04-06-1993 - Regular Meeting - MinutesM I N U T' E_S., REGULAR MEETING • WEST COVINA CITY COUNCIL April 6, 1993 • The regular meeting of the West Covina City Council was called to order by Mayor Manners at 7:35 pm in the City Hall Council Xhambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Mayor Pro Tem Jennings and the Pledge of Allegiance was led by Councilmember McFadden. ROLL CALL Mayor Manners, Mayor Pro Tem Jennings, Councilmembers Herfert, McFadden, Wong Others Present: Starbird, Wylie, Orr, Hanna, Keating, Glover, Collier, Thomas, Salazar, Gannon, Samaniego, Cheramie, Buchanan, Yoshizaki, Nagel, Berry, Koniarsky, Tucker, O'Guinn APPROVAL OF MINUTES Regular meeting of March 2, 1993: Councilmember Herfert corrected the minutes to include Steve Samaniego's state- ment that a violation exists in regards to the BKK ridge line issues. Mayor Manners corrected the reference on the last page to Herfert - she was the one who -,had -reported on the high schoolers at West Covina.High. Motion by Manners, seconded by Jennings, and unani- mously carried to approve the minutes as corrected. Motion by Manners, seconded by Jennings to approve the minutes of March 16, 1993. Motion carried with McFadden abstaining (absent from 3/16 meeting). PROCLAMATIONS Councilmember Wong proclaimed the month of April, 1993, as MONTH OF THE YOUNG CHILD. Councilmember Wong proclaimed the month of April, 1993, as NATIONAL FAIR HOUSING MONTH. Councilmember Wong proclaimed April 11 through 17,11993, as NATIONAL TELECOMMUNICATORS' WEEK and presented the proclamation to Mary O'•Guinn, Communications Supervisor. Mayor Manners proclaimed the week of April 18 through 14, 1993, as APRIL POOLS WEEK and presented the proclama- tion to Fire Chief Greene. Mayor Manners proclaimed April 18 through 25, 1993, as DAYS OF REMEMBRANCE OF THE VICTIMS OF THE HOLOCAUST. Mayor Manners proclaimed April 19 through 24, 1993, as GENERAL FEDERATION OF WOMEN'S CLUBS AWARENESS WEEK and presented the proclamation to the president of the West Covina Women's Club, Nancy Sachs. • HEARING AMENDMENT NO. 253 - MINIATURE POT-BELLIED PIGS The amendment establishes provisions and development Amendment No. 253 standards for the keeping of miniature pot-bellied pigs in single family zones. Councilmember Herfert stated he would support the amend - Council comments ment, although he preferred'thetCaty_handle,:the_.pot-..- bellied pigs in thersamesfashion as it handles dogs. He suggested reviewing the amendment in a year. Councilmember McFadden agreed there was too much regu- lation and Council may eliminate the administrative process next year. Councilmember Wong suggested that.it not be reviewed unless there was a problem. Mayor Pro Tem Jennings agreed. Mayor Manners felteenough time and effort had already been spent on thecmatter and an annual review wasn't necessary. He was concerned about the Royal Brown future of the barrier between the street and the c.._ condominium development to the south. He asked about the notification process. Jean Arneson, 1116 Donna Beth, commented about the Galster Park stream (E-1). She asked about the lab:.:.o_' Jean Arneson results. She also felt the EPA reports are inconsis=:.I. tent, referencing a report that discussed historical contamination at the Galster Park stream. She asked why didn't the Waste Management & Environmental Quality Commission receive routine reports. - 2 - • • 0 CITY COUNCIL MINUTES April 6, 1993 Page Three Terry Brutocao Terry Brutocao, president of the West Covina Chamber of Commerce, spoke in support of K-2c (Chamber of Commerce Auto Promotion). Tim Valles Tim Valles of West Covina Nissan, also spoke in support of K-2c, noting that 9 of the 10 auto dealers in the area are working in concert on this project. He also spoke in support of GI-b (formation of the West Covina Auto Plaza Business Improvement District). Walt Hauser Walt Hauser, president of West -Covina Police Officers' Association, stated that the City's request that the police give up two benefitsis, unacceptable. He noted that 86 of the 112 police officers work on the streets. That equates to._.a low ratio of one officer per 1000 population. He said the Council was making the officers' job -more dangerous. Jean Arneson Jean Arneson, 1116 Donna Beth, made additional comments regarding the BKK health risks. Staff Response City Engineer Thomas explained the proposed street vacation and explained the notification process for the public hearing. It will be at that time that all concerns raised by the citizens will be addressed. Mayor Manners stated that the comments regarding Galster Park and the auto promotion will be addressed when the matter comes up on the Agenda. City Manager Starbird responded to WCP.OA's president. Council would be discussing the issues in depth during the closed session at the end of the meeting. He assured Mr. Hauser that the City does run a tight ship, but thatuina.no.,way:meansothat the Police Department is overstaffed. END OF CONSENT CALENDAR - 7 - CITY COUNCIL MINUTES April 6, 1993 Page Eight I PUBLIC WORKS SERVICES 1) WP 90103 - LEAK DETECTION PROGRAM - SELECTION OF CONSULTANT Council reviewed the staff report. • Motion by Herfert, seconded by McFadden, and WP 90103 - unanimously carried to accept the proposal of Fluid Fluid Conservation Systems Conservation Systems, Inc., Austin, Texas, in the Inc. amount of $11,675.51, and authorize the Mayor and City Clerk to execute the contract. 2) WP 93112 - RESERVOIR, PUMP STATIONS, AND WATER LINE DESIGN - SELECTION OF CONSULTANT Council reviewed the staff report.and City Engineer Thomas responded to questions, noting that the pro- WP 93112 - ject(n- would be funded by the Water Revenue Bonds J.F. Davidson Associates issued in late 1990. Motion by Wong, seconded by McFadden, and unanimously carried to a) transfer $25,000 from Water Revenue Bond funds to WP 93112; and b) accept the proposal of J.F. Davidson Associates, Inc., Ontario, in a "not -to -exceed" amount of $150,264.00 and authorize the;Mayor and City Clerk to execute the contract. 0- • WASTE MANAGEMENT ENFORCEMENT AGENCY (LEA) Galster Park Stream ENVIRONMENTAL SERVICES COMMUNITY DEVELOPMENT 1) GALSTER PARK STREAM Waste Management Enforcement Manager Samaniego elaborated on the staff report. Although the test results obtained from the Regional Water Quality Control Board indicated no evidence of contamination from the BKK Landfill, the EPA took samples April 1 forltheiruown anA lysis. Mr. Samaniego was directed to seek quick response from the EPA as the EPA is notorious for lengthy response time. Councilmember Herfert referred to a 1984 report tfiat�referenced::historical contamination. He asked why wasn-'nthatcinformation made.publicuat..that-time. Staff was directed to report back to the Council. He also asked why is it the Waste Management and Environmental Quality Commission doesn't receive all available information (such as the EPA Work Plan) when in fact.members of the public have access to it. Staff to respond on this question 4 as well. Motion by Jennings, seconded by McFadden, and unanimously carried to receive and file the report. No reports scheduled for this meeting. Councilmember Wong suggested amending the reso- lution to include the La Ronde Apartments. Council concurred. He agreed with Councilmember Wong's concern Automated Telephone System about lengthy menus. His goal is to have as short and effective a menu as possible. MAYOR'S REPORTS No reports for this meeting. COUNCILMEMBERS' REPORTS 1) AMENDMENT NO. 2 TO THE FOOTHILL TRANSIT JOINT EXERCISE OF POWERS: AGREEMENT Councilmember Wong elaborated on the report. Amendment No. 2 - Motion by Wong, seconded by Jennings, and Foothill Transit JPA unanimously carried to a) approve Amendment No. 2 to the Foothill Transit Joint Exercise of Powers Agreement, and b) authorize the Mayor and City Clerk to execute Amendment No. 2 to the Foothill Transit Joint Exercise of Powers Agreement. Councilmember Wong reported on the recently held American Heart Association's fundraiser. Councilmember Herfert asked what is the next step in the Long Range Financial Planning sessions. City Manager Starbird responded that staff would pull :i together Council's comments of last night and present it in the near future. Councilmember Herfert was also assured that Council would have an opportunity to discuss fully the potential role of the BKK MOU issue in the Long Range Financial Planning process. City Manager Starbird stated that a study session has been scheduled for Monday, April 12, 1993 at 7:00 pm to receive information on_the various documents and regulations pertaining to the BKK Landfill. There will also be a closed session following the public meeting regarding BKK as well. • Closed Session Mayor Manners recessed the City Council at 11:01 pm to convene a closed session, per:the statements made earlier by the City Attorney.
