02-01-1994 - Regular Meeting - MinutesREGULAR MEETING WEST COVINA CITY COUNCIL February 1, 1994 The regular meeting of the West Covina City Council was called to order • by Mayor Jennings at 7:40 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Rev. Sung-Yop Lee of West Covina United Methodist Church and the Pledge of Allegiance was led by Councilmember Herfert. ROLL CALL Mayor Jennings, Mayor Pro Tem Wong, Council - members Herfert, Manners, McFadden Others Present: Starbird, Wylie, Hanna, Miller, Thomas, Orr, Glover, Salazar, Greene, Collier, Distelrath, Evans, Yoshizaki, Samaniego, Keating, Berry APPROVAL OF MINUTES Motion by Manners, seconded by McFadden, and unanimously carried to approve the minutes of the regular meeting held January 18, 1994. PRESENTATIONS Mayor Jennings introduced Pete Makowski, President of Queen of the Valley Hospital, who came forward to accept a Resolution of Commendation recognizing the hospital's selection as one of the TOP 100 UNITED STATES HOSPITALS. Mr. Jerry Silva of Southern California Edison presented a $17,324 check to the City for participating in the Energy Management Hardware Rebate Program. Councilmember Manners announced a local volunteer group heading an earthquake relief program "Metropolitan Housing Bank" matching the needs of earthquake victims. Redevelopment Agency Called to Order Mayor Jennings called to order the Redevelopment Agency at 7:55 pm to consider the following joint public hearing. HEARING JOINT PUBLIC HEARING - BIRTCHER DISPOSITION AND DEVELOPMENT AGREEMENT Birtcher Senior DDA City Clerk Berry stated that the affidavits of publication and mailing were on file and that the record contains the following documents: 1) Disposition and Development Agreement between the West Covina Redevelopment Agency and Birtcher Senior Properties; and 2) Summary Report as required by Section 33433 of the Redevelopment Law. Mayor Jennings opened the public and the staff report was presented by Project Manager Evans. Public —Testimony Mayor Jennings opened the public testimony portion of the hearing and asked for favorable comments. City Clerk Berry stated that no written comments had been received. Council Action: City Clerk Berry: Resolution 9048 - RESOLUTION NO. 9048 - A RESOLUTION OF THE approving land sale CITY COUNCIL OF WEST COVINA APPROVING THE SALE OF LAND PURSUANT TO A DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE WEST COVINA REDEVELOPMENT AGENCY AND BIRTCHER SENIOR PROPERTIES, INC. AND MAKING CERTAIN FINDINGS IN CONNECTION,THEREWITH Motion by Herfert, seconded by Manners, and unanimously carried to waive further reading of the resolution and adopt. Redevelopment Action: Secretary Berry presented: Resolution 457 - RESOLUTION NO. 457 - A RESOLUTION OF THE approving DDA WEST COVINA REDEVELOPMENT AGENCY APPROVING THE DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE WEST COVINA REDEVELOPMENT AGENCY AND BIRTCHER SENIOR PROPERTIES, INC. AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH Motion by Herfert, seconded by McFadden, and unanimously carried to waive further reading of the resolution and adopt. Redevelopment Agency Mayor Jennings recessed the Redevelopment Agency recessed at 8:11 pm to continue the City Council meeting. Royal Brown, 2153 Aroma Drive, asked for the status of the last Notice and Order issued to BKK regarding a solid waste facility permit. Mayor Jennings stated that the comments favoring the Metrolink subsidy would be considered.at the time the subject comes up on the Agenda. City Manager Starbird stated that staff will look into Mr. Touhey's suggestion for funding • additional police officers. Waste Management Enforcement Manager Samaniego stated that BKK has not complied with the Notice and Order which required BKK to obtain a revised SWFP by January of 1994. Recommendation is to acknowledge completion of rough grading of storm drains and catch basins and authorize release of Developers Insurance Company Bond No. 977083 for Tract 46781 and Bond Nos. 206164 and 223852 for Tract 46780 in the amount of $313,000 and release cash deposit in the amount of $6,000.00. This would allow staff the opportunity to re- evaluate the bid proposal language and bonding requirements and further produce the opportunity to attract additional bidders for this maintenance contract. GP-94-312 - Maintenance of Heating and Air Conditioning Equipment in Twelve City -Owned Buildings Recommendation is to postpone the award of this contract until the March 1, 1994 Council meeting to allow staff adequate time to evaluate the performance capabilities of the low bidder, Abban Industries of Rancho Cucamonga. GP 94313 - New Parking Lot at Cortez Park GP 94313 Recommendation is to take the following E.C. Construction actions: a) Transfer to GP 94313 from the fol- lowing projects: $30,000 from GP 94304 $10,000 from PP 93201 $20,000 from PP 93213 $33,000 from GP 94303 b) Accept the bid of E.C. Construction in the amount of $208,352 as submitted at the bid opening of 1/13/94 and authorize the Mayor and City Clerk to execute the contract. 4) GP 87308 - New Fire Station No. 2 at Cortez GP 87308 Recommendation is to reject all bids and re - Reject bids advertize for new bid proposals. This will allow staff an opportunity to contract additional contractors in an effort to obtain a lower contract bid. CONSENT CALENDAR MOTION Mayor Pro Tem Wong requested Item C-8a be removed from the Consent Calendar for separate action. 5 • • City Council Minutes of 2/1/94 Motion by Manners, seconded by McFadden to waive further reading of the ordinance and to adopt, and to approve all other items listed on the Consent Calendar, except Item C-8a. PUBLIC WORKS PP 93211 - FRIENDSHIP PARR BASEBALL FIELD LIGHTING Council reviewed the staff report. PP 93211 - Motion by Herfert, seconded by McFadden, and Plans & specs approved unanimously carried to approve the plans and specifications for PP 93211 and authorize the City Engineer to call for bids. WASTE MANAGEMENT ENFORCEMENT AGENCY (LEA) ENVIRONMENTAL SERVICES No report. No reports. COMMUNITY SERVICES PLANNING DEPARTMENT EAST CAMERON AVENUE PARK SITE (HERITAGE GARDENS) CONSULTANT AGREEMENT FOR MASTER PLAN DEVELOPMENT Council reviewed the staff report. Heritage Gardens - Motion by Herfert, seconded by Manners, and The Dike Partnership unanimously carried to authorize the Mayor and City Clerk to execute a consultant agreement with The Dike Partnership to provide professional services for the preparation of Heritage Gardens Park Specific Plan at a cost of $25,530. REDEVELOPMENT AGENCY 1) Mayor Jennings recessed the City Council meeting at 8:43 pm to reconvene the Redevelopment Agency. The City Council meeting reconvened at 9:15 pm: 2) Third Amendment to Negotiating Agreement Between the Agency and Hassen Imports Partnership. Inc. Council reviewed the staff report. RDA and Hassen Imports Motion by Manners, seconded by McFadden, and unanimously carried to approve the Third Amendment to Negotiating Agreement extending the negotiation period to June 7, 1994, relating to property adjacent to the new Dodge site. City Council Minutes of 2/1/94 HUMAN SERVICES' 1) METROLINR INCENTIVE PROGRAM Human Services Director Salazar presented Metrolink subsidy the staff report. A lengthy discussion ensued regarding the following issues: a) • should there be a cap on the number of subsidies, b) should the subsidy be in the amount of $25 as proposed or limited to $20 so that the metrolink ticket equals the same ticket amount as a Foothill Transit pass ($92/month), and c) should there also be a subsidy for Foothill Transit riders. Motion by Manners, seconded by Jennings to refer the matter back to the Human Services Commission to consider other options. After further discussion, Herfert offered a substitute motion, seconded by McFadden, to approve a $20 subsidy and refer the issue of a bus pass subsidy to the Human Services Commission. Upon further comments, the first motion was withdrawn by Manners and Jennings. Wong amended the substitute motion to approve the staff recommended $25 subsidy, and this amendment was seconded by McFadden. Mayor Jennings asked for a vote on the amendment and it failed by the following vote: AYES: McFadden, Wong NOES: Herfert, Manners, Jennings At this point, Council voted on the motion to approve the $20 subsidy and refer the issue of a bus pass subsidy to the Human Services Commission. This motion was approved unanimously. Council noted that the original $7500 suggested by staff as a cap for this particular program would provide more than 50 subsidies. 2) VETERANS' MEMORIAL STATUS REPORT Human Services Director Salazar presented the staff report. Veterans' Memorial Motion by Herfert, seconded by Manners, and unanimously carried to receive and file the status report. 3) FOOTBALL FIELD LIGHTING AT CORTEZ PARR Human Services Director Salazar presented the staff report. Cortez Park Football Motion by Herfert, seconded by lighting McFadden, and unanimously carried to include the Cortez Park Football Lighting Project into the 94/95 CIP Budget process. 4) JOINT CITY/SCHOOL DISTRICT PROJECTS • Human Services Director Salazar presented the staff report, stating that the third City/School projects project on page 2 has been eliminated (West Covina High School Gym Lighting Upgrade). Motion by Herfert, seconded by Manners, and unanimously carried to approve the city's participation in projects listed 7 City Council Minutes of 2/1/94 under Category A pending School District concurrence, and authorize staff to proceed with their implementation (eliminating the WCHS gym lighting project). • CITY ATTORNEY City Attorney Hanna stated that there would not be a need for a closed session at the close of the meeting. APPROVAL OF DEMANDS Motion by Wong, seconded by Manners to approve Demands totaling $1,873,679.27 as listed on check registers FI 145196 through 145546. Motion carried by roll call vote: AYES: Herfert, Manners, McFadden, Wong, Jennings NOES: None ORAL COMMUNICATIONS Michael Touhey, 223 N. Toland Avenue, spoke further on his earlier comments regarding Prop C and Prop A funds being used as a secondary source for police funding - not a primary source of funding. City Manager Starbird noted that staff would look into the suggestion. MAYOR'S REPORTS Approval of a Resolution of Commendation for Queen of the Valley Hospital was taken earlier in the meeting. COUNCILMEMBERS' REPORTS Mayor Pro Tem Wong reported that Foothill Transit has loaned twelve busses to the San Fernando area in response to a request from MTA. He asked staff to look into the possibility of temporarily suspending truck delivery hours to West Covina businesses. The earthquake damaged freeways are overly congested and this may help to keep the trucks off during commute peak hours. Councilmember Herfert requested a status report on the project located at 330 La Serena. Councilmember McFadden asked for a report outlining various available Federal, state, and local funding sources for earthquake victims in the event West Covina is faced with the same situation as that occurring in the San Fernando Valley. He also asked for an update on the Police Association Meet and Confer negotiations. City Manager Starbird stated that at the end of the meeting he would be asking Council to check dates and times for a closed session on Meet and Confer. • Councilmember Manners wished Councilmember McFadden's mother well as she was scheduled for surgery the following day. She also commented about her brother's earthquake damaged home and thought that FEMA low cost loans and other avenues of emergency assistance were well publicized.
