04-05-1994 - Special Meeting - Minutesl _J 0- M I N U T E S SPECIAL MEETING WEST COVINA CITY COUNCIL April 5, 1994 The special meeting of the West Covina City Council was called to order by Mayor Jennings at 6:12 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. ROLL CALL Jennings, Wong, Manners Others Present Starbird, Wylie, Buchanan, Hanna -Dixon, Orr, Thomas, Collier, Keating, Warren, Rossman, Patton, Gannon, Miller, Urban, Parker, Samaniego, Fernald Councilmember McFadden arrived at 6:28 pm. HEARINGS 1994 CONGESTION MANAGEMENT PROGRAM (CMP) CONFORMANCE SELF -CERTIFICATION Planning Director Collier and Transportation Planner Warren presented the staff report., Council Action Motion by Manners, seconded by Wong, and unanimously carried to take the following actions: a) Direct staff to bring Deficiency Plan Credit Claim Worksheets before the Council as a Consent Calendar Item prior to the November 1, 1994 submittal deadline to the L.A. County Metropolitan Transportation Authority; b) Adopt RESOLUTION NO. 9063, FINDING THE Resolution 9063 CITY OF WEST COVINA TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL IMPLEMENTATION REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089; and c) Adopt RESOLUTION NO. 9064, ADOPTING A Resolution 9064 LAND USE ANALYSIS PROGRAM PURSUANT TO STATE GOVERNMENT CODE SECTIONS 65089 AND 65089.3. Motion carried by roll call vote: AYES: Manners, McFadden, Wong, Jennings NOES: None ABSENT: Herfert AMENDMENT NO. 257 (ADULT -ORIENTED BUSINESSES AND PUBLICATION VENDING MACHINES Senior Planner Liza Virata presented the staff report. Public Testimony Bob Pamplin, 3208 Hollingworth, stated that the City need to highly regulate these businesses. Noted the City of Lancaster's ordinance regarding Adult -Oriented Businesses, stating their strict regulations regarding hours of operations, lighting, etc. Expressed concerns with distances from schools, apartments, and churches. Suggested the City hire the National Law Center for Families to write the ordinance. Mr. Page, resident of the extreme northwest end of the City. Stated that he feels the City likes to send its, "garbage" to his section of West Covina. Spoke with Assemblyman Horcher's SPECIAL MEETING OF 4/05/94 Page Two regarding AB17 and was informed that this bill does not address distance from schools. Stated that he was in total opposition to the proposed ordinances. David Saeger, 1222 Bubbling Well Road, thanked the Council and staff for their interest in the Adult -Oriented. Business ordinance and the welfare of our community. Mayor Jennings welcomed questions from Councilmembers. Councilmember McFadden asked how did staff come to the 300 ft. distance. City Attorney Hanna -Dixon responded that the West Covina ordinance had been painstakingly researched and the 300 ft. distance is legitimate without infringing on 1st Amendment Rights. Council Action Mayor Jennings entertained a motion to continue this item to the regular 7:30 pm.
