05-07-1996 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL May 7, 1996 The regular meeting of the West Covina City Council was called to order by Mayor Touhey at 7:30 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The Invocation was given by Rev. Dr. Il Hzum Yun of West Covina United Methodist Church (Korean) and the Pledge of Allegiance was led by Councilmember Herfert. ROLL CALL Mayor Touhey, Mayor Pro Tem McFadden, Councilmembers Herfert, Manners, Wong Others Present: Starbird, Wylie, Fredrics, Glover, Collier, Dixon, Salazar, Miller, Koniarsky, Samaniego, Keating, Greene, Jones, Bonaparte, Bommarito, Mayer, Distelrath, Schimanski, Alcaino, Pullin, McIssac, Palkhiwala, Berry APPROVAL OF MINUTES Motion by Wong and seconded by Herfert to approve the minutes of the special meeting of April 15, 1996. Motion carried 5-0. Motion by Wong and seconded by Herfert to approve the minutes of the special meeting of April 16, 1996 and the regular meeting of April 16, 1996. Motion carried 4-0-1 with Manners abstaining (absent on the 16th). PRESENTATIONS/PROCLAMATIONS Mayor Touhey presented a five-year service pin to City Manager Jim Starbird. With the assistance of Pete Williams, member of the West Covina Rotary Club, Mayor Touhey presented Certificates of Recognition to the following individuals for their participation in the Rotary Youth Leaders of America program: Lap Luu (absent) Chandra Walker (present) David Citani (absent) George Cruz (absent) Manuel Petinarakis (absent) Winson Ly (absent) Louise Chung (present) Trang Phan (absent) Tiffany Knight (present) Mayor Touhey proclaimed the month of May as OLDER AMERICANS MONTH and presented the proclamation to Elba Comeau. Ms. Comeau was also recognized as West Covina's Older American and will be honored at an annual luncheon in downtown Los Angeles. Mayor Touhey presented a CLEAN CITY AWARD to Environmental Services Director Miller, who discussed the City's accomplishments in the use • of alternative fuels and air quality improvement. Mayor Touhey proclaimed May 11, 1996 as FIRE SERVICE RECOG- NITION DAY and presented the proclamation to Fire Chief Greene and Fire Fighter Steve Wilch. Fire Fighter Wilch announced the events scheduled for May 11 and invited the community to attend the festivities. Mayor Touhey proclaimed May 19 through May 25 as EMERGENCY MEDICAL SERVICES WEEK and presented the proclamation to Karl Van Allen of Citrus Valley Medical Center/Queen of the Valley Hospital. Council Minutes of May 7, 1996 2 • • Mayor Touhey proclaimed the month of May as National Mental Health Month and presented the proclamation to Elsie Redline of the Alliance for the Mentally III, E.S.G.V.Chapter. HEARING APPEAL OF TENTATIVE TRACT MAP NO.52117 SOUTH HILLS HOMES PARTNERSHIP Location: Sunrise Road at Hillside Drive T.T. Map No. 52117 City Clerk Berry verified the affidavit of publication and mailing. Mayor Touhey opened the hearing and the staff report was presented by Planning Director Collier. Mr. Collier presented slides of the street and responded to Council's questions regarding the definition of "condom- " notification to adjacent property owners, financial savings to the City if the street was approved for private ownership, and comments made at the Planning Com- mission hearing. Public Testimony Mayor Touhey opened the public testimony portion of the hearing and asked for comments in favor of the street closure. The following addressed Council: Ziad Alhassen Ziad Alhassen, 3050 Sunrise Road, applicant, noted that the seven homes were constructed in 1987 as model homes for the development and were now all owned by family members. He recited the reasons for the requested gating of the cul-de-sac street. Janice Bonneville Janice Bonneville, 1521 Fairway Knolls, urged Council to approve the request and concurred with the vandalism experienced on the street. Mayor Touhey asked for comments opposing the closing of the street and the following addressed Council: Joe Gallo Joe Gallo, 3045 Hillside Drive, stated his opposition noting that he when he moved into his home, he bought into the whole neighborhood. Gating Sunrise Road would change the integrity of the neighborhood and set a dan- gerous precedent for the City. He also stated that the mobile home used as a sales office many years ago still remains on the property, a violation of City code. Mayor Touhey permitted rebuttal comments from Mr. Alhassen who stated that there would be a pedestrian gate for the neighbors and that the trailer was scheduled to be removed in the very near future. Testimony closed losed Mayor Touhey closed the public testimony portion of the hearing. Council Discussion Councilmember Herfert commenced Council discussion, stating that he was in agreement with the comments made by Mr. Gallo. He stated his opposition to gating the cul-de-sac as setting a bad precedent. He acknowledged vandalism as a problem but gating the street is not the answer. Councilmember Wong stated that he lived in the area and was sensitive to both sides of the issue. None of the neighbors he talked to who walk the streets for exercise include Sunrise Road in their walk. Given the seven property owners are willing to maintain the street and absorb that cost, he would support the request. Councilmember Manners stated that generally she is not inclined to overturn decisions made by commissioners and that there were no compelling reasons to do so in this matter. She said it was a nice street and suggested leaving it as is. Mayor Pro Tem McFadden suggested returning the matter to the Planning Commission. Mr. Alhassen was not able to attend the Planning Commission hearing, although he did send a representative. He felt Mr. Alhassen may not have received "due process" at the commission and suggested Mayor Touhey allow Mr. Alhassen to address that issue. Council Minutes of May 7, 1996 Mayor Touhey permitted Mr. Alhassen to again speak to Council, addressing only new and different testimony which might -indicate a reason to send the matter back to the Planning Commission. Mr. Alhassen stated that the Planning Commission was not represented by legal counsel that evening. He also felt Chairman Solinger should have abstained, as ' should have Mr. Zeller - both in his estimation to have conflicts of interest. City Attorney Dixon related her conversations with Commissioners Solinger and Zeller about their individual situations. She stated that neither commis- sioner had a conflict of interest situation that required abstention. Mayor Touhey echoed Councilmember Manners' earlier statements about leaving the street as it is and noted further that this particular matter is separate and unrelated to the projects that the applicant brings into the City. Motion by Herfert and seconded by Manners to deny the tentative tract map and uphold the Planning Commission's decision. Mayor Touhey asked for the title of the resolution. City Clerk presented: Resolution 9305 - RESOLUTION NO. 9305 - A RESOLUTION OF THE CITY denying TT Map 52117 COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DENYING TENTATIVE TRACT MAP NO. 52117 Motion by Herfert and seconded by Manners to waive further reading of the resolution and to adopt. Motion carried 4-1 with Wong voting no. HEARING ORDINANCE TO RESCIND URGENCY ORDINANCE NO. 1962, REMOVING THE REQUIREMENT TO OBTAIN AN ADMINISTRATIVE PERMIT FOR THE KEEPING OF HORSES City Clerk Berry verified the affidavit of publication. Mayor Touhey opened the hearing and the staff report was presented by Planning Director Collier. Public Testimony Mayor Touhey opened the public testimony portion of the hearing and asked for comments. The following person addressed Council: Shelly Sanderson Shelly Sanderson, 2743 Vanderhoof, thanked Council for being open and listening to the residents. She urged approval of the proposed ordinance. Testimony, closed There being no others wishing to address Council, Mayor Touhey closed the public testimony portion of the hearing. Council discussion Councilmember Manners stated that she would not vote in favor of the rescission as she had at the last meeting. She thought then the issue had been resolved, but has come to realize that potential problems still remain and could not therefore support it tonight. Council Minutes of May 7, 1996 4 Public Testimonv Mayor Touhey opened the public testimony portion of the hearing and asked for comments. The following addressed Council: John Ryan John Ryan, 1235 S. Mullender Ave., stated that his girlfriend owned the property and her constitutional rights had been violated. He complained that at ' no time did either the City or the County Health Department present evidence that the pool was out of chemical balance. Emma Fischbeck Emma Fischbeck, 1137 Auburn Avenue, stated that she was aware of a par- ticular kind of fish that can be bought and placed in pools to eat the algae. Patricia Mattison Patricia Mattison, 1235 S. Mullender Ave., property owner, stated that no one swims in her pool. She was in jail for fourteen days, during which time the pool was pumped. She complained about the Code Enforcement Officers and the judge who had heard the case and had her incarcerated, during which period of time her mother died. Robert Parry Robert Party, editor of The Guardian, related a situation in which a child was missing and eventually found at the bottom of a green pool. John Ryan Mr. Ryan spoke again, noting that Ms. Mattison's gates are always locked and the pool is surrounded by a six-foot fence. Testimony closed Mayor Touhey closed the public testimony portion of the hearing and com- menced Council discussion. Council discussion Councilmember Herfert clarified that the pools for each of these addresses have already been pumped and this evening's action is to authorize staff to send bills for the work that was done. He felt the emotions displayed this evening by Mr. Ryan and Ms. Mattison regarding their court proceeding was probably mis- placed. Mayor Pro Tern McFadden stated that he would approve the action this evening, but would like a report on Ms. Mattison's case. City Manager Star - bird responded that the steps taken by Code Enforcement were correctly executed. City Attorney Dixon added that the hearing before Council is an administrative code enforcement hearing, not a criminal hearing as experienced by Ms. Mattison in court. Councilmember Wong stated he had no need for a report regarding Code Enforcement's work. Councilmember Manners and Mayor Touhey concurred. Mayor Touhey said that unmaintained pools were intolerable in the community and the City must take a pro -active approach for the health and safety of the citizens. Motion carried 5-0. HEARING 1996/97 COMMUNITY DEVELOPMENT BLOCK GRANT ACTION PROGRAM FY 96/97 CDBG City Clerk Berry verified the affidavit of publication and Mayor Touhey opened the hearing. The staff report was presented by Human Services Director Salazar. Mayor Touhey stated that due to conflict of interest laws, he would abstain from participating in the discussion and vote regarding the Community Food Bank (Item No. 5) and Future America (Item No..16). Councilmembers asked for a clarification of several items and the methodology used by the Human Services Commission in determining the priorities and amounts. Mr. Salazar responded. Council also asked about unused funds at the end of this fiscal year and what were Council's options should more than $217,500 be received for next year. It was explained that any unused funds this year could be reallocated to one agency or another, but must be done within this same fiscal year. Any funds received over the anticipated $217,500 for next year could be designated as Council prefers. This led into a discussion on the possibility of additional funds and Council preferences. Public Testimonv Mayor Touhey opened the public testimony portion of the hearing and the following addressed Council: Terry Howell Terry Howell, Center for Independent Living, thanked Council for the City's support over the past year and requested support for the upcoming year (Item No. 7). Debbie Dalton Debbie Dalton, WINGS, thanked Council for the City's supprt over the past year and requested support for the upcoming year (Item No. 4). She was disappointed that the Commission recommended $3,000 rather than the requested $7,949, Arsenio Pamintuan Arsenio Pamintuan, Filipino/American Food Bank, requested Council's support as a new food bank located in the southern part of West Covina. He talked about the activities and services provided by the Filipino American Seniors & Associates (FASA) of which he is president. Angelo Kay Angelo Kay, legal advisor for FASA, spoke favorably of the organization and urged Council's financial support for the food bank. Testimony closed As there were no others wishing to address Council, Mayor Touhey closed • the public testimony portion of the hearing and commenced Council discussion. Council discussion Council reiterated their preferences for the following additional funding, should it become available: a) an additional $3000 to Item No. 4 - WINGS, b) an additional $2500 to Item No. I I - the Filipino/American Food Bank, c) $1000 to Item No. 17 - the Alliance for Mentally Ill (a new request this year), and d) $3000 to Item No. 21 - Claremont Dispute Resolution Center (which this year was categorized as a Priority C - no funding). Council Minutes of May 7, 1996 • • After further discussion, motion by Manners and seconded by Touhey to accept Priority A and Priority B recommendations and increase Items 4, 11, 17, and 21 in concept. Council will decide on the financial amounts as the end of the fiscal year draws closer and final surplus figures are available. Motion carried 5-0. City Clerk presented: Resolution 9311 - RESOLUTION NO. 9311 - A RESOLUTION OF THE CITY 96/97 CDBG COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DECLARING ITS INTENTION TO APPLY FOR FUNDS PURSUANT TO THE 1974 FEDERAL HOUSING AND COMMUNITY DEVELOPMENT ACT AS AMENDED AND CERTIFYING THE ENVIRONMENTAL REVIEW RECORD THEREOF Motion by Wong and seconded by Manners to waive further reading of the resolution and adopt. Motion carried 5-0. RECESS Mayor Touhey called a recess at 11:10 pm. The City Council reconvened at 11:20 pm with all members present. RDA Called to Order Mayor Touhey convened the Redevelopment Agency at 11:20 pm in order to conduct the followingjoint public hearing. HEARING CONTINUED JOINT PUBLIC HEARING ON THE PROPOSED AMENDED AND RESTATED DISPOSITION, DEVELOPMENT AND OWNER PARTICIPATION AGREEMENT BY AND AMONG THE REDEVELOPMENT AGENCY AND HASSEN IMPORTS PART- NERSHH' AND WEST COVINA MOTORS, INC. Motion by Wong and seconded by Herfert to approve the staff recommenda- tion.to continue this joint public hearing to May 21, 1996. Motion carried 5-0. RDA Recessed Mayor Touhey recessed the Redevelopment Agency at 11:21 pm to continue the City Council Agenda. AGENDA AND ORAL COMMUNICATIONS Yaseen Jahouri Yaseen Jahouri encouraged the City Council to approve Consent Calendar Item C-IOa (Street Lighting on Aroma Drive Westerly of Galster Way). Iris Delameter Iris Delameter, 1212 W. Eckerman, was happy to see a decrease in the pro- posed assessments for Maintenance District No. 4 and the Citywide District (Consent Calendar Item C-IOb and C-IOc). On another matter, Ms. Delameter suggested the meeting scheduled for May 16 regarding the BKK Closure Plans be rescheduled as there are several community functions happening on that same evening. Katherine Castucci Katherine Castucci, 430 S. Pima Avenue, addressed three items: a) She offered congratulations to the new Mayor and Mayor Pro Tem. b) She noted her displeasure with the Council's handling of the MRF issue; particularly by Councilmember Herfert and Mayor Touhey. She also felt staff was abused and misused on the MRF issue. c) She spoke again of the Council majority not responding to the pay raise issue for police mid -management in a fashion that would engender good working relations between the police and the City Council. She noted that she is speaking for herself on this issue - she was not approached by the Police Department to speak on their behalf. The Council majority responded to Ms. Castucci's comments and Mayor Touhey added that there is an offer currently on the table for the police mid - management, of which Ms. Castucci is unaware. Council Minutes of May 7, 1996 CONSENT CALENDAR Written Communications A letter was received from Mrs. Donna Lemoi requesting additional parking be provided at Edgewood Middle School adjacent to the swimming pool and track. Miscellaneous - Public Works ' 1) Street Lighting on Amar Drive - Westerly of Galster Way SL 96116 - Recommendation is to a) establish project SL 96116 for Aroma Drive Project established Street Lighting, and b) appropriate $23,000 from Citywide Main- tenance District reserves to SL 96116. This funding is to be repaid to the Citywide Maintenance District by the adjacent developer in accordance with the conditions of approval. 2) West Covina Landscaping Maintenance Districts Nos. 4. 6, and 7 The rates for Districts 6 & 7 are proposed to remain the same as currently established and the rates for District 4 are proposed for a 7.5% decrease. Honeywell and Evelyn Honeywell and (2) Robert B. Landeros and Clysta K. Telford. 9) Maintenance of Landscape, Hardscape, and Sprinkler Systems on Citywide Park Property - Approval of Plans and Specifications Park Sprinkler Sytems - Recommendation is to approve plans and specifications for citywide Plans & specs approved park landscape maintenance and authorize the city Engineer to call for bids. Miscellaneous - LEA Resolution Authorizing Enforcement Asistance Grant Application To receive a fund allocation of $15,000 from the California Integrated Waste Management Board, staff recommends adopting the following resolution: Resolution 9322 - RESOLUTION NO. 9322 - A RESOLUTION OF THE CITY CIWMB Grant COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD FOR AN ENFORCEMENT ASSISTANCE GRANT Councilmember Wong requested Item 10b (West Covina Landscaping Maintenance District Nos. 4, 6, and 7) be removed from the Consent Calendar for separate action. Due to conflict of interest laws, he would need to abstain from the discussion and vote regarding MD #7. Motion carried 5-0. CITY MANAGER 1) JOINT MEETING WITH PERSONNEL COMMISSION Council reviewed the staff report. Council concurred on a joint meeting date of June 27 at 6:30 pm with the Personnel Com- mission to be held in the Management Resource Center. • 2) CITY OF WEST COVINA VS BKK CORPORATION Due to the late hour of this meeting, the City Manager will give a report on this issue at the next regular City Council meeting of May 21. 3) BKK CLOSURE PLAN STATUS The City Council set 5:30 pm on May 21st as the date and time for this Council/multi-Commission meeting and public forum regarding the BKK Landfill closure status, and particularly the landscaping component of the closure plan. COUNCILMEMBERS' REPORTS Councilmember Manners, as a member of the Mosequito Abatement District Board of Directors, announced several opportunties for citizens to give input to the Board regarding an increase in the assessment fees: May 10 at 7:00 am, June 14 at 7:00 am, and June 10 at 7:30 pm (all to be held at the District's Headquarters located at 1145 A North Azusa Canyon Road). Councilmember Wong stated that he would not electioneer from his Council seat; however, he would use his seat to fully explain his position if other Councilmembers make misleading statements about his positions. Councilmember Herfert stated that he felt it was his duty to the citizens to present the facts as he knows them to be. Councilmember Manners suggested adjourning the meeting in memory of Sylvan Shulman (passed away on April 23) and direct staff to convey Counci's condolences to his survivors. Mr. Shulman was the original owner/developer of West Covina Fashion Plaza. Motion by Manners and seconded by Touhey to adjourn the meeting at 12:34 am in memory of Sylvan Shulman.
