02-02-1993 - Regular Meeting - Minutes• M I N U T E S REGULAR MEETING WEST COVINA CITY COUNCIL February 2, 1993 • The regular meeting of the West Covina City Council was called to order by Mayor Manners at 7:35 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Don Bommarito and the Pledge of Allegiance was given by Mayor Pro Tem Jennings. • ROLL CALL Mayor Manners, Mayor Pro Tem Jennings, Councilmembers McFadden and Wong Absent: Councilmember Herfert Others Present: Starbird, Hanna, Thomas, Miller, Salazar, Orr, Keating, Panas, Glover, Collier, Nelson, Warren, Samaniego, Pat Bommarito, Cheramie, Holmes, Greene, Berry, Wylie, Yoshizaki, Rossman APPROVAL OF MINUTES Motion by Wong, seconded by McFadden, and unanimously carried to approve the minutes of the regular meeting of January 19, 1993. PRESENTATIONS/PROCLAMATIONS Several students from the Vine Elementary School Speech Class spoke to the audience as part of their class assign - Vine School Student Speakers ment. Council commended the young speakers as well as their speech teacher and the principal of Vine School, Gary Lawson. Councilmember Wong presented Certificates of Recognition to the recipients of Daughters of the American Revolution for their Good Citizen Awards: Good Citizen Awards Nidia Bautista William Workman School Claudia Jiminez . . Mayor Manners presented a Certificate of Recognition to Gary Enderle for his support of community youth sports programs. Mayor Manners proclaimed the month of February as AFRO- AMERICAN HISTORY MONTH and WEST COVINA BEAUTIFUL MONTH. TRANSPORTATION DEMAND MANAGEMENT ORDINANCE/LAND USE ANALYSIS PROGRAM (AMENDMENT No. 254): NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR AMEND. NO. 254; REVISIONS TO CITY COUNCIL RESOLUTION NO. 8648 - GUIDELINES IMPLEMENTING THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) In response to the statutory requirements of the Los Angeles County Congestion Management Program (CMP.), Amendment No. 254 would establish provisions, development standards and guidelines for a Transportation Demand Management (TDM) Ordinance and a Land Use Analysis Pro- gram (LUAP). In addition, a minor modification to - 1 - CITY COUNCIL MINUTES February 2, 1993 Page, -Two • Resolution No. 8648 - implementing CEQA - will include the TDM and LUAP requirement for transit operator review and input in the Environmental Impact Review process. • City Clerk verified the affidavit of publication. The staff report was presented by Planning Director Collier. Public Mayor Manners opened the hearing for comments in favor —Testimony of the amendment and the following individual addressed In Favor: Emma Fischbeck Council: Emma Fischbeck, 1137 Auburn Drive, asked for a clari- fication for this amendment. Mayor Manners responded that In Opposition; the purpose is to ease congestion. None Mayor Manners asked for comments in opposition to the amendment and no one addressed Council. She then closed Public —Testimony —closed the public testimony portion of the hearing. City Clerk presented: Resolution 8919 - RESOLUTION_..NO. 8919 - A RESOLUTION OF THE CITY ;- implementing procedures COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, REPEALING of CEQA RESOLUTION NO. 8648 AND ADOPTING PROCEDURES TO IMPLEMENT THE CALIFORNIA ENVIRONMENTAL QUALITY ACT Motion by Jennings; seconded by McFadden, and unani- mously carried to waive further reading of the resolution and to adopt. Motion by McFadden, seconded by Jennings, and,:unanimously carried to receive and file a revision to Planning Com- mission Resolution No. 2513 "Design Standards for Off - Street Parking Facilities", and a new Planning Commission . resolution for a land use analysis program. V.A.I.D.E.P. added City Manager Starbird explained that an item has come up to the Agenda from the Police Department that is in need of Council • action if the Police are going to participate in a state grant, in cooperation with several neighboring cities. After further discussion, motion by Jennings, seconded by McFadden, and unanimously carried to place the item on the Council Agenda as Item I-2. - 2 - • • • CITY COUNCIL MINUTES AGENDA AND ORAL COMMUNICATIONS February 2, 1993 Page Three Jean Arneson, 1116 Donna Beth, addressed F-2 (Puente Hills Landfill). She suggested Council take no action on this Jean Arneson item as previous Councils have done, and she cited her reasons for this position. Mayor Manners noted that because Councilmember Herfert was absent, Council would be taking action to hold this matter over until a full Council was present to discuss it. Jack Wong, 1139 S. Valinda Avenue, spoke in opposition to Jack Wong Traffic Committee .Item VI wherein the MeilindajSthool principal had requested parking restrictions along Valinda. Mark Brasher, 1135 Valinda Avenue, also spoke in opposition the parking restrictions on Valinda Avenue adjacent to Mark Brasher the school. He felt the school was very demanding, un- cooperative, and wanted the City to solve itsoproblem. •He works for the Hacienda/La Puente School District and related the solutions that were implemented by his employer Phyllis McDonald Phyllis McDonald, Principal of Merlinda School, explained the problems occurring during drop-off and pick-up times at the school and the reasons behind the recommended parking restrictions. Gilbert Dominguez Gilbert Dominguez, 705 E. Barbara, related the situations as he views.;them based on his own experience in dropping off and picking up his children. He felt the parking restrictions a'crecommended were a fair solution.to the congestion and unsafe conditions. Sandy Brasher Sandy Brasher, 1135 Valinda Avenue, noted that it really isn.;t going to matter whether the curb is painted red or not - parents will continue to stop at the curbs for their children. Susan_Stanley Susan Stanley, PTA president at Merlinda School, encouraged Council to proceed with implementing the parking pro- hibition with red curbs. Susanne Barnes Susanne Barnes of Families United, Inc., a non-profit organization, requested City funds to assist with the administration of Families United. Mayor Manners referred her to Human Services Director Salazar and explained that her request will be considered by Council during.the appropriate budgetary review process. Emma Fischbeck Emma Fischbeck, 1137 Auburn Street, commented on several items: a) CSO's, S.H.O.P., and Police Officers should help with the Merlinda School traffic congestion,. b) reminded the City Council of its obligation to provide affordable housing because the City of Industry will be looking for land within fifteen miles of its borders to comply with the same state.lAws that governor West Covina, and c) asked for a clarification regarding Council's action (purported to be in violation of the Brown Act according to2the Tribune) in relation to the wildlife sanctuary accident. Agenda and Oral Communications was closed and the following responses were given. City Manager Starbird clarified the situation in which the contractor, on a joint project with - 3 - CITY COUNCIL MINUTES February 2, 1993 Page Four • Staff Response the City of Walnut, drained his water lines into the catch basin which emptied into the pond at Mt. SAC and sub- sequently killed some of the small animals and micro- organisms. Council was alerted to the possibility of a claim resulting from this accident during a closed session on another matter sometime in December. Council has not yet received any further information or reports from staff because Mt. SAC and City personnel have been working on a satisfactory resolution of the problem and are not yet ready to bring it to Council. The Tribune article implied that the incident was being kept a secret. That statement is false; in fact..Mt.:.:SAC.reported the incident on the front page of the Mountaineer, the City of Walnut printed the story in their community newsletter, and the City was contacted by a Highlander reporter (however no article followed). City Engineer Thomas stated that he encouraged Mt. SAC to contact the Regional Water Quality Control Board and the Fish and Game Depart- ment. City Attorney Hanna clarified that the Brown Act provides closed,: session for councils to meet with their legal advisors on pending and threatening lawsuits as well as ongoing lawsuits. City Manager Starbird and Assistant City Manager Wylie addressed the affordable housing issue mentioned by Ms. Fischbeck. Mr. Wylie noted that her point was well taken. COMMUNITY DEVELOPMENT SERVICES Mayor Manners recessed the City Council meeting at Redevelopment Agency 9:27 pm to convene the Redevelopment Agency. The City Council reconvened at 9:29 pm with Herfert absent. HUMAN SERVICES SHUTTLE AGREEMENT AMENDMENT Council reviewed..the staff report. Extension of shuttle service Motion by Jennings, seconded by Wong, and unanimously to Metrolink station carried to approve Amendment No. 2 to the West Covina Shuttle Agreement with DAVE Transportation Services, Inc. PUBLIC SAFETY SERVICES ANNUAL REPORT - 1992 Chief Holmes elaborated on the staff report. 1992 Annual Report Motion by Jennings, seconded by McFadden, and unani- mously carried to receive and file the informational report. VALLEY AGENCIES IMPAIRED DRIVE ENFORCEMENT PROGRAM (V.A.I.D.E.P..) • This item was placed on the Agenda earlier through Council action. Chief. Holmes elaborated on the staff report. Eckerman, thought it was a good idea to get all parties involved to solve the problem of Iris Delameter the traffic congestion at Merlinda School. Ms. Delameter stated that there should be a consistent policy on this matter. MAYOR'S REPORTS Mayor Manners requested staff to agendize the concept of a graffiti ad hoc committee for Council consideration. ' REPORTS Councilmember McFadden reported two spots of graffiti. He also asked about the Chamber.:of Commerce's report regarding markers and paint:.cans in the local shops. Councilmember McFadden stated that his mother was improving from a recent cardiac arrest. Mayor Pro Tem Jennings expressed support for the graffiti ad hoc committee idea. He also reminded the audience of the upcoming March 8th study session on expenditures. He noted that he had received many favorable comments about staff's presentations at the January 25th study session regarding revenues.
