APPROVAL OF MINUTES Motion by Councilman Chappell, seconded by
Councilman Browne to approve minutes of
the adjourned meeting and 'the regular meeting
of City Council on December 23, 1974.
Councilman Tice asked that the regular meeting minutes be corrected to
slow that he made the comment attributed to Councilman Chappell on
Page 28 regarding the National Youth Project Using Mini. -bikes;
Mayor Shearer asked that a correction be made in the adjourned regular_
meeting, Page 5, top lire should be Captain Schwartz rather than
Captain Short.

these requests for notice from local agencies may be maintained it
would be my recommendation that this item be referred to the City
Engineer so he can maintain a permanent file-.

Mayor Shearer: A question - how soon will it be open
to the public:
Ron Sloane Mr. Mayor and members of Council, at the
Umark, Inc. last Planning Commission meeting there
32129 Lendaro Canyon were quite a few homeowners present and
we had the opportunity to explain .to
them - yes, the streets are paved and are very inviting but please
stay off of them. The West Covina Police Department is ticketing
them on a regular basis and the reason for this is the City has not
formally accepted this street and we are raising manholes, we have
probably another two weeks work of raising manholes to the street
level. People are in there. I tried to close a street similar to
this in another city, put barricades up, anchored them to the
ground - and did this on a daily basis and it cost me $300. a
week for barricades, they were just in splinters day after day.
So we are not going to attempt to close it because it only creates
a bigger hazard putting the barricades up and losing them. We put
up no trespassing signs, stay out, etc., and we do have blinkers
on each manhole that we are raising. It will probably take about
30 more days before it belongs to you.

Councilman Browne: Mr. Mayor, a. questiori regarding ,Shadow Oak
Drive. It is indicated that the city is
responsible in the future for the final 2"
of overlay on the asphalt covering - what is the reason behind this,
• Mr. Zimmerman?
Mr. Zimmerman: Mr. Mayor and members of Council, there is an
approved procedure for joining in the costs of
improving streets and the Council has
approved this procedure. In the case of Shadow Oak Drive a compari-
son was made between the center two lanes and the top layer of pave-
ment plus some sidewalk and substitution was made to get the .lower
layer_ of pavement instead of leaving the center two lanes blank.
So it is in accordance with the participation policy as approved by
Council some years ago.
Councilman Browne; When completed will this be an assessment to the
district or as part of the street project?
Mr. Zimmerman: Councilman Browne, the policy calls for the
city to assume the cost of additional paving.
However, as the road now stands it is able to
handle traffic and the lighter traffic on the street compared to
other streets in the City it is not felt that this final layer of
pavement be placed on it.
Motion carried.

• Harry J. Kaelin, Jr., Mr. Mayor., this pertains to the
611 S. St. Malo Redevelopment Agency. I am here to
West Covina talk about the businesses in the so -
Shopping breezeway area of the Plaza
Shopping Center. I would like to talk about the barbershop next to
the Bank_ of America. I talked to the owner and he has had one re-
location to his present position and is still in doubt if another
location to the mall will be covered by the City. His business has
dropped about 20/ since he moved, but he feels part of that is due
to the economics and he does intend to move to the mall }mowing
this is rent will be almost double to that of what he is presently
paying.
Kim's Wig Shop - I talked to the owner
and he has had a small decline in business. His overhead. is
neglible to other. kinds of businesses in his area and his is a
non-perishable article and his only employees are he and his wife,
who own the business.
I talked to the owner of the Casa de
Candles Shop who was relocated, lie has two other shops in the
Valley, and since the beginning of construction and the closing of
businesses and the demolition of the buildings his business has
gone - on a rating scale of good, fair, poor - to poor. He has a
letter stating that his place of business in the new mall will be
available in May of this year and he intends to relocate even
though his rent will double of that in his present location.
If you don't believe me he said he would be glad to tell you himself
if you will just take the time to come and visit him.
The Pet Shop - I talked to -an employee
that seemed to know about the status of the business there and he
said it has dropped off about 10/, but that the business is such
a type that it hasn't hurt too much and he really doesn't have too
much competition in the area, but does admit business has dropped
off.
The restaurant in the breezeway on a
rating from good, fair, poor, - his business is poor right now
and he is at a point if it goes any lower he is out. He can't get
any money out of his equipment and couldn't even sell his business
right now. He had one offer for his business, half of what he wanted.
And the person was only willing to come up with 60/ of what he
wanted and he would he. -,would have to take a second for the balance
and he don't know whether that man now would even go along with that
price. He would hesitate to carry a second trust deed on the
balance. He tried to sell his equipment but at the most he could
get only 10/ of what actually it is worth and a lot of it has no
market value at all. I asked if he intended to- move into the mall
and got a definite "no". In fact he doubts that he will be able to
last the year out if the new mall opens as all the traffic will not
be• in his direction. His business is going down the drain and no
one is helping him out. That area is in a bli.ght,condition, both
in cleanliness and as. far as people are concerned,.
I talked to the owner of the uniform
shop - this business is a desirable type in any area and although
there has been a slight decrease in business it was determined it
could be .because of the state of the economy. People out of wo :k.
do not need uniforms and anyone coming into that shop is buying a

tax deductible item. She admits there is a decline in business but
is not too worried.
I also understand Karl's Shoe Store is moving out -
period.. The Plaza Beauty Shop - I talked to the owner there and having
been a former owner of a beaut-r shop I am quite familiar withthis
type of business. Although it is sim_ilar to that. of a barbershop it
is quite different since it requires a high amount of foot traffic
and a certain amount of beauticians to stay in business. Since
beauticians work on a commission basis and they have no one there
their work is unable to be seen by others and they have no way of
advertising their expertise. They can't have their clients
walking around in the shopping area with a.sign on their back saying
this coiffeur was done by Michael Angelo. The location of the Plaza
Beauty Shop is presently in a blight area of the Plaza and sooner
than we think it will look like the center area on Garvey Avenue.
Levitz has helped the small businesses in the Glendora Area and no
doubt the mall will help the small businesses still left in the
Plaza area, but at this point in time it has come to a showdown with
a few of .the businesses and any further reduction in business will
close them out. The Plaza Beauty Salon is past the point of time of
being able to stay in business. The person presently there is the
owner and is acting as the janitor and clean-up person, and makes
her own payroll and all she is getting out of it at present is
$100. a week, and I don't believe any of you gentlemen on -the Council
would do all that work for $100. a week. I believe the Council should
take consideration of this. When construction began she immediately
lost two of her employees due to the noise, which reduced her income
by 20% and it has been in a decline ever since and is threatened now
with losing everything she has invested in the business. Prior to
the construction phase when_ the Plaza was in full swing siie could
have sold her business with the landlord's consent for approximately
$241000 but at the present time .i_t would be a miracle if she could
get 1/10th of that. Her present physical condition due to her
business situation has caused her to come under the constant care
of a doctor for her health and he has recommended tranquillizers -..and
sleeping pills. Since she is in one of the buildings not
immediately being demolished she is not entitled to relocation. If
given the opportunity to relocate in the Plaza area where she would
be in a better position that she is now and with the same rent,
she might be able to come back to life again.
I understand the Peter Pan Beauty Salon is
going to close soon also - I didn't know that she said - and if her
rent is higher and she is closer up front near Coffee Dan's and she
didn't make it - honestly how can one logically believe that a small
business of this type can survive given another location in the same
area? She has only the following solutions to her problem, as I see
it. A - get rid of her business and equipment for whatever she can
get out of it, get rid of her possessions which consist of a car and
go into bankruptcy; B - if her operators would stay with her - and
again you must understand each beautician is on her own and dependent
on the clientele they can get - she will stay. And I emphasize this -
if she can find a suitable location within the city and if she can
get additional operators to work for her she could have another
profit making business for herself and revenue for the City, and l
hope this is still one of the top priorities of our elected city 1_
officials. According to what I understand the Redevelopment Agency
is not responsible to those that own businesses. You don't have to
tear down a business to stop a business - what has been done here is
stopping businesses; C - maybe it is time for you gentlemen to take
another look - perhaps since you are so close to the forest you
can't see the -trees anymore. Why not consider_ giving help - for

'example - how about financial aid to sec_ them through this stage
of the mall until completed, or how about giving them the same
assistance in relocation that you. gave -C-o those stores that were
removed to other parts of the C"ity so they can afford the rent and
build up their businesses again and start bringing revenue back
into the City. Although it is generally understood and thought
that the citizens of the City and those we can entice into the City
to spend money bring in -the revenue both sales taxes and property
taxes is what we are talking about.
Gentlemen, will you look into this and unless
we have become very cold hearted, help them. This has been brought
to my attention by Mrs. Baird, owner of the Plaza Beauty Salon -
she needs help from the City that she leaves in and has owned this
business for the past 20 years and until reconstruction began it
was an asset to her and the City. Now if you want her to go out of
business and go into bankruptcy and the others that are about to be
in the same position, don't do anything about it. Just tell her
you will look into it, drag your feet in the process and by the
time you get down to a decision it will be too late and she and
others will be out of business. Gentlemen, we have a crisis on
our hands. We should clear the deck of all other matters and take
action and don't take too long or they will be gone by the time you
get there. Thank you.
Discussion followed between Councilman Browne
and Mr. Kaelin - Councilman Browne asked if he were a self-appointed
representative of these people or picked by the group to represent
them and Mr. Kaelin stated neither, just an interested citizen of
West Covina.
Councilman Browne: I am sure there are many things involved here
and I am sure City Council is cognizant of some
of the situations prevailing, but going back
to the start of the Redevelopment Agency everybody was faced with the
same facts in the area. Free enterprise is free enterprise and very
competitive, coupled with the recession we are in today I think
everybody is seeing a downtrend in business and unfortunately this
prevails possibly more in this area because of the circumstances
that prevailed. I don't.know whether there is a legal step that
the City Council could initiate, we are advocating spending the
taxpayers' money, I don't think we are in the financing business.
However, I would be very receptive to directing some input into
the Redevelopment Agency through the City Manager's office and
sitting down as quickly as possible to try and discuss these pro-
blems. (Mr. Kaelin offered his assistance in anyway.) I can't assure
you there will be any resolvement of it because I think the City
Attorney can instruct you on the involvement we can take, but I
think we deserve to the community a helping hand and an ear to their
problems and maybe we can give them: some assistance and advice, but
monetary - I don't think. we can.

Mr. Kaelin to see if there are ways in which the City can assist.

impasse and we asked staff to work with the
applicant to some -how demonstrate to Council
. the line of sight problem primarily from Citrus Avenue.
The Planning Director presealteca slides and stated at the last
meeting Council instructed staff -to work with the applicant.
Explained what had been done and pointed out the visibility of
the proposed sign at the 42' height from different angles, etc.

HEARING ON VARIANCE NO. 711.

West Covina Mr. Mayor and -members of Council,
(Malldy Williams Olds) there are 4 points that must be shown
before any variance is granted. I am
sure you are all aware of them but I would like to read those
points and my comments. 1 - That there are exceptional or extra-
ordinary circumstances not applicable genex:ally to other property
or class of use in the same vicinity or zone. (This Agency is in a
commercial development, just east of Citrus on Workman Avenue.
When this zoning was granted some 15 years ago our exposure from
Citrus and Workman was excellent, but today this isn't the case.
Several other businesses and signs have gone up in the past 15 years
and severely limited the visibility of our sign. We are the only
auto dealer on a secondary street. The new sign will enhance the
appearance and givc reasonable exposure to this business.
2 - That such a variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other proper-
ty in the same vicinity and zone but which is denied to the property
in question. (Variances Have been granted to five other agencies in
the City, some on the grounds they were next to the freeway and needed
the additional height. (If you have freeway exposure, which we do
not, you don't really need the additional height. If this variance
is denied I feel as a property owner I am being denied. a right
already extended to five other auto agencies.in this City.)
3 - That the granting of such a variance will not be detrimental to
the public welfare or injurious to the property or improvements in
such vicinity and zone in which the property is located. (This
would not be detrimental to public welfare or injurious to other
property owners. `.There are two other signs on poles, one directly
across the street. The Eastland Theatre directly across the
street has a pole sign which is 48' high, and Akron which is very
near in the same development has a sign which is 55' high.) 4 -- That
the granting of such variance will inadversely affect the comprehen-
sive General Plan. (This variance will not be detrimental to the
General.Plan. I feel if this were a completely new agency coming
into this City there would be no problem. This has actually been
proven. Since I am one of the older agencies in the City desiring
to upgrade our signs I don't see why I should be denied the same
rights granted to other agencies when they moved in: After reviewing
the General Plan I feel that my request is implementing the plan by
improving the appearance and economic viability of this City's
commercial areas. Thank you.)

at 1.014 W. Garvey I would just like to back up what
West Covina Mandy Williams said. When I first
came to -this community there was a
tremendous problem on signs as they related to certain types of
businesses that needed exposure. As a businessman and at the-

Chamber of Commerce level, we felt we needed a study that developed
uniformity and legal laws that we can abide by and conform -to. So
we wouldn't have to be working by opinions where somebody liked
something and somebody doesn't. I think. by spelling out the 4
• points that. Mandy Williams spelled out, was ont of the major break-
throughs that the businesses had in establishing criteria that you
could sit in judgment on and in my opinion I believe he met all the
requirements. I believe this is what you are judging tonight that
he met the requirements of the 4 conditions of a variance. Thank

W.C. Chamber of Commerce Mayor Shearer and members of the
1207 W. C. Parkway, West Council, in addition to approving and
being in agreement with what has been
brought to you by Mr. Williams and Mr. Way:, I would like to cover
two subjects. One is the West Covina Chamber of Commerce is current-
ly interested in preserving both the aesthetics and environmental
atmosphere and we are also very aware that certain controls must be
exercised.to maintain this particular protection as far as -the
community is concerned. We are also very aware of the need. to
move along in a direction that will best promote the trade in
West Covina, that is where a good deal of our tax money comes from
and certainly the auto dealers contribute their share.
We think that this is a very legitimate
request that Mr. Williams has asked for his business and we would
like very much to see it approved. It isn't just a matter of meeting
the requirements of the sign ordinance for a conditional use permit
it is also our opinion -that he needs the additional help. I think
if he read to go a little higher it aouldnit do any harm to the
aesthetics in that area. We are currently working through the
Und.erground_ng Utilities Committee, which the City is directly
involved with, in working out the undergrounding of the utility
in that area which would greatly enhance the aestheticsof the area
and certainly make the Oldsmobile Agency more visible as far as the
community and public is concerned.
We would like to urge the Council to
help in the promotion of this general trade. Most of the research
of the Chamber of Commerce is going into two general areas - New
Business Development as well as the Promotion of Retail Trade. I
think this is a very definite step in the right direction. I think
it is deserved and that �:Te must start cooperating with the business
community and if they are willing to spend this type of money to
help with the general promotion of trade I think we should do
everything we can to encourage them. and,encourage promotion. of
retail trade in this area.- Thank you.

2100 Casa Grande Gentlemen, for those of you who do'not
West Covina know me, I am a property owner across
the street from this proposal and I
also operate the business there known as the Eastland Theatre.
I have come this evening to express my viewpoint, which is
completely unsolicited, 1 rr,zght add. I would just like to say
that there are two things that concern me as a businessman there.
One is the architectural and aesthetic value of property in that
area, and the other is of course business volume. This proposal
which you have before you this evening, and I have, looked. over,
in my opinion unquestionably improves the aesthetic environment
in that area, which is sorely needs. I would hope you would not
reject, it because of the great need and although I know nothing
about the auto business, I would assume with a nicer and more

Councilman Browne: Mr. Mayor, I would like to make a comment. I
expressed the opinion that. Mr. Williams had
made a showing on the four requirements of a
variance when he made his original presentation. At the same time
I requested that the Sign Ordinance, having been emansculated to a
degree in regard to the car dealers, that everyone in the city has
a variance, that I thought this should be looked into. I would
like to make the point clear right now that I think the staff
should review the existing Sign Ordinance and upgrade it and make
it consistent with what we have today in the City by.the various
dealerships and I think we would then eliminate future hearings
such as this. I would further state in an area of a business,
be it freeway oriented, on a major or secondary street or whatever,
I think the same degree entitlement of a sign goes with the business
regardless of location.
I would hope, Mr. Mayor,that you and Council-
man Miller would think as a businessman might and see your way clear
to agreeing to some of the facts brought out this evening.
Councilman Miller: Mr. Mayor. Again, a variance is based on those
four points and it has to be demonstrated. I
feel personally last time those points :were
not demonstrated, tonight it was. So I move that we approve.

Mayor Shearer; I don't want to prolong the discussion on the
concept of signs but frankly I thought the
exposure of the 35' sign could Yee seen better
than the 42' sign, but if a businessman feels he can sell more cars
at 42' exposure than he can at 351, well maybe he can in his wisdom.
It is his business and his livelihood, so maybe I am a little wrong
in that situation. I have never bought a car on impulse because I
saw a sign, but maybe I am different than most people.
I would like to comment that I am going to
disagree at this point with Councilman Browne in the concept
there should be no difference in signs be it on a freeway exposure
or a major or secondary street.. One of the concepts of signage is
the ability to read and when traffic is moving faster the sign has
to be bigger in order to be reed. That is a proven situation that
we can't get around and a sign that can be read by traffic moving
55 to 75 miles per hour needs to be considerably larger than a
sign intended to be read by traffic moving 25 or 30. So I think
for future discussions there is a need for consideration as to the
type of sign dependent upon the view both in height and size of
letters.
Councilman Tice: Mr. Mayor, a question. Councilman Browne -
are you referring to the free standing type
of sign for all situations as far as review-
ing that portion of the ordinance? (Answered: Precisely so.)

Staff report dated January 13 and Resolution No. 2566 briefly
summarized; slides shown and explained by the Planning Director
as to location, zoning of proposed apartment and surrounding
area; elevations shown as to architecture and layout. The
Planning.Director stated one criteria necessary for approving a
Precise Plan is that: it be not substantially causing traffic con-
gestion. The Engineering Department and Planning Department
agreed and recommended to the Planning Commission, who also agreed,
that this type of development would incur traffic congestion due
to the design of the development as submitted with tenant access
directly to the street for all but three units, which will encourage
on -street parking, ultimately endangering the public health, safety
and welfare. Pointed out that a number of cars in the area are
now parking on the street and an apartment building ofthis type
would compound the situation. The Planning Commission indicated
that it would hold this over if the applicant cared to change
the layout but the applicant indicated he wanted a "yes" or "no"
answer that night so the planning Commission "denied".

President I represent
Bobby Lee & Associates on this is the design factor of this
Construction and Real. building is something that is very
Estate Brokerage firm very beautiful and very unique. It
has individual entries to each build-
ing rather than the tenement type, herding twenty families down a
long corridor to get to the apartments. It takes the apartment
complex feeling away from the project, it makes them more like an
individual home and it is more desirable for the people. We
can't see where it is going to incur anymore traffic whether you
have the front door or the back door there. People will park
on the street anyway. If the city departments don't want parking
on the street, have them post an 8 to 5 no parking sign, or paint
the curb red. We are not arguing for parking there. We are just
arguing for design. We are not trying to take something away
from the city, we are just trying to add something to it. We are
not trying to cut the cost, we are trying to make a beautiful
building out of it.
We had two meetings before this where
we were supposed tc negotiate these matters and work them out.
Any negotiation so far has been changes only for the other side
and none for us. We gave in to every change they wanted except
this one. We felt very strongly about it, it is the way to go for

this project on this -property. The property is surrounded by three
streets, there is covered parking in the rear and we feel each
ten -ant will. use his own covered parking inthe spaces provided
for him. Sure there will be parking on the street. If you look
at some of the slides just show-n (which was evidently taken in the
middle of the day) it shows places where they have the entrances
off, the'street and the streets are covered with. parking. We
analyzed this and we figured we will be bringing around $30,000
of taxes to the City of West Covina and we want to use the street.
If the Street Department doesn't want us to use the street put up
a "no parking" sign.
As far as causing a traffic congestion.
How can we be causing more traffic by people using their property?
If parking on the street is the congestion then every apartment
house in the City of West Covina has a problem. We have agreed
to put in a fire plug, necessary street lighting and every other
thing that we have been asked to do. All we want to do is build a
beautiful building and we are asking your cooperation on it.

.M & S Drafting I designed the building and spent a lot of time
992 East Artisan on it and did so to have something beautiful
Long Beach and different. I also believe that the people
that live there have the right to use the
streets. We have 40 parking spaces in the back, which is 2 for one
parking for everyone living there, so I don't feel there should be any
parking problems. Another thing we should take into account here is
in case there is a fire the people won't be all going into the
courtyard trying to get out of the one entrance the Planning Depart-
ment wants. I would like to see it the way it is, I think it is a
beautiful building and will be the nicest building around there.
I feel if the people pay $36. a year for taxes they should be able
to use the streets like the other people. Thank you.

Mark Brasher (Sworn in by the City Clerk)
1008 S. California Mr. Mayor and gentlemen - as this proposed
plot plan sets he is talking about 40 places
for people to park. This is sitting next to
my bedroom. There are two master bedrooms in the house on that
side, we have five adults -living there, which is a pretty full
house. I rented the apartment and made a mistake renting one
next to these parking areas and from 6 in the morning until 12 at
night or later you have people coming and going. I don't think
it is quite fair to my mother and the two elderly ladies living
with us to have to put up with this problem. As far as the parking
goes it is a. real gimmick. Over at the school on Saturday and
Sunday they have baseball, little League, football, etc., it is
parked solid, you can't get anymore people around there. This is
only a half a street and if you try and drive down it you can't
because of the people parked there. People.from -those apartments
do park there and -there isn't room for two ears because it is
is only a half a street. There is no stop sign on the side street,
so there is congestion. It is a bottleneck - plus the other
problem now of unemployment, we have all the unemployment people
coming through there now. We can't keep people out now. We put
up a 6' fence and we can't stop them. (Explained further)
We can't contain the people now and he is talking about multiple
density, 20 apartments with 2 and 3 bedrooms. It will have a lot
of people and kids and noise. I personally don't think it should
be next to a re s i_deni.i al house. I would say the grandfather clause

regarding apartments is in our favor. We were there first with
the mostest - as I understand it.
Another thing, in my opinion, the way it is
set up and I didn't get a. good shot of that one plot plan - is
that driveway going to go both ways on that street? (Applicant
answered "yes") Does that mean I will.. have people going both ways
from California Avenue? (Slide xeshown)
Mayor Shearer: Yes, there will be a driveway out on St. M alo
and on California on the proposed plan.
Mr. Brasher: There is no room to handle it. I have a
hassle getting out myself when I go td work
now. How am I going to sell my Property
with an apartment house next to it?
Mayor Shearer: The question before us now is not a matter of
zoning. The zoning that allows 20 units to the
acre is already on the property. The question
we are discussing this evening is the precise plan - what the man
is legally entitled to under the present zoning.
Mr. Brasher: I will so stipulate that I don't like it.
PUBLIC HEARING CLOSED; COUNCIL DISCUSSION.
Councilman Miller: Mr. Mayor. I have always felt that still the
emphasis in West Covina is the single family
home dwelling. We are faced with sections of
property where it may be of more use value to put something else
th ere, iHaving studied tilis report .I_ note there is the possib _l ity
of another apartment building perhaps in the future going in
across the street - that is only speculation. With the concern of
traffic congestion at this time I would feel that with this
complex being proposed it warrants consideration if we can overcome
our traffic congestion of what might overall develop in that
immediate area. So at this immediate time I would move to dis-
approve.
(Council members ascertained that the Engineering and Planning
Departments main objection is the fact the units are oriented to
the outside rather than the interior court; also two apartments
would have no access if the plan were reversed; the Building Code
had no specifics relating to the access of all apartments such
as this one to the interior and the plan would have to be redrawn
to make those two units accessible. With regard to the half street
Council was advised there would.be dedication of the street when
the adjacent property is developed. Councilman Browne asked
Mr. Miller "do you feel in your own mind that the street is at
present overburdened with parking based on the overflow from
the existing apartments"and Mr. Miller said "at this point in time
it seems to be handling it fairly well, the main concern staff has
is the encouragement of the use of streets by the exterior feed to
the unit when this property does develop."
Councilman Chappell: Basically I am becoming more and more
dissatisfied with apartments period,
but we do have a zoning situation here and the gentlemen have come
in with what appears to be a good plan but the only waythis plan
would be acceptable would be to no park that street, such as we
did with the Barranca apartments. We put no parking along there
because we had a problem and we solved that by painting the curbs
red and the builder here has said he has no objection to painting
those curbs red and :Forcing the people to park in the back as we

would like to do. If we are going to have apartments in our city,
and I can't stop them - there is property zoned all over for them -
I think we should attempt to have apartments that are attractive
and beautiful. We used to call this the City of Beautiful Homes and.
now we have a development coming in here with apartments that are far
more attractive than many we have thro7_zghout the. City. The simple
solution would be to paint the curb red all around the property and
solve the problem -and let them park in the back where they should.
We can't force them to park back there but we can make it inconvenient
to park anywhere else along that street.
Mr. Miller: Mr. Mayor, one further comment. From staffs4.
point of view and the Commission concurred
because this came up at the Commission hearing,
that if we can by design in a new project eliminate a future problem
such as traffic congestion we should steer it that way rather than
allowing a problem to go in and then correct it or solve it by
painting the curbs or restricted parking, that probably at some
future time would raise some concern of property owners or tenants
living in the project and then it would come before the City
Traffic Committee or other parties to get it changed and then we
would have the traffic congestion. If we had an existing apartment
on the site, now and we were before the Traffic Committee the painting
of the curbs red would be an alternative one and an acceptable one
to staff, I believe, however if we can eliminate that problem before
that problem occurs that would be the preferable solution and that
is why staff recommended what they did.
Councilman Chappell: But we have that design in a lot of apartments
and the Barranca is a good example, yet we had
to paint the street along there in red because
they were parking out there. I don't think they are going to park
in the bark anyway, I think they will park in front no matter which
way you have the apartments face, and this is an improvement over
some of our apartments with barrack type exteriors. The parking
problem will be there no matter how you design it. I don't see any
difference in the parking problem on Vine Street at this time and I
may be wrong. Once again I say I don't like apartments. At one
time I thought they were good for West Covina and voted for a
:couple of zone changes to apartments but I don't think they are
the answer to West Covina, but this property is zoned MF-20 - - I
would like to have my fellow councilmen comment on my remarks.
Councilman Tice: I don't think it is fair to paint the curbing
red along there - there probably will be two
cars to a family so where do the visitors park?
Councilman.Chappell: If .they turn the design around we have to
vote for it - we have to pass it. So we really
haven't solved anything, that is all I am saying.
Mayor Shearer: What kind of access is there from the rear off
the courtyard now? I think somewhere I read
in the report about sliding glass doors?
Mr: Miller: Yes, there are sliding glass doors with access
off the interior and providing access from the
units into the interior courtyard. If the plan were reversed what
staff was suggesting was that the mai_nentrance be off the interior
courtyard am a and that the sliding glass door upon onto a small_
patio separated from the front yard or sidewalk or street by a
fence or wall so it would be a usable area for patio purposes and
maintain the secondary access for emergency purposes but would not
be direct access to the street.

Mayor Shearer: Frankly.1 think the comments made here on both
sides have boen good. We had on the Consent
Calendar a letter trom a.citizen objecting to
our street parking. Probably in. the last 5 years or so we have had
at least a dozen or more such requests to restrict our street parking
primarily to allow street sweeping operations to be conducted. Yes,
we could paint the curb red. An overall parking ban I think would be
unfair because eventually the street will be wide enough to handle
parking and vehicles, the ma.inproblem is the ability to sweep.
I think that now is the time before we build and design permanently
a structure that encourages rather than discourages voluntary com-
pliance with off-street parking. If we don't do it now then our
only recourse is by putting up arbitrary no parking signs, which
really may not solve the problem we are trying to solve. I believe
the building could be as beautiful set with the main entrances
being with the internal access as it can be with the external or from
the street access. I will vote to sustain the action of the
Planning Commission.
(Councilmen Tice and Chappell felt that either way it went there
would be a parking problem; stated their reasons.)
Councilman Browne: Mr. Mayor, this particular property over a period
of years - I think it has been zoned multiple
family since 1962 - has had three separate plans
come in .for approval and at no time have these plans been implemented.
I think at least one before the Planning Commission was denied by
factors of no compliance of two parking spaces. There was a deficiency
of two and there was a continuation on and on. I feel if this is the
same ownership coming in for development they should be pretty
cognizant of what the city is trying to plan for the future - eliminate
problems of parking. I would have to agree half way with what
Councilman Chappell said in reference to painting the curbs red;
however that will not solve the problem. We will have complaints from
adjoining houses, people will not have sufficient parking space for
visitors and until such time as the applicant would deem fit to come
in with a plan that would be more towards eliminating the.problem or
move to the rear, which I think can be achieved very easily, I would
be against putting this in. I do want to point out the zoning is
in existence and what we are considering is the precise plan and it is
the charge of the Planning Commission and the pity Council to protect
the rights of the city and the surrounding residents. I feel very
sincerely that way.
Motion by Councilman Browne to disapprove Precise Plan #66.5 and uphold.

Umark, Inc., I will attempt to be very brief_,
32129 Lendaro Canyon Mr. Mayor. Mr. Miller covered it very
West Lake Village adequately but with the addition of
the two new Councilmen I would like to
run quickly through what has transpired and what we are trying to do
here. If you have a specific question as to any of the changes per se
other than it being a house cleaning operation which if you followed
the Planning Commission's minutes from time to time you will see that
they wanted this updated for sometime. The fire station - wrong
location; Shadow Oak - different configuration than shown in the
original plan; city boundary changes - things of this type. We all
drug our feet because there were other priorities. Open space
elements, the various elements, the Planning staff had to go through,
a totally new Planning Staff than what approved the PCD originally.
So the Planning Commission suggested that Umark with their unlimited
"cash reserves" do the necessary staff work and theoretically update
the Master Plan text. This we attempted to do with. a great deal of
help from staff. We turned our engineers lose and our staff, and did
come up with what we think is a very workable plan. We did try to
cover all bases, but I know, just as Mr. Miller does that we haven't
covered them all, we will go on down the road a year or six months
and say - how did we miss that, and be back for some minor change.
(Briefly explained what transpired previously. Pointed out the re-
location of the community park and that it has been graded by
Umark at an expense of some $300,000 to get that land in a. condition
for use by developers.) We paid $11,000,000 cash for this land in.
3.969, we are not going to walk away. Whether a builder comes in and
doesn't make it he can come and go but Umark has an awful big anchor
tied to it to stay here for sometime.
Jane Kerzik (Asked specifically what the Amendment involved
1737 Oak Green in the area she lived in.)

Ron Sloane What is immediately adjacent to you hasn't .
Umark, Inc. changed. We have a 4-plex project that exists
there right now. A portion of that will be
continued I am sure immediately adjacent to our northwesterly
property line. The rest of that area there will be a development
plan filed probably in 6 to 8 months and at that time you will
again receive notice and, at that time the plan will show what type
of projects. The zoning hasn't changed in that area. As I recall
it is all single family with 2, 4, and 15 units per acre - no apart-
ments whatever. The development plan we are working on right now
called for a town home and a cluster type concept,_ and at one time
there was talk of a church going in just off of Azusa, however at
this time they don't feel there is enough buildable -acreage in
there for their site. So I am sure you will have raw land there
for the next several years.
Donald Steve Just a question. I received a letter the same
3028 La. Puente Rd. as the lady and what I am confused about is,
Mr. Miller explained to me that directly
across the street from where I live it will be Walnut on both sides.
Why would I get a letter if I am next door to- Walnut?

La Puente Directly behind me there is Amar Road and then
a fairly steep hill and I am concerned about
what kind of housing or construction will be built there and when?
(Mr. Miller stated that area is zoned as 7 dwelling units per acre
and it is anticipated to go into single family and that Mr. Sloane'
indicated possibly within 6 to 8 months or longer, depending on when
he gets a developer for it. Mr. Benson .asked if there is any
possibility of that plan changing to multiple family dwellings?
Mr. Miller said only through a public hearing similar to this and
all property owners within 300' would be notified.) (Ron Sloane
offered to answer any questions anyone in the audience might have
after the hearing if they wished to discuss it further with him.)

COUNCIL DISCUSSION.
(Cou.nci-.ldiscussed the proposed plan of development, feeling it
was a big improvement especially in regard to usable land,.
Councilman Miller asked Mr. Sloane in regard to the single family
dwelling where they are shown as attached and detached what
percentage of the homes will be detached? Mr. Sloane said he
could not give a flat answer as to 50/ or 10/ but the present
market is shying away from attached housing (explained in further
detail the reasons). Councilman Miller asked how many condominiums
projects are we looking at? Mr. Sloane stated FHA suggested
condominiums, 10 units to. the acre and pointed out the area;
explaire d the latitude allowed under the PCD but until a developer
is found nothing is set.)
Councilman Miller: . On page 8 it talks about the pedestrian
connections. The last sentence reads "the
security lighting system shall be approved by the City of West
Covina Police Department." Are we saying a combination of our
City Police patrolling that area and then the City actually
incorporating the lighting system also?
(Mr. Miller explained over the past several months there has been
discussions with Rowland School District regarding access to the
school from the subject sites. Umark and the School District have
come to an agreement to provide temporary access as the developments
north of the City boundary and the bowl area and south of Shadow Oak:
as -they develop they will provide temporary access to the school..
Umark will.provide the accessway provided the School District

(Staff Report) cerned if this is
the complete
description of the test. In one area in particular I think it
leaves,it open for variations from test to test. I think today
particularly we should make sure we do not lay ourselves open to
allegations of fixing or rigging a test to that certain element of
society that normally does not want to become firemen and police-
men. That has to do with the obstacle course. I -lost of the items
are pretty well described as to length, time, etc., bu t the
obstacle course says "candidates shall spring 20 yards to a over-
head ladder bar and traverse the. bar hand over hand - now is this
ladder bar 3' long, 20' long or what? The same comment where
later it talks about proceeding to a maze.but it doesn't say what
this maze is?.

Up as we were out there. We would take pylons with us and set it.up
and then rely on diagrams front the preceding tests and set it some-
what close to what the original test was. What we have done here -
we are working with Rio Honda College, we will use the physical
agility test course constructed at the college. It is a filled test
course. If the Council desires we can get further information. It
won't be amended, it is installed in concrete and it is there.
(Mayor Shearer asked Mr. Wakefield if there was any problem in the
wording, where the City might be open to comments saying the ladder
used to be 4' long and now it is o' long or whatever?),
Mr. Wakefield; Mr. Mayor, I don't believe so. This is like
any other portion of the examination. The
questions and the test are subject to change
as circumstances may require. I can't conceive of there being any
question arise with reference to the physical agility course - that
already exists. The key ingredient is the fact it is the saine for
all applicants for any one given test.
(The Mayor yDointed out the running test was 11-4 miles, four laps
around an oval track and the Deputy Chief said that was supposed to
have been amended- to 5 laps. Mayor Shearer questioned why firemen
have to run an extra quarter mile in 12 mi-.-lutes over police officers?
Deputy Chief Meacham stated he was not aware of any discrepancy between
the two tests - the only difference was in the fire.''

VAPOR RECOVERY SYSTEM Mr. Aiassa: Mr. Mayor and members
of Council, this item
is a request from the Air Pollution Control Board which we must
comply with. I have only one provision to add to it, that the in-
dividual who makes the installation is the one that gets the proper
approval from the District stating it meets their requirements.
(Councilman Browne questioned the price, asking how many people
had been contacted and how many pumps are involved? Mr. Wolfe,
Street Superintendent, stated there are two pumps to be connected
to the Vapor Recovery System plus a Vapor Recovery System .from the
tanks to the delivery -truck. Councilman Browne and Mr. Wolfe
conversed further in regard to the system and the price. Council-
man Browne stated the price was excessive in comparison to two
other situations he was aware of where four pumps were involved and
six tanks, and offered to supply the name of the contractor that
accomplished that job, if staff so desired. Mayor Shearer
suggested that Council go ahead and approve the expenditure tonight
because of the time element involved but with the understanding
that this be reduced as much as possible. Council agreed.)

from the general revenue sharing funds for equipment and installa-
t .li.on of a vapor recovery system at City Yard as mandated by the Air
Pollution Control Di -strict, and instruct staff to work with
councilman Browne -to try and secure additional cost information.
