05-02-2000 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL MAY 2, 2000 • The regular meeting of the West Covina City Council was called to order by Mayor Herfert at 7:45 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. City Manager Hobbs gave the invocation and Mayor Herfert led the Pledge of Allegiance. ROLL CALL Mayor Herfert, Mayor Pro Tern Wong, Councilmembers Howard, Touhey, Melendez Others Present: Hobbs, Collier, Greene, Mayer, Chung, Hatch, Keating, Pidgeon, Samaniego, McIsaac, MacDonald, Bommarito, Schimanski, Wills, Berry APPROVAL OF MINUTES The following minutes were approved as presented: Regular meeting of April 4, 2000 Special meeting of April 18, 2000 Regular meeting of April 18, 2000 Special meeting of April 20, 2000 (closed session) PROCLAMATIONS Mayor Herfert proclaimed May 13, 2000 as Fire Service Day and presented the proclamation to Fire Chief Greene. Mayor Herfert proclaimed May 15 through 19, 2000 as California Bike Commute Week 2000 and presented the proclamation to Environmental Management Director Samaniego. INTRODUCTIONS Police Chief Wills introduced four newly hired Police Officers. Councilmember Touhey administered the Oath of Office to incoming Officer Kenneth Plunkett. Mayor Herfert administered the Oath of Office to Officers Elsa Garcia, Roberto Ohong, and David Cole. ANNOUNCEMENT Mayor Herfert announced a change in the City Council Agenda whereby Oral Communications have been relocated to the front of the Agenda. He encouraged the speakers to refrain from making comments of a personal nature. ORAL COMMUNICATIONS Sean Ilagan Sean Ilagan, 710 N. Orange Avenue, spoke in defense of Moe the Chimp, encouraging Council to permit the chimpanzee to move back with its owners and drop the charges at Pomona Court. • Frances Nelson Frances Nelson, 1049 E. Casad Avenue, asked several questions to which she received several responses: * The City is self -insured up to a certain amount. * The City is participating in court -ordered mediation. * The City does carry workman's compensation. * The picture of Moe on the internet is the one from the incident where he had escaped; only it has been cropped. Mayor Herfert stated that because of the court case, the City Council wasn't free to enter into a discussion on Moe. Council Minutes of 5/2/00 Cookie Nance Cookie Nance, 1236 W. Eckerman, addressed the upcoming National Day of Prayer event. She felt now that Steve Herfert was mayor, harmony would be brought back to the Council Chambers. Phil Ossman Phil Ossman, 2102 E. Larkwood Street, felt Moe was not a wild • animal, but domesticated like any other pet. He hoped Council would give special consideration to the Moe situation and permit the chimp to go back to its owners. He stated that even though he is supportive of the Moe case, he did not condone honking. John Scheuplein John Scheuplein, 1520 E. Newcrest Drive, agreed with a letter sub- mitted by Cookie Nance requesting that the cable channel close caption the Council and Commission meetings. Mayor Herfert noted that there are a couple of issues the City has with the Cable Company at the moment, and this item will be added to the list for follow-up. John Lindow John Lindow, 415 Lyall Avenue, welcomed the new mayor to his post, congratulated Kathy Howard on her term as mayor, and encouraged the police to keep up the good work with traffic safety stops. A MOU Recommendation is to take the following actions: * Authorize the City Manager and City Attorney to sign the MOU approving the continuation of the Proposition A Discretionary Incentive Program for Specialized Trans- portation Services; and * Authorize the City Manager and City Attorney to administratively sign all future MOUs for the purpose of receiving the City's annual allotment of Proposition A' Discretionary Incentive funds. • CONSENT CALENDAR ACTION Motion by Melendez and seconded by Touhey to waive further reading of the ordinances/resolutions and adopt, and to approve all other items listed on the Consent Calendar. ENVIRONMENTAL MANAGEMENT No reports for this meeting. REDEVELOPMENT AGENCY Mayor Herfert recessed the City Council meeting at 8:22 pm to convene the Redevelopment Agency. At 8:28 pm he reconvened the City Council meeting in order to consider the following item jointly between the two bodies. BKK INDUSTRIAL BUSINESS PARK AND GOLF COURSE PROJECT Mayor Herfert stated that due to conflict of interest laws, he would abstain from the discussion and vote on this matter. Mayor Pro Tem Wong presided over this item. BKK Business Park & Golf Project Redevelopment Agency Director Chung presented the staff report. The following individuals addressed the Agency Board and City Council: Royal Brown Royal Brown, 2153 Aroma Drive, suggested that Council simply receive and file the report, and not permit BKK to form an assessment district under Mello -Roos. Further explanations by Mr. Chung and Interim City Attorney Lennard clarified that the City would not be lending any financial assistance or loaning any money to BKK under the Mello -Roos assessment district. Councilmember Howard noted that it cost the City nothing for BKK to go out and seek an underwriter even though the City believes their chances are slim. Motion by Howard and seconded by Melendez to receive and file the report, both at the Agency level and the Council level. Motion carried 5-0. At this point, Mayor Pro Tem Wong returned the gavel to Mayor Herfert. Mayor Herfert adjourned the Redevelopment Agency at 8:47 pm and continued forward with the City Council Agenda. COMMUNITY SERVICES REQUEST TO CONTRACT FOR 2001 ROSE FLOAT EVENT Community Services Director Hatch presented the staff report and responded to questions. Fred Burkhardt Fred Burkhardt, Chairman of the West Covina Tournament of Roses Foundation addressed Council, supporting the staff recom- mendation and responding to additional questions and comments. Councilmember Wong reiterated his position from the past two • years on his opposition to the use of BIT funds for the float. Mike Miller Mike Miller, 735 E. Herring Avenue, noted that work for the 2001 is getting behind schedule and time is of the essence. He discussed some of the new concepts envisioned by the Foundation: reaching out to the PTA groups and the sports leagues. Councilmember Touhey suggested implementing a cap on the BIT earmarked for the float at $120,000. 13 Council Minutes of 5/2/00 Motion Motion by Touhey and seconded by Howard to approve a not to exceed $120,000 from BIT excess funds for the 2001 Float entry. Motion carried 4-1 with Wong voting no. Recess Mayor Herfert called a recess at 9:20 pm.. The City Council recon- vened at 9:31 pm with all members present. APPROVAL OF DEMANDS AND WIRE TRANSFERS Motion by Wong and seconded by Howard to approve demands totaling $1,640,248.96 ($1,098,347.64 in wire transfers) as listed on check registers 3021129 through 3021433. Motion carried by roll call vote: AYES: Howard, Melendez, Touhey, Wong, Herfert NOES: None ABSTAIN: Touhey re Community Food Bank MAYOR'S REPORT ANNUAL APPOINTMENTS OF CITY COUNCIL REPRESENTATIVES TO OTHER AGENCIES Mayor Herfert stated that all Councilmembers received the list of agencies and organizations. He requested that they take them home and indicate their preferences and return to the City Manager's Office before the next Council meeting. COUNCILMEMBERS' REPORTS ORDINANCE INTRODUCTION: COUNCIL REORGANI- ZATION — MAYOR PRO TEM W ONG Councilmember Wong presented the ordinance and recommended a change to clarify the procedure when a vacancy occurs at the Mayor or Mayor Pro Tem's position. City Clerk presented Ordinance introduced - AN ORDINANCE OF THE CITY COUNCIL OF THE Mayor rotation process CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, AMENDING THE MUNICIPAL CODE BY CREATING A ROTATION PROCESS FOR THE SELECTION OF MAYOR AND MAYOR PRO TEM, as amended. Motion by Wong and seconded by Touhey to waive further reading of the ordinance and to introduce, as amended. Motion • carried by roll call vote: AYES: Melendez, Touhey, Wong, Herfert NOES: Howard COMMISSION ON WOMEN — COUNCILMEMBER TOUHEY Councilmember Touhey requested that the item be pulled from consideration as he wanted to pursue another avenue. G Council Minutes of 5/2/00 CITY MANAGER'S REPORT City Manager Hobbs requested Council concurrence on proposed budget study dates. Council agreed that the next budget session will be on Wednesday, May 10 at 6:00 pm in the Management Resource Center and end around 9:00 pm. Mayor Herfert announced the National Day of Prayer event scheduled for Thursday, May 4th at noon in the civic center court yard. He also reported on the Saturday event, April 29, celebrating the 25'h anniversary of the fall of Saigon.
