04-09-1990 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING April 9, 1990 The regular meeting of the West Covina City Council was called to order at 7:30 p.m. by Mayor Bacon in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. The Pledge of Allegiance was led by Councilmember Tarozzi and the invocation was given by Reverend Lawrence Cole of the Community Christian Center. ROLL CALL • • Others Present: APPROVAL OF MINUTES PRESENTATIONS Temporary Sign Program Mayor Bacon, Mayor Pro Tem Lewis, Councilmembers Manners, McFadden, and Tarozzi Fast, Hanna, Wylie, Eliot, Thomas, Holmes, Miller, Holler, Haley, Dunlop, Keating, O'Guinn, Johnson, Virata, Yoshizaki, Diederichs, Orr, Salazar, Fertal, Perkins Motion by Lewis, seconded by Tarozzi, and unanimously carried to approve the Minutes of the regular meeting of March 26, 1990. Mayor Bacon proclaimed April 8-14, 1990, as National Telecommunicators Week and presented the proclamation to Mary O'Guinn, Communications Supervisor for the City of West Covina. Mayor Bacon proclaimed April 22-28, 1990, as California Juniors Week and presented the proclamation to Maria Shroeder and Marilyn Driftmeier of the West Covina Jr. Women's Club. Barbara Cooke from Assemblyman Bill Lancaster's office presented Mayor Bacon with California Legislature Resolution Number 808 commending him for his many years of service to the City and the State. Temporary Sign Program (Amendment No. 227) Amendment No. 227 proposes to establish provisions for a "Temporary Sign Program" for large buildings in nonresi- dential zones. Deputy City Clerk Perkins verified the affidavit of publica- tion. Mayor Bacon opened the hearing and Planning Director Haley presented the staff report. Public Testimony Mayor Bacon opened the public testimony portion of the In Favor: hearing and asked for comments favoring the matter. Mayor Bacon commenced Council discussion. Council questions were answered by staff. City Attorney presented: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE, CHAPTER 26, AS IT RELATES TO TEMPORARY SIGNS FOR LARGER BUILDINGS IN NON RESIDENTIAL ZONES. (Amendment No. 227) Motion by Manners, seconded by Lewis, and unanimously carried to waive further reading of the ordinance and introduce. Mayor Bacon called to order the Redevelopment Agency at 8:15 p.m. to conduct the following joint public hearing. Shulman Co./ West Covina Associates. Deputy City Clerk Perkins verified the affidavit of publica- tion. Mayor Bacon opened the hearing and Redevelopment Manager Yoshizaki presented the staff report. Council concurred on Section G providing for an appraiser satisfactory to both the developer and the Assistant Executive Director of the Agency. City Attorney presented: Resolution 8481 - First RESOLUTION NO. 8481 - A RESOLUTION OF THE CITY COUNCIL OF Amendment to OPA with WEST COVINA, CALIFORNIA, APPROVING THAT CERTAIN AGREEMENT Sylvan S. Shulman Co./ ENTITLED "FIRST AMENDMENT TO OWNER PARTICIPATION AGREEMENT BY West Covina Assoc. AND BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF WEST Fashion Plaza Expansion COVINA AND SYLVAN S. SHULMAN CO./WEST COVINA ASSOCIATES" DATED APRIL 9, 1990 as amended. Motion by Manners, seconded by McFadden, and carried by • the following vote: AYES: Lewis, Manners, McFadden, Bacon NOES: Tarozzi Mayor Bacon completed the remainder of the Redevelopment Agency agenda to the end. He recessed the Redevelopment Agency at 9:30 p.m. and continued with the City Council agenda. AGENDA COMMUNICATIONS Doug Stevens, Director, Mid Valley Mental Health, requested Council to send a letter to the Los Angeles County Department of Mental Health protesting the cutting of funds for County Doug Stevens Mental Health services provided by Mid Valley. (Agenda Item No. K-2) Henry Palmer, 3436 Acridge Drive, requested the City staff to have the earthquake faults studied before allowing a 29 Henry Palmer story office building to be built. Ordinance for Adoption (Item C6) Ordinance 1840 - Oversize ORDINANCE NO. 8140 - AN ORDINANCE OF THE CITY COUNCIL OF Vehicle Parking THE CITY OF WEST COVINA, CALIFORNIA, AMENDING SECTION 22-22(a) OF THE WEST COVINA MUNICIPAL CODE RELATING TO THE REMOVAL OF VEHICLES FROM CITY STREETS. AYES: Lewis, Manners, Tarozzi, Bacon NOES: McFadden PUBLIC WORKS DIVISION Proposition 111-Traffic Congestion Relief and Spending Limitation Act of 1990; and Proposition 108-Rail Bond and Clean Air Act of 1990. City Engineer Thomas presented the staff report and a video by the League of California Cities and answered Council questions. City Attorney presented: Resolution 8486 - Support RESOLUTION NO. 8486 - A RESOLUTION OF THE CITY COUNCIL of Proposition 111 & 108 OF THE CITY OF WEST COVINA, CALIFORNIA, SUPPORTING PROPOSITION 111 AND 108 - THE TRAFFIC CONGESTION RELIEF AND LIMITATION ACT OF 1990. Motion by Tarozzi, seconded by Manners, and unanimously carried to waive further reading of the resolution. Motion by Manners, seconded by Lewis, to support Proposition 111. CITY COUNCIL MINUTES 2) Medfly Eradication Program April 9, 1990 Page Five Council reviewed the staff report. Medfly Eradication Program Recommendation is that the City Council request the Governor authorize and the State of California finance an independent examination of the use of malathion in the Medfly Eradication Program and report the results to the public in 90 days. The independent examination is to consist of medical professionals outside of all • governmental agencies and the agricultural field, excluding universities, that are qualified to examine this issue. Motion by Lewis, seconded by Tarozzi, and unanimously carried to approve. 3) Integrated Waste Management Task Force Council reviewed the staff report. Integrated Waste Management Motion by Tarozzi, seconded by Manners, and unanimously Task Force carried to receive and file this informational report. 4) County Household Hazardous Waste Roundups Council reviewed the staff report. Mayor Bacon announced the dates and locations of the four roundups scheduled throughout the county. Councilmember County Household Hazardous Lewis stated he hoped the Tribune would advertise the Waste Roundups schedule. OPERATIONAL SERVICES DIVISION Personnel Services Resolution Electing Coverage Under the Public Employees' Medical and Hospital Care Act • Council reviewed the staff report. PUBLIC SAFETY DIVISION Police Department Destruction of Obsolete Records Council reviewed the staff report. Motion by Tarozzi, seconded by McFadden, and unanimously carried to receive and file the report. FISCAL SERVICES DIVISION No items schedule for this meeting. CITY MANAGER Legislation Council reviewed the staff report. Motion by Manners, seconded by McFadden, and unanimously carried to support SB 1998 and oppose SB 1853. Mid -Valley Community Mental Health Council reviewed the staff report. Motion by Manners, seconded by McFadden, and unanimously • carried to send a letter to Los Angeles County requesting the continued use of Mid -Valley Community Mental Health in providing services to San Gabriel Valley residents. Amendment of Resolution No. 8411 City Attorney presented: RESOLUTION NO. 8488 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION NO. 8411. Motion by Tarozzi, seconded by McFadden, and unanimously carried to adopt. Proclamations Mayor Bacon proclaimed April 22-28, 1990 as Kids Fitness Week. Mayor Bacon proclaimed April 1990 as California Earthquake Preparedness Month. 1 of Resolution of Commendation for Colin Lennard Motion by Manners, seconded Resolution of Commendation carried to approve a Resolution for Colin Lennard Lennard. by McFadden, and unanimously of Commendation for Colin Mayor Bacon remarked that West Covina has good government, good level of services with fewer dollars than most other cities in Los Angeles County. The average person pays $44 per year in direct taxes to the City. He suggested the Tribune should start using 25% recycled paper. He thanked the many citizens who have appreciated his service. He also thanked the staff and Councilmember Manners for their help. He feels the new Council needs to take a hard look at what has been accomplished and what needs to be done for the future. COUNCILMEMBERS' REPORTS Approval of Resolution of Commendation and City Tile Motion by Lewis, seconded by McFadden, and unanimously Resolution of Commendation carried to approve a Resolution of Commendation and a City for Robert Bacon Tile for Mayor Robert Bacon. Councilmember Tarozzi stated his concern about a location for the West Covina Playhouse. They have been approached by another city. He hopes we can help them get a new place Tarozzi to use. Councilmember McFadden agreed with Mayor Bacon regarding the use of recycled paper by the Tribune. He also wants to see ads run on recycled paper rather than slick stock. He also commented on the need to find a home for the West Covina Playhouse, the Historical Society, and the Chamber of McFadden Commerce. Councilmember Manners commented on the "Trash 2000" Symposium sponsored by the Rose Institute she attended in Claremont. Manners She also commented on the SGVAC Rail Haul effort. Closed Session Mayor Bacon called a recess at 11:30 p.m. for the purpose of a closed session on personnel matters. Council reconvened at 11:40 p.m. with all members present. • ADJOURNMENT Motion by McFadden, seconded by Tarozzi, to cablecast the Study Session on April 16 and to hold the meeting in the Council Chambers.
