12-19-1995 - Regular Meeting - MinutesREGULAR MEETING OF THE WEST COVINA CITY COUNCIL December 19, 1995 • The regular meeting of the West Covina City Council was called to order by Mayor Pro Tem Touhey at 7:33 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Rev. Don Bommarito and the Pledge of Allegiance was led by Councilmember Manners. ROLL CALL, Mayor Pro Tem Touhey, Councilmembers Manners and McFadden. Mayor Herfert arrived at 8:05 pm. Absent: Councilmember Wong (excused) Others Present: Starbird, Wylie, Glover, Clark, Samaniego, Yoshizaki, Greene, Collier, Patton, Koniarsky, Gould, Tucker, Panas, Delgadillo, Salazar, Distelrath, Fong, Palkhiwala, Berry APPROVAL OF MINUTES Motion by Manners and seconded by McFadden to approve the minutes of the special meeting of December 12, 1995, and the minutes of the regular meeting of December 12, 1995. Motion carried 3-0. PRESENTATION Oscar Abarca,. Director of Intergovernmental Affairs for the South Coast Air Quality Management District, presented the purpose of the SCAQMD and noted he was available to the Council, the Chamber of Commerce, and any other interested groups or individuals who require their services or have questions. RECESS FOR REDEVELOPMENT AGENCY Mayor Pro Tem Touhey recessed the City Council meeting at 7:37 pm to conduct the RDA public hearing. The City Council reconvened at 7:50 pm with Herfert and Wong absent. PRESENTATIONS City Manager Starbird presented three awards received by the City for outstanding budget and financial reporting documents. The three awards were: G.F.O.A. Budget Award, C.S.M.F.O. Budget Award, and the G.F.O.A. CAFR Award. The employees receiving the awards were: Marie Delgadillo, Basil Panas, David Gould, Margie Tucker; and Abe Koniarsky. • HEARING No hearings scheduled forrthe City Council. H AGENDA AND ORAL COMMUNICATIONS • Rudy Munoz, representative of Mt. Calvary - Faith Lutheran Church, addressed Item C-5b (Request for Surety Reduction - CUP #357). He requested that the surety reduction.be reduced to $10,000 rather than the $20,000 as listed on the Agenda. • City Council Minutes of 12/19/95 2 City Engineer Glover responded that staff had looked into the $10,000 reduction request earlier in the day and found it to be accep- table and supported Mr. Munoz's request. Brownlee filed a claim for property damage amounting to $2,660. On October 25, 1995 Philip Ung filed a claim against Oak To Go and the City for property damage amounting to $1,501.91. On September 8, 1995 Nora G. Lopez filed a claim for property damage amounting to $173.60. Temporary Use Permits (receive & file) TUP #2288-95 was issued to Mike Steele for a Christmas Tree lot at 744 S. Glendora on 12/1 through 12/30. TUP #2289-95 was issued to Mike Steele for a Christmas Tree lot at 220 S. Vincent on 12/1 through 12/30. TUP #2294-95 was issued to Bill and Tami Boggan for a Christmas Tree lot at 143 N. Barranca on 12/1 through 12/20. TUP.#2295-95 was issued to West Covina Toyota, 821 S. Glendora for a tent sale on 11/10. Acceptance of Improvements/Release of Bonds Merced Avenue Recommendation is to accept improvements and release American Motorists Insurance Company Surety Bond No. 3SM-806-469-000 in the amount of $30,400 to Dan-Kel Development. Church Recommendation is to grant the surety reduction for the church improvements at 2110 W. Francisquito Avenue from the amount of $50,000 to $10,000 (as stated by the City Engineer during Agenda Communications). Precise Plan No. 850 - On and Off -Site Improvements - Rich Development Recommendation is to accept on and off - site improvements and authorize release of a cash deposit in the amount of $38,500. City Council Minutes of 12/19/95 Precise Plan No. 848 On and Off -Site Improvements - Faith Community Church Recommendation is to accept improvements and authorize release of Indemnity Company of California Bond No. 1849475 in the amount of $103,000. City Treasurer's Report (receive & file) Report for the month of November, 1995. Award of Bids PP 95218 - Softball Lighting at Cameron Park PP 95218 - Recommendation is to accept the lowest Electro Construction responsible bid for the installation of sports lighting for the softball field at Cameron Park by taking the following actions: a) appropriate $14,300 from unappropriated Park Dedication District D funds to PP 95218; b) accept the bid of Electro Construction in the amount of $81,182 as submitted at the bid opening and authorize the Mayor and City Clerk to execute the contract. WP 96110 - Installation of Pressure Reducing Valves WP 96110 - Recommendation is to accept the lowest T.A. Rivard, Inc. responsible bid for the installation of pres- sure reducing valves at four locations in the City's water system by taking the following actions: a) appropriate $50,000 from the City's Water Fund Reserve to WP 96110; b) accept the bid of T.A. Rivard, Inc., Riverside, in the amount of $44,800 as submitted at the bid opening and authorize the Mayor and City Clerk to execute the contract. Purchase of Three New Patrol Fleet Vehicles Ed Butts Ford The Police Department requests approval for the purchase of three Ford Crown Victoria Police vehicles to be purchased with savings in its current budget. Recommendation is to take the following actions: a) find that State Bid No. 196231401 satis- fies the formal bid process per WCMC § 2-333 and justifies waiver of the formal bid process (WCMC § 2-330); b) authorize staff to purchase. three Ford Crown Victoria Police Interceptor vehicles from Ed Butts Ford for $59,470.95 (plus tax and transfer fees). . • Purchase of Two New Police Motorcycles Pomona Kawasaki The Police Department requests approval for the purchase of two Kawasaki Police motor- cycles to be purchased with savings in its current budget. Recommendation is to take the following actions: a) find that Ontario, Pomona and Chino bids for 1996 Police motorcycles satisfy the formal bid process per WCMC § 2-333 and justify waiver of the formal bid process (WCMC § 2- 330) ; City Council Minutes of 12/19/95 4 b) authorize staff to purchase two Kawasaki KZ-1000 Police motorcycles from Pomona Kawasaki for $7,550.00 (plus tax and transfer fees). • Miscellaneous'- Public Works uiscricc No. i - Approyai or rians h Jpecs. The cost is estimated at $80,000. Recom- mendation is to approve plans and specifica- tions for PP 94205 and authorize the City Engineer to call for bids. PP 96201 - Remodel Snack Bar and Restrooms at Del Norte Park - Approval of Plans & Specs. PP 96201 - This project consists of remodeling and up - Plans & Specs. grading the existing restrooms and snack bar facilities at Del Norte Park. The cost is estimated at $17,200. Recommendation is to approve plans and specifications for PP 96201 and authorize the City Engineer to call for bids. Miscellaneous - Finance Department Comprehensive Annual Financial Report (CAFR) Recommendation is to receive and file the City's CAFR for FY 94/95, which has been audited by Moreland & Associates. Los Anaeles Countv - West Covina Civic Center Authoritv Financial Report - Fiscal Year End June 30, 1995 Recommendation is to receive and file the Authority's Annual Financial Report for the year ending June 30, 1995 (audited by Moreland & Associates).' Investment Policy for.1996 Recommendation is to receive and file the investment policy for 1996. Miscellaneous - Human services Agreement for Use of Gvmnasiums at West Covina High School and Edgewood Middle School Agreement with Recommendation is to approve the Gymnasium Use W.C.U.S.D. Agreement with the West Covina Unified School District, governing the use of the gyms during non -school use, and authorize the Mayor and City Clerk to execute the agreement pending • West Covina School District approval. • Homeless Population Needs Assessment Lutheran Social Services Recommendation is to approve the proposal sub- mitted by Lutheran Social Services of Baldwin Park in an amount not to exceed $3,000 for the Homeless Population Needs Assessment and authorize the Mayor and City Clerk to execute the contract. City Council Minutes of 12/19/95 5 Human Services Budget and Organization Rec. Supervisor Recommendation is to authorize the continu- ation of the second Recreation Supervisor position for three months, with funding of $13,000 from one-time savings in the General. • Fund FY 94/95 year-end balance. COMMUNITY DEVELOPMENT REDEVELOPMENT AGENCY Mayor Pro Tem Touhey recessed the City Council meeting at 7:59 pm to finish the Redevelopment Agency agenda. The City Council reconvened at 8:00 pm with Herfert and Wong absent. PARKING AUTHORITY Mayor Pro Tem Touhey recessed the City Council meeting at 8:00 pm to convene the Parking Authority meeting. The City Council recon- vened at 8:02 pm with Herfert and Wong absent: HUMAN SERVICES AMERICAN LITTLE LEAGUE BALLFIELD IMPROVEMENTS AT CORTEZ PARK City Manager Starbird elaborated on the staff report. Cortez Park ballfield Motion by Manners and seconded by McFadden to approve an allocation of $25,000 from the Capital Projects Fund for the expan- sion of the American Little league's minor .division ballfield project at Cortez Park and waive the formal bidding process. Motion' carried 3-0. PUBLIC SAFETY No reports scheduled for this meeting. ADMINISTRATIVE SERVICES - FINANCE DEPARTMENT FINAL FISCAL YEAR 1995/96 BUDGET FY 95/96 Budget City Manager Starbird elaborated on the staff . report, referring to the budget document. Mayor Herfert arrived at 8:05 pm and chaired the remainder of the • meeting. Motion by Manners and seconded by McFadden to approve the Final FY 95/96 Budget. Council - member McFadden commended the City Manager and staff for incorporating Council's directives into the budget. Mayor Herfert felt that the FY 95/96 budget was one of the biggest suc- cesses of the year for the City. Council con- curred. Motion to approve the budget carried 4-0. City Council Minutes of 12/19/95 GENERAL ADMINISTRATION - CITY ATTORNEY City Attorney stated there were no reports. APPROVAL OF DEMANDS Motion by Herfert and seconded by Touhey to approve Demands totaling $988,257.12 as listed on check registers FI 159458 through 159764. Motion carried by roll call vote: AYES: Manners, McFadden, Touhey, Herfert NOES: None ABSENT: Wong ABSTAIN: Herfert re SCE ORAL COMMUNICATIONS Royal Brown, 2153 Aroma Drive, inquired as to what took place during the closed session held at 5:30 pm regarding BKK. City Attorney Dixon responded that there was nothing to report out after the meeting and the court date is still set for January 16, 1996. MAYOR'S REPORTS Motion by Manners and seconded by Touhey to declare the seat vacant on the Human Services Commission that had been filled by Michael Cano and commence the selection process to fill the vacancy. Motion carried 4-0. COUNCILMEMBERS' REPORTS 1) LIVE ENTERTAINMENT, BILLIARD TABLE, VIDEO GAME REGULATIONS (Councilmember McFadden) Live Entertainment, etc. Councilmember McFadden addressed this report as he has proposed revisions to the applicable parts of the zoning code. Motion by McFadden and seconded by Herfert to refer this to the Planning staff for development of.the appropriate zoning code amendment and to have the Planning Commission review the ordinance and provide a recommendation for Council action. Councilmember Manners stated she could not support this as she has heard no burning desires from the business community to change the current regula- tions. She could not approve staff spending time on this now with so much other work facing the City. The above motion carried 3-1 with Manners voting no. Mayor Pro Tem Touhey wished Happy Holi- days to Council, staff, and the citizens of West Covina. .Councilmember Manners concurred and sug- gested those people facing problems and troubles be remembered during the holi- days. Councilmember McFadden apologized for missing the' Craig Meacham memorial dedication. Mayor Herfert reported on the recent "Sounds of Christmas" recital held at Faith Community Church to which over 1000 people attended.
