know where the City boundaries are. Herb Redholtz Herb Redholtz, 2622 Altamira Drive, also agreed with identifying the entry ways welcoming people to West Covina. He suggested signs on the freeway off ramps. Motion by Touhey and seconded by Wong to direct staff to bring back to Council on December 4, 2001 a Request for Proposal for landscape architects to assist in developing plans for entrance treatments to the City. Motion carried 5-0.
