MINUTES
REGULAR MEETING OF THE
WEST COVINA CITY COUNCIL
April 2,1996
The regular meeting of the West Covina City Council was called to order by Mayor Herfert at 7:37 pm in
the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by
City Manager Starbird and the Pledge of Allegiance was led by Mayor Herfert.

APPROVAL OF MINUTES Motion by Manners and seconded by Touhey to approve the minutes
of the special meeting of March 19, 1996 and the regular meeting of
March 19, 1996 with the following corrections to the regular
meeting: Pg 7 - explain City Attorney's response and Pg 9 - change
the vote from 4-1-1 to 3-1-1. Motion carried 5-0.
PRESENTATION Mayor Pro Tem Touhey presented a Certificate of Recognition to
Todd Muncie and gift certificates from National Sports Grill for
having ridden 50,000 miles on his bike.
PROCLAMATIONS Mayor Herfert proclaimed April 15-21 as APRIL POOLS WEEK
and presented the proclamation to Fire Chief Greene.
Mayor Herfert proclaimed April 14-20 as NATIONAL PUBLIC
SAFETY TELECOMMUNICATIONS WEEK and presented the
proclamation to Mary O'Guinn, West Covina Communications
Supervisor.
HEARING APPEAL OF TENTATIVE TRACK MAP NO. 52117
City Clerk Berry verified the affidavit of publication and mailing.
Mayor Herfert opened the hearing and stated that the appellant
desired a continuation of the matter until May 7, 1996.
Motion by Manners and seconded by Touhey to continue the
appeal of Tentative Tract Map No. 52117 to the City Council
meeting of May 7, 1996. Motion carried 5-0.
HEARING TIME EXTENSION - URGENCY ORDINANCE NO. 1966
REVERSE VENDING MACHINE REGULATION
Reverse Vending Machines City Clerk Berry verified the affidavit of publication. Mayor Herfert
opened the hearing and the staff report was presented by the City
Manager, who noted that Council could extend the effectiveness of
Ordinance No. 1966 for a period of ten months and fifteen days in
accordance with Government Code Section 65858(a).

Public Testimony Mayor Herfert opened the public testimony portion of the hearing
and asked for comments favoring the extension to Ordinance No.
None 1966. He then asked for comments opposing the time extension.
No one addressed Council. Mayor Herfert closed the public

AGENDA AND ORAL COMMUNICATIONS
Mabel Tronsgard Mabel Tronsgard, 1334 W. Glenmere, complained that the letter
promised to her explaining the reasons why Mayor Herfert has no
conflict of interest in voting for sports lighting, but does have a
conflict when voting on the Lark Ellen Towers project. City
Attorney Dixon noted that the letter had been her responsibility and
she would get it out the next day.
Mario Cardenas Mario Cardenas, 16453 Hayland St., Valinda, West Covina Youth
Pony Baseball, stated his league really needs assistance paying the
electrical bill (Item N-3).
Tony Valdez Tony Valdez, 16352 Doublegrove, Valinda, West Covina Youth
Pony Baseball, urged Council to have the City pay the electrical bill
(Item N-3).
Paul Olvera Paul Olvera, 2228 Rockway Drive, West Covina Youth Pony
Baseball, appreciated Council's past actions with Prop A funds and
CIP funds towards youth activities.

Bid No. 96-002 - Recommendation is to a) award the bid to Instant Replay Communi-
Instant Replay Comm. cations Company, Marina del Rey, to upgrade the Police Jail CCTV
system (including the color multiplexers and broadcast receiver
option) at a total cost of $46,677.30, and b) appropriate $21,000.00
from the unappropriated fund balance of the Inmate Welfare Fund
and $27,677.30 from the Drug Asset Forfeiture Fund to pay for this
project.

Weed Abatement Contracts - Recommendation is to approve a one (1) year extension to the 1993

City Clerk to execute the contracts.

Calendar, except: C-6 and C-7b. Motion carried by roll call vote:

Item C-6 Councilmember Wong stated that he would need to abstain from the
adoption of Ordinance No. 1968 (Amendment No. 271) due to
conflict of interest laws. Motion by Herfert and seconded by
Manners to waive further reading of the ordinance and adopt.
Motion carried 4-0-1 with Wong abstaining.
Item C-7b Council discussed at length the one component of the bid which
would provide for the installation of televisions in the jail cells.
Council agreed that until such time as televisions are mandated for
inmates, that portion of the bid would be eliminated.
Motion by Manners and seconded by Herfert to approve the
contract award with the elimination of the televisions for the jail
cells. Motion carried 5-0.

REDEVELOPMENT AGENCY Mayor Herfert recessed the City Council meeting at 8:15 pm to
convene the Redevelopment Agency meeting. The City Council
reconvened at 8:17 pm with all members present.

MAYOR'S REPORTS 1) Certificate of Commendation
Motion by Manners and seconded by Wong to approve a
Certificate of Commendation for retiring Maintenance
employee Fritz Lengerke. Motion carried 5-0.
2) The Federal Gang Violence Act of 1996 and
The Methamphetamine Control Act of 1996
Council reviewed the staff report. Motion by Manners and
seconded by McFadden to support both bills and notify
applicable legislators. Motion carried 5-0.
3) Youth Sports Organizations Request for Funding
of Electricity Costs
Electrical Costs of Sport Lighting City Manager Starbird and City Engineer Glover elaborated
on the staff report.
Councilmember Wong stated that he could support
the action proposed this evening for equity sake. He sug-
gested, though, that during the budget sessions consideration
be given to all youth sports and perhaps the City contribute
to the various sports on a per child basis. He felt that would
be a more equitable way to assist with youth sports. He also
suggested the electrical costs ($70,000 in total) be charged
against the BKK Augmentation Fund rather than the citywide
maintenance district.
Councilmember Manners felt there was no way to be
completely equitable. She was more concerned that actions
like this evening would result in increasing the burdens on
the taxpayers and, at the same time, reduce the motivation
of the leagues to sustain themselves. Where will the requests
end and when will the handouts stop. She suggested
matching funds as an alternative, or the formation of a

Action on motion
COUNCII,MEMBERS' REPORTS
committee to discuss how to help the leagues without
destroying their incentives. Her opposition to the recom-
mendation was not to be taken as being in opposition to the
league, but as a protest vote.
Mayor Pro Tern Touhey suggested that the citywide
assessments be reduced if the electrical bills are paid for
through the BKK Augmentation Fund. .
Mayor Herfert recited the history of recreation
services prior to Prop 13 and the resultant volunteer groups
caused by the decrease in recreational funds.
Motion by Wong and seconded by Manners to
approve funding the costs ($70,000) starting April 1, 1996,
for electricity associated with operating youth sports leagues
at Palm View Park, Sunset Field, Cameron Park, Del Norte
Park, and Coronado School and that the funding source be
designated as the BKK Augmentation Fund.
Mayor Herfert stated that the staff report reflected
enough available funding for these bills within the citywide
maintenance district. A substitute motion was offered by
Herfert and seconded by Touhey to approve the funding for
electricity through the citywide district. Motion failed 2-3
with Manners, McFadden, and Wong voting no.
The original motion, stated about, was adopted 5-0.
The surplus created by this motion in the citywide district
will be discussed during the budget sessions at the time the
maintenance districts are considered.
Councilmember Wong reported on the library forum held
last week in relation to the County Library's proposed
Community Facility District. The Council's official survey
will be mailed out next week seeking the preferences of the
affected parcel owners. He noted that SB 1988 was
discussed at the forum. This bill would give cities the option
of receiving its share of funds and operating libraries as their
own.
Councilmember Manners related the origin of the League's
Library Task Force. She will be attending a league meeting
Thursday evening in this connection.
Councilmember McFadden commented on the recent judicial
race held March 26th and the personal accusations made
against him, which were false. The Guardian never con-
tacted him prior to running its article, contrary to what the
author stated.
Mayor Herfert noted that the Guardian focuses on negative
happenings in West Covina, as well as certain Council -
members. Positive accomplishments, particularly those of
those same Councilmembers, are all but ignored.
Councilmember Wong said press scrutiny is part of public
life.
Councilmember Touhey agreed with Mr. Wong's statement,
but noted that the Tribune and the Independent present
balanced articles.

to continue the closed session that had commenced prior to
the regular meeting. The City Council concluded their
closed session at 10:30 pm.
