03-16-1993 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING • West Covina City Council March 16, 1993 • The regular meeting of the West Covina City Council was called to order at 7:35 pm by Mayor Manners in the City Hall Council Chambers, 1444 W. Garvey Avenue „ West Covina. The invocation was given by Rev. Helmut Hefner of St. Christopher's Catholic Church. The Pledge of Allegiance was led by Mayor Pro Tem Jennings. ROLL CALL Mayor Manners, Mayor Pro Tem Jennings, Councilmembers Herfert, Wong Absent: Councilmember McFadden (excused) Others Present: Starbird, Hanna, Miller, Salazar,.Samaniego, Wylie, Orr, Mayer, Evans, Glover, Holmes, Greene, Collier, Berry, Yoshizaki APPROVAL OF MINUTES Regular meeting of February 16, 1993 In regard to the Veterans' Memorial, Councilmember Herfert statedethat he was in favor of the perpetual flame and desired the statement in the minutes be changed. Thereforettheasentence;was amended to say: Council, with the exception of Herfert, expressed reluctance in approving a perpetual flame - for safety reasons as well as the initial installation costs for the gas line. Adjourned regular meeting of January 25, 1993 Councilmember Herfert desired the following statement to be added: Councilmember Herfert requested staff to report back on potentialcliability,,to the City from homeownersuitsLin the event the closure of BKK does not happen in accordance with the MOU. Motion by Jennings, seconded by Wong, and unanimously carried to approve the minutes, as amended above. PROCLAMATIONS Mayor Manners proclaimed the week of April 5 through 11, 1993, as PUBLIC HEALTH WEEK. Mayor Manners proclaimed April 11 through 17, 1993, as FETAL ALCOHOL SYNDROME WEEK and presented the proclamation to representatives of DECA, a high school marketing club. HEARINGS No hearings scheduled for this meeting. AGENDA AND ORAL COMMUNICATIONS Mr. David Saeger, 1222 Bubbling Well Road, commenced a discussion in opposition to sexually explicit materials that apparently are easily accessible through newsrack,: David Saeger stands, particularly those at the post office. He submitted • samples and petitions signed by residents throughout the valley. Bob Pamplin Bob Pamplin, 3208.Hollingworth Street, submitted a letter encouraging Council to adopt a sexually oriented business ordinance to regulate such businesses. • Dwight Ek Dwight Ek, 1222 E. Grovecenter, a West Covina teacher, concurred with the previous two speakers. City Manager Starbird stated the City Attorney can report back with information on what the Council can and cannot regulate in regardc:toothis issue. He noted the City would be happy to utilize the services of the National Law Center for Children and Families, as suggested. She is planning on attending an • upcoming workshop and will share the information when she comes back to increase awareness of second hand smoke. Motion by Manners, seconded by Herfert, and unani- mously carried to refer the matter to staff. Item 7b Council was interested in the contract language regarding the street sweeping. Motion by Wong, seconded by Jennings, and unanimously carried -to hold over this item until the next meeting. Item 7c Councilmember Wong stated that due to conflicts of interest he would have to.abstain on votingi:regarding Landscape Maintenance Districts No. 4 and 7. Motion by Herfert, seconded by Jennings, and unani- mously carried to waive further reading of the resolutions and adopt. Motion carried with Wong abstaining on Resolutions 8933 and 8934 (MD 114) and Resolutions 8937 and 8938 (MD #7). Mayor Pro Tem added that in regards to Item lb, the Federal government has been subsidizing the tobacco industry and suggested Council write a letter in opposition to this practice. Council concurred. PUBLIC WORKS SERVICES 1) TS 93122 - FUEL EFFICIENT TRAFFIC SIGNAL MANAGEMENT PROGRAM - GRANT PROJECT Council reviewed the staff report. Motion by Jennings, seconded by Wong, and unani- mously carried to a) establish TS 93122 and approp='. riate $8,000 from State FETSIM Funds, and b) find that the aforesaid improvements are categorically exempt pursuant to Sections 15101 and 15106 of the California Environmental Quality Act. NOES: None ABSENT: McFadden ORAL COMMUNICATIONS No comments offered by the citizens. m:_ CITY COUNCIL MINUTES C J March 16, 1993 Page Seven MAYOR'S REPORTS No reports offered for this meeting. • COUNCILMEMBERS'.REPORTS Councilmember Herfert suggested reformatting the public testimony portion of the public hearings. There are many citizens who wish to make a comment or ask a question Herfert and they are neither in favor of or in opposition to the matter at hand. City Attorney stated that there are hearings in which it would be quite acceptable to simply ask for comments. .Therefore, unless a hearing requires pros and cons (such as appeal hearings, assessment hearings), staff will indicate a comment period whenever possible. Councilmember Wong remarked that since the meetings Wong are now cablecast, perhaps there is a way to have the meetings even more accessible to the public, via call in phone or video. Staff was directed to look into the possiblities.
