05-29-1990 - Regular Meeting - MinutesM I N U T E S WEST COVINA CITY COUNCIL REGULAR MEETING May 29, 1990 • The regular meeting of the West Covina City Council was called to order by Mayor Tarozzi at 7:35 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The Pledge of Allegiance was led by Councilmember Manners and the invocation was given by Syd Friested of West Covina Assembly of God. ROLL CALL Mayor Tarozzi, Mayor Pro Tem McFadden, Councilmembers Herfert, Jennings, Manners Others Present: Fast, Wylie, Miller, Keating, Thomas, D6iderichs, Holler, Holmes, Hanna, Eliot, Panas, Koniarksy, Haley, Berry APPROVAL OF MINUTES PRESENTATIONS HEARINGS Regarding the minutes of May 14, 1990, page three incor- rectly referenced Mayor Bacon instead of Mayor Tarozzi, and on page five the minutes should read that Herfert suggested the six-inch caliper, rather than McFadden. Motion by Manners, seconded by Herfert, and unani- mously carried to approve the minutes of April 16, May'7, and May 14, as corrected. Mayor Tarozzi proclaimed June 4 - 8, 1990 as MANAGEMENT WEEK, presenting the proclamation to the local repre- sentative from MMA, Ron Burlson. Mayor Tarozzi presented a Mayor's Commendation to Alvaro Garcia, Jr., and Lisa Delfin, both students were recipients of the Silver Congressional Award. Mayor Tarozzi presented a resolution of commendation to Pete Reynolds, Covina's Citizen of the Year and an out- standing member of the West Covina community. No hearings scheduled for this evening. AGENDA COMMUNICATIONS Louis Fine, 1210 S. Robin Road, opposed automated refuse Louis Fine pickup but supported recycling (Agenda Item E-lc). Royal Brown, 2153 Aroma Drive, opposed mandated automated refuse pickup (Item E-lc), opposed financial incentives for carpooling employees (Item E-lb), and requested infor- mation regarding cross -connection control program Royal Brown required of water purveyors (Item C-6c). Hywanna Berkow, 2245 E. Walnut Creek Parkway, spoke in support of her request to the Traffic Committee for a multi -way stop sign at Hollenbeck and Walnut Creek Park- Hywanna Berkow way (Item C-7 VIII). • Albert Foster, 1232 Farlington, supported the Traffic Committee's recommendation for a left -turn pocket on Albert Foster Francisquito adjacent to the Faith Lutheran Church. Iris Delameter, 1212 W. Eckerman, opposed incentives to employees carpooling (Item E-lb), opposed automated trash pickup (Item E716), and questioned the language of the resolution specifying the City's monthly flexible spending Iris Delameter amount (Item F-2). - 1 - CITY COUNCIL MINUTES May 29, 1990 Page Two Gloria Sullivan, 3298 E. Holt, objected to the EIR adopted by Council last year regarding the Poss project. Mayor Tarozzi asked her to leave a copy of her material • Gloria Sullivan with the City Clerk for him.. Annette Lyford, 3106 Los Cerillos Drive, opposed the Annette Lyford Poss project when it was approved by Council. Councilmember Manners noted that a very extensive public hearing was conducted on the Poss project two years ago. There was a lot of interaction between.the developer and the adjacent neighborhood.citizens which led to a project that gained the concurrence. of almost every person surrounding the project area. On March 30, 1990 a claim for property damage amounting to $170.00 was received by the City Clerk's Office from Shirley York, Temporary Use Permits (receive and file) TUP #1944-90 was issued to West Covina Toyota, 821 S. Glendora, for balloons on 5/19 - 5/20. TUP #1945-90 was issued to Best Products, 501 S. Vincent, for a sidewalk sale on 5/26 - 5/28. Acceptance of Improvements and/or Release of Bonds Mission Car Wash Mission Car Wash - Water System Improvements Location: 748 N. Nogales in Walnut. Recommendation is to accept water system improvements and release cash deposit of $12,000. Motion carried by roll call vote: AYES: Herfert, Jennings, Manners, McFadden, Tarozzi NOES: None Council commented on the items removed for separate discussion. Regarding Item 7(VIII), staff was directed to conduct an additional traffic count at the intersection of Hollenbeck and Walnut Creek Parkway. Discussion regarding temporary signs for larger buildings (ordinance proposed for adoption) led to the following motion: Temporary Signs ordinance Motion by Herfert, seconded by Manners, and unani- mously carried to amend the ordinance to reflect a two year maximum time limit for displaying temporary signs with the ability to apply to the Planning Commission for another two-year period. Recess Mayor Tarozzi recessed the City Council meeting at 9:13 pm to provide time for the City Attorney to rework the ordinance language to incorporate the motion. Council reconvened at 9:23 pm with all members present. • City Attorney presented Ordinance 1847 as amended. Ordinance 1847 Motion by Manners, seconded by Herfert, and unani- reintroduced, as amended mously carried to waive further reading of the ordinance. Motion by Manners, seconded by Herfert, and unanimously carried to reintroduce the ordinance, as amended. Finance Director Koniarsky introduced the representative from Ask Mr. Foster/Morgan Travel to clarify the proposed agreement for City travel services. - 4 - CITY COUNCIL MINUTES May 29, 1990 Page Five Motion by Herfert, seconded by Manners to approve the remaining items of the Consent Calendar. Motion carried by the following roll call vote: • AYES: Herfert,.Jennings, Manners, McFadden, Tarozzi NOES: None However, Councilmember Manners voted no in relation to the adoption of.the ordinance implementing a senior citizens commission (Ordinance Not 1846)-. - +. PUBLIC WORKS DIVISION LANDSCAPE MAINTENANCE DISTRICT 7 - RATE STABILIZATION FUND Council reviewed the staff report. Motion by Jennings, seconded by Manners, and unani- Rate Stabilization fund mously carried to a) establish a Rate Stabilization Fund (Land. Main. Dist. 7) for Landscape Maintenance District No. 7, and b) transfer $56,000 from general fund contingency to Land. Main. District No. 7 Contingency and Reserve Fund. COMMUNITY SERVICES DIVISION 1) COMMERCIAL RECYCLING Council reviewed the staff report. Motion by Manners, seconded by McFadden to Commercial Recycling approve the recommendation,for discussion purposes. Council comments did not support implementing two different requirements and time frames: one for existing businesses and one for new businesses. The vote on the motion was as follows: • AYES: McFadden NOES: Jennings, Manners, Herfert, Tarozzi 2) COMMUTE MANAGEMENT PLAN Council reviewed the staff report and discussed various points of concern. Council was not supportive of any of the four options, particularly reimbursing employees for carpooling.at a cost of $56,000. Councilmember Manners was supportive of flexible Commute Management Plan hours, but not incorporating benefit negotiations into the meet and confer process. Councilmember Herfert favored an internal reward system, using little or no general fund monies. Councilmember Jennings suggested merging with other large businesses to come up with a joint effort. Mayor Tarozzi requested Council to phone in their suggestions to Community Services Director Miller. Motion by Tarozzi, seconded by Manners, and unanimously carried to refer the plan back to staff for alternate solutions, 3) AUTOMATED REFUSE SERVICE AND CURBSIDE RECYCLING Council reviewed the staff report. • Councilmember Manners favored unlimited pickup, start with a recycling program, and implement an Automated Refuse Service automated service later.in phases. Mayor Tarozzi noted:there were three companies offering different types of, services that he-,cJould lookinto,and ,pass along to staff. Careship Program Motion by Herfert, seconded by Jennings, and unanimously carried to receive and file the report and request the Human Resources Commission to comment. OPERATIONAL SERVICES DIVISION FINANCE DEPARTMENT 1) AUDIT CONTRACT Council reviewed the.staff report. Motion by Manners, seconded by Jennings, and Audit Contract with unanimously carried to authorize the Finance Director McGladrey and Pullen to extend the agreement with McGladrey and Pullen to perform annual audits of. City, Agency, and Authorities' records for the fiscal year ending June 30, 1990, for a sum not to exceed $66,000. Resolution 8515 - Flexible Spending Amount PUBLIC SAFETY DIVISION FISCAL SERVICES DIVISION REDEVELOPMENT AGENCY • WEST COVINA COMMUNITY INFORMATION INC, PERSONNEL SERVICES 1) RESOLUTION SPECIFYING THE CITY'S MONTHLY FLEXIBLE SPENDING AMOUNT Council reviewed the staff report. Mayor'Pro Tem McFadden requested financial amounts to be included in the Agenda summary. City Attorney presented: RESOLUTION NO. 8515 - A RESOLUTION OF THE CITY COUNCILOFTHE CITY OF WEST COVINA, CALIFORNIA, AUTHORIZING THE INCREASES IN THE CITY'S CONTRIBUTIO TO THE MONTHLY FLEXIBLE BENEFIT AMOUNT Motion by Jennings, seconded by Herfert, and unanimously carried to waive further reading of the resolution and adopt. FIRE DEPARTMENT 1) ANTIQUE FIRE TRUCK City Manager Fast withdrew this item from the Agenda explaining that the City's policy is to loan out the fire truck to nonprofit organizations, and the request from Warner Brothers Productions doesn't qualify. Council -concurred: No items scheduled for this meeting. Mayor Tarozzi recessed the City Council meeting at 11:05pm to convene the Redevelopment Agency meeting. The Council was called back to order at 11:18 pm to convene the annual meeting of the West Covina Community Information, Inc. The City Council was reconvened at 11:20 pm with all members present. CITY COUNCIL MINUTES May 29, 1990 Page Seven CITY MANAGER 1) APPOINTMENT OF REPRESENTATIVE TO INDEPENDENT CITIES RISK MANAGEMENT AUTHORITY (I.C.R.M.A.) Council reviewed the staff report. • City Attorney presented: RESOLUTION NO. 8516 - A RESOLUTION OF THE CITY Resolution 8516 - COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, I.C.R.M.A. TO APPOINT SPECIFIC REPRESENTATIVES TO THE INDE- PENDENT CITIES RISK MANAGEMENT AUTHORITY Motion by Manners, seconded by Herfert, and unanimously carried to waive further reading of the resolution and to adopt. 2 ) AMENDMENT TO JOINT POWERS AGREEMENT - SAN GABRIEL VALLEY CONSORTIUM Council reviewed the staff report. JPA Amendment re San Gabriel Motion by Herfert, seconded by McFadden, and Valley Consortium unanimously carried to approve Amendment No. 2 to the JPA and direct the Mayor and City Clerk to execute the amendment. 3) LEGISLATION Council reviewed the staff report. Motion by Manners, seconded by Jennings, and unani- Legislation mously carried to support AB 1820. Motion by Manners, seconded by Herfert to support SCA 50. Motion carried with McFadden voting no. • APPROVAL OF DEMANDS Motion by McFadden, seconded by Manners to approve Demands totaling $1,857,346.20 as listed on check registers FI 116317 through 116753. Motion carried by roll call vote: AYES: Herfert, Jennings, Manners, McFadden, Tarozzi NOES: None ORAL COMMUNICATIONS Iris Delameter, 1212 W. Eckerman, complained that the McIntyre property on Sunset was not cleaned up often enought,'and the Tonopah site was in poor condition. She also would like the ability'to obtain a full Council packet from the City Clerk's Office, for a fee Iris Delameter if need be. MAYOR'S REPORTS Motion by Manners, seconded by McFadden, and unanimously carried to approve a resolution of commendation for Sherwin Elkins, a retiring Fire Department employee, Resolutions of Commendation and for St. Chritopher's Emergency Preparedness Program. Mayor Tarozzi proclaimed the following: NATIONAL FOSTER CARE MONTH (May) CHILD PASSENGER SAFETY WEEK (6/2 - 6/10) • Relocation Appeal Board Appointments Mayor Tarozzi suggested David Solinger, Katherine Appointees to Relocation Castucci, Bob Levy, Bill Fowler. Councilmember Herfert Appeals Board suggested Iris Delameter.as'the fifth member. Motion by Jennings, seconded by Herfert, and unani- mously carried to approve the five appointees and John Drake as an alternate. - 7 - COUNCIL MINUTES May 29, 1990 Page Eight COUNCILMEBERS' REPORTS Citywide Mailings During Election Periods Councilmember Herfert suggested prohibiting the Citywide mailings dissemination of citywide mailings during the time prior to the municipal elections, perhaps 60 days. Councilmember Manners felt Herfert's objectives could be attained by instructing staff to use more sensitivity in the articles that are included in the mailings, rather than implementing a ban on the dis- semination of all citywide informational mailers. Councilmember Herfert requested cost figures for the "Economic Directions". Motion by Tarozzi, seconded by Herfert to prohibit the dissemination of official city mailings -,City news- letter "West Covina Today," and "Directions" for a period of 90 days prior to a municipal election. Motion carried by the following vote: AYES: Herfert, McFadden, Tarozzi NOES: Jennings, Manners Manners Councilmember Manners related an article regarding La Puente's drug problem and asked for information about a possible intercity coalition or task force. She also spoke of possible areas the new Senior Citizens Commission address, including an outreach pro- gram for shut-ins and visitations to convalescent homes. He also suggested the idea of a community parade. Councilmember Herfert noted the subject of community projects such as garden, parades, etc., will come before Council at a future date. Mayor Tarozzi reported on'the Edgewood Middle School Eighth Grade class' project regarding recycling. Councilmember Manners reported on Students in Government Day.
