02-07-1995 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING OF THE WEST COVINA CITY COUNCIL February 7, 1995 The regular meeting of the West Covina City Council was called to order • by mayor McFadden at 7:40 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Pastor Bob Orr of Faith Community Church and the Pledge of Allegiance was led by Mayor McFadden. ROLL CALL Mayor McFadden, Mayor Pro Tem Herfert, Council - members Manners, Touhey, Wong Others Present: Starbird, Orr, Wylie, Glover, Miller, Collier, Samaniego, Greene, Mayer, Shott, Ure, Patton, McIsaac, Yoshizaki, Panis, Salazar, Jarrin; Berry APPROVAL OF MINUTES Councilmember Wong made several corrections to the minutes of December 20, 1994. Motion by Manners and seconded by McFadden to approve the following sets of minutes: Regular meeting of December 20, 1994, as corrected Special meeting of January 17, 1995 Regular meeting of January 17, 1995 Special meeting of January 25, 1995 Motion carried 5-0. PRESENTATIONS Southern California Edison representative, Jerry Silva, presented the City with a $5,000 rebate check for its efforts in energy conservation. In addition, he also presented Senior Building Inspector Michael Shott with a plaque for his perseverance in maintaining the conservation efforts for the City. Mayor McFadden introduced the nominees for the 1994 Citizen of the Year Award: Eva Lawson Cy Lichtman Talmadge and Betsy Ross Michael Touhey with special appreciation to the winner: Suzanne Dunn who was nominated by the Lions Club of West Covina. HEARING CONTINUED PUBLIC HEARING - RESIDENTIAL LIGHT AND GLARE ORDINANCE (AMENDMENT NO. 262) Motion by Manners and seconded by Touhey to continue .the public hearing for Amendment No. 262 to the meeting of February 21, 1995, as staff is in the process'of compiling information • for Council. Motion carried 5-0. HEARING GENERAL PLAN AMENDMENT IV-94-23 - HOUSING ELEMENT UPDATE Housing Element update City Clerk Berry verified the affidavit of pub- lication and Mayor McFadden opened the hearing. The staff report was presented by Principal Planner McIsaac who stated that this update Minutes of February 7, 1995 K brings the Housing Element of the General Plan into compliance with new legislative require- ments. • Public Testimony Mayor McFadden opened the public testimony por- tion of the hearing and asked for comments from None the audience. HEARING ORANGEWOOD PARR MASTER PLAN AMENDMENT NO. 1 - 1615 WEST MERCED AVENUE Orangewood Master Plan City Clerk Berry verified the affidavit of pub- lication and mailing. Mayor McFadden opened the hearing. Planning Director Collier presented the staff report and responded to Council questions regarding the proposed trailer to house the office and pro shop, and the financial arrangements. Public Testimony Mayor McFadden opened the public testimony por- tion of the hearing and asked for comments from the audience. The following individuals addressed Council: Ray Silva Ray Silva, owner of Play It Again Sports, expressed concern regarding the pro shop located at the site as having an unfair advantage over shops situated elsewhere in the City, such as his. Dino Diaz Dino Diaz, president of West Covina Bruins, expressed concern that the football program will eventually be pushed out of Orangewood Park practice field. Testimony closed There being no others wishing to address Coun- cil, Mayor McFadden closed the public testimony portion of the hearing to commence Council dis- cussion. • Council Discussion Discussion ensued regarding the pro shop pro- posed for the roller hockey rinks in relation to the RFP process, costs to be incurred by the operator, and the Planning Commission's intent to have the rinks and the pro shop controlled by the same operator. Bryan Garland of California Street Hockey Asso- ciation (CSHA) responded to Council's comments and concerns. HEARING JOINT PUBLIC HEARING ON THE PROPOSED DISPOSITION AND DEVELOPMENT AGREEMENT (DDA) BY AND AMONG THE REDEVELOPMENT AGENCY OF THE CITY OF WEST COVINA, VAL J. FEJTER AND SOUTHLAND MOTORS, INC. City Clerk Berry verified the affidavit of pub- lication and Mayor McFadden opened the joint public hearing. Motion by Manners and seconded by Touhey to continue the public hearing to February 21, 1995. The motion carried 5-0. The Redevelopment Agency was adjourned at 8:37 pm at which time the City Council continued with its agenda. She also addressed Item F-2 (Dis- posal of Waste from other Counties). E.T. Snell E.T. Snell commented on the Claims Against the City (Item C-4) and felt he was not treated fairly by the West Covina Police Department. Mayor Pro Tem Herfert requested information regarding Mr. Snell's situation. Minutes of February 7, 1995 Councilmember Touhey requested Item C-llf (1995 Summer Concert Series Budget) be held over and the City Council approved the hold over. • Councilmember Wong removed Items C-10d (BSI' Consultant funding), C-10f (Geotechnical Inves- tigation at 3033 Cecelia Street), and C-lla (MD resolutions) because he would be abstaining on the vote, due to conflict of interest laws. CONSENT CALENDAR MOTION Motion by Herfert and seconded by Touhey to waive further reading of the resolutions and ordinances and to adopt, and to approve all other items listed on the Consent Calendar except: C-3, C-10d, C-10f, C-lla. Motion carried by roll call vote AYES: Herfert, Manners, Touhey, Wong, McFadden NOES: None Item C-3 Motion by Wong and seconded by Manners to approve the staff recommendation. Motion carried 4-0-1 with Touhey abstaining. C-10d, C-10f, C-lla Motion by Manners and seconded by Herfert to approve the staff recommendations for these three items. Motion carried 4-0-1 with Wong abstaining, due to conflict of interest laws. PUBLIC WORKS MAINTENANCE DEPARTMENT SERVICE LEVELS/COST CONTROLS AND TRANSITION PLAN Maintenance Dept. City Engineer Glover elaborated on the staff changes report. Councilmember Wong hoped the quality of service would remain high, particularly with the graffiti removal program. Councilmember Manners applauded the efforts but was cautious about moving full bore with private contractors. She suggested moving forward slowly to ensure the quality of service. Mayor Pro Tem Herfert felt this was a positive response to the community's concern in seeking ways to save money and keep taxes down. He also noted that Council is sym- pathetic to the layoff concerns of the employ- ees, favoring the reduction of the work force through attrition instead. Motion by Herfert and seconded by Touhey to approve the proposed Maintenance Department transition plan and direct staff to bring back the following items for Council approval: a) bid specifications for street maintenance, parks mowing and graffiti removal functions; and b) bid specifications for the purchase of crack sealing equipment (approximately $30,000), enabling resolutions for PERS allowing partici- pation in an early retirement incentive program for specified classifications of employees in the Maintenance Department, and d) an early • departure cash out program for employees not eligible for early retirement. Motion carried 5-0. INFORMATIONAL REPORT ON SPEED HUMPS Speed Humps Council reviewed the staff report. Motion by Manners and seconded by McFadden to continue to use the existing policy of not using humps and bumps as speed control devices. • Minutes of February 7, 1995 PP 95216 - SCORE BOOTH/STORAGE BUILDING AND FLAG POLE AT SHADOW OAK PARK PP 95216 - Council reviewed the staff report. Bill Theo Construction Motion by Manners and seconded by Wong to a) appropriate $37,000 from the Capital Projects Fund to PP 95216, and b) accept the bid of Bill Theo Construction, Downey, in the amount of $29,999 as submitted at the bid opening of Janu- ary 25, 1995 and authorize the Mayor and City Clerk to execute the contract. WASTE MANAGEMENT ENFORCEMENT AGENCY (LEA) BKK LANDFILL DATA SUPPORTING ABANDONMENT OF "K" LINE GAS COLLECTION WELLS AND RESPONSES TO JEAN ARNESON'S QUESTIONS BKK's "K" Line Wells Waste Management Enforcement Manager Samaniego elaborated on the staff report. Upon suggestion by City Manager Starbird, a motion was made by Herfert and seconded by Touhey to make a formal request of the CIWMB to firm up the well issue and report its findings in relation to the Stipulated Permanent Injunction with greater data. Motion carried 5-0. Recess REPORT REGARDING LEA EVALUATION AND REPORT ON SPECIAL LEGISLATION AFFECTING CITY LAND USE AUTHORITY OVER THE'BKK LANDFILL City Manager Starbird presented verbal comments on the latest rumor that the CIWMB is going to recommend that West Covina be relieved of its responsibilities in regulating and administering the landfill. City staff feels this is a delib- erate attempt to circumvent local interest. Mr. Starbird stated that he and Mr. Samaniego would be leaving shortly to fly to Sacramento to address this and AB 241 as well. Part of the trip included a meeting with Assemblyman Paul Horcher. Motion by Manners and seconded by Herfert to receive and file the City Manager's report. Motion carried 5-0. Mayor McFadden recessed the meeting at 9:26 pm at which time City Manager Starbird and Waste Management Enforcement Manager the meeting to catch a_ flight The City Council reconvened at members present. • ENVIRONMENTAL SERVICES GRAFFITI REMOVAL COST RECOVERY Samaniego left to Sacramento. 9;40 pm with all Graffiti Removal Council reviewed the staff report and directed staff to use cost-effective approaches. Motion by Manners and seconded by Touhey to direct staff to prepare the necessary code amendment to allow the City to recover all City costs asso- ciated with the prosecution and removal of graffiti by a vandal. • • Minutes of February 7, 1995 RECEIPT OF WASTE FROM OTHER COUNTIES FOR DISPOSAL Council reviewed the staff report and Mayor Pro Tem Herfert stated he would vote against this. Councilmember Touhey concurred. Motion by Manners and seconded by McFadden to receive and file the report. Motion carried 3-2 with Herfert and Touhey voting no. REDEVELOPMENT AGENCY The Redevelopment Agency meeting was conducted earlier in the evening. HUMAN SERVICES No scheduled reports. PUBLIC SAFETY No scheduled reports. ADMINISTRATIVE SERVICES FINANCE DEPARTMENT MID -YEAR BUDGET REPORT Assistant City Manager Wylie elaborated on the staff report. Motion by Herfert and seconded by Manners to receive and file the status report. Motion carried 5-0. CITY MANAGER BUSINESS LICENSE ADVISORY COMMITTEE Council reviewed the staff report, noting that Councilmember Manners was the only member of the Council to have submitted names to the City Manager's Office. Council stated they would forward names by Monday to Steve Wylie.
