REGULAR MEETING OF THE
WEST COVINA CITY COUNCIL
April 16, 1996
The regular meeting of the West Covina City Council was called to order by Mayor Herfert at 7:35
pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation
was given by Rev. Dr. Kundan Peter of West Covina United Methodist Church and the Pledge of
Allegiance was led by Mayor Herfert.
ROLL CALL Mayor Herfert, Mayor Pro Tem Touhey, Councilmembers
McFadden, Wong
Absent: Councilmember Manners (excused)

APPROVAL OF MINUTES Councilmember Wong pointed out two different arrival times for
Mayor Herfert in the special meeting minutes of April 2, 1996.
Mayor Herfert directed the City Clerk to double check the
arrival time and change the minutes accordingly. In addition,
Councilmember Wong pointed out the word "not" should be
corrected to the word "no" on page 5 of the minutes for the
regular meeting of April 2, 1996.
Motion by Wong and seconded by Touhey to approve
the minutes of the special meeting of April 2, 1996; the minutes
of the regular meeting of April 2, 1996; and the minutes of the
special meeting of April 5, 1996. Corrections noted above.
Motion carried 4-0.
PRESENTATIONS/PROCLAMATIONS
Daryl Mills, Public Sector Programs Manager, and Bradley
Meister, Project Manager, both of the California Energy
Commission, presented the Mayor with the Outstanding
Energy Achievement in Local Government award and
commended Pat Glover and Mike Shott for their accomp-
lishments in conserving energy within the City's organization.
Bob Kelly of The United Way presented the Mayor with a
Certificate of Recognition for the City's consistent personnel
contributions to The United Way. City Manager Starbird to
forward the certificate and congratulations to Barbara Banks for
spearheading the fund raising drives year after year.
Mayor Herfert proclaimed April 16, 1996 as West Covina
Emblem Club Day, recognizing forty years of service to the
community, and presented the proclamation to Gene Dana,
president of the West Covina Emblem Club.
Mayor Herfert proclaimed the month of May as West Covina
Beautiful Month and presented the proclamation to Fran .

Mayor Herfert proclaimed May 1 through 7 as Elks National
Youth Week and presented the proclamation to Arthur
Edelson, Loyal Knight of the West Covina Elks Club.
HEARING WEED ABATEMENT 1996 - PROTEST HEARING
Weed Abatement 1996 City Clerk verified the affidavit of mailing. Motion by McFadden
and seconded by Wong to receive and file the affidavit. Motion
carried 4-0. Mayor Herfert opened the hearing and the staff
,report was presented by Fire Chief Greene.
Public Testimony City Clerk reported that no written communications or protests
had been received. Mayor Herfert asked for verbal comments
or protests. No one addressed the City Council and Mayor
Testimony closed Herfert asked for a motion to close the hearing. Motion by
Touhey and seconded by McFadden to close the public
hearing. Motion carried 4-0.
Motion by Touhey and seconded by Wong to authorize the Fire
Chief to order the abatement of weeds and removal of rubbish
on those properties described in Resolution of Intention No.
9304. Motion carried 4-0.
AGENDA AND ORAL COMMUNICATIONS
Royal Brown, 2153 Aroma Drive, addressed Item K-2 (oral
report regarding the City's lawsuit with BKK). He asked about
the status of documents that were to have been submitted by
BKK in January and when would the public be able to comment
on those documents. On another matter, he noted an Open
House scheduled by the EPA for May 4 at St. Martha's Epis-
copal Church regarding BKK issues. He suggested the City
intervene to have the EPA use a City facility.
Mayor Herfert stated that the City has sent letters to the
legislators requesting them to urge the EPA to use a City
facility.
Robert Parry, editor and publisher of The Guardian, defended
his paper. In response to comments made at the last Council
meeting, Mr. Parry pointed out a vast number of articles that
reflect positive happenings in West Covina.

Technical Amendments to the Business License Ordinance
The proposed ordinances make clean-up amendments to the
business license ordinance to remove superseded provisions.
Recommendation is to adopt the urgency ordinance and intro-
duce the regular ordinance:

REDEVELOPMENT AGENCY Mayor Herfert recessed the City Council meeting at 8:00 pm to
convene the Redevelopment Agency meeting. The City
Council meeting reconvened at 8:03 pm with Manners absent.

CITY MANAGER 1) Oral Report re: Meeting with Personnel Commission
City Manager Starbird stated that he would discuss this
matter at the next meeting, when he could suggest
some possible dates for a joint meeting.
2) Oral Report re: Litigation with BKK Corporation
City Manager Starbird stated that the final negotiations
have been going along very well and would be in a

better position to report by the next meeting. He would
give an overview of the grading and landscaping plans
in May and discuss a process for public review.
APPROVAL OF DEMANDS Motion by Herfert and seconded by Touhey to approve
demands totaling $1,249,713.36 as listed on check registers FI
161917 through 162198. Motion carried by roll call vote:

MAYOR'S REPORTS VIDEO PRESENTATION BY MAYOR HERFERT
The video presented the successes and accomplishments of
the past year under the leadership of the City Council. Mayor
Herfert noted the video would be aired several more times on
Channel 56.
COUNCILMEMBERS' REPORTS No reports offered.
COUNCIL REORGANIZATION Mayor Herfert thanked his family, the commissioners, and the
people of West Covina for their support throughout the past
year. He felt a lot was accomplished during his tenure as
Mayor, particularly in response to his YES program (Y - youth,
E - environment, S - safety) and expounded on the successes
in each of these areas. He was very pleased with the Fourth of
July event in 1995 and is looking forward to the 1996 event. He
also commented on the upcoming closure of the landfill.
ELECTION OF MAYOR City Clerk Berry conducted the election for the Mayor of West
Covina. Councilmember Wong nominated Mayor Pro Tem
Touhey. There were no other nominations and nominations
were closed.
Motion by Herfert and seconded by Wong to elect
Michael Touhey as Mayor of West Covina. Motion carried 4-0.
Mayor Touhey Newly -elected Mayor Touhey introduced his family and
his goals for the upcoming year, including the continuance of
pro -family programs, retaining current businesses, maintain
community enhancements and public safety. He announced
that Council would be making a very fair and equitable offering
to the labor organizations while noting the fiscal restraints of
the past three years. He looked forward to a positive, pros-
perous year especially with the,upcoming Edwards Theatre
project and the Eastland Shopping Center renovation.
ELECTION OF MAYOR PRO TEM
City Clerk Berry conducted the election for the Mayor Pro Tem
of West Covina. Councilmember Herfert nominated Council -
member McFadden as Mayor Pro Tem. Councilmember Wong
nominated Councilmember Manners as Mayor Pro Tem. Nomi-
nations for Mayor Pro Tem were then closed.

Motion by Herfert and seconded by Touhey to elect
Bradley McFadden as Mayor Pro Tem of West Covina. Motion
carried 3-0-1 with Wong abstaining.
Mayor Pro Tem McFadden Newly -elected Mayor Pro Tem McFadden thanked the
Council for their vote and congratulated immediate past Mayor
Herfert on a fine year and Touhey for his election. He noted
his appreciation to staff and looked forward to working with the
Council and staff.
Mayor Touhey stated he enjoyed working closely with Steve
Herfert as the Mayor Pro Tem and being his running mate in
the April '94 election. He presented Councilmember Herfert
with an outgoing Mayor's plaque.
DESIGNATION OF ALTERNATE TO THE L.A. COUNTY SANITATION DISTRICT BOARD
Mayor Touhey stated that as Mayor of West Covina, he is
automatically a Director on the Sanitation Board of Directors
and at this point Council needs to select an alternate, in the

Mayor Touhey suggested Mayor Pro Tem McFadden.
Motion by Herfert and seconded by McFadden to designate
Mayor Pro Tem McFadden as alternate. Motion carried 4-0.
Councilmember Wong noted that the Councilmembers all have
the best interest of the City at heart and while the goals may
be the same, the method for attaining those goals are different.
He congratulated Councilmember Herfert on his year as Mayor
and newly -elected Mayor and Mayor Pro Tem. He looked
forward to working with Mayor Touhey during the ensuing year.
Motion by Herfert and seconded by Wong to adjourn the
meeting at 8:37 pm. Motion carried 4-0.
