03-03-1992 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING WEST COVINA CITY COUNCIL March 3, 1992 • The regular meeting of the West Covina City Council was called to order by Mayor Jennings at 7:37 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The Invocation was given by Mayor Jennings and the Pledge of Allegiance was led by Girl -Scout Troop No. 418. ROLL CALL Others Present: APPROVAL OF MINUTES Jennings, Herfert, Manners, McFadden Starbird, Wylie, Thomas, Miller, Orr, Manheim; Wolff, Hanna, McKenna, Salazar, Bonaparte, Lennard, Haley, Berry Motion by Herfert, seconded by McFadden, and unanimously carried to approve the following minutes: Special meeting of.January 29, 1992 Adjourned regular meeting of February 8, 1992 Adjourned regular meeting of February 13, 1992 Adjourned regular meeting of February 20, 1992 Note: 2/8/92 adjournment time was 12:29 am, not 12:29 pm. — PRESENTATIONS Beverly Carter, Chair of the Administrative Board for WINGS, presented the CityrCouncil with a thank you WINGS plaque for the City's support. Mayor Jennings presented Wayne Loar a Resolution of. Com- mendation for twenty-two years of service in the Main- Wayne Loar tenance Department. Mayor Jennings -presented a Resolution of Commendation to Jeremy Hammond, a student from West Covina High School, for his'.achieveinent as the reigning 1991 Senior Menns Jeremy Hammond National Baton Twirling Champion. Mayor Jennings presented Girl Scout Troop No. 418 with the proclamation proclaiming March 8 through March 14 Girl Scout Week as GIRL SCOUT WEEK. Mayor -:Jennings presented Michella Ott with the proclama- tion proclaiming the month of March as L.A. MEANS L.A. Means Business Month BUSINESS MONTH. Mayor Jennings presented the ARBOR DAY (March 15, 1992) proclamation to Tina Daniels -and Rita Heieck, both of Arbor Day West Covina Beautiful. Police Chief Holmes reported on the recent gang_related shooting at the Plaza at West Covina and the suspects Police Chief Holmes have been apprehended. " HEARINGS APPEAL OF A PLANNING COMMISSION DECISION - SHOE 'CITY ='SIGN ADJUSTMENT NO. 1 This matter was continued until March 3, 1992, and the Shoe'City - continued staff recommendation is to again continue until April • until April 7, 1992 7, 1992, per request of appellant. Motion by Manners, seconded by Herfert, and unani- mously carried to continue this matter until April 7, 1992. - 1 - CITY COUNCIL MINUTES March 3, 1992 Page 2 RECEIPT OF INFORMATION CONCERNING IMPASSE BETWEEN THE CITY AND SERVICE EMPLOYEES INTERNATIONAL UNION (SEIU), LOCAL 347 • Impasse Hearing re Mayor Jennings opened the matter by explaining that SEIU SEIU (Maintenance employees of the City) have declared an impasse'.in the negotiations with the City. He stated that the Union's letter has been placed in the record. City Manager Starbird explained the procedures for the impasse hearing, referring tb Section 2-222 of the Municipal Code. David Trowbridge, SEIU's representative, presented the Maintenance workers' position. City Manager Starbird presented the City Management's position, noting that the impasse is not reflective of management's high opinion of the Maintenance Department and its employees. Louis Gilbert suggested mediation. Pursuant to Government Code Section 54957.6 (personnel Closed Session matters) and Section 54957.9(b) (litigation matters), Mayor Jennings recessed the City Council at 8:30 pm for the purpose of a closed session. Council -reconvened at 9:22 pm. Council commented that the economic situation speaks for itself when it comes to the cons ideiation.of increasing wage§±And benefits-. Councilmember McFadden noted that there is justanot enough -revenue coming into -the City. Mayor Jennings noted that the City's last offer to SEIU is consistent with Council's actions towards the other labor unions. Motion by Herfert, seconded by McFadden to direct staff to bring back to Council appropriatendocumentation to implement the City's final offer of a unilateral base.of 3% effective February 1, 1992. Motion carried by roll call vote: AYES: Herfert, Manners, McFadden, Jennings NOES: None AGENDA AND ORAL COMMUNICATIONS Olegario Cantos, National Field Representative of the National Federation of the. Blind, addressed Item E-2a, Audible pedestrian signals. The staff report disagreed with his letter recommending that the audible signals Olegario Cantos be removed and he presented his case verbally. Xavier Hermosillo, 1930 Shamwood Street, offered opinions Xavier Hermosillo about several agenda items. Louis Gilbert, 428 S. Fernwood, encouraged Council to seek continuation of the City of West Covina Lead Enforcement Agency in the matters concerning the BKK Louis Gilbert Landfill. Royal Brown, 2153 Aroma Drive, complained that materials were not available for review until today (those regarding Notice of Violations at BKK Landfill and the Engineer's Royal Brown Report regarding the 12/29/91 storm water and mud runoff). • He felt the violations have been an ongoing problem and the penalties should be appropriately high. - 2 - • CITY COUNCIL MINUTES March 3, 1992 Page 3 Iris Delameter, 1212 W. Eckerman, asked for clarification Iris Delameter regarding several items.and commented on several others. Sandy Bellville, Woodside Village Apartments Manager, didnut agree with response time as reported in the Police Sandy Bellville Chief's Annual Report (G-1a) and suggested soliciting money from BKK to help gang abatement . A representative from Guarantee Management Property spoke in favor of N-2, temporary use of flags and banners to Gaurantee Mngt. Property attract renters for apartment complexes. Motion by Herfert, seconded by McFadden, and unanimously carried to have the automated trash pickup back to Council in thirty days. 2) LOCAL ENFORCEMENT AGENCY Assistant City Attorney Lennard elaborated on the staff re report. City as LEA Motion by Manners, seconded by Herfert, and unani- mously carried to a) direct a response to the Los Angeles County Department of Health Services declining their offer, -to act as.the City's LEA and b) authorize staff to continue City's role as LEA and -.to prepare an appli- cation to redesignate the City as the Local Enforcement Agency as required by State law. 3) AMENDMENT TO AGREEMENT FOR CONSULTING SERVICES BETWEEN THE CITY OF WEST COVINA AND 'BROWN; VENCE &ASSOCIATES Council reviewed the staff report and discussed the Brown, Vence & Associates appropriation request. Agreement amendment Motion by Herfert, seconded by McFadden, and unani- mously carried to a) appropriate $8,000.00 from unapprop- riated General Fund reserves to Account 2313-6120 for funding and b) approve the amendment to the Brown, Vence & Associates Agreement adding to the scope of work at.a total cost not to exceed $20,000 for the total contract. 4) REPORT OF MUD WATER FLOW INCIDENT OF 12/29/91 Mud Water Flow Incident Council reviewed the staff report. of 12/29/91 Motion by Manners, seconded by Herfert, and unani- mously carried to receive and file the informational report. HUMAN.:SERVICES DEPARTMENT 1) 'AUDIBLE PEDESTRIAN SIGNALS Council reviewed the staff report. Ms. Candy Coker Staff was directed to provide blueprints. Iris Delameter, 1212 Eckerman, expressed concern for her Iris Delameter safety at the mall. Xavier Hermosillo, 1930 Shamwood Street, felt gang issues were not being addressed by the City Council. He also Xavier Hermosillo requested USA Waste be agendized for the next meeting.
