06-06-2000 - Regular Meeting - MinutesI -I • MINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL NNE 6, 2000 The regular meeting of the West Covina City Council was called to order by Mayor Herfert at 7:40 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The Pledge of Allegiance was led by Explorers from the West Covina Fire Department, Post 465, and the invocation was given by City Manager Hobbs. ROLL CALL Mayor Herfert, Mayor Pro Tem Wong, Councilmembers Howard, Melendez Absent: Councilmember Touhey Others Present: Hobbs, Fields, Pidgeon, Samaniego, Hatch, Green, McIsaac, Lennard, Mayer, Keating, Bommarito, Schimanski, Morgan, Fox, Chung, Berry " APPROVAL OF MINUTES The minutes of the special meeting of May 16, 2000 and the regular meeting of May 16, 2000 were approved as presented. PRESENTATIONS Rick Richmond of the Alameda Corridor — East construction project, presented an update of the project the Council. Mayor Herfert presented a Certificate of Commendation to out- going Community Services Commissioner Tom Puchalski. Mayor Herfert proclaimed June 11, 2000 as Filipino -American Heritage Day in West Covina and presented the proclamation to Linda Santos, president of the Filipino -American Chamber of Commerce. Mayor Herfert introduced two West Covina members of the National Junior Basketball "North Stars" team, Shiondre Austin and Vanessa Valdez. The two addressed an upcoming event for which they sought sponsorships and donations. John Hughes announced the five-day Fourth of July celebrations planned for Cameron Park and West Covina High School, proceeds to be raised for the MDA. ORAL COMMUNICATIONS Mike Miller Mike Miller, 735 E. Herring, referred to an action taken at the last Council meeting (May 16, 2000), and the minutes thereof, granting an extension to the Athens Disposal Company franchise to a twelve-year term. He asked if the intent of the action included prohibiting Athens from imposing the CPI retroactively for the next two years when they come in at the third year for a rate increase. Mayor Herfert agreed that there would be a "no catch-up" clause that would be included in the final agreement indicating a rate freeze for two years and that the minutes for this meeting shall so reflect that understanding. Council Minutes 6/6/00 • is Herb Redholtz Herb Redholtz, 2622 Altamira Drive, requested Council to urge Norm Reeves Honda to remove the plastic banner and install a permanent sign. On an matter, he noted that Edwards Theatre repre- sentatives have in the past stated that their water fountain would be operational. It remains today as a trash heap. Royal Brown Royal Brown, 2153 Aroma Drive, encouraged all interested persons to attend the next Planning Commission at which meeting the BKK development plan will be discussed. Cookie Nance Cookie Nance, 1236 W. Eckerman, said she submitted a request for information to the Assistant City Manager and related that he stated that it would be forthcoming. Mary Smith Mary Smith, 16207 Bamboo, La Puente, spoke in support of returning Moe the Chimp to the City of West Covina. John Scheuplein John Scheuplein, 1520 E. Newcrest Drive, addressed several issues: a) fingerprinting little league volunteers, b) sending job flyers to a former employee, c) the recent hiring of an interim public services director and the ICRMA, and d) a RACCOON notice regarding the development plans of BKK to use Aroma Drive as the main thoroughfare to their proposed golf course. Jennifer Rhyne Jennifer Rhyne, 1335 Evanwood Avenue, asked Mayor Herfert if he had received a letter from Dorothy Moore several weeks earlier as she was still awaiting a response. Ms. Rhyne then spoke in favor of a) returning Moe the Chimp to West Covina and b) the fingerprinting proposal. Melissa Ramirez Melissa Ramirez, 1227 Grovecenter, also urged the return of Moe to West Covina. Mayor Herfert stated that the City is currently in court -mandated mediation with the Davis' and the Council cannot comment on the Moe the Chimp situation. HEARING WEST COVINA CITYWIDE SEWER SERVICE CHARGE Citywide Sewer Service City Clerk Berry verified the affidavit of publication. Mayor Herfert opened the hearing and City Engineer Mayer presented the staff report. Mr. Mayer stated that the proposed sewer charge rate of $21.95 per unit is the same as last year's rate. Public Testimonv City Clerk Berry stated that no written communications have been received regarding this matter. Mayor Herfert asked for verbal comments or protests. None No one addressed the City Council. As there was no one interested in Addressing the City Council, Testimony closed Mayor Herfert closed the public testimony portion of the hearing. City Clerk presented: Resolution 2000-43 - RESOLUTION NO. 2000-43 — A RESOLUTION OF THE Sewer Service Charge CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, AUTHORIZING THE COLLECTION OF THE ANNUAL SEWER SERVICE CHARGE THROUGH THE COUNTY TAX BILL Motion by Wong and seconded by Howard to waive further reading of the resolution and to adopt. Motion carried 4-0. 2 Council Minutes 616100 • • HEARING WEST COVINA CITYWIDE LIGHTING AND MAINTENANCE Citywide Lighting & Maint. City Clerk Berry verified the affidavit of publication. Mayor Herfert opened the hearing and City Engineer Mayer presented the staff report. Mr. Mayer stated that staff proposes to use the voter - approved CPI adjustment to increase the assessment rates 2% from the current level. Public Testimonv City Clerk Berry stated that no written communications have been received regarding the assessment district. Mayor Herfert asked for verbal comments regarding the maintenance district and the 2% rate increase. None No one addressed the City Council. CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, CONFIRMING THE ENGINEER'S REPORT AND THE PLANS, SPECIFICATIONS, ESTIMATES, DIAGRAM AND ASSESSMENTS CONTAINED THEREIN; ORDERING CERTAIN LIGHTING FIXTURES AND ELECTRICAL CUR- RENT TO BE FURNISHED FOR LIGHTING FIXTURES AND TO ORDER CERTAIN STREET TREES TO BE INSTALLED AND MAINTAINED FOR FISCAL YEAR BEGINNING JULY 1, 2000 Motion by Howard and seconded by Melendez to waive further reading of the resolution and adopt. Motion carried 4-0, Mayor Herfert moved forward the fingerprinting issue for con- sideration by the City Council at this time. COMMUNITY SERVICES FINGERPRINTING POLICY FOR YOUTH SPORT VOLUNTEERS Fingerprinting Policy Community Services Director Hatch presented the staff report with an overview of the history and steps taken to date on the issue. He responded to Council questions and comments. Frank Michaud Frank Michaud, Community Services Commissioner, discussed the commission's point of view that fingerprinting should be man- datory to protect the youth. In response to Council questions regarding liability, Interim City Attorney Lennard responded that the City would incur liability regardless of the option chosen, however it can be mitigated somewhat depending on how the regulation or ordinance is structured. Rob Sotelo Rob Sotelo, president of West Covina Girls Softball and representing the Youth Council, stated that he would like to see the City contract with U.S. Fingerprinting, Inc., to protect the youth. Recess Mayor Herfert called a recess at 9:25 pm. The City Council reconvened at 9:40 pm with all members present, except Touhey. Greg Spiker Greg Spiker, ICRMA representative, stated that Independent Cities Risk Management Authority is fully supportive of fingerprinting adult volunteers for the leagues, particularly Option No. 1 (leagues R1 Council Minutes 616100 taking full responsibility). He felt the exposure to the City would be where the City interprets the results of the fingerprinting results. On behalf of the ICRMA, he commended the City of West Covina for being the first to address this issue. Frank Wills Frank Wills, Chief of Police, noted the Police Department is cer- tainly supportive of the welfare of its citizens. He noted the high islevel of restrictions placed on law enforcement officers and not on the general public in relation to the dissemination of the finger- printing results from the Department of Justice. Annette Johnson Annette Johnson, Personnel Assistant of the East San Gabriel Valley ROP, noted that her agency managers and operates the Live Scan fingerprinting machine currently used at the West Covina Police Station. The machine would be available in the evenings and on weekends to fingerprint the adult volunteers. Mark Englander Mark Englander and Harry Scalinos, U.S. Fingerprinting, described their company, their services, and primarily information regarding the fingerprinting process and regulations. The responded to Council questions about the procedures, obtaining and interpreting the results obtained from the Department of Justice. Leslie Nichols Leslie Nichols, president of American Little League, spoke in full support of background checks and fingerprinting of the coaches, assistant coaches, managers and any other volunteers having inter- face with the children. In fact, the American Little League has thought of purchasing a machine to handle it within the league as they believe the City should have minimal involvement. Ken Clevenger Ken Clevenger, president of West Covina Youth Basketball, noted that their league feels that they need to take responsibility for the fingerprinting. He noted that if the City took over the process, the City would not be able to obtain FBI checks. The leagues can. Royal Brown Royal Brown, 2153 Aroma Drive, felt the City should finance the purchase of a Live Scan and the process. It should not fall on the shoulders of the volunteers or the leagues. John Scheuplein John Scheuplein, 1520 E, Newcrest Drive, discussed an "open book" background check, which would only be available if the City handles the fingerprinting process. Mary Chaba Mary Chaba, president of West Covina Youth Soccer, noted that her organization already has fingerprinting processes in place on their adult volunteers. She felt the City.should mandate finger- printing for the safety of the children. Anthony Garcia Anthony Garcia, In Vice President of the West Covina Bruins, felt the responsibility for fingerprinting should be placed with the City because of the costs involved per each individual and each league. The City should purchase the machine. • Council Comments Councilmember Melendez spoke in favor of Option No. 1, the responsibility of the fingerprinting process with the leagues taking full responsibility, with some assistance by the City. Councilmember Howard stated her preference would be implement a trial program for one year, using the current Live Scan and leaving the City and Police Department out of the process. The 2 Council Minutes 616100 • • leagues would have a choice whether to use the current Live Scan program or go to an outside agency, such as U. S. Fingerprinting. The City is not able to obtain FBI checks, but the leagues can. Motion Motion by Melendez and seconded by Wong to approve Option No. 1 with the leagues being responsible. The City also purchases the necessary equipment to enhance the consortium machine to process volunteers faster. This would still allow groups to decide how to fingerprint or if they want to fingerprint volunteers. City Police would provide support to the extent it's wanted or needed to league officials and they would remain available as they do now if they are notified by the Justice Department about a volunteer. Mayor Herfert would have preferred that the fingerprinting be mandatory, not voluntary. He was pleased that the West Covina Police would be involved and available to the leagues. Motion carried 4-0. Recess Mayor Herfert called a recess at 10:57 pm. The City Council reconvened at 11:18 pm with all members present, except Touhey. Miscellaneous — Police Department Appropriating Donated Funds for the "Every Fifteen Minutes" "Every Fifteen Minutes" Recommendation is to take the following actions: * Approve the Police Department's continuing participating in the "Every 15 Minutes" program. * Authorize the Police Department to expend up to $4,556.34 in accumulated donated funds collected for this program, from account 110-320-2110-6468 in the current fiscal year. * Establish Fund 127 to account for Police donations, and authorize the transfer of remaining donation balance after the program is carried out (an estimated $1,147) from the 110-320-2110-6468 into Fund 127. * Direct the Finance Department to include $3,000 in estimated revenues (donations from the community) and $3,000 in appropriations for this program in the FY 2000- 2001 budget. In relation to Item B-8f (Every 15 Minutes), Mayor Pro Tem Wong • commended the Police Chief and Officer Cirrito for coordinating the program at South Hills High School for this very effective program depicting the relationship between drinking and driving. He suggested that the ten-minute video be shown at the beginning of a future Council meeting. COUNCILMEMBERS REPORTS Meeting of Schools Subcommittee — Edgewood Soccer Fields Staff was directed to arrange a meeting of the subcommittee of Howard and Herfert shall meet with the school district. "North Stars" Girls All -Star Basketball Team Council suggested the City can help by permitting their request for donations on the cable television corkboard, but the Council policy of not donating to one group or another should remain unchanged.
