On question -by Council the City
Attorney explained this was not an ex,clusive-franchise s-ituation
simply -a busi-ness license and would not prohibit another such
company also soliciting business.
Motion by Tice to waive full reading of
said ordinance; seconded by Chappell and carried.

Miller asked Council consideration to
add a provision o . vision to the ordinance to prohibit the presentation of
obscene motion pictures, similar to that already contained in -
the ordinance pertaining to theatres. Council had no objection
and asked for the advice of the City Attorney.
Mr. Wakefield: Mr. Mayor I would recommend that a
pa;o paragraph be added to the section in the
ordinance to simply provide that"the
broadcasting of x—rated movies or obscene movies as described in
our-::exi8tihg code section would constitute a revoking of the
Business License.
Tice moved'to amend the motion to include

The Mayor stated due to an oversight
the.City neglected to advertise this as a new hearing;_it is
the recommendation ofthe City Attorney that the Council now set
the'meeting.of'Mondayg-November 289 1977 as a public hearing on
Study Plan B.

ORAL COMMUNICATIONS

Alfred , Pe rz I have a question regarding the City
-70,8 `'-- 5 h a dyd al 6- landscaping policy. Two week's ago
West Covina — at my request the City removed two
trees from .my property and'I requested
they plant others trees, my preference being Magnolia trees.
I was advised that the City policy for my area -is to plant
Holly Oak trees. I respectfully ask that -Council consider my
request for Magnolia Trees, since there is no predominance of
Holly Oak in the area.anyway,
The Mayor advised he talked with
Mr. Perz-'and would like to suggest that this be referred to
Staff for a further report to determine whether the policy set
by Council many years ago is still valid. Chappell asked if
the trees removed were diseased and if the Magnolia Tree was on
the City's list of trees; the answer was "yes" to both questions.
Ticeaskedwhile staff was making this report.if they would look
into the situation of two other areas — one next door to where he
lived and the other across the street; both have been waiting
several months now.
Council agreed to refer back to Staff for
a report in two weeks.
Ernie Winter, My purpose in appearing this evening is
Secretary/Treas.', to respond to some recent meetings with
BKK.Corporation the Mayor, Mayor Pro Tem and. City Staff
and assure you of.the.continued desire
of BKK to work with the City towards
solving some of our mutual problems. (Introduced Robert DeVlerp
in charge of the BKK operation; a sincere sensitive man who has
dedicated himself to operating the led,dfill). I would like to
read a letter from the corporation but before doing
ng so I have
some reasonably good news — our Project Engineer'. John Adams,
has stated it appears from an early look at the disposal that the
rate of fill on the site is going to shorten considerably our
completion time for the project. I have asked Mr. Adams to pro—
vide the City with a new perspective date. (Read BKK letter and
presented copies to -the City Clerk.)

The May-br questioned the method of
disposing this type of equipment. The City Attorney stated the
procedure described in the City's Purchasing Ordinance provides
that the items declared surplus may be sold by the'Purchasing
Agent pursua ' nt to the established procedures approved by the City
Manager and ,if the item has a value of $250,, or more the sale is
•.subject to.the approval of the City Council. The City Manager
stated Staff will probably be recommending a sealed bid proce*dur-e
and explained other methods of disposal; also advised staff intends
to take the low Blue Book figure as the minimum amount of each
vehicle.

BINGO Staff Report summarized by City Manager.
Motion by Tice to adopt an ordinance
reenacting the provisions of the current bingo ordinance and
making amendments to provide for specific revocation of a license
and permitting veterans organizations and senior citizens groups
to conduct bingo games; and instruct the City-Attornby to prepare
the proper ordinance; seconded by Browne and carried. Miller
voting "no" having opposed this item,from,its inception.
,LEAVE OF ABSENCE City Manager summarized Staff Report.

[indamood and Motion by Browne to approve a leave,.of
• Hoppe absence without.pay from December 7. 1977
through June 30 . 9 1978, for Equipment
Operator Wayne Lindamood in order that he may recover from an
accident; and additionally approve a leave of, absence without pay
for Account Clerk Erin Hoppe from November 27, 1977 through
June 309-1978 in order that she may recover from illness; seconded
by Chappell and carried.
AWARD OF EDA PUBLIC City Manager explained the problem in
WORKS PROJECT BIDS meeting the deadline set for the award
(Informational Staff of bids and requested a Council meeting
Repo'rt) Council discussed and agreed on November
21 at 6 P.M. Browne advising he could
not be present anytime in that week.
.'AFFIRMATIVE ACTION Council discussed and preferred to have
PLAN (Staff Report) comments from both the Human Resources
Commission and the Porsonnel Board.
Motion by Tice to request the -Personnel
Board to'.review and forward their comments to City Council;
seconded by Browne and carried.
SENATE SELECT COMMITTEE 'The City Manager advised notice has just
ON TRANSPORTATION ... - been received that this Committee is
doing to be holding ahearing in
• California ' and we have been contacted relative to our position
on ramp metering,. We have asked them to delay their installation
of meters in our ar - ea'and after
fter Councills'action they did agree to
work with the City and actually delay their installation for about
a year..- Staffs understanding. -is there will not be a submittal of

an environmental impact study ra,l-ative.to ramp Metering effects

,b,e':i-ha.',poor'positi6n,?�to.assess the effect of ramp metering,
and the :mitigating -measures ,.that -might be applied. Staff would
recommend to Council that. someone from the City, an elected -
official'or staff member, appear beforethe Senate Select
Committee hearinq to express our concerns for an environmental
impact study. This hearing will occur prior to Council's next
meeting.,.
Motion by Chappell that if this item
were.a conflict of interest for the Mayor that the Mayor Pro Tem
be appointed along with staff,mem.bers to attend this hearing;
seconded. -by Miller and -carried.
TRAFFIC SAFETY,.GRANT-- City Manager informed Council the..
Traffic Safety Grant requesting
four, police officers for purposes of
attempting to cut down the accident ratio in the City has been
approved and -this involves $2.49,000 of manpower and equipment
to the City in the first year.
MAYOR'S REPORTS Mayor Shearer: I have three items.
I believe Council has
been.polled previous
to authorizing the Mayor to attend the National Leage of Cities
Conference.in San Francisco December 3 to 7th. I would like
authorization to attend with actual personal expenses not to
exceed $250.00 (exclusive of the registration fee)', whichever is
less.

Browne and carried on roll call vote:

NOES.: None
Mayor Shearer: I would also like Council authorization —
the'City Manager has indicated an interest
in attending and this is a rare situation
where this meeting is held in California.
So moved.by Tice, seconded by Miller and
carried.
Mayor Shearer: In another month or so the State
Legislature will be reconvening. I
think it would be appropriate for the -
City Council, perhaps at a dinner meeting, t=o.me-et_ wilth'A's's6,mblyman
Lancaster and discuss the many items of legislatl:b-h:-that will be
coming up of interest to the City. If this,meets with Council
pleasure I would suggest this and ask that staff find a date on
which we can meet.

Mayor Shearer: One further item — the alternate
voting delegate for the National League
is recommended to be Mr. Fast.

-Councilman Chappell: The League of California Cities L.A.
County Division is having their
installation of new officers the 1st
of December and I hope that my colleagues can be present that
evening.
Mayor Shearer: Councilman'Chappell will be installed
as the President of the L.A. County
Division — this is the first time a
member of this Council has reached such an elevated position.
It represents a lot of time spent by Councilman Chappell.

TIVE SESSION The Mayorconvened the Council at 9 P.M.
RE LITIGATION for the Executive Session. City Council
reconvened at 9:35 P.M.
Mr. Wakefield: In connection with certain items of
pending litigation the first of which
is the Rowland Unified School District
versus the City of West Covina,, it would be my recommendation
that the City Council -authorize. the City Attorney and Burke,
Williams and SorensOn to defend the action an behalf of the City,*

Mr. Wakefield: —The second,_item relates to the case of
Burkhard J. Wolfe versus the City of
West Covina and it is my recommendation
that the City. Attorney be authorized to represent.the City in
the; action.,

Mr'. Wakefield:.- The third item is a case pen . ding in the
Federal Court entitled Hillard Davis, Jr.,
versus the City of West Covina and the.
City of West Covina,police officers — Carroll and Gano. The
recommend " ation is that the City Council authorize the City Attorney
and Burke, Williams & Sorens'en to represent the City in the action.
