• The regular meeting of the City Council was called to order at
7:30 P.M, by Mayor Tice. The Pledge of Allegiance was led by
Councilman Browne; the invocation was given by Councilman Shearer.

CONSENT CALENDAR Requested that the Council reconsider
ITEM 7-a, NO. I, the decision of the Traffic Committee
(TRAFFIC COMMITTEE MINUTES) because deletion of parking along Garvey
in front of apartments with inadequate
Mr. Raymer Weisman on -site parking would create a hardship
_and setback in property value.
Suggested that since the subject inter-
sections are not major and do .not carry heavy traffic, that the
recommended parking restrictions for adequate sight distance be
cut in half.
Mr. Earnest Weight Concurred that deletion of parking would
create a hardship. Requested further
study of the situation, with consideration
of reduction of parking restrictions.
Staff explained the findings of the
Traffic Committee. Parking restrictions to allow for adequate sight
distances -re -based upon the prevailing speeds of the streets involved.
In this case, the Committee seriously considered the effect of parking
restrictions on the adjacent apartment dwellers, recognizing the lack
of adequate on -site parking, but determined that parking restrictions
were necessary for intersection safety. The matter had come before the
Committee in the form of a petition from residents on Mardina Street
complaining about the lack of visibility at the intersections.
• In light of the Staff explanation, the
Council determined further study of the matter would not be necessary;
the engineering considerations had been determined, any other decision
at this point would be political. Council wished additional time to
review the matter.
Motion made by Browne, seconded by Chappell
to hold over Agenda Item 7-a, No. ;I.until April 10, 1978. Motion carried.
CONSENT CALENDAR Shearer reported that as an employee of
ITEM 1-a CALTRANS, he might not be able to discuss
"COME TOGETHER" or vote on action on this item, but he
could note that the Association, CALTRANS,
and County would like some Council response
re the program. Briefly outlined program.
Staff reviewed contact with the program
administrators to date. A future meeting would better delineate the
City's participation in the program. Report on that will be forthcoming.

that the City Council approve the plans and specifications as presented,
and authorize the Staff to go to bid for the installation of two 100
ton.staged air conditioning compressors to serve the Civic Center
buildings. Motion carried.
ORAL COMMUNICATIONS (7 : 55 P.M.)
Mr. D. O.-T_ellis On behalf of the Senior Citizen's
Association of West Covina, reported
that the president-elect is no longer
With the.Association, and apologized for any uncomplimentary remarks
he might have made to the Council while in the position. The senior
citizens want to have.fun, and greatly enjoy the building the City
reserves for the Association for this purpose.
Invited the Council to attend an "Old
Fashioned Picnic" on July 4th, Cortez Park, to be hosted by the
Association.
Thanked the Council and the City for all
of the things that have been given to the senior citizens.
Mrs. M. Wessel Reported that the 1977 Fourth of July
Mrs. J. East Parade Committee had not carried on to
form a Committee for 1978. Therefore,
Wessel and East had begun formation of
a Committee in order to continue the
tradition.
In making some preliminary plans, they
discovered that the 1977 Committee still has an outstanding bill of
$446 to the Pepsi Cola Company. To their knowledge, the Company
has not pursued this bill to date.
Due to proposed reconstruction work on
Cameron.,:.Avenue (the traditional parade route) around the fourth of
July, alternate parade routes were considered. Since none were
found to be suitable, the Committee is organizing a traditional Bell
Ringing Ceremony and picnic to be held in Cameron Park.
Although.$1200 was appropriated by the
Council in the 1977=78 Fiscal Year Budget to assist the Parade
Committee, the,.Committee would request no financial support for the
• proposed Ceremony,.only use of the City park, show -mobile, and a
limited number 'of -chairs.: Community businesses will be contacted
for active, participation and support.

proposed Los Angeles County General Plan.
Chappell noted it was encouraging that
the County allowed.the.East San Gabriel Valley Planning Committee to
basically design ',the' -plan.
Tice noted the City's input through the
Planning Committee had been included in the proposed plan.
Miller stated that he did not see a need
for, and therefore would not support Housing Element, Section 4-13,

Election ballot to modify the local vote requirement of Article 34 so

Miller would also not support Transportation Element, Section 5-8,
"Support mandatory vehicle inspections and maintenance."
Other than these two sections, Miller
indicated he would support the proposed plan in a general way.

be authorized to enter into and sign an Agreement with the State of
California, California State Personnel Board, Cooperative Personnel
Services Division for the purpose of performing examining services
for the City of West Covina, California. Motion carried.

COMPUTER SERVICE CONTRACT Staff presented the Report.

Motion made by Shearer, seconded by
• Browne that the City Council authorize the Mayor and the City Clerk
to execute a Computer Service Contract.with the City of Baldwin Park
and to appropriate $6,000 from unappropriated funds to pay for the
one-time costs of installing the necessary equipment and programming
for the computer services operation. Motion carried on roll call vote:

THE TAX ROLL Motion made by Browne, seconded by
Chappell that the City Council reject
the two bids received for the property
located at Merced and Glendora Avenues, and authorize the City
Finance Officer and the City Manager to readvertise for formal bid
for the sale of the property, such bids to be opened so as to be
before the Council for consideration on April 10, 1978. Motion
carried.

FOURTH OF JULY (Comments re subject taken from the
PARADE COMMITTEE Fourth of July Parade Committee under
Oral Communications - 7:55 P.M.)
Motion made by Shearer, seconded by
Chappell that the City Council -endorse the 1978 Fourth of July
Parade Committee's efforts to introduce a park.celebration in lieu
of a parade, at no cost to the City. Motion carried.
Council requested Staff to contact the
Chairman of the 1977 Fourth of July Parade Committee concerning the
outstanding bill to the Pepsi Cola Company.
BUILDING ACCESSIBILITY Staff presented the Report.

TAX INITIATIVE
ALTERNATIVE BUDGET Motion made by Chappell, seconded by
Browne that the City Council schedule
a Public Hearing on April 17, 1978, to receive input on service
preferences from residents and to provide policy decisions to Staff
for purposes of preparation of an alternative budget necessitated
by passage of Proposition 13. Motion carried.
REPORTS ON GRADING TRACTS 30682, 30971, 30728, 30830
AND CONSTRUCTION HEARTHSTONE HOMEOWNERS'BUILDING COMPLAINTS
W & A BUILDERS
Staff presented the Report.
Mr. L. Cook Thanked the Staff for their investigation
Homeowner of flood damage and complaints on the
houses.
Disagreed with the preliminary grading
report submitted to the Council. The report was prepared by Beech -
Leighton and Associates, the same company that did the initial soils
engineering on the lots in question. In other words, a company was
requested to investigate its - own self.
Reviewed the report briefly, making the
following comments: "Lush grass cover held water rather than shedding
it. Lower slope may have been saturated by runoff from upper slope
when drainage terrace became filled with debris. Rodent burrows
provided access for waters to penetrate the slope. - Gentlemen, I
have lived there for seven months and I have never seen a rodent.
Three of us toured the whole tract on the slopes, and we never found
one rodent hole. What is called a rodent hole by the company was
made by two legged rodents.- by the landscapers. The landscapers
came and pulled weeds. As'to the lush slope coverage - we have a
letter from the West -,Covina Building and Safety Department in which

't"he Inspector states: 'I made a visual inspection of the slope behind
your house. At the time of my inspection, a landscape maintenance
company was seeding the slope. I found the slope in poor condition.
• There was a greater percentage of weeds than ground cover. I phoned
W & A Builders to express my concern.' As far as I am concerned,
this preliminary report could be reduced to•the fact,that there were
holes made by people pulling weeds, the terraces for drainage were.
full of weeds. I have photographs of this. I think Council should
get an independent soils engineer rather than an engineer employed
by W & A Builders to do their soils engineering. When I called the
soils engineer -and explained some facts to him, he said, 'We have
never been informed of these facts.''` I cannot see having Leighton
investigate Leighton."

Tract 30682
Called.attention'to a memorandum,
dated March 15, 1978, to Mr. H. Thomas from N. J. Palkhiwala,
and quoted: "Examination and comparisons of the grading plans of
the other tracts in Woodside Village have been done by the City on
the basis of similar nature of soil, slopes and height..."
Noted that only the slopes engineered by Leighton and Associates
had showed distress during the heavy rains.
Referred then to a memorandum,
• dated March 23, 1978, to the City Manager and City Council from
H. W. Thomas, and quoted: "In summary, it is Staff's feeling
that the damage to the slopes in the-W & A Builders' tracts is
not attributable to lack of conformance with City ordinances
and good engineering practices."
In comparing these two memoranda,
felt that it was obvious that the City Engineer agreed that those
slopes engineered by Leighton and Associates were the only ones
that did not hold up during the heavy rains.

opinion, and, if so, whomi
In the oral Staff Report, Staff referred
to "additional information that went into the Staff's finding."
Wondered what that additional information was, and why it was not
made available to the homeowners.
"The Hearthstone Homeowners Association
will not accept the Staff's findings as submitted by Mr. Harry W.
• Thomas, City Engineer, and request that an impartial survey be done
by a City soils engineer that has no previous association with W & A
Builders or Leighton and Associates. Thank you."

Mr. D. Anderson, No. specific comments. Reported he had
W & A Builders met with the homeowners on several
occasions. Would hope that the proposal
• submitted to the homeowners would be
acceptable to them, and that the problem
could be resolved.
George Wakefield, "I might make just one comment with
City Attorney reference to the information that
was supplied by Leighton and Associates.
I think that information was attached
to the Staff Report simply as information for the City Council. It
doesn'.t indicate either approval or disapproval of the substance of
Leighton and Associates' findings. So, at least as to that portion
of the item, the appropriate Council action would be to simply
"receive and file" it." a
Mayor Tice: "This is simply a part of the on -going
process."
Mr. Wakefield: "Yes. This was simply requested of them
as a part of the information necessary
for the City Engineer's evaluation of
the overall situation."
Councilman Shearer: "Do you have any idea (Mr. Fast) of the
• cost to the City to comply with the
request of Mr. Varela to have a "second
set of eyes" review the situation as it relates strictly to the.
City's involvement in this?"
Mr. Fast: "No I do not have an opinion at this
moment on what such -an opinion might
cost.
However, I would like to suggest that
the only type of opinion that the Council could receive is whether
in fact the City procedures relative to approval of plans, and to
certification by registered or State approved engineers has occurred.
That is really an administrative task. A soils engineer would be no
more expert -in ascertaining whether the City records were complete or
not. I would hesitate to recommend that the City be involved in any
way in retaining a soils engineer to enter.into a situation relative
to the current status of the private slopes within the Hearthstone
tracts.
Staff has responded to the City Council
relative to the City involvement. It involves an administrative
• review todeterminewhether or not. the file is complete, whether, in
fact,. we did inspections, whether the plans were filed properly,
whether certifications were properly filed by a certified and/or
registered geologist or soils engineer. Our records show that these
are all complete. If you wish to double check whether or not this
is the case, it would require more of an auditing or administrative
type check as opposed to a soils engineer."

During the height of the storm, under the
Emergency Conditions powers granted to me, we did hire a soils engineer
to advise various homeowners who had problems throughout the City what
things they might be able to do to attempt to forestall any additional
serious, immediate danger or disaster to their life or their property.
That was an individual from the same firm, Leighton and Associates, but
it was a different individual than was involved in the actual certifica-
tions of the slopes involved here."
Motion made by Miller, seconded by
Chappell that the City Council receive and file the Reports on
Grading and Construction re Tracts 30682, 30971, 30728, and
30830 (W & A Builders, and Hearthstone Homeowners' Building Complaints.
Motion carried.
LEGISLATION - SJR 38 NIMMO Staff presented the Report.
PROPOSED IRS REGULATION RE
COMPENSATION PROGRAM Motion made by Chappell, seconded by
Browne that the City Council support
SJR 38 (Nimmo) and authorize the Mayor
to correspond with the appropriate legislator. Motion carried.
CETA VI POSITION/CHANGE IN Staff presented the Report.
ALLOCATION OF AUTHORIZED
POSITION/RECREATION DEPT. Motion made by Chappell, seconded by
Browne that the City Council authorize
a change in CETA Title VI authorized
position list to reflect a Senior Recreation Leader slot in lieu
of a Landscape Designer.. Motion carried, 4 in favor, 1 opposed (Miller)
INTRODUCTION OF NEW STAFF Fast introduced new Staff member, Mr.
MEMBER - Mr. M. Hodge M. Hodge, who has taken the position of
Risk Management Coordinator.
