REGULAR MEETING OF THE
WEST COVINA CITY COUNCIL
November 7, 1995
• The regular meeting of the West Covina City Council was called to order
by Mayor Herfert at 7:37 pm in the City Hall Council Chambers, 1444 W.
Garvey Avenue, West Covina. The Invocation was given by City Manager
Starbird and the Pledge of Allegiance was led by Mayor Herfert.
ROLL CALL Mayor Herfert, Mayor Pro Tem Touhey, Council -
members Manners, McFadden, Wong (arrived at
7:58 pm).
Others Present: Starbird, Wylie, Dixon, Glover, Miller, Ure,
Dunlap, Distelrath, Collier, Bommarito, Jones,

APPROVAL OF MINUTES Motion by Manners and seconded by Touhey to
approve the minutes of the regular meeting of
October 3, 1995, the regular meeting of
October 17, 1995, and the special meeting of
October 30, 1995. Motion carried 4-0.
IONS Mayor Herfert and Redevelopment Agency Manager
Yoshizaki presented Certificates of Partici-
pation to the families that participated in
the Redevelopment Agency's First Time Home
Buyer Program which began in September, 1994.
A total of nineteen families were recognized
and two were present to receive Certificates:
* Alfonso and Teresa Espinoza
* Syed and Ragia Uddin
Mayor Herfert presented Certificates of
Appreciation to two outgoing Commissioners from
the Personnel Commission:
* Dorothy Shepherd
* Robert Roudebush
PROCLAMATION Mayor Herfert proclaimed November 16, 1995, as
Great American Smokeout & SmokeScream Day and
presented the proclamation to Cy Lichtman.
Banner Program Redevelopment Agency Manager Yoshizaki intro-
duced the new Banner Program for the City of
West Covina. Two banners were hung in the
Council Chambers for display, while the others
have already been hung in the Central Busines
District. He showed pictures of other pro-
posed banners for various holidays, noting
that the Azusa Avenue/Amar Road area was
targeted for City banners as well.
• HEARINGS GENERAL PLAN AMENDMENT NO. II-95-24, ZONE
CHANGE NO. 645, AND NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT (Continued from October 3
with hearing closed)
Old Aroma Ballfield Site
Planning Director Collier presented a brief
overview of the parcel in question and the
three alternatives presented to Council.

Council discussion Motion by Herfert and seconded by Touhey to
approve the second alternative (in essence:
retain property as open space for possible
future development as a park and discuss the
funding of such a park within the CIP process
during the next fiscal year budget).
• Councilmember Manners stated that she
supported not proceeding with the rezoning,
but could not support the second part of the
motion as it implied a foregone conclusion
that the property was destined to be developed
as a park.
Councilmember Wong arrived at 7:58 pm.
City Manager Starbird clarified that if the
Council's intent is to approve the second
alternative, the proper motion should be to
deny the application for the rezone and uphold
the Planning Commission's recommendation to
not proceed with the rezoning. The issue of
whether or not to develop the property as a
park would be considered by the Human Services
Commission during their annual review of com-
munity needs in context of the entire City.
As clarified by the City Manager, Coun-
cilmember Manners was satisfied that the
motion would not automatically earmark the
property for park development and she could
support that.
Action on motion The motion, as restated above by the City
Manager, was approved 4-0-1 (with Wong ab-
staining, having missed part of the discus-
sion).
Second motion Motion by Herfert and seconded by Wong to
refer the vacant property issue to the Human
Services Commission to be included in their
annual City needs and assessment review.
Motion carried 5-0.
Mayor Herfert called the Redevelopment Agency
to order at 8:07 pm to conduct the following
two joint public hearings.
HEARING JOINT PUBLIC HEARING ON THE PROPOSED DISPOSI-
TION AND DEVELOPMENT AGREEMENT BETWEEN THE
WEST COVINA REDEVELOPMENT AGENCY AND EDWARDS
THEATRES CIRCUIT, INC.
Matter Held Over Motion by Herfert and seconded by Touhey to
accept the recommendation that the public
hearing on the Edwards Entertainment Center
project be further continued to a date yet to
be determined. Motion carried 4-0-1 (with
Wong abstaining, due to conflict of interest
laws).
• HEARING JOINT PUBLIC HEARING ON THE PROPOSED AMENDED
AND RESTATED DISPOSITION, DEVELOPMENT AND
OWNER PARTICIPATION AGREEMENT (ARDDOPA) BY AND
AMONG THE REDEVELOPMENT AGENCY AND HASSEN IM-
PORTS PARTNERSHIP AND WEST COVINA MOTORS, INC.
Item Removed City Manager Starbird recommended that the
City.Council pull this item off the agenda to
be reagendized at a later date.

Motion by Wong and seconded by Touhey to
pull this matter off the Agenda and reagendize
for a later date. Motion carried 5-0.
Mayor Herfert recessed the Redevelopment
• Agency at 8:12 pm to continue the City Council
Agenda.
Mayor Herfert requested Council's concurrence
in bringing forward Item J-1 to be considered
by Council at this time. Council agreed.
ADMINISTRATIVE SERVICES PERSONNEL SERVICES DEPARTMENT
1) TRANSMISSION OF RESOLUTION CHANGING SICK
LEAVE INCENTIVE AND VACATION PAY BACK
PROGRAMS (Non -sworn Management Employees)
Sick Leave/Vacation City Manager Starbird elaborated on the
staff report, noting a change in the text
of the resolution since the staff report
was prepared: The enforceability of the
immediate termination of the two programs
was questionable and the City Attorney
has suggested that Council reconsider
that action and postpone termination
until the end of this year's programs.
Mayor Herfert concurred with the
City Manager's recommendation, noting
employees have been promised this all
year long and it wouldn't be fair to take
it away at this stage in the program.
Mayor Pro Tem Touhey and Councilmember
McFadden echoed the Mayor's sentiments.
Councilmember Wong stated that he
would not support the recommendation
because he is opposed to eliminating the
programs, regardless of the termination
dates. Councilmember Manners concurred
with Mr. Wong.

Mayor Herfert asked for comments from the
audience, as this matter has been pulled
forward of the Agenda and Oral Communica-
tions portion of the Agenda. No one
addressed Council.
Upon request by Councilmember Wong, the
City Manager read the amendments to the
resolution which reflected an effective
date of on or about December 1, 1995, as
the end of the program year for the sick
leave incentive program, and January 1,
1996, for the vacation pay back program.

Motion by Touhey and seconded by
Herfert to waive further reading of the
resolution and adopt, as amended. Motion
carried 3-2 (with Wong and Manners voting

AGENDA AND ORAL COMMUNICATIONS
Thomas Morrison Thomas Morrison, 3402 Jodee Drive, spoke in
opposition to the recommendation to close the
north wing of the Senior Citizens' Center on
Saturdays (Item H-2).
• Orelia Delgado Orelia Delgado, 15648 Fairgrove Avenue, La
Puente, concurred with the statements made by
Mr. Morrison in leaving the Senior Citizen's
Center open on Saturdays.
Emma Fischbeck Emma Fischbeck, 1137 Auburn Drive, agreed with
the previous two speakers, adding it would be
unreasonable to close the ,center.
Royal Brown Royal Brown, 2153 Aroma Drive, was shocked at
the recommendation to close the north wing on
Saturday afternoons.
Iris Delameter Iris Delameter, 1212 W. Eckerman Avenue, liked
the banners and suggested that whenever the
banners fly in the Azusa/Aroma area they be
the same as those displayed elsewhere in the
community. She also agreed that the north
wing of the Seniors' Center not be closed on
Saturday afternoons.
Ya Sen Gadore Ya Sen Gadore, Aroma Drive, asked for a clari-
fication of streets that had been approved for
Aroma Drive but have not yet been installed.
Mayor Herfert stated that City Engineer
Glover will check into the situation.
Royal Brown Royal Brown, 2153 Aroma Drive, explained his
theory for Edison's failure to erect the
streetlights on Aroma Drive.
Katy McComb Katy McComb reported that her problem with
E.T. Snell has been resolved through a court
proceeding at Citrus Municipal Court. She
asked Councilmember McFadden why he wrote a
letter seeking leniency on behalf of Mr.
Snell.
Councilmember McFadden denied writing a
letter of leniency, and indicated that the
person was not adequately represented. He
asked the court that any disposition of this
case be reasonable.
Elsa Popp Elsa Popp, Rowland Heights, commented on
police procedures regarding her twenty-five
year old missing son.and commended several of
the West Covina Police officers.

bid opening and authorize the Mayor and City
Clerk to execute the contract.
Project GP 95305 — Installation of Diesel Fume

GP 95305 - Recommendation is to accept the bid of Air
Air Cleaning Systems Cleaning Systems, Pomona, in the amount of
$32,413.24 and. authorize the Mayor and City

Heritage Gardens Park - Phase 1 - Consideration
of Project Design and Budget
Heritage Gardens - Recommendation is to take the following
Hondo Company actions: a) transfer $87,342.39 from Galster
Park Trail PP 95225 to PP 95214; and b) accept
the bid of Hondo Company, Inc., Santa Ana, in
the amount of $240,862 and authorize the Mayor
and City Clerk to execute the contract.

Radio Purchase for Unmarked Police Vehicles
Motorola Recommendation is to a) find that the use
of the County of Los Angeles's existing con-
tract with Motorola eliminates the need for a
formal bid process; and b) authorize staff to
purchase 24 UHF Motorola Spectra mobile radios
from Motorola at a total cost of $46, 714.00
including tax.

Information on Revenue Loss Due to State
Legislation
Recommendation is to receive and file the
staff report reporting on .recent legislation
prohibiting a fire department from imposing
any fee for service related to structural pest
control activities. As a result the WC Fire
Department will not collect an estimated
$29,000 annually.
MISCELLANEOUS - HUMAN SERVICES
Participation of the Muscular Dystrophy Asso-
ciation in the 1996 Fourth of July Event
Recommendation is to approve the partici-
pation of the Muscular Dystrophy Association
in the 1996 July 4th Event, using Cameron Park
as the site of its annual chili cookoff. .
Motion by Herfert and seconded by Manners to
waive further reading of the ordinance and
introduce, and to approve all other items

REDEVELOPMENT AGENCY Mayor Herfert recessed the City Council meeting
at 9:11 pm to reconvene the Redevelopment
Agency. The City Council reconvened at 9:16
pm with all members present.
HUMAN SERVICES 1) MEALS PROGRAM DONATION
Human Services Director Salazar presented
the staff report, responding to Council
questions and comments.
Mayor Herfert was reluctant to vote
on this issue as he hadn't conferred with
any members of the Senior Citizens' Com-
mission. Councilmember Wong noted that
the current amount of $1.50 is strictly
voluntary as is .the proposed amount of
$1.75; therefore, those individuals who
are purchasing their meal for a lesser
amount can still participate.
Meals Program Donation Motion by Manners and seconded by
Wong to approve an increase in the Meals
Program's suggested donation from $1.50
to. $1.75, effective November 13, 1995.
Motion carried 3-2 with Touhey and
Herfert voting no.
2) CLOSURE OF SENIOR CITIZENS' CENTER'S NORTH
WING ON SATURDAY AFTERNOONS
Human Services Director Salazar presented
the staff report, responding to Council
questions and comments. Council acknow-
ledged the parking problem and supported
staff's efforts in relocating as much as
possible the various groups utilizing the
center to help all that problem.
However, Council was strongly opposed to
the closure of the north wing as a solu-
tion to the parking problem. Staff was
encouraged to continue with seeking

alternatives to the parking situation.
Senior Citizens' Center Motion by Wong and seconded by
Touhey to receive and file the report.

MAYOR'S REPORTS No comments offered.
COUNCILMEMBERS' REPORTS Councilmember McFadden remarked that he still
has a cable show on WCCT. This Thursday he
will have guests discussing domestic violence
issues.
Councilmember Manners suggested that tonight's
Council meeting be adjourned in memory ,of
Isreal's Prime Minister Yitzhak Rabin, who was
recently assassinated while in the active
process of pursuing peace for his country.
Councilmember Wong echoed Ms.. Manners'
sentiment.
Mayor Herfert referred to a recent article in
the San Gabriel Valley Tribune regarding a
recent threat to some of the Councilmembers of
West Covina. Councilmember McFadden added his
comments to the situation as well.
ADJOURNMENT Motion by Manners and seconded by McFadden to
adjourn the meeting at 9:37 pm in memory of
Yitzhak Rabin. Motion carried 5-0.
