MINUTES OF THE ADJOURNED REGULAR MEETING
OF THE
CITY COUNCIL AND PLANNING COMMISSION
CITY OF WEST COVINA, CALIFORNIA

The adjourned regular meeting of the City Council was called to order at 7:00 p.m. by
Mayor Chester Shearer.
ROLL CALL

The adjourned regular meeting of the Planning Commission was called to order by
Chairman Peter Kochis.
ROLL CALL
Present: Chairman Kochis; Commissioners: Bacon, Christopher,
Jordon, and Saucedo
WATER CONSERVATION Randy Vogel of Southwest. S&Vburban Water Company
PROGRAM presented a film on water conservation and dis-
cussed the program which Sufburban is following,
including the distribution of water conservation
kits to customers.
PROPERTY MAINTENANCE Shearer indicated that there was an apparent
ORDINANCE philosophical difference of opinion between the
Planning Commission and the City Council con-
cerning the proposed property maintenance
ordinance and said he wanted to prevent addition-
al work by the staff if the majority of the Council
was opposed to the concept.
Diaz presented a brief history and summary of the
proposed ordinance.
Members of the Council questioned the need for the
consolidation of the ordinance. They indicated that
the majority of the proposed ordinance is currently
in other sections of the code, and that the remaining
items are probably impositions on the liberties of
residents. In addition to the philosophical reserva-
tions, the Councilmen questioned the problems of
implementation, including the staff needed to enforce
the proposed changes.

The Planning Commissioners discussed their concerns
about the intervention of government into private
property matters and the restrictions on ownership
rights. The Commissioners, however, recognized
the need to prevent property deterioration and the
need to respond in serious situations. Commissioners
expressed a desire to hold public hearings to discuss
the proposed ordinance.
Councilmen indicated general support of part of
the proposed ordinance but requested legal
interpretation by the City Attorney; stricter
definitions of standards; and a direct relationship
of the ordinance to the health, safety, and wel-
fare of the community.
Motion made by Chappell, seconded by Browne to
direct the Planning Commission,upon consultation with the City Attorney, to pursue the
Property Maintenance Ordinance with the stipulation that specific standards or levels are
established upon which judgment can be made, and that the language of the proposed
ordinance be reviewed with the City Council and the Planning Commission before public
hearings are held. Motion carried 5 - 0.
Diaz explained the origins of the proposed ordinance
• and then discussed the reasons that staff proceeded
with its study.
CITY BUILDING CODES AND Kochis discussed solar energy and questioned
ENERGY CONSERVATION whether the building regulations placed road-
blocks on solar energy applications. Diaz
explained the City's roll in permits and zoning
applications.
Shearer asked if a provision to all ordinances can
be enacted which granted exceptions from restric-
tions in the case of energy conserving devices.
Motion made by Tice, seconded by Browne to
request the City Attorney to review manners of flexibility in approving exotic energy -
saving devices other than by variances. Motion carried 5 - 0.
CALIFORNIA ENVIRONMENTAL Kochis explained the process which the Planning
QUALITY ACT PROCEDURE Commission was following regarding environmental
impact reports -and the.-Ci-ty Counci•I approved the
concept.;: <Diaz explained that verbatim minutes

PLANNING COMMISSION PUBLIC Shearer complimented the Planning Commission on
HEARINGS its performance but expressed concern about two
areas: (1) witnesses at hearings should be allowed
to present testimony without interuptions from the
Commission; and (2) the Commission should restrict
itself to pertinent items and should not get involved
in extraneous comments.
Commissioners briefly discussed their thoughts.
ADJOURNMENT Planning Commission adjourned at 10:03 p.m.
Fast presented an additional City Council item.
He indicated that one additional promotional pay
disparity exists in the Fire Department because
of circumstances not foreseen in the meet and
confer process. As with the three inequitable
situations settled at the Council Meeting of March
17, there is no legal obligation to compensate the
affected employee.
• Motion made by Browne, seconded by Tice to
authorize payment of $1,842 to Battalion Chief Womack to settle an inequity in his salary,
although the City has no legal requirement to make the adjustment. Motion carried on

to adjourn the meeting at 10:05 p.m. until the
next regular meeting. Motion carried.
