10-01-1991 - Regular Meeting - MinutesM I N U T E S ADJOURNED REGULAR MEETING WEST COVINA CITY COUNCIL October 1, 1991 The adjourned regular meeting of the West Covina City Council was called to order at 7:30 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina, by Mayor Jennings. The Pledge.of Allegiance was led by Councilmember McFadden. ROLL CALL Mayor Jennings, Mayor Pro Tem Herfert, Councilmembers Manners, McFadden, Tarozzi Others Present: Starbird, Wylie, Miller, Thomas, Hanna, Koniarsky, Panas, Holler, Perkins HEARING South Hills Community Facilities District Mayor Jennings explained that the purpose of the meeting was to receive a report on the Community Facilities District No. 91-1, conduct a public hearing regarding the proposed change in the rate and method of apportioning special taxes for the • Community Facilities District and consider the holding and certification of an election by the property owners regarding the formation of the special district. Deputy City Clerk Perkins verified the affidavit of publication. Mayor Jennings opened the hearing. City Manager Starbird and Operational Services Division Manager Thomas gave the staff report. The City Manager shared some of the issues that had been raised in recent press articles. The City Manager then introduced Keenan Rice of David Taussig &.Associates. Mr. Rice gave an overview of the change in the rate and method of apportionment and answered Council questions. City Manager Starbird then introduced the other members of the City's Consultant Team, John Murphy of Stradling, Yocca, Carlson and Rauth; • Bill Marticorena of Rutan and Tucker; and Bill Fieldman of Fieldman, Rolapp and Associates. Public Testimony Mayor Jennings opened the hearing for public testimony and asked for comments favoring the matter. The following addressed Council: In Favor: Lou Feldman Lou Feldman, Counsel for Developer thanked the Council and staff for their • cooperation on this project. Mayor Jennings asked for comments opposing the matter. The following addressed Council: In Opposition: Robert Reich Robert Reich, 2135 E. Vine Avenue . questioned the legality of this Mello -Roos project,. questioned the actual costs vs. estimated costs of the project, and questioned the grading of the hills and the cost of issuance of the bonds. Rebuttal: Lou Feldman stated that in his view this project would not be able to go forward without the Mello -Roos funding. He also stated as far as the legality was concerned, four law firms have agreed that this is legal. CITY COUNCIL MINUTES OCTOBER 1, 1991 PAGE TWO Public Testimony Closed City Manager Starbird asked Special Counsel John Murphy to respond to the legality questions and City Engineer Thomas to respond to the grading questions. The City Manager also asked Keenan Rice to respond to the question of Mello -Roos vs. Conventional Financing. Mayor Jennings closed the public testimony portion of the hearing. RECESS Mayor Jennings called a recess at 9:15 p.m. The Council reconvened at 9:30 p.m. with all members present. Council Discussion Mayor Jennings commenced Council discussion on the issue. All of the Councilmembers stated that they are generally in favor of the project with the exception of Mayor Jennings. Mayor Jennings asked Deputy City Clerk Perkins if any written protest had been received and she verified that none had been received. Mayor Jennings then called for the reading of the resolution heading: • Resolution 8742 - RESOLUTION NO. 8742 - A RESOLUTION OF THE CFD 91-1 Election CITY COUNCIL OF THE CITY OF WEST COVINA ACTING AS THE LEGISLATIVE BODY OF COMMUNITY FACILITIES DISTRICT NO. 91-1 OF THE CITY OF WEST COVINA (SOUTH HILLS) CALLING AN ELECTION REGARDING CHANGES TO THE RATE AND METHOD OF APPORTIONMENT OF THE SPECIAL TAX TO BE LEVIED WITHIN COMMUNITY FACILITIES DISTRICT NO.'91-1 OF THE CITY OF WEST COVINA (SOUTH HILLS). Motion by Tarozzi, seconded by Herfert, and carried by the following vote: AYES: Herfert, Manners, McFadden, Tarozzi NOES: Jennings RECESS A recess was called for the purpose of conducting the election. Verification of Election Mayor Jennings asked for verification that the election had been held. Deputy City Clerk • Perkins presented to the Council the election results: AYES: 291, NOES: 0. Mayor Jennings asked Deputy City Clerk Perkins to read the heading of the resolution certifying the election results: Resolution No. 8743 RESOLUTION NO. 8743 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA ACTING IN ITS CAPACITY AS THE LEGISLATIVE BODY OF COMMUNITY FACILITIES DISTRICT NO. 91-1 OF THE • CITY OF WEST COVINA (SOUTH HILLS) DECLARING THE RESULTS OF A SPECIAL BOND AND SPECIAL TAX ELECTION. Motion by Herfert, seconded by Tarozzi, and carried by the following vote•: AYES: Herfert, Manners, McFadden, Manners NOES: Jennings ORAL COMMUNICATIONS Ziad Alhassen thanked the City Council and staff Ziad Alhassen for their work and time spent on this project.
