SPECIAL MEETING
OF THE
WEST COVINA CITY COUNCIL
December 11, 1998
The special meeting of the West Covina City Council was called to order by Mayor Melendez at 5:17
pm in the City Hall Management Resource Center, 1444 W. Garvey Avenue, West Covina.
ROLL CALL Mayor Melendez, Councilmembers Howard, Touhey, Wong
Absent: Mayor Pro Tern Herfert
Others Present: Hobbs, Fields, Keating, Gannon, Marticorena
PUBLIC COMMENT ON ITEMS ON THE AGENDA No comments offered.
CLOSED SESSION City Manager Hobbs stated that since the agenda for this study
session was posted, the need has arisen to have a closed session on
the same subject matter. Mr. Hobbs reviewed the.procedure for
adding a closed session to the Agenda.
Motion by Howard and seconded by Wong to add a closed
session, as recommended, to the agenda. Motion carried 4-0.
Mayor Melendez commenced a closed session at 5:20 pm in the
City Manager's Conference Room to discuss the following
matters:
CONFERENCE WITH REAL PROPERTY NEGOTIATOR:
Jack Keating
Pursuant to Government Code § 54956.8
Property: City right-of-way
Negotiating Party: Cable company
Under Negotiation: Approval and terms of transfer, franchise
renewal and/or franchise extension
CONFERENCE WITH LEGAL COUNSEL —
Anticipated Litigation
Pursuant to Government Code § 54956.9(b)
One case.
The closed session concluded at 6:48 pm at which time Mayor
Melendez reconvened the meeting in the Management Resource
Center. All members of the City Council were present, except
Mayor Pro Tern Herfert.

FRANCHISE RENEWAL/TRANSFER OF OWNERSHIP
Mayor Melendez noted that this matter would be rescheduled for
another Council meeting.
DISCUSSION RELATIVE TO RELEASE FEES
Police Commander Gannon presented the staff report. The City
Council discussed the merits of a franchise fee in relation to the

cost/recovery methodology as used in the MSI Study. Staff was
directed to conduct a survey of release fees imposed by other cities
and report back to Council.
Motion by Touhey and seconded
at 7:23 pm. Motion carried 5-0.
