12-01-1992 - Regular Meeting - MinutesI M I N U T E S REGULAR MEETING WEST COVINA CITY COUNCIL • December 1, 1992 • The regular meeting of the West Covina City Council was called to order by Mayor Pro..Tem Jennings at 7:40 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue. The invocation was given by Rev. Gerard Kiemeney, West Covina Hills Church and the Pledge of Allegiance was led by Councilmember Herfert. ROLL CALL Mayor Pro Tem Jennings, Councilmembers Herfert, Wong Absent: Mayor Manners, Councilmember McFadden (both attending National League of Cities Conference) Others Present: Starbird, Wylie, Thomas, Munoz, Orr, Keating, Greene, Holmes, Salazar, Urban, Collier, Miller, Glover, Berry PRESENTATIONS/PROCLAMATIONS Vine School Elementary School Principal Gary Lawson explained the Education 2000 Program at Vine School. Education 2000 He asked Council if they would like to participate as community educators. Councilmembers Herfert and Wong volunteered to serve as a subcommittee. Mayor Pro Tem Jennings proclaimed the month of December, Proclamation 1992 as NATIONAL DRUNK AND DRUGGED DRIVING (3D) PREVENTION MONTH and presented the proclamation to Police Chief Ron Holmes. HEARING No hearings scheduled for this meeting. AGENDA AND::ORAL COMMUNICATIONS Dennis Chiapetta, General Manager of West Covina Disposal, Dennis Chiapetta addressed Item F-1 (West Covina Disposal Insurance), explaining their request for approval of a change in insurance company ratings. Environmental Services Director Miller responded to Mike Miller questions and comments offered.at the last Council meeting regarding the new automated trash pickup service in West Covina. Councilmember Herfert asked for a clarification •. on the amount of trash one can overload the containers. Dennis Chiapetta stated that the containers overloadec with bagged trash pose no problems. If there is loose trash preventing the top from closing, it may very well spill onto the street. He then responded to the last meeting's complaints and addressed other concerns as well. There is a problem with comingled trash - contaminated greenwaste cannot be disposed of properly and must be included with regular trash. He stated that West Covina Disposal aids the City with SB 939 requirements & statis-• • tical recordckeeping. Councilmember Wong asked how -- the City notifies new residents about the City's mandatory subscription • to trash disposal. Mr. Miller responded that the City is working on a notification process through the Board of Realtors. - 1 - CITY COUNCIL MINUTES December 1, 1992 Page Two • Larry McDonough Larry McDonough, 541 E. Merced Avenue, noted that his trash seems to "grow" overnight when he puts his con- tainer out the night before pickup day. This could very well turn into quite a problem if a homeowner doesn't get his trash picked up because someone else has overloaded his container. Bill Singleton Bill Singleton, 243 N. Leland, observed a trashman transferring trash into a green waste container. John Fellis John Fellis, 114 S. Butterfield, stated his approval of the automated trash pickup but that there is no place at his home to put the containers. Dennis Chiapetta Dennis Chiapetta respondedithat West Covina Disposal was aware of the transferring of trash done by one of the employees and has been reinstructed as to proper disposal. He emphasized that West Covina Disposal is receptive'to complaints,,as 'theycareas.:-eagercto_.rectify-problems_as, the citizens.are. He was also aware of Mr. Fellis' plight in storing his containers and West Covina Disposal is willing to go to his home to.:work out a solution. ENVIRONMENTAL SERVICES WEST COVINA DISPOSAL INSURANCE Council reviewed the staff report. Councilmember Herfert repeated his need for more information about any cost savings before voting to approve the request. West Covina Disposal.'._General Manager Chiapetta responded. Councilmember Wong expressed West Covina Disposal concern about the number of "hoops" Council was requiring Insurance West Covina Disposal to jump through and asked if the_ -City imposed insurance rate requirements onother contractors. Engineer Thomas responded that public works contractors .did not have this requirement. Mayor Pro Tem Jennings expressed reluctance with the City Council requesting information to see West Covina Disposal's insurance premiums. Further discussion ensued. Mdtion by.Wong, seconded by Herfert, and unanimously carried to receive and file the informational report, -and staff to obtain the premium amount.that West Covina Dis- posal has been paying and the premium amount that they will be paying. COMMUNITY DEVELOPMENT SERVICES REDEVELOPMENT AGENCY Mayor Pro Tem Jennings recessed the City Council meeting at 8:56 pm to convene the Redevelopment Agency. The City Council reconvened at 9:00 pm. HUMAN SERVICES SHUTTLE SERVICE TO THE METROLINK STATION IN BALDWIN PARK Council reviewed the staff report. Motion by Herfert, seconded by Wong, and unanimously carried to a) amend the contract with DAVE Transporation Shuttle Service to Services, Inc. to reflect the added service; and b) Metrolink station authorize the additional appropriation of $19,000 to the West Covina Shuttle program. City Attorney Hanna stated there would not be a need for a closed session. • CITY MANANGER 1) NOMINATION FOR THE BOARD OF THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY City Manager Starbird elaborated on the staff report. - 5 - • • • CITY COUNCIL MINUTES December 1, 1992 Page Six Motion by Herfert, seconded by Wong, and unanimously carried to nominate Councilmember McFadden to represent cities without water rights for the upcoming election to the San Gabriel Basin Water Quality Authority Board, and to waive further reading and adopt the following reso- lution: Resolution 8902 - RESOLUTION NO. 8902 - A RESOLUTION OF THE CITY McFadden nominated COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, NOMINATING for position COUNCILMEMBER BRAD MC FADDEN AS A CANDIDATE TO FILL THE BOARD SEAT DESIGNATED FOR CITIES WITHOUT WATER PUMPING RIGHTS FOR THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY CONTRACT WITH THE LAW FIRM OF BURKE, WILLIAMS AND SORENSEN (COLIN LENNARD) FOR LEGAL SERVICES Burke, Williams & Council reviewed the staff report. Sorensenacontract Motion by Herfert, seconded by Wong, and unanimously carried to authorize the Mayor to execute the contract for legal services with the firm of Burke, Williams & Sorensen as outlined in the staff report. APPROVAL OF DEMANDS Motion by Jennings, seconded by Wong to approve Demands totaling $2,088,259.74 as listed on check registers FI 136163 through 136435, except for Check No. 136295 (SCE bill) in the amount of $3,964.93 and Check No. 136313 (SCE bill) in the amount of $90,433.04. Councilmember Herfert must abstain from voting on SCE bills due to con- flict of interest. Without a quorum these two bills cannot be considered by Council. The motion carried by roll call vote: AYES: Herfert, Wong, Jennings NOES: None ABSENT: McFadden, Manners ORAL COMMUNICATIONS Iris Delameter, 1212 Eckerman, requested information as to why West Covina Disposal's insurance carrier require - Iris Delameter ment was not clarified during franchise negotiations. Bill Singleton, 253 N. Leland, commented on a freeway accident which caused the demolition of a section of soundwall near Butterfield Avenue, and requested the Bill Singleton City's assistance in restoring the wall. MAYOR'S REPORTS Motion by Herfert, seconded by Wong, and unanimously carried to approve".Resolutions of Commendation and City tiles for Jim Gurr and Morris Wolff.
