MINUTES OF THE REGULAR MEETING OF THEiCITY COUNCIL
CITY OF WEST COVINA, CALIFORNIA
DECEMBER 27, 1976
The regular meeting of the City Council was called to order at
7:30 P.M. by Mayor Nevin Browne. The Pledge of Allegiance was
led by Councilman Chappell; the invocation was given by the
Reverend John Freitag, Immanuel First Lutheran Church.

Mr. K. Hayashi Reviewed two reasons for Council approval of
• 2129 Eva.ngelina of Tentative Tract 33076 over the protests of
West Covina, Ca. adjacent homeowners at the December 13, 1976
meeting of the Council. Submitted Superior
Court cases and findings for same in s-milar
matters, and again requested a Moratorium to allow sufficient time
for a new Environmental Impact Report on the area to be drafted
(to be concerned with, but not limited to, density, parking, traffic,
police problems, and the school situation).

Browne received the Superior Court cases and
findings, and explained that the Council must submit them to the
City Attorney,for:his 'interpretation and counsel. The residents
will be advised.

P.O. Box 5922 Reviewed Alternate I - an 18 lot subdivision
El Monte, Ca.. with no provision for dedication to West
Covina. Parkway. Based on the theory that the
applicant should not be required to dedicate
for the Parkway, but should the -City make such a requirement, the
applicant should be given credit for the dedication in the lot
sizes and not be required to request lot size variances. Noted
three precedences in the City for this type of action - (1) the
apartment development on Citrus Avenue where a building was
permitted to be constructed within the so-called West Covina
Parkway area; (2) the Mayer Construction Company Barranca. I
development -where credit was given for the entire parcel for
purposes of density and portions of the Parkway were permitted to
be used for parking, landscaping and private purposes; and, (3) the
seven house tract to the east of the subject property and west of
Grand Avenue where the developer was given credit for frontage
road dedication. Was of the opinion, therefore, that if the City
required dedication, it would constitute excessive taking - some
40 percent of the parcel would be then dedicated. Pointed out
that the Parkway would be of no use to the development, which
. would take access to Ba.rra.nca Street.
Reviewed Alternate II - a 17 lot subdivision
with a. 60 foot dedication for West Covina Parkway. Based on
the possibility that the Parkway width might be reduced.
Reviewed the need for a. variance for Lot 1
on both Alternates I and II - a lot encumbered with many detri-
mental factors that would have to be sold at a. lower cost.
Realized City's past and current studies
and concern for a need for the Parkway. Pointed out that the
residents of the subject area had thus far not come forth 'to
oppose the proposed development, and were not desirous of having
the Parkway extended through the subject area.
Briefly reviewed the history of the property,
noting that originally the applicant proposed a. 200 unit apartment
development. Alternates I and II would be the base developments
that the applicant would propose. The applicant never wanted to
argue with the City; his only desire has been to build a quality
development, as he did with the Barranca I development. Pointed
out that at the Hearing before the.Planning Commission, three
• Commissioners indicated -they would: look fa.vora.bly upon Alternate
II should West Covina: Parkway be reduced.
=Re'quested'that the Council consider the
results of studies concerning a.need for the Parkway, the desires
of the residents in the -area, and to (1) hold over the subject
application a.nd instruct ,Staff to begin proceedings to reduce the
Parkway width, or to eliminate the Parkway completely, or to

(2) return the subject application to the Planning Commission for
reconsideration along with instructions for a General Plan
• amendment to accomplish Parkway changes. Recognized that if the
Council should be willing to go forward and make some changes
that there would be some delays. The applicant would be happy
to be patient and work with the City under those circumstances.

PUBLIC HEARING CLOSED
COUNCIL DISCUSSION Chappell noted that the subject property
had never been zoned for apartment use.
Felt that because the Parkway is under study
for consideration of reduction in size, it would be fitting to
hold over the application until completion of the study and Staff
recommendation.
•Browne reviewed the study currently being
done to consider West Covina..Parkway width, and explained that
until that study has been'comple ed, the Council would not take
action on the Parkway. Concurred with Chappell'srecommendation
to hold over the -,subject applica.-tion.'
Tice concurred, noting that he has never felt
there is a need to extend the Parkway,.., -'although the Parkway will
probably go through at some width yet to be determined.
Shearer concurred, noting that if the Council
had at this time a Plan designating the Parkway to be 60 feet, he
would support Alternate II. (Browne concurred.)
Miller concurred with the statements made by
his fellow Councilmen.
The City Attorney advised what action could
be legally taken in this matter. Mr. Ingram, on behalf of the
applicant consented to hold over the matter.
Motion made by Chappell, seconded by Tice
that the City Council, with the consent of the developer, hold
over the consideration of Variance 731 and Tentative Tract No.
33`014 until April 25, 1977. Motion carried.

Staff reviewed the Report, clarifying certain
sections upon Council request. Some Council-
men recalled .that certain City parks had been
Master Planned in the past; Staff will look
into any such possibility;, and furnish a
report to Council.

Wondered if bar-b-que pits were planned for
any of the City parks.
Browne explained that the Recreation and Parks
Department is considering bar-b-que pits, but that same had not
been included in the subject proposal for spending of the Grant.
Mrs. K. Jackson Requested clarification of Item (E)
(Planning/Management - Citizen -Communication
Program - $5,000) and Item (F) (Administration -
Citizen/Staff - $71,000) of the Proposed Third
Year CD Projects List.
Staff explained Item (t) would finance the
Citizens Participation Program; Item (F) would finance the
salaries of the personnel assigned to the program, however, there
was a typographical error on the List, it should be corrected to
read: "(F) ADMINISTRATION - $71,000."
Mrs. Jackson noted that the Report referred
to "restrooms01 that had been made accessible to the handicapped
during the second year funding of the Grant, and questioned what
restrooms.
Staff explained that one restroom at Cortez
Park had been made accessible to the handicapped; it had not been
possible to --modf,fyr,-; the second restroom because a bearing wall
of the building was involved. The restrooms at Palm View and
Del Norte Parks will be modified.
Mr. Jeffers Since only'one restroom had been modified
131 S. Barranca at Cortez Park, wondered if the handicapped
West Covina, Ca.-.. were expected to post.someone outside while
in use. Felt that would be an inconvenience
and an infringement on his civil rights.
:'Staff explained that procedure would
probably have to be followed. The modifications have to be made
on existing buildings that were constructed prior to the regula-
tions for the handicapped; the City is trying to do the best with
what exists. Noted that the exterior restrooms in Cortez Park
will be modified for the handicapped.

ORAL COMMUNICATIONS
Mrs. K. Jackson Had read in the newspaper that the Police
Officers are giving citations to vehicles
parked illegally, including vehicles
• parked illegally in handicapped stalls. Commended the Police
Force for their action. However, had heard that the merchants
were quite irate about the situation, and were going to request
the Council to void.the citations. Requested Council explain
the situation.
Browne explained that the information
the Council had was that the Police Department was issuing a
number of parking violation citations. This Council would not
become involved in directing the Police Department to "fix" or
rescind any citations written as long as they are written in
adherence to vehicle ordinances and codes.

Mayor's Reports December 27, 1976
REAL ESTATE REPORT Mayor reviewed the Real Estate Report
received from Staff, and suggested that
in addition to the Real Estate Report
• received by prospective homeowners, they also receive a Report
containing the following information: the PCD Plan, including
reference to proposed park and school sites, delineation of the
feasibility of schools being.constructed, utilities and City
service schedules, and information on the Maintenance and Lighting
Districts. This Report would be prepared by Staff; duplication
and distribution of same would be a condition of any development
approved in the PCD area.

to instruct Staff to prepare such'a Report. Motion carried.
COUNCILMEN'S REPORTS/COMMENTS
4 Shearer stated that it has always been
the intent of the Council to grant City employees fair pay/benefits
consistent with the` City'.s financial ability, and reviewed the
current situation wherein one City's Meet and Confer negotiations
had not yet been settled in a. Memorandum of Understanding. In
light of the City's'intent and'upon'advise from the City Attorney,
the following resolution was adopted.

CITY OF WEST COVINA, CALIFORNIA, RESERVING
THE RIGHT TO MAKE SALARY ADJUSTMENTS FOR

DEPARTMENT EFFECTIVE AS OF DECEMBER 1, 1976.

MID -VALLEY MENTAL
HEALTH COUNCIL Shearer reported that the City would be
unable to match the commitments of the other cities in the Mid -
Valley Mental Health Council because those cities committed $1.00
per capita. of Anti -Recessionary Funds, which they were able to do
because their funding received was higher than that received by
West Covina.
Motion made by Shearer, seconded by Tice
to authorize payment to Mid-Valley'Menta.l Health of Anti-
Recessiona.ry'funds in the amount of $48,000, with the understanding
• that in the event additional programs, i.e. CETA, become available
.to the City, the City would consider on a high priority basis
additional commitments. Motion carried on roll call vote.
