04-21-1992 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING WEST COVINA CITY COUNCIL April 21, 1992 • The regular meeting of the West Covina City Council was called to order by Mayor Jennings at 7:30 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The invocation was given by Rev. Burt All of United Methodist Church and the Pledge of Allegiance was led by Mayor'Pro Tem Herfert. ROLL CALL Jennings, Herfert, Manners, McFadden Others Present: Starbird, Wylie,.Thomas, Hanna, Miller, Koniarsky, Brown, Orr, Holmes, Virata, Haley, Gardner, Keating, Morris, Berry PRESENTATIONS Mayor Jennings proclaimed the following: APRIL POOL'S DAY - April 25, 1992 NATIONAL YOUTH SERVICES DAY - April 28, 1992 " 'HEARING TIME EXTENSION - INTERIM ORDINANCE NO. 1893 - RELATING TO'HISTORICAL 'BTILDINGS The proposed extension of the interim ordinance would extend Time Extension - the measure, currently due to expire on May 1,:1992--tb historical buildings March 7, 1993. City Clerk Berry verified the affidavit of publication. Mayor Jennings opened the hearing and the staff report was presented by Planning Director Haley. Public Testimony Mayor Jennings opened the public testimony portion of the In Favor hearing and asked for comments favoring the matter. City Clerk presented: ORDINANCE NO. 1899 - AN ORDINANCE OF THE CITY COUNCIL Ordinance 1899 - OF THE CITY OF WEST COVINA, CALIFORNIA, EXTENDING ORDINANCE historical buildings NO. 1893 PURSUANT TO SECTION 65858(a) OF THE CALIFORNIA GOVERNMENT CODE Motion by Herfert, seconded by McFadden, and unanimously carried to waive further reading of the ordinance and adopt. HEARING INTERIM ORDINANCE EXTENSION - BANNERS AND FLAGS FOR APARTMENTS The proposed interim urgency ordinance extension will allow Banners & flags for for the temporary use of banners, flags and pennants per - apartments taining to the lease or rental of units in multiple -family zones until March 7, 1993, pursuant to state law. City Clerk Berry verified the affidavit of publication and mailing. City Clerk Berry stated a letter had been received in opposition to the time extension. It was received from Bruce and Lee Rosengren, Managers of the Villa de Rosa Apartments. No oral comments in opposition were received and Mayor Jennings closed the public portion of the hearing. CONSENT CALENDAR Written Communications (none received) Commission Summary of Actions (receive & file) Planning Commission 4/13/92 Senior Citizens Commission 4/9/92 Claims for Action (deny and notify claimant): Virginia Steffen filed a claim on December 20, 1991, for personal injuries and property damages. The amount of claim was not known at time of presentation. Bruce and Lorraine Wild filed a claim on March 4, 1992 for property damage amounting to $1,391.10. Miscellaneous Public Works a)- Street Sweeping- Contract Renewal Citywide Street Sweeping - Recommendation is to grant renewal of the Community Community Disposal Co: Disposal Company contract for the coming twelve-month --e--?-period at a 3.1% increase based upon the change in the CPI. Contract would increase from $190,142.85 to $196,137.28. b) SP'92119 - Street Rehabilitation (Phase I) Recommendation is to hold over the award of this project until the next regular Council meeting of May 5, 1992, c) Construction Activity Report Recommendation is to receive and file. d) Revising the Water Conservation Plan from Mandatory to Voluntary': (adopt resolution) Resolution8811 - RESOLUTION NO. 8811 - A RESOLUTION OF THE CITY COUNCIL Voluntary water conser- OF THE CITY OF WEST COVINA, FINDING THAT THE PHASE I vation plan SHORTAGE OF THE CITY'S WATER CONSERVATION ORDINANCE IS NO LONGER IN FORCE AS OF APRIL 1, 1992 AND RESCINDING RESOLUTION NO. 8629 - 2 - CITY COUNCIL MINUTES April 21, 1992 Pg. 3 6) Transportation Development Act - Article 3, Regional Allocation of Funds for Walnut Creek Bikeway Project TDA - return of funds Recommendation is to authorize staff to return to the to LACTC Los Angeles Transportation Commission an amount of • $149,628.00 because the projected was abandoned in 11/90. Ordinance for Adoption (waive reading and adopt) Ordinance 1901 - ORDINANCE NO. 1901 - AN ORDINANCE OF THE CITY COUNCIL OFTTHE Zone Change 641 CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP (Zone Change No. 641) Award of Bid Purchase of Special Enforcement Team (S.E.T':) Replacement Vehicles . One Police vehicle - Recommendation is to a) find that it would be impractical, Ed Butts Ford uneconomical and wasteful to initiate a formal bid process; and b) authorize the Police Chief to purchase one unmarked vehicle from Ed Butts Ford, La Punete, through Asset For- feiture Funds, at a price not to exceed $14,072.50, including all taxes and fees. SP 92120 - Motion by Manners, seconded by Herfert, and unani- Plans & specs approved mously carried to a) -establish SP 92120, and b) approve plans and specifications for SP 52120 and authorize the City Engineer to call for bids. COMMUNITY SERVICES DIVISION OFFICE OF COMMUNITY SERVICES -:1)--ERASE GRAFFITI PROGRAM Council reviewed the staff report and Community Services Adopt -A -Wall program Division Manager Miller commented further. Motion by Manners, seconded by Herfert, and unani- mously carried to approve the City of West Covina Erase Graffiti - Volunteer Adopt -A -Wall Program as presented. SAFETY DIVISION No items scheduled for this meeting. • REDEVELOPMENTAGENCY L Mayor Jennings recessed the City Council meeting at 8:04 pm to convene the Redevelopment Agency meeting. Motion carried by roll call vote: AYES: Herfert, Manners, McFadden, Jennings NOES: None • ABSTAIN: Herfert re SCE billing ELECTION MATTERS 1) CERTIFICATE OF CANVASS-'4/14/92'.GENERAL-.MUNICIPAL'.ELECTION Council reviewed the staff report. City Clerk presented: Resolution 8812 - RESOLUTION NO. 8812 - A RESOLUTION OF THE CITY 4/14/92 results COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD APRIL 14, 1992 DECLARING THE RESULTS AND OTHER SUCH MATTERS AS PROVIDED BY LAW Motion by Manners, seconded by Herfert, and unani- mously carried to waive further reading of the resolution and adopt. 2) OATHS OF OFFICE Judge Michael Rutberg administered the Oath of Office to reelected City Clerk Janet Berry.and presented her with the Certificate of Election. Judge Rutberg then administered the Oath of Office for reelected Councilmember Nancy Manners and Councilmember Bradley McFadden and newly elected Councilmember Benjamin Wong. Each received their Certificate of Election. 3) REORGANIZATION OF COUNCIL City Clerk Berry conducted the election of mayor. Mayor Jennings nominated Councilmember Manners.:.^There being no other nominations, the nominations were closed. Nancy Manners elected - Motion by Jennings, seconded by Wong,to elect Council - Mayor of West Covina member Manners as Mayor of Wesi7Covina. The motion carried with McFadden and Herfert voting no. City Clerk Berry turned the meeting over to Mayor Manners.to conduct the election of mayor pro tem. Council - member Wong nominated Councilmember Jennings•__TherQ-- being no other nominations, the nominations were closed. Motion by Wong, seconded by Manners to elect Council - Richard Jennings elected - member Jennings as Mayor Pro Tem of West Covina. The Mayor Pro Tem motion carried with McFadden and Herfert voting no. Designation of Alternate to Los Angeles County Sanitation District Board Mayor Manners stated that the Mayor is automatically the voting delegate to the Sanitation Board. She asked for Council's concurrence in appointing Mayor Pro Tem Jennings as the alternate. Council concurred. 4) COUNCIL COMMENTS Mayor Manners thanked her committee members and the citizens for her reelection. Councilmember McFadden pledged his efforts to represent the resident taxpayers . of West Covina. Councilmember Wong thanked his committee members and supporters, and discussed the campaign pro- cess. - 4 - • • CITY COUNCIL MINUTES April 21, 1992 Pg. 5 5) PRESENTATION OF PLAQUE TO OUTGOING MAYOR BY NEWLY ELECTED MAYOR Mayor Manners presented a plaque to immediate past Mayor Richard Jennings. He expressed pleasure in serving the citizens this past year as Mayor of West Covina. Councilmember Herfert commented on the goals he set two years ago and his accomplishments thus far on the Council. He presented the list to the City Clerk for availability -.to the citizenry. Mayor Manners spoke about the issues of the upcoming year., that Council would be working on to help bring the community together: the school district, the historical society, cultural diversity. --just some -of. the items facing the City. ORAL COMMUNICATIONS Rita•Heieck-,:-president of West Covina Beautiful, extended her congratulations to the Council, and reminded the audience of the upcoming Clean -Up, Paint -Up, Fix -Up Week scheduled Rita Heieck for the first week in May. Katherine Castucci, 430 S. Pima, expressed her appreciation for Council's commitment towards community participation and the positive attitude conveyed by the Councilmembers Katherine Castucci for the upcoming year; - William Ketteringham of the Waste Management and Environ- mental Quality Commission noted Earth Day would be celebrated William Ketteringham in the Courtyard on Saturday beginning at 10:00 am. Daniel Robinson, 3315 E. Virginia Avenue, extended his con- gratulations to the Council and urged them to work as a Daniel Robinson unit, rather than working is,'individuals. City Manager Jim Starbird spoke on behalf of the employees in extending congratulations to the new Council. MAYOR'S REPORTS No additional comments. COUNCILMEMBERS' REPORTS Councilmember Wong -commented that it was his belief that Council could work together and noted that more can be done by holding hands than pointing fingers.
