ADJOURNED SPECIAL MEETING OF THE
WEST COVINA CITY COUNCIL
September 28, 1995
The adjourned special meeting of the West Covina City Council was called to order at 5:05
p.m. by Mayor Herfert in the City Manager's Conference Room, City Hall, 1444 W. Garvey
Avenue, West Covina.

Absent: McFadden
Others Present Starbird, Wylie, Dixon
PUBLIC COMMENTS ON ITEMS ON THE AGENDA
Dave Barford indicated that Charter and Gaylord had agreed to the City's position
regarding the curing of past breaches of the cable franchise, as well as the "going
forward" provisions. He expressed thanks to the City Council and looks forward to a
good relationship in the future.
CABLE TELEVISION FRANCHISE TRANSFER
Assistant City Manager Wylie provided an overview of the settlement agreement and
findings necessary to approve the franchise transfer and presented the following
resolution:
RESOLUTION NO. 9259 - A RESOLUTION OF THE CITYCOUNCIL OF
THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE TRANSFER
OF A CABLE TELEVISION FRANCHISE FROM CENCOM CABLE TELEVISION,
INC. TO CHARTER COMMUNICATIONS ENTERTAINMENT 11, L.P.
Motion by Herfert and seconded by Touhey to waive further reading of the
resolution and adopt. Motion carried 4-0.
Mr. Wylie presented the following agreement:
Agreement Relating to the Consent of the City of West Covina, California, to
the Transfer of the Franchise Agreement Granted to Cencorn Cable Television,
Inc. to Charter Communications Entertainment 11, L.P. and Settlement of Certain
Disputes
Motion by Manners and seconded by Herfert to approve the agreement. Motion
carried 4-0.
CLOSED SESSION
Mayor Herfert recessed the City Council meeting to conduct a closed session for the
following purposes:
CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION
Pursuant to Government Code Section 54956.9(a)
City of West Covina -vs- BKK Corporation
REPORT ON CLOSED SESSION No report necessary.
ADJOURNMENT Motion by Herfert and seconded by Touhey to adjourn the meeting at
6:15 p.m. Motion carried 4-0.
