10-19-1993 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING WEST COVINA CITY COUNCIL October 19, 1993 The regular meeting of the West Covina City Council was called to order by Mayor Jennings at 7:44 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Father Ray Smith of St. Martha's Episcopal Church and the Pledge of Allegiance was led by Councilmember McFadden. ROLL CALL Mayor Jennings, Mayor Pro Tem Wong, Councilmembers Herfert, Manners, McFadden Others Present: Starbird, Wylie, Orr, Distelrath, Ure, Salazar, Glover, Collier, Nagel, Thomas, Hanna, Samaniego, Gardner, Pullen, Bonaparte, Patton, Yoshizaki, Berry APPROVAL OF MINUTES Motion by Wong, seconded by McFadden, and unanimously carried to approve the following Council minutes: Special meeting of September 28, 1993 Special meeting of October 4, 1993 Special meeting of October 5, 1993 Regular meeting of October 5, 1993 PROCLAMATIONS Mayor Jennings proclaimed the month of November, 1993 as ESCROW MONTH and presented the proclamation to Henry E. Vagt, president of the Escrow Association of The San Gabriel Valley. Mayor Jennings proclaimed the following: RED RIBBON WEEK (10/24 - 10/30) NATIONAL ARTS AND HUMANITIES MONTH (11/93) BUCKLE UP FOR LIFE (11/93 - 1/94) HEARING SECOND SUPPLEMENTAL WEED AND RUBBISH ABATEMENT LIST 2nd Sup. Weed Abatement City Clerk Berry verified the affidavit of List mailing. Motion by Herfert, seconded by Wong, and unanimously carried to receive and file the affidavit. Public -Testimony Mayor Jennings opened the hearing and the staff none report was presented by Fire Marshal Nagel. City Public_Testimony_Closed Clerk Berry stated that no written protests or objections had been received. Mayor Jennings asked for verbal protests or objections and no one addressed the City Council. Motion by Manners, seconded by Herfert, and unanimously carried to order the abatement of weeds and rubbish on those properties described in Resolution No. 9022. HEARING MP 94126 - UNDERGROUND UTILITY DISTRICT NO. 5 Motion by Manners, seconded, by McFadden, and unanimously carried that this informal public hearing be rescheduled for November 16, 1993, as recommended by staff. I City Council Minutes 10/19/93 AGENDA AND ORAL George Sarumian George Sarumian, A & D Disposal Company, addressed K-le (West Covina Disposal rates), stating that the City's franchisee is unfair (rates too high) and the City should solicit bids for trash collection service. Mike Mohajer Mike Mohajer, 738 S. Hillward Avenue, supported the staff recommendations re C-3a (claim received from BKK), K-ld (budget appropriations for BKK litigation), and B-3 (resolution redesignating the City as the Local Solid Waste Management Enforcement Agency hearing panal). Adrianne Metzger Adrianne Metzger, 2926 Onyx Way, addressed K-lc (animal service task force). She thanked Council for the formation of the committee and made several suggestions. Dan Leonard Lt. Dan Leonard of WCPD addressed C-6j (proposed police memorial outside the Police Department). Iris Delameter Iris Delameter, 1212 W. Eckerman, favored once a week street sweeping (C-6h) and the idea of holiday decorations (D-1). She agreed with the City Manager's recommendation to place youth sports financial requests in the budgetary process: Jon Dickey Jon Dickey, 916 S. Heritage Drive, addressed Council as the former president of West Covina Youth Pony Baseball. He supported the.group's request for City funds to complete their .lighting project (H-1). Dino Diaz Dino Diaz, 1241 Valinda, spoke on behalf of West Covina Bruins and the need for lighting at Cortez Park. Gilbert Rodriguez Gilbert Rodriguez, 3016 Greenleaf Street, addressed H-1 (the lighting issue for youth pony baseball at Coronado Park). Albert Behr Albert Behr, 1333 Glenn Alan, current president of West Covina Youth Pony Baseball, addressed H- 1 (lights at Coronado Park). Jean Arneson Jean Arneson, 1116 Donna Beth, noted her support of N-3 (LEA hearing panal) and K-ld (budget appropriation for BKK litigation). Kimberly Dalton Kimberly Dalton, 2926 Onyx Way, complained about Pomona Valley Humane Society and supported the formation of.an animal services task force. Paul Hammerstrom Paul Hammerstrom, 1519 Newcrest, supported the staff recommendation for budget appropriations in relation to the BKK lawsuit (K-ld). Mayor Jennings stated that the items will be discussed at the time they come up on the Agenda; however, due to the large number of people in the audience regarding the baseball league's request for additional lighting funds, that item would be considered at this time. 2 City Council Minutes 10/19/93 HUMAN SERVICES Additional Funding for the Coronado Ball Field Lighting City Manager Starbird elaborated on the staff report, emphasizing the two issues at hand:,I) the need for a process for addressing such requests, and 2) the actual request before Council tonight for an additional $19,306 over the $15,000 already granted to this league and to verify the financial resources of the league for this project. . Coronado Ball Field Councilmember Manners concurred in the need to implement a process to receive and review requests, and make recommendations to, the Council. Circumventing that process may result in inadequate review, lack of prioritization of projects, and funding being approved at the expense of other city projects. It also places the Council in a very difficult position because Council is sympathetic and enthusiastic towards youth activities but funding sources are scarce. Councilmember McFadden noted his support in allocating the additional $19,306 and would like to see other league requests on the agenda. He would need to see that the leagues are working hard to raise funds on their own when they make their requests. Councilmember Herfert reflected on one of his election platforms relating to the need for more athletic endeavors for a city as large as West Covina. He felt the West Covina Youth Pony Baseball League did go through the process and the $19,306 would be a good investment. Mayor Pro Tem Wong spoke of the conflict with this evening's matter. There is a need to support organized sports for the youth in the community. At the same time, though, taking needs or projects on a piecemeal basis doesn't allow for assessing the needs of the entire community. Aside from tonight's issue, he favored implementing a process that would give all concerned groups a chance to request funds. He wasn't sure the City should be held responsible for covering $11,000 in light poles that one of the contributors had promised to supply but was unable to fulfill: Mayor Jennings reiterated the difficulty in authorizing funds when the financial situation of the City is such that many other programs and projects have been placed on hold. He was dis- pleased with requests brought directly to the Council without prior processing. Councilmember Manners asked for a recap of the prior funding approved for this league and the current status of available funds. Human Service Salazar responded and noted that there was $45,000 of undesignated funds in this particular park dedication account. He recommended approval of the project funding. I 11 City Council Minutes 10/19/93 City Manager Starbird suggested that 1) perhaps this particular project has been caught between processes and could be given special considera- tion and 2) a process be implemented to address future requests. Motion by Manners to postpone action on the League's request until the next meeting. Motion was seconded by Wong adding that all the other leagues be contacted to submit requests. A substitute motion was offered by McFadden and seconded by Herfert to approve this evening the additional $19,306 for the league. Motion failed by the following vote: AYES: Herfert, McFadden NOES: Manners, Wong, Jennings Mayor Jennings stated the original motion was again on the floor. City Manager Starbird stated that staff may not be able to accomplish contact and receive responses from all the other leagues by the next Council meeting. Action postponed Manners restated the original motion to until next meeting postpone action on the league's request until the next Council meeting. Motion was seconded by Wong and unanimously carried. City Manager Starbird stated that projects such as the League's ballfield lighting falls under capital improvements and thorough review of CIP projects has been scheduled to begin in January, 1994. McFadden encouraged the leagues to submit their requests for the January review. Recess Mayor Jennings recessed the City Council meeting at 9:45 pm. Council reconvened at 9:55 pm with all members present. CONSENT CALENDAR Written Communications (none received) Commissions' Summary of Action (receive & file) Personnel Commission 10/13/93 Claims for Action (deny and notify claimant) On October 1, 1993, the City Clerk's Office received a claim from BKK Corporation purporting to have tortious merit amounting to $3,919,659.66. On April 2, 1993, the City Clerk's Office received a claim from Bonnie Shalhoub for personal injuries. The amount of claim had not been determined at time of presentation. Award of Bids 1) Landscape Maintenance Contract - MD93-11 - Citywide Medians & Freeway Rights -of -Way Landscape Maintenance - Recommendation is to accept the responsive Azteca Landscape low bid of Azteca Landscape, Pomona, for a five year contract in the amount of $519,480.00 ($103,896 annually) and authorize the Mayor and City Clerk to execute the agreement. 2) Landscape Maintenance Contract - MD 1 & 2- 93-11 (Main. WP 93111 - Waiver of a Formal Competitive Bidding Procedure - Purchase of Pressure Reducing Valves and Gate Valves WP 93111 - Recommendation is to a) appropriate $5,000 Pacific Industrial from City's Water Funds reserve to WP 93111, Supply Company and b) approve waiver of a formal competitive bidding procedure and authorize the Finance Director to issue Purchase Orders to Pacific Industrial Supply Company, Riverside, in the amount of $26,629.50, and Familian Pipe and Supply Company, Industry, in the amount of $6,324.25, both including all taxes and delivery charges. 5) Street Sweeping - Informational Recommendation is that the specifications Street Sweeping for the street sweeping contract be specifications rewritten and rebid in January/February of next year with alternate levels of service as follows: Base Bid: Current service of twice per month in residential areas and three times per week in business/commercial areas. Alternate 1: Residential areas once per month; downtown commercial areas three times per week. Alternate 2: Residential areas once per month; downtown commercial areas twice per week. Flashing yellow lights at school locations 6) Flashing Yellow Signals Work Program - Informational (receive & file) The Traffic Committee will review the need installation of flashing yellow signals at 12 elementary school locations - study to take 3 to 4 months. Miscellaneous - Police Department Outside Police Memorial Recommendation is to approve the 36" x 12" dirt area to be used by the Police Department to erect the above Police Memorial. City Council Minutes 10/19/93 Miscellaneous - Human services Fair Housin4 Assessment Consultant Aareement Recommendation is to authorize the Mayor to Willdan Associates - execute an agreement with Willdan Associates for assessment plan the preparation of the West Covina Fair Housing Assessment Plan at a cost not to exceed $8,000. Motion by Manners, seconded by McFadden to waive further reading of the resolutions/ordinances and introduce or adopt, as applicable, and to approve all other items listed, except: C-5a, C-5b, C-6b & c, C-6g, C-6h, C-6i. Herfert, Manners, McFadden, Wong, Jennings NOES: None CONSENT CALENDAR ITEMS TAKEN SEPARATELY: C-5a Councilmember Herfert commended Maintenance Director Glover for the cost savings on the maintenance contracts. Motion by Manners, seconded by Wong, and unanimously carried to approve. C-5b Mayor Pro Tem Wong stated that he would abstain on this item due to a conflict of interest. Motion by Manners, seconded by McFadden to approve. Motion carried with Wong abstaining. C-6b and c Councilmember McFadden asked for clarification some of the documents proposed for destruction and the nomination period for the upcoming City election. Motion by Wong, seconded by McFadden, and unanimously carried to waive further reading of Resolutions 9024, 9025, 9026, 9027, and adopt. C-6g Mayor Pro Tem Wong asked for a clarification for the recommended purchases. He was concerned about such expenditures without obvious gains back to the City. Motion by Manners, seconded by McFadden to approve. Motion carried with Wong voting no. C-6h Councilmember Manners suggested Alternate #3 to the street sweeping specs: twice a month in the residential areas and twice a week in the commercial areas. McFadden suggested Alternate #4: once a month in the residential areas and once a week in the residential areas. Motion by McFadden, seconded by Wong, and unanimously carried to approve the. additional two alternates. C-6i Councilmember Herfert suggested that studying all elementary schools for flashing .yellow lights wasn't necessary, but Merlinda School should definitely be reviewed with a report back to Council. Discussion ensued regarding all schools. Motion by Wong, seconded by Manners, and unanimously carried to receive and file the report, and staff to use discretion in choosing which sites to study. M City Council Minutes 10/19/93 PUBLIC WORKS SERVICES Holiday Decorations Holiday Decorations Maintenance Director Glover elaborated on the staff report. Council discussed the time element involved with this upcoming holiday season and the available funding. Motion by Manners, seconded by Jennings, and unanimously carried to disapprove at this time and directed staff to reintroduce the matter next year during budgetary preparations. WASTE MANAGEMENT ENFORCEMENT AGENCY (LEA) No reports scheduled for this meeting. ENVIRONMENTAL SERVICES Zero Tolerance Graffiti Implementation Program Council concurred on holding this item over until the November 2, 1993 City Council meeting. Mayor Jennings stated that because it was already 11:20 pm Council should discuss only the items that required action this evening. It was decided that the remaining items would be considered on Monday evening, October 25, at 7:30 pm. DEVELOPMENT SERVICES Redevelopment Agency 1) Mayor Jennings recessed the City Council meeting. at 11:25 pm to convene the Redevelopment Agency.The City Council meeting reconvened at 11:31 pm with all members present. 2) Plan Amendment/Merger Council reviewed the staff report. City Clerk presented: Resolution 9028 - RESOLUTION NO. 9028 - A RESOLUTION OF setting hearing date THE CITY COUNCIL OF THE CITY OF WEST COVINA CONSENTING TO AND CALLING FOR A JOINT PUBLIC HEARING ON THE PROPOSED REDEVELOPMENT PLAN FOR THE CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT AND EASTLAND REDEVELOPMENT PROJECT MERGER/AMENDMENT AND THE PROPOSED ENVIRONMENTAL IMPACT REPORT PREPARED IN CONNECTION THEREWITH Resolution 9029 - RESOLUTION NO. 9029 - A RESOLUTION OF housing set aside funds THE CITY COUNCIL OF THE CITY OF WEST COVINA FINDING THAT THE USE OF TAXES ALLOCATED FROM THE CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT AND EASTLAND REDEVELOPMENT PROJECT MERGER/AMENDMENT FOR THE PURPOSE OF HOUSING OUTSIDE THE PROJECT AREA WILL BE OF BENEFIT TO THE PROJECT Motion by McFadden, seconded by Herfert to waive further reading of the resolutions and adopt. APPROVAL OF DEMANDS Motion by Wong, seconded by Manners to approve Demands totaling $2,446,380.47 is listed on check registers FI 142977 through 143295. Motion carried by roll call vote: AYES: Herfert, Manners, McFadden, Wong, Jennings NOES: None ABSTAIN: Herfert re SCE billing GENERAL ADMINISTRATION City Manager 1) Animal Services Task Force Council reviewed the staff report. City Manager Starbird noted that the basic question was whether Council is desirous of establishing a separate committee or utilizing the West Covinans for Animal Care Reform with Councilmember Herfert as the liaison between them and the Council. Councilmember McFadden favored a task force similar to the Anti -Graffiti Task Force and that the group be permitted to look into any animal related issues. He felt staff should type up reports of the committee and if that wasn't acceptable, he would have his secretary do the typing. Councilmember Manners stated that the graffiti task force was set up to tackle a big problem. She did not favor setting up a task force for a non -problem and suggested Herfert interface with the West Covinans for Animal Care Reform and report back to the City Council. Motion by McFadden, seconded by Herfert for a sanctioned committee, unlimited number of members (must be West Covinaresidents), report monthly, address any animal related issues, and Herfert be Council's liaison. Motion failed by the following vote: AYES: Herfert, McFadden NOES: Manners, Wong, Jennings McFadden offered a second motion deleting the reference to a sanctioned committee. Motion carried with Jennings voting no. 10 t City Council Minutes 10/19/93 MAYOR'S REPORTS Motion by Wong, seconded by Jennings,.and unanimously carried to approve a resolution of commendation for Police Reserve Commander Terry Smith uponhis retirement with 30 years of service to the community.
