JANUARY 22, 1979
The regular meeting of the City Council was called to order at 7:30 PM by Mayor Tice
in the West Covina City Hall Council Chambers. The Pledge of Allegiance was led by
Mayor. Pro.Tem Chappell, invocation was given by Rabbi Elisha Nattiv, Temple Shalom.

Response to Residents' Mike Miller gave report and answered any questions that
Petition regarding BKK Council raised. Mayor asked citizens who live in the
Sanitary Landfill landfill area to come forward with comments.
Paul Breit Reiterated his concerns that appeared in the petition and
2701 Miranda stated that the odors are very bad on weekends. Also stated
that the communications operator could not refer his weekend
call to any staff member -did not have the authorization,
Royal Brown Suggested the City hire a full time staff person to monitor
Galster-Homeowners Assn, the BKK landfill day and night.

Steve Welsh Stated he believes there is no technology today to eliminate
2044 Lorraine Street the odors or take care of the problem and feels that a closure
would solve the problem.
Staff Response Fast responded by stat_njthat BKK officials, County Sanitation
District and City staff are meeting and have met to work on
this problem. The County Sanitation District is experimenting
in this area and there is no real sure technique right now.

Council Discussion Browne indicated that Homeowners Package for those who
purchase homes in Woodside area should include all
information about the BKK Landfill.
Shearer suggested installation of some type of device in
the residential areas that could possibly monitor the odors
that residents are experiencing.
Council stated that closure of the landfill would only
present more problems in mmny, J different areas.
Motion made by Chappell, seconded by Browne to approve
the addition of a condition to the Solid Waste Facility
Permit requiring BKK to conduct an odor mitigation study
or participate in such a study and develop and implement
an odor mitigation plan as outlined in the report, and
Authorize the Mayor to transmit a request to the State
Department of Health Services requesting them to conduct
an odor mitigationst.u'dy- in conjunction with the State Solid
Waste Management Board which will be generally applicable
to sanitary landfills and BKK. Motion carried 5 - 0.
ORAL COMMUNICATIONS
Ed Connally President of West Covina Beautiful - Connally announced
1317 E. Michelle the Annual. City's Birthday Ball. It will be held on
February 9, 7:00 :PMZto midnight at the West Covina Elks
Lodge. Dinner at 8 PM and cost for the event is $12.50.
SEIU Presentation Strongberg,gave his report and requested Council to consider
Bill Strongberg _ their proposed memorandum of understanding and to direct
(Representing SEIU) staff to continue the bargaining.
City Manager presented report.
After discussion w'i.th regard to the medical benefits a motion
was made.'
Motion made by Shearer, seconded by Chappell to pass
a resolution` making any increases with regard to insurance
that this council may ultimately agree to in February or
later, effective the Ist of January. Motion carried 5 - 0.

SB 154 was brought up and it was stated that under
this law it prohibits cash payment to employees for
medical. Staff suggested that they would like to
study the motion made and work out the answer to
the issue and present it to the Council at the next
meeting.
Motion made by Shearer, seconded by Chappell to
take this matter under advisement with staff and
present at the next regular meeting; motion carried
5-0.

Comments on EIR Mr. Diaz responded to comments raised by Mr. Brown
by Staff as follows: "Mr. Mayor and members of the Council, the
comments that were raised this evening are similar to those
raised at the Planning Commission hearing and are the
verbatim minutes which are part of the EIR before you,
therefore, I will refer to the Planning Commission hearing
minutes and attempt to address these environmental concerns
as briefly as possible. First of all with regard to the traffic
d Azusa, signalization and traffic issue
problem of Aroma an
is referred to on pages 43 to 45 by Mr. Thomas in those
minutes. Mr. Thomas indicated that the results of the
study show that demand for signalization had not been met
at this time and that the project in and of itself does not
generate enough traffic to warrant the signalization and
the possibility being that the warrants might be met by
1981.

Comments on EIR With regard to an offer to pay for signalization as was
by Staff (continued) indicated, the developer spoke of a benefit district. In
addition and we cannot require that type of justification
for the developer to pay for signalization as it does not
meet the warrants at this time,and finally...... as the
Council will recall from testimony on other signalization
questions, when you install a signal where warrants are
not met, often times you can compound the problem rather
than solve it.
With regard to the recreational issue, these are examined
on Page 40 of the verbatim minutes. The developer is
required to pay park fees, it says set forth in the resolution
that is recommended to you. He has not -requested refusal of
any of those park fees, although he is empowered to do so
because the development does contain recreational
facilities, but it .'.has been the policy of the City of West
Covina to require'these park fees. , The developer does
not have any say as to how the money which is arrived from
these park fees; is `spen.t.: except for that say which is
outlined in the (Quimby ., Bill which requires that the money
be spent for the benefit of that subdivision plan which is
granted. So that is the only'say that the developer has
in this particular project, he cannot demand that the money
be spent on Galstar Park, he cannot demand it be spent
on a baseball diamond, he can only require that the money
be spent in the park that will be utilized by the residents of
that development and therefore, the EIR should not address
the issues of where the money should be spent, this is a
policy decision which rests with the City Council. The
EIR though, does state that the recreational needs of the
area or demands on recreational facilities are or wi 11 be
met by the developer paying fees and provide the recreational
facilities.
With regards to the mud slide problems (and geologic hazards
this is examined on page 41 of the verbatim minutes. I wi II
not go through them., ;as you have received the minutes
of the Planning Commission as part of the EIR. The entire
procedure that is :utilized :; by the City in examining
grading plans was outlined that evening as well as the
changes which have been made in the City's procedures
throughout the years as different problems have arisen was
also examined. So that the grading plan and all grading
will be done to the current state-of-the-art and to the
current requirements of the City of West Covina. With
regard to the slide area, the same Thing holds here, that
particular area will be treated and will be made safe in
accordance with our particular requirements for grading.
With regards to the altenatives, the possibility of industrial
and commercial uses on that site, staff would not recommend
any. industrial or commercial uses on that particular site.

Comments on EIR If indeed the traffic problems are real, which we believe
by Staff (continued) they are not, any traffic problem would be greatly impacted
by industrial and commercial uses on this site.
And finally, with regards to the comments that staff was in
collusion with the developer, this does not relate to the
EIR and therefore I will not address it. Thank you."
PUBLIC HEARING CLOSED
COUNCIL DISCUSSION Miller indicated that he is still not supporting this project.
He feels that the findings for a zone change number I have
not even been met.
Shearer indicated his concern regarding the traffic signal
and that this item should be"br"ought up in the very near
future. He also expressed his feelings, along with other
Councilmen,. making sure the prospective buyers in that
area are aware of the BKK landfill and the problems going
on regarding this landfill. City Attorney stated that this
should be the responsibility of the developer to the buyer.
Shearer moved that this item be added to the ordinance
and should read, 'that; -the prospective buyer be aware of
the potential. ;i0problem associated with -the sanitary landfill".

Legislation Motion made by Shearer, seconded by Chappell to
approve staff recommendation of reaffirming its support
of the League Legislative Program as presented at the
Annual Conference, and authorize the Mayor to correspond
with the appropriate legislators informing them of our
support; motion carried 5 - 0.
Deputy City Clerk City Manager informed the Council the the City'Clerk

and he would recommend that the Council pass a
resolution authorizing an additional $50 per month for
this purpose.
