07-15-1997 - Regular Meeting - MinutesMINUTES WEST COVINA CITY COUNCIL REGULAR MEETING JULY 15, 1997 . ` The regular meeting of the West Covina City Council was called to order by Mayor Wong at 7:40 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Assistant City Manager Wylie and the Pledge of Allegiance was led by Councilmember Howard. ROLL CALL Mayor Wong, Councilmembers Herfert, Howard, Touhey Absent: Mayor Pro Tem Melendez (excused) Others Present: Starbird, Wylie, Miller, Glover, Marlyn, Collins, Collier, Yoshizaki, Hernandez, Fong, Garcia, Distelrath, Palkhiwala, Greene, Lee, Compean, Samaniego, Bommarito, Joyce, Ure, King, Janis, Berry APPROVAL OF MINUTES Councilmember Herfert stated he would abstain from approving the minutes of June 17 as he was absent from that meeting and that there were two motions with votes need correction as they included Herfert in their numbers. Motion by Herfert and seconded by Howard to approve the minutes of the regular meeting of June 17, as corrected, and the minutes of the regular meeting of July 1, 1997. Motion carried 4-0 with Herfert abstaining on the June 17 minutes. PRESENTATIONS/PROCLAMATIONS Mayor Wong and Personnel Commission Chairman Thrasher presented City of West Covina employee Steve Fekete with a Certificate as the first recipient of the Employee Recognition Program. Mayor Wong presented Warren Joyce with a Resolution of Commendation and a City Tile upon his retirement after 30 years of service with the City. Mayor Wong and Planning Commission Chair Reiner presented Ed Connolly with a Resolution of Commendation from the Planning Commission and another one from the City Council for serving on the Planning Commission from 1980 to 1997. Mayor Wong presented certificates to the members of the West Covina All American Little League All -Stars, Champions of the 1997 City Tournament. Mayor Wong proclaimed the month of July as PARKS AND RECREATION MONTH. Community Services Director Collins and Commissioners Puchalski and Buckingham received the proclamation. In turn, participants of the Recreation program presented posters and staff shirts to the City Council. City Council Minutes of 7/15/97 • HEARING WEST COVINA CITYWIDE LIGHTING & MAINTENANCE DISTRICT - PUBLIC HEARING Mayor Wong introduced the subject matter and City Clerk Berry veri- fied the affidavit of publication. Mayor Wong opened the hearing and the staff report was presented by City Engineer Glover. Public Testimony Mayor Wong opened the public testimony portion of the hearing. City Clerk Berry stated that over and beyond the mailed protest hearing ballots received, there were a few additional communications received. The letters and notes had been enclosed with the mailed ballots and Ms. Berry read these aloud. Mayor Wong asked for additional comments from the audience and the following addressed Council: Royal Brown Royal Brown, 2153 Aroma Drive, appreciated staffs revision of the proposed assessments on Aroma Drive adjacent to his condominium complex. Originally street trees had been included and in actuality there are none abutting the complex. George Odgen George Ogden, 1240 Valinda Avenue, represented the VFW. He was afraid the VFW ballot hadn't been mailed in time for the hearing and asked for a substitute ballot. Public Hearing Recess Mayor Wong recessed the public hearing at 8:24 pm to give Miguel Hernandez, Civil Engineering Assistant, a chance to create a substitute ballot regarding the VFW property. Mayor Wong proceeded with the Consent Calendar. CONSENT CALENDAR Written Communications (refer to stall) Letter received from Vincent East, Manager of the Covina Concert Bank, requesting the City Council consider including the Covina Concert Band in the 1998 Fourth of July activities as well as the 1998 Summer Concert Series. Commissions/Summary of Actions (receive & file) Planning Commission 7/8/97 Temporary Use Permits (receive & file) TUP #2402-97 was issued.to West Covina Buddhist Temple for the Obon Festival at 1203 W. Puente Avenue on 6/7/97. TUP #2405-97 was issued to Loehmann's at 2753 Eastland Center Drive, Suite 2000, for an office trailer during construction from 6/30/97 to 8/5/97. TUP #2406-97 was issued to West Covina Lincoln-Mercury, 2539 E. Garvey for a roof -top balloon from 6/25/97 to 7/9/97. Acceptance of Improvements/Release of Bonds PP 97205B - Location: Orangewood Park Century Paving, Inc. Recommendation is to accept asphalt repairs and release Insurance Company of the West Bond No. 1486527 in the amount of $11,993.00, subject to Notice of Completion procedures. Miscellaneous - Community Services Department Human Services Commission Name and Organizational Changes Recommendation is to introduce the following ordinance: Ordinance introduced - AN ORDINANCE OF THE CITY COUNCIL OF THE Community Services Commission CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFOR- NIA, REORGANIZING AND RENAMING THE HUMAN SERVICES COMMISSION TO THE "COMMUNITY SERVICES COMMISSION" BY AMENDING THE WEST COVINA MUNICIPAL CODE SECTION 2-74, ET. SEQ. Miscellaneous - Environmental Services BKK Landfill Closure Plans Status Resort Recommendation is to receive and file the informational report. CONSENT CALENDAR MOTION Motion by Touhey and seconded by Herfert to waive further reading of the ordinances/resolutionand to introduceladopt, as applicable, and to approve all other items listed, except Item B-7c (BKK Status Report). Motion by Howard and seconded by Touhey to receive and file the informational report. Motion carried 3-0-1 with Herfert abstaining. Recess Mayor Wong recessed the City Council meeting at 8:27. pm to convene the Redevelopment Agency. The City Council reconvened at 8:31 pm with all members present except Melendez. City Council Minutes of 7/15/97 RETURN TO HEARING At 8:31 pm Mayor Wong returned to the protest hearing, noting that Civil Engineering Assistant Hernandez and Mr. Odgen had returned and the substitute ballot was turned in for tallying. Mayor Wong asked for any further comments and no one addressed the Council. He then asked of there was anyone else needing to turn in a ballot at this time, as it would be too late once the public testimony portion of the hearing ' was closed. No one responded and the public testimony portion of the Testimony closed hearing was closed. Mayor Wong asked for Council discussion. No comments were offered and he then asked the City Clerk to announce the results of the protest hearing ballots. City Clerk Berry reported that 6131 protest ballots were returned for processing, equating to a 241/o turnout with the following results: Vote Designation No. of Ballots Assessment Amounts Percentage Yes 4735 $251,667.43 70% No 1396 108,668.25 30% City Clerk presented: Resolution 9472 - RESOLUTION NO. 9472 - A RESOLUTION OF THE Citywide MD/Protest Hearing CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFOR- NIA, CONFIRMING THE ENGINEER'S REPORT AND THE PLANS, SPECIFICATIONS, ESTIMATES, DIAGRAM AND ASSESSMENTS CONTAINED THEREIN; ORDERING CERTAIN LIGHTING FIXTURES AND ELECTRICAL CURRENT TO BE FURNISHED FOR LIGHTING FIXTURES AND TO ORDER CERTAIN STREET TREES TO BE INSTALLED AND MAINTAINED FOR FISCAL YEARS BEGINNING JULY 1, 1997 (West Covina Citywide Lighting and Maintenance District Commen- cing FY 97/98) Councilmembers thanked the citizens of West Covina for voicing their votes and noted their disappointment with the position taken by the School Boards. Motion by Howard and seconded by Herfert to waive further reading of the resolution and adopt. Motion carried 4-0. Recess Mayor Wong recessed the City Council meting at 8:43 pm. At 9:01 pm Mayor Wong announced some technical difficulties and the Council meeting would resume as soon as possible. The City Council reconvened at 9:28 pm with all members present, except Melendez. PUBLIC WORKS UPDATE ON POTENTIAL SALE OF THE WEST COVINA WATER SUPPLY SYSTEM City's Water Supply System City Engineer Glover presented the staff report. Councilmember Herfert clarified the staff recommended requested amount was changed to $3500. Mayor Wong asked questions about the timing of the RFQ process, election requirements and potential water deregulation. Motion by Herfert and seconded by Touhey to appropriate ' $3500 from the water fund reserves and approve the retention of Bookman-Edmonston to prepare the RFQ and assist in evaluating the responses. Motion carried 4-0. WASTE MANAGEMENT ENFORCEMENT AGENCY (LEA) No reports for this meeting. 4 City Council Minutes of 7/15/97 ENVIRONMENTAL SERVICES REDEVELOPMENT AGENCY No reports for this meeting. The Redevelopment Agency meeting was held earlier in the meeting. ` COMMUNITY SERVICES No reports for this meeting. PUBLIC SAFETY - FIRE DEPARTMENT PARAMEDIC ENGINE COMPANIES Paramedic Engine Companies Fire Chief Greene and Battalion Chief Janis presented the staff report and responded to Council's questions and comments. Carl Johnson Carl Johnson, 329 N. Orange Avenue, spoke both for himself and the West Covina Citizens For Local Fire Control. His comments were very supportive of the concept proposed by the Fire Department. Iris Delameter Iris Delameter, 1212 W. Eckerman, expressed her support for this and noted that the reorganization exemplifies what a locally - controlled fire department can achieve. Council supported the proposal; however, Councilmember Howard stated she would abstain on this matter as she questioned the timing of it in light of the current firefighter initiative. Motion by Herfert and seconded by Touhey to: a) meet and confer with the Firefighters Association for program implementation; b) begin negotiation with our two ambulance providers, Cole-Shaefer and American Medical Response, to develop a proposal that will be beneficial to the City as well as to the ambulance provider; and c) authorize the Fire Department to reserve four paramedic training slots for the September training class. Motion carried 3-0-1 with Howard abstaining. ADMINISTRATIVE SERVICES No reports for this meeting. GENERAL ADMINISTRATION No reports for this meeting. APPROVAL OF DEMANDS Motion by Herfert and seconded by Touhey to approve Demands for FY 96/97 totaling $14,219.70 as fisted on check registers FI 171061 through 171063. Motion carried by roll call vote: AYES: Herfert, Howard, Touhey, Wong NOES: None ABSENT: Melendez Councilmember Herfert stated that he is not required to abstain on SCE due to the rates falling below a certain threshold. Motion by Herfert and seconded by Touhey to approve Demands for FY 97/98 totaling $1,094,475.14 as listed on check registers FI 171064 ' through 171305. Motion carried by roll call vote: AYES: Herfert, Howard, Touhey, Wong NOES: None ABSENT: Melendez ABSTAIN: Howard re Future America Touhey re Community Food Bank City Council Minutes of 7/15/97 • ORAL COMMUNICATIONS Audrey Lynberg MAYOR'S REPORTS Audrey Lynberg, 1311 Golden Vista Drive, commended the City Manager and Fire Chief on their presentation to the Covina City Council earlier this evening. She then asked Council to direct the City Attorney to review the petition currently being circulated through -out the City by the firefighters, particularly in relation to the signature gathering methods. She concluded her remarks supporting the proposed reorganization to paramedic engine companies. No reports for this meeting. COUNCILMEMBERS' REPORTS No reports for this meeting.
