The regular meeting of the West Covina City Council was called to order by Mayor Herfert at 7:42 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by City Manager Jim Starbird and the Pledge of Allegiance was led by Councilmember McFadden. ROLL CALL Mayor Herfert, Mayor Pro Tem Touhey, Council - members McFadden, Wong Absent: Councilmember Manners Others Present: Starbird, Miller, Salazar, Dixon, Irwin, Orr, Distelrath, Samaniego, Collier,, Glover, Keating, Panas, Greene, Patton, Cleary, Palkawaki, Berry APPROVAL OF MINUTES Motion by Wong and seconded by Touhey to approve the minutes of the special meeting of .May 2, 1995 and the special meeting of May 3, 1995. Councilmember Wong requested the minutes of the regular meeting of May 2, 1995, be held over until the next meeting for the City Clerk to check the motions relating to the Consolidated Plan for Housing and Community Development pub- lic hearing. Mayor Herfert recognized the West Covina High School students from Mr. Cimeno's government class attending the. Council meeting. PROCLAMATIONS Mayor Herfert proclaimed May 14-20 as EMERGENCY MEDICAL SERVICES WEEK and presented the procla- mation to Fire Chief Greene and the Rescue 71 Team. Mayor Herfert proclaimed the week of June 4-11 as MANAGEMENT WEEK and presented the proclama- tion to Lew Coleman, the representative from National Management Association. PRESENTATIONS The West Covina High School Drill Team was introduced by Coach Cathy Julien. The drill team was recognized for winning the following honors: * Large Military Group - USA National Champs * Small Military Group - USA National Champs * Miss Drill Team USA • HEARING PALMVIEW PARK FIELD LIGHT PROJECT PALMVIEW PARK MASTER PLAN AMENDMENT NO. 1 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT This matter was considered at the May 2 Council meeting at which time the public testimony por- tion of the hearing was closed. Staff has pre- pared amended resolutions of approval for this project as directed by the Council on May 2. • • Minutes of 5/16/95 2 City Clerk Berry presented: Resolution 9218 - RESOLUTION NO. 9218 - A RESOLUTION OF THE certifying Neg. CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR PALMVIEW PARK MASTER PLAN AMENDMENT NO. 1, PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT OF 1970, AS AMENDED Motion by Herfert and seconded by Touhey to waive further reading of the resolution and adopt. Motion carried 3-1 with Wong voting no. City Clerk Berry presented: Resolution 9219 - RESOLUTION NO. 9219 - A RESOLUTION OF THE approving Amend #1 CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, APPROVING PALMVIEW PARK MASTER PLAN AMENDMENT NO. 1 Motion by Touhey and seconded by McFadden to waive further reading of the resolution and adopt. Motion carried 3-1 with Wong voting no. HEARING WEST COVINA CITYWIDE LIGHTING AND MAINTENANCE DISTRICT NO. 1995/96 95/96 Citywide City Clerk Berry verified the affidavit of pub- lication. Mayor Herfert opened the hearing and the staff report was presented by city Engineer Glover. Public Testimony Mayor Herfert opened the public testimony por- tion of the hearing. City Clerk Berry stated that no written objections or protests had been received. Mayor Herfert asked for verbal com- ments and the following individual addressed Council: Lee Garcia Lee Garcia, 1225 Rexwood Street, complained about the street light in front of his house. Mayor Herfert stated that staff would notify Edison in the morning. There being no others interested in addressing Council, Mayor Herfert closed the Testimony closed testimony portion of the hearing. Council Comments Councilmember Wong suggested that the $100,000 that had been earmarked for the bandshell pro- ject, which was recently voted down, be returned to the citywide district. Those funds could reduce this year's overall assessment by 3% Councilmember McFadden reminded staff to impose the same high standards to citywide district contractors as those imposed on City employees (in relation to maintenance contracts). Mayor Herfert responded to Councilmember Wong's suggestion regarding the bandshell funds. It was his feeling that although the bandshell was not favorably received for installation at Cor- tez Park, it could be placed elsewhere in the City. Once those funds are no longer earmarked for a bandshell project, allocating additional funds could be difficult. Mayor Pro Tem Touhey supported the concept of reducing the district's assessments as .he was always in favoring of reducing taxes. Motion Motion by Wong and seconded by Touhey to reduce the assessment by 3% and credit the $100,000 into the district reserves. Minutes of 5/16/95 Councilmember McFadden noted that the 3% re- duction would be a one-time reduction and next year the assessment will be higher. City Manager Starbird confirmed this, adding that it is difficult on residents when the tax goes down one year and then goes up the following year just to bring it back to its normal level. Action Mayor Herfert asked for a vote on the motion made earlier by Councilmember Wong. Motion failed 2-2 with McFadden and Herfert voting no. City Clerk Berry presented: Resolution heading A RESOLUTION OF THE CITY COUNCIL OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CONFIRMING THE REPORT OF THE CITY ENGINEER DATED APRIL 10, 1995 PREPARED PURSUANT TO RESOLUTION NO. 9177, DATED FEBRUARY 7, 1995 AND PRELIMINARILY APPROVED PURSUANT TO RESOLUTION NO. 9194 OF SAID COUNCIL, AND THE PLANS, SPECIFICATIONS, ESTIMATE, DIAGRAM AND ASSESSMENT CONTAINED IN SAID REPORT; ORDERING CERTAIN LIGHTING FIXTURES AND ELECTRICAL CURRENT TO BE FURNISHED FOR LIGHTING FIXTURES AND TO ORDER CERTAIN LANDSCAPING TO BE INSTALLED AND MAINTAINED AND TO ORDER CERTAIN PARKS TO BE IMPROVED AND MAINTAINED FOR FISCAL YEAR BEGINNING JULY 1, 1995 (West Covina Citywide Lighting and Maintenance District No. 95/96) Motion by Herfert and seconded by McFadden to waive further reading of the resolution and adopt. Motion failed 2-2 with Touhey and Wong voting no. Motion by Herfert and seconded by McFadden to reagendize this matter for the next Council meeting and open the public testimony portion for additional public comment. Motion carried 4-0. HEARING CITYWIDE SEWER STANDBY AND AVAILABILITY CHARGES FOR 1995/96 AND METHOD OF COLLECTION Citywide Sewer Standby , City Clerk Berry verified the affidavit of pub- & Availability Charges lication. Mayor Herfert opened the hearing and the staff report was presented by City Engineer Glover. Mr. Glover stated that the proposed rate of $21.95 per unit for FY 95/96 was unchanged from the current year's rate. Public Testimony City Clerk Berry stated that no written protests or objections had been received. Mayor Herfert None asked for verbal protests or objections. No comments were offered. The City Clerk presented: Resolution 9220 - Citywide Sewer, etc. RESOLUTION NO. 9220 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, AUTHORIZING THE COLLECTION OF THE ANNUAL SEWER STANDBY AND AVAILABILITY CHARGES THROUGH THE COUNTY GENERAL TAX BILL (Citywide Sewer Standby & Availability Charges for FY 95/96) Motion by Herfert and seconded by Touhey to waive further reading of the resolution and adopt. Motion carried 4-0. • Minutes of 5/16/95 Recess Mayor Herfert called a recess at 8:42 pm to convene the Redevelopment Agency for an RDA public hearing. The City Council reconvened at 8:45 pm with Manners absent. AGENDA AND ORAL COMMUNICATIONS Iris Delameter Iris Delameter, 1212 W. Eckerman, addressed Redevelopment Agency Item II (Tenant Signage Assistance Program for the Capri Center). She favored the City helping the tenants with bus- iness signs, particularly those who have been there a long time. Paul Olvera Paul Olvera, 2228 Rockway Drive, encouraged Council to move forward with the Palmview Park project. The amount of claim had not been determined at time of presentation. On March 16, 1995 the City Clerk's Office received a claim for property damage amounting to $117.26 from Robert James Cunningham, Jr. On February 15, 1995 the City Clerk's Office received a claim for personal injuries amounting to $550,000.00 from Gregory Walter Gruszeczka. Miscellaneous - Human Services Citizen Participation Plan Amendment No. 1 Citizen Participation Recommendation is to approve the proposed Amend - Plan ment No. 1 to the West Covina Citizens Partici- pation Plan to bring it into conformance with the recently approved Consolidated Plan and new requirements. Miscellaneous - LEA Resolution Authorizing Enforcement Assistance Grant Application (adopt resolution) The CIWMB has an Enforcement Assistance Grant Fund Allocation for Local Enforcement Agencies. The fund allocation for the City of West Covina will be approximately $16,415. Resolution 9221 - RESOLUTION NO. 9221 - A RESOLUTION OF THE LEA grant CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, AUTHORIZING THE SUBMITTAL OF AN APPLI- CATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD FOR AN ENFORCEMENT ASSISTANCE GRANT CONSENT CALENDAR MOTION Motion by Touhey and seconded by McFadden to waive further reading of the resolution and ordinance and to adopt, and to approve all other items listed on the Consent Calendar, except Item C-8 (Award of Bid). Motion by Herfert and seconded by Touhey to direct staff to use restricted funds as much as possible for the project. Motion carried 4-0. REDEVELOPMENT AGENCY Mayor Herfert recessed the City Council meeting at 9:00 pm to reconvene the Redevelopment Agency. The City Council reconvened at 9:14 pm with Manners absent. HUMAN SERVICES No reports for this meeting. PUBLIC SAFETY No reports for this meeting. ADMINISTRATIVE SERVICES No reports for this meeting. GENERAL ADMINISTRATION CITY MANAGER Approval of the FY 95/96 Budaet Calendar Council reviewed the staff report. Council - member Wong stated that he would not be able to attend the May 22 public meeting, but could review the video tape of the meeting. Motion by Touhey and seconded by McFadden to approve the scheduled, as submitted. Motion carried 4-0. APPROVAL OF DEMANDS Motion by Herfert and seconded by Touhey to approve demands totaling $1,017,099.67 as listed on check registers FI 155232 through 155537. Motion carried by roll call vote: AYES: McFadden, Touhey, Wong, Herfert NOES: None ABSENT: Manners ABSTAIN: Herfert re SCE ORAL COMMUNICATIONS Robert Parry, 3200 Oak Knoll Drive, noted that West Covina does not have a facility large enough for a major dinner or event such as the Prayer/Breakfast he recently attended that was held at Industry Hills. He also suggested that a vending machine would be nice for citizens attending Council meetings. • Minutes of 5/16/95 MAYOR'S REPORT Resolution 9222 - Long Beach Shipyard 7 Resolution of Support Council reviewed the staff report. City Clerk presented: RESOLUTION NO. 9222 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, SUPPORTING THE CONTINUED OPERATIONS OF THE LONG BEACH NAVAL SHIPYARD AND OTHER SOUTHERN CALIFORNIA MILITARY FACILITIES Motion by Touhey and seconded by McFadden to waive further reading of the resolution and adopt. Motion carried 4-0. COUNCILMEMBERS' REPORTS Councilmember Wong requested that a resolution Wong of commendation for Bob Ebiner be placed on the next Agenda, commending him for his outstanding dedication to the Boy Scouts of America. McFadden Councilmember McFadden requested that the ordinance regulating pool tables, Karokee, etc. be placed on the agenda for the second meeting in June. Mayor Herfert suggested that Council - member McFadden offer his suggestions to the Planning Department so that the matter will be considered first by the Planning Commission. He also reported that the subcommittee working with the WC School District was open to the idea of lighting the high school field for little league use. He noted that during the budgetary process, he is planning on discussing the allocation of funds for a motivational speaker. Touhey Mayor Pro Tem Touhey reported on several events he has recently attended: a) Prayer/Breakfast, b) Fire Safety Day at the Fire Station, c) an installation at the VFW Hall. Herfert Mayor Herfert reported that he will continue the Mayor's Show on Channel 56, noting that the second show will be taped next week. He also requested an update on the July 4th Fireworks Show.
