02-21-1995 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING of THE WEST COVINA CITY COUNCIL February 21, 1995 The regular meeting of the West Covina City Council was called to order by Mayor McFadden at 7:50 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Pastor Tommie Farris of Faith Community Church and the Pledge of Allegiance was led by Mayor McFadden. ROLL CALL Mayor McFadden, Mayor Pro Tem Herfert, Council - members Manners (left at 12:51 am), Touhey, Wong Others Present: Wylie, McIsaac, Miller, Bonaparte, Pullin, Orr, Keating, Greene, Jarrin, Glover, Dixon „ Cleary, Irwin, .Clark, Yoshizaki, Distelrath, Salazar, Patton, Ure, Berry APPROVAL OF MINUTES Councilmember Manners noted that a couple of roll calls in the January 3, 1995 minutes indi- cated that she voted aye, when in fact she was absent from that particular meeting. Motion by Manners and seconded by Herfert to approve the following sets of minutes: Regular meeting corrected Special meeting Special meeting Regular meeting Motion carried 5-0. of January above of February of February of February 3, 1995 as 6, 1995 7, 1995 7, 1995 PRESENTATION Maria Lengerke of Kaiser Permanente presented the City with a grant of $2,900 for after -school staff training. HEARING CONTINUED PUBLIC HEARING - AMENDMENT NO. 262 RESIDENTIAL LIGHT AND GLARE ORDINANCE Mayor McFadden stated that this was a continued hearing on a City -initiated amendment relating to light and glare on single-family residential properties. The staff report was presented by Principal Planner McIsaac and included a demonstration of footcandle measurements and glare. He noted that the goal was to create standards that would not affect most residents, but would allow some leverage for the City in addressing problems ex- perienced in the community. Councilmember Wong expressed concern over subjectivity and involving the City in neighbor- hood disputes. Mr. McIsaac stated that the City would respond on a complaint basis and the • ordinance gives the City many options in helping residents with light and glare problems. Public Testimony Mayor McFadden opened the hearing for public testimony and asked for comments from the audience. The following addressed Council: Lloyd Johnson Lloyd Johnson, 1809 Adams Drive, supported the amendment and commented on motion detection lights. • Minutes of February 21, 1995 2 Testimony closed There being no others wishing to address Council, Mayor McFadden closed the testimony portion of the hearing. Council discussion Council comments favored the amendment and the effort by staff to address the issue. It was . noted that the subject matter can be revisited if the amendment seems to be a problem. City Clerk presented: Ordinance introduced AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING AN AMENDMENT TO CERTAIN SECTIONS OF CHAPTER 1 (GENERAL PROVISIONS) AND CHAPTER 26 (ZONING) OF THE WEST COVINA MUNICIPAL CODE RELATING TO LIGHT AND GLARE IN SINGLE-FAMILY RESIDENTIAL ZONES (Amendment No. 262) Motion by Manners and seconded by Touhey to waive further reading of the ordinance and introduce. Motion carried by roll call vote: AYES: Herfert, Manners, Touhey, Wong, McFadden NOES: None HEARING RECORD OF COST OF ABATEMENT HEARING LOCATION: 1549 EAST ROWLAND AVENUE City Clerk Berry verified the affidavit of posting. Mayor McFadden opened the hearing and the staff report was presented by Principal Planner McIsaac. Public Testimony Mayor McFadden opened the public testimony portion of thehearing and asked for comments none addressing this matter. No one addressed the City Council and the public testimony portion was Testimony closed closed. City Clerk Berry presented: Resolution 9183 - RESOLUTION NO. 9183 - A RESOLUTION OF THE Confirming cost CITY COUNCIL OF THE CITY OF WEST COVINA, CALI- FORNIA, CONFIRMING THE COST REPORT TO ABATE THE DECLARED PUBLIC NUISANCE LOCATED AT 1549 EAST ROWLAND AVENUE Motion by Manners and seconded by Wong to waive further reading of the resolution and adopt. Motion carried 5-0. Mayor McFadden called to order the Redevelopment Agency at 8:24 pm to consider the following con- tinued joint public hearing. HEARING CONTINUED JOINT PUBLIC HEARING ON THE PROPOSED DISPOSITION AND DEVELOPMENT AGREEMENT BY AND AMONG THE REDEVELOPMENT AGENCY OF THE CITY OF WEST COVINA, VAL J. FEJTER AND SOUTHLAND MOTORS Motion by Manners and seconded by McFadden to continue this meeting until the next regularly scheduled meeting of March 7, 1995. Motion car- ried 5-0. Mayor McFadden recessed the Redevelopment Agency at 8:26 pm to continue with the regular City Council Agenda. Minutes of February 21, 1995 AGENDA AND ORAL COMMUNICATIONS 3 Jean Arneson Jean Arneson, 1116 Donna Beth, noted a change to her statements reflected in the minutes of January 3, 1995. Her change will be made by the City Clerk. • Royal Brown Royal Brown, 2153 Aroma Drive, commended Council for allowing the City Manager and the Local Enforcement Manager to attend the meetings at La Quinta - in relation to the CIWMB. Robert Ramirez Robert Ramirez, 154 N. Roberto #B, father of the following speaker, commented on political signs that are still erect in West Covina. Andy Ramirez Andy Ramirez, 154 N. Roberto #B, noted that his signs have been taken down as of January 31st. He favored the idea of a sign posting ordinance. Tracy Brown Tracy Brown, 2715 Vanderhoof Drive, noted the need to have an ordinance update to housing of horses. She related the history of the City's intention to complete this, but it has been several years since then and has still not been done. Sheley Sanderson Sheley Sanderson, 630 N. Leaf Avenue, concurred with Ms. Brown's statements, offering her own survey of 18 surrounding.cities for City staff. She also mentioned that there is a particular citizen who continually harasses the horse owners and the Police Department has issued a restraining order against him. Rita Callahan Rita Callahan, 1533 E. Rio Verde Drive, com- plained about inoperable vehicles in her neigh- borhood and submitted pictures. Staff Response The horse ordinance has been calendared for Council in June of 1995 and had been delayed to accommodate other matters, such as the BKK issue. Mayor McFadden asked that it be expedited and that Council be given the back- ground on the situation. The inoperable vehicle matter will be forwarded to Code Enforcement. Mayor Pro Tem Herfert commented on political signs remaining up long after elections are over. He noted that Council candidates remove them promptly, but the larger election candi- dates have a problem removing theirs in a timely fashion. WASTE MANAGEMENT ENFORCEMENT AGENCY (LEA) Assistant City Manager Wylie reported that the CIWMB meeting City Manager had phoned him to relay that the meeting with the subcommittee of the California Integrated Waste Management Board had gone well. The City's request to take decertification of the City's LEA off the table for consideration was granted for thirty days. The actual Board meeting will take place tomorrow, February 22, at La Quinta City Hall. Mayor Pro Tem Herfert added that this effort was aided by. local legislators and concerned citizens. He was appreciative of the editorials in the San Gabriel Valley Daily Tribune. Councilmember Manners noted that she had met at length with Assemblyman Horcher regarding his particular bill and the upshot of the dis- cussion was that Mr. Horcher was willing to do whatever he could to assist West Covina. Mayor McFadden noted that BKK had applied pressure on the legislators in Sacramento to have the City's LEA decertified. Motion by Manners'and seconded by McFadden to receive and file the staff report. Motion carried 5-0. REDEVELOPMENT AGENCY 1) Mayor McFadden recessed the City Council meeting at 9:04 pm to reconvene the.Rede- velopment Agency. Councilmember Manners left the meeting at 12:51 am. The City Council reconvened at 12:56 am with Councilmember Manners excused. 2) First Amendment/Restatement of Park and Ride Agreement - Park and Ride Facilities at the Plaza at West Covina Park & Ride at The Plaza Council reviewed the staff report. Motion by Herfert and seconded by Touhey to approve the First Amendment/Re- statement of Park and Ride Agreement between the Redevelopment Agency, the City of West Covina and Centermark Properties, Inc. of West Covina. Motion carried 4-0. HUMAN SERVICES 1) OLDER AMERICANS RECOGNITION DAY Penny Schaefer Council reviewed the staff report. Motion by Herfert and seconded by Wong to select Thelma "Penny" Schaefer as the City's nominee for Older Americans Recog- nition Day. Motion carried 4-0. ORAL COMMUNICATIONS No comments offered. MAYOR'S REPORTS Mayor McFadden reminded the audience of his show on Channel 56 scheduled for Thursday at 7:00 pm focusing on Black History Month. Minutes of February 21, 1995 7 COUNCILMEMBERS' REPORTS Mayor Pro Tem Herfert commenced a discussion to consider regulations which would allow Little Leagues to place sponsorship signs/banners on the outfield fences. ATTEST: cii-�vll€rk Q'&I t Berr • Councilmember Touhey noted that West Covina High School uses banners and takes them down between games. Councilmember Wong suggested that the guidelines be developed in conjunction with the school district to avoid conflicting policies. He also noted that CalTrans has standards that may be useful to staff in developing guidelines for the City. Councilmember Touhey suggested that the City individual responsible for each park be named as the designated person to remove and maintain the various sponsorship signs. He asked staff to look into the Western Cities article on Pepsi's sponsorship of scoreboards in the City. Mayor Pro Tem Herfert asked staff to contact Charles Hewett, Cal Spas, who is leaving the City because of sign restrictions. Councilmember Touhey suggested looking into purchasing mobile snack bars for use by soccer leagues and other sport teams in locations where the City does not have facilities. Motion by Herfert and seconded by Touhey to adjourn the meeting at 1:05 am (Wednesday 2/22). Motion carried 4-0.
