11-05-1996 - Regular Meeting - Minutes0 MINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL NOVEMBER 5, 1996 The regular meeting of the West Covina City Council was called to order by Mayor Touhey at 7:37 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Father James Williams of St. Martha's Episcopal Church and the Pledge of Allegiance was led by Mayor Pro Tern McFadden. ROLL CALL Mayor Touhey, Mayor Pro Tern McFadden, Councilmembers Herfert, Manners, Wong Others Present: Starbird, Wylie, Martyn, Greene, Glover, Collier, McIsaac, Pullin, Tong, Ure, Fong, Distelrath, Koniarsky, Berry APPROVAL OF MINUTES Councilmember Wong noted that the special meeting of October 15 was called to order by the Mayor Pro Tern and page three of the regularmeeting minutes need to indicate the ordinance was adopted as amended. Motion by Manners and seconded by Wong to approve the following minutes as corrected above: special meeting of September 3, 1996, the special meeting of October 15, 1996, and the regular meeting of October 15, 1996. Motion carried 5-0 with Touhey abstaining for the minutes of the special meeting of October 15, 1996 (absent from meeting). PRESENTATIONS Gregory Shaffer of the California Healthy Cities Project presented a special achievement award to Fire Chief Greene for the Challenge the EO.R.C.E. program. An eight minutes tape of the program was aired for the viewing audience. A number of the middle school students who participated in the program were introduced at the podium. Mayor Touhey presented Bill Ketteringham a Resolution of Com- mendation for his seven years of service as a member of the Waste Management and Environmental Quality Commission. HEARING PUBLIC NUISANCE ABATEMENT HEARING Locations: 903 Bruce Avenue 1113 West Pine Street Swimming Pools City Clerk Berry verified the affidavits of posting and Mayor Touhey opened the hearing. The staff report was presented by Planning Director Collier. Public Testimony Mayor Touhey opened the public testimony portion of the hearing and the following individual addressed Council: Miguel Miranda Miguel Miranda, 903 Bruce Avenue, addressed Council regarding a confusion over the contractor who actually pumped the pool. Testimony closed Mayor Touhey closed the public testimony portion of the hearing as there were no others wishing to address Council. Council Minutes of November 5, 1996 Planning Director Collier clarified the procedures used for pumping pools and was asked to discuss it further with Mr. Miranda. PINE STREET Motion by Manners and seconded by Wong to waive further reading of the resolutions and adopt. Motion carried 5-0. HEARING CODE AMENDMENT NO.265 - COMPREHENSIVE SIGN ORDINANCE REVISION and NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT Mayor Touhey explained the City -initiated amendment revises por- Code Amendment 265 - tions of Chapter 7 and Chapter 26 relating to signs. The intent of Sign Code revisions the revisions is to streamline sign review procedures, make sign code standards easier to understand, and to update the regulations to reflect current market conditions. Mayor Pro Tern McFadden stated his desire to hold this matter over to another Council meeting. City Clerk Berry verified. the affidavit of publication and Mayor Touhey opened the hearing. In light of the request to hold the matter over, Mayor Touhey stated the staff report would not be given tonight. He opened the public testimony portion of the hearing in the event there were members of the audience who wished Public Testimony to address Council on this subject. The. following person addressed Council: Joe Corona Joe Corona, 2203 E. Alaska Street, requested Council to have illegal signs removed as there are a lot all over the City. As there were no others wishing to address Council, Mayor Touhey entertained a motion to hold over the hearing until the next meeting. Motion by Herfert and seconded by Wong to carry the hearing over until the next regular Council meeting. Motion carried 5-0. Councilmember Herfert requested staff to include enforce- ment of sign removal as done by the Edison Company. It may help in devising an enforcement procedure. AGENDA AND ORAL COMMUNICATIONS Jean Arneson Jean Arneson, 1116 Donna Beth, discussed Item K-1 (March 4, . 1997 Ballot Measure). She suggested that the instructions for Candidate Statements include the prohibition of false, slanderous and libelous statements, as well as a disclaimer similar to that found in the County's pamphlet noting that the contents have not been checked for accuracy. 2 Council Minutes of November 5, 1996 is Bob Pamplin Bob Pamplin, 3208 Hollingworth, discussed Item 0-3 ("Saturday Night Specials") opposing the proposed ordinance banning cheap handguns. Suzanne Paul Suzanne Paul, speaking on behalf of The Plaza at West Covina, noted support of the proposed street name changes (Item G-2b). Bruce Schutte Bruce Schutte, President of West Covina Chamber of Commerce, introduced the following speaker in relation to a survey conducted by the Chamber regarding the Business License Tax (BLT) and the Business Improvement Tax (BIT) - Item K-2a. Steve Hamilton Steve Hamilton, West Covina Chamber of Commerce, reported on the Chamber's survey results and responded to Council's comments and questions. Robert Roudebush Robert Roudebush, 206 N. Lang, spoke in support of any ordinance that may be developed addressing trees and debris in residential zones (Item G-1). He also commented on Saturday Night Specials (cheap handguns), noting his support for a prohibition. Miscellaneous - Personnel Services 1) PERS Payroll Deduction Plan PERS Payroll Deduction Plan Recommendation is to adopt the PERS resolution, attached to the staff report, to enable action and approval of PERS to implement the deduction plan. 2) Reclassification of Photo Technician and Clerk Positions in the Police Department P.D. - Two reclassifications Recommendation is to approve the proposed reclassification of one vacant Clerk position to a Police Records Clerk I, and one vacant Photo Technician position to a Community Services Officer. Miscellaneous - Police Department Crime Free Multi -Housing Program Crime Free Multi -Housing Recommendation is to direct the City Manager and the City of Program Police to enter into an agreement (MOU) with the San Bernardino County Sheriff's Department Special Projects Unit to allow unlimited assistance to implement the Crime Free Multi -Housing Program here iri the City of West Covina. Motion carried by roll call vote: AYES: Herfert, Manners, McFadden, Wong, Touhey NOES: None Item C-10i In relation to the proposed reclassification of the Photo Technician to a Community Services Officer, Councilmember Wong expressed concern over the quality of the crime scene photos that would be used in court proceedings. The expertise of a well -trained photo- grapher avoids the mistakes that happen with point -and -shoot photo- graphy. He asked Police Chief Distelrath if he was comfortable with the reclassification. Chief Distelrath acknowledged that the City was well -served in the past by the photographer whose position is now vacant. How- ever, the fingerprint detection system (Item C-9d) and the forensic mapping system (Item C-9c) authorized for purchase this evening will do far more things for the police at crime scenes than a photo- graph could do. Motion by Manners and seconded by Herfert to approve Item C-10i as recommended by staff. Motion carried 4-1 with Wong voting no. PUBLIC WORKS 1) REVIEW OF AZUSA AVENUE MEDIANS FROM TEMPLE AVENUE TO NORTH CITY LIMITS Council reviewed the staff report. Azusa Avenue Medians Motion by Manners and seconded by Herfert to authorize staff to retain the services of a landscape architect to develop preliminary plans and cost estimates for Council review at a cost not to exceed $10,000. REDEVELOPMENT AGENCY 1) RDA MEETING Mayor Touhey recessed the City Council meeting at 9:11 pm to convene the Redevelopment Agency meeting. GENERAL ADMINISTRATION OFFICE OF THE CITY CLERK INITIATING THE MARCH 4, 1997 GENERAL MUNICIPAL ELECTION March 4th Election Council reviewed the staff report. Council concurred on the following ballot measure wording: "Shall. the West Covina General Plan be amended to Require a 2/3 Vote of the Electors for Siting Solid Waste Facilities Within One Mile of Residential Property?" Following a discussion on arguments and rebuttals, Council con- cluded that an argument in favor of the measure will be authored by the City Council and no rebuttal arguments will be permitted. A discussion ensued on the content validity of Candidate Statements and to what extent the City Clerk can have statements corrected or cleaned -up. The Council agreed to direct staff to include a disclaimer in the sample ballot indicating that statements have not been verified and that any grammatical or typographical errors are those of the candidate. Councilmember Herfert was not in agreement with inserting a disclaimer statement into the Sample Ballot indi- cating to the voters that the content of the candidate statements had not been verified. CITY MANAGER 1) CITY BUSINESS IMPROVEMENT TAX SURVEY & REPORT ON CHAMBER OF COMMERCE BIT/BLT SURVEY Council reviewed the staff report. BIT/BLT Chamber Survey Motion by Manners and seconded by Herfert to receive and file the report. Staff to report back on how to generate bills with separate BIT calculation, and clarify how the Brr and BLT are computed. Motion carried 5-0. 2) FINAL FY 1996/97 BUDGET City Manager Starbird presented a brief overview of the Final FY 96/97 Budget final budget document. Councilmember Herfert complimen- ted staff on the fine work. Motion by McFadden and seconded by Wong to adopt the final FY 96/97 Annual Budget as presented. Motion carried 5-0. 3) RECONIMENDATION FOR APPROPRIATION OF FUNDS FOR HURST HISTORICAL MUSEUM FOUNDATION Council reviewed the staff report. Hurst Historical Museum Motion by Herfert and seconded by McFadden to designate Project No. 114-320-3754-7500 as the Hurst W Council Minutes of November 5, 1996 Ranch Historical Foundation Funding, appropriate $100,000 and authorize the City Manager to make periodic allocations to the Hurst Ranch Historical foundation for its work as described in the staff report. Motion carried 5-0. APPROVAL OF DEMANDS Motion by Herfert and seconded by McFadden to approve Demands totaling $1,702,423.09 as listed on check registers FI 165745 through FI 166131. MAYOR'S REPORTS Motion by Manners and seconded by Herfert to approve a Resolution of Commendation for Bill Ketteringham, outgoing Waste Management & Environmental Services Commissioner. Motion carried 5-0. COUNCII.MEMBERS' REPORTS 1) FEE STRUCTURE FOR FOOTHILL TRANSIT ZONE Council reviewed the staff report. Councilmember Herfert stated that what he has been looking for are the Transit Zone's full budget documents for the last six years, and this matter need not be agendized again. 2) USE OF CABLE TELEVISION FACILITIES BY CANDIDATES Councilmember Wong requested a report of staff time and money expended to produce the Mayor or Councilmember shows. Councilmember McFadden stated that he would cease the television show if he takes out nomination papers - not when nominations open. 3) RESOLUTION NO. 96-2 OF THE S.G.V. COUNCIL OF GOVERNMENTS Saturday Night Specials Councilmember Manners commenced a discussion on the ban of "Saturday Night Specials" as requested by the San Gabriel Valley Council of Governments. Council discussion ensued. Motion by Manners and seconded by Herfert to have staff prepare an ordinance similar to the sample prepared by the S.G.V. Council of Governments. Motion carried 4-1 with Touhey voting no. Mayor Touhey felt it was unconsti- tutional to impose such a ban because these types of guns are those that are available to low-income individuals. 10 Council Minutes of November 5, 1996 0 Other Items Councilmember Wong requested that the subject matter of the Amar Drive traffic barrier be reagendized for the next Council meeting. Councilmember Wong also requested that the meeting be adjourned in memory of Jason Martinez, who died at seventeen. Councilmember Herfert requested that staff arrange a meeting with the City Engineer and the Walmerado Little League President. Councilmember Herfert stated that the political rally recently held for Presidential candidate Bob Dole precluded the Mayor from the event. He felt that an event of this magnitude in any City should include the Mayor of the City. Mayor Touhey agreed and noted that he was able to attend because he knew some of the FBI men worldng the event. Other Councilmembers concurred that the Mayor should have been included among the recognized dignitaries.
