The Pledge of Allegiance was led by Diana Spencer, Renee McConkey, Melody Adams and Charlotte Eckler, members of Brownie Troup 444, under the leadership of Mrs. Tiska. The invocation was given by Reverend Myrus Knutson of Christ Lutheran Church in West Covina. Mayor Shearers The next order of business will be to turn the floor over to Councilman Miller for any opening comments he would like to make. Councilman Millers I will just take a moment to say it is indeed a high privilege and honor for me to be here on this City Council to represent the citizens of West Covina. A real personal thanks to all those people for their efforts, time and prayers. To take the challenge at this moment to go forth and meet the challenges of our day and age with our youth and youth programs, to meet our tax structure through our central business district, and to move forward into meeting the needs of our senior citizens, and to work with this fine Council, I thank you. Mayor Shearers I would just like to say a word of wel- come to Gary. It has been a rather long and difficult situation that the Council has gone through - much debate, much soul searching. I think we have come up with the best solution possible that we as mere mortals can come up with. We have our limitations in the wisdom with which we can operate. He has shown that to me already. I feel like an old man nowt it wasn't long ago I was the Junior member of the Council, and now I am the second Senior member. Like all of us when we first cams on, we had a lot to learn then, and I am sure Gary realizes he has a lot to learnt and those of us who have been on, still have a lot to learn. Gary, good luck. We know that the City of West Covina will move ahead under your helpful direction. CONSENT CALENDAR Mayor Shearer explained the procedure of the Consent Calendar items and asked if there were any comments on any of the following items& 1. Mr. Aiassa reported that the City is following the standards of the Board of Supervisors very closely. Most of the Christmas decorations and lights in the interior of City Hall will be closed at the time the office is closed.except for some overhead lights for the janitorial service. It is being discussed that maybe one tree will remain lit. Councilman Browne replied that he did not want to be a Scrooge, but he felt that the energy situation is not as lessened as some people think it is, and any action that the City takes along with the County will set an example for the people in the community. He would like to see the policy adhered to; but, if the City Manager would like to have one tree remain lit until 10j00 P.M., that is fine. Mayor Shearer agreed with Councilman Browne. He noted that according to the Item, lights will be turned off at the end of the workday, which in effect is nightfall, so why have them on at all? CITY ATTORNEY ORDINANCE NO.' 1260 "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADDING SECTION 6239.1 TO THE WEST COVINA MUNICIPAL CODE RELATING TO THE SUSPENSION AND REVOCATION OF AMBULANCE AND TOW TRUCK OPERATOR BUSINESS LICENSES." Mr. Wakefield] This ordinance is designed to place the City's procedure in line with the pro- cedures recently adopted by the County of Los Angeles which provides for the revocation of tow truck and ambulance operator's business licenses for violations of the State laws which prohibit soliciting business for attorneys. Motion made by Councilman Browne, seconded by Councilman Miller to approve the request. Councilman Tice reported that he had looked over the area that had specifically called the problem'to attention. There could be some real problems in that area. He felt that the situation should be resolved post-haste before someone gets hurt. Mayor Shearer noted that everyone agreed with Councilman Tice, but it is a very difficult thing to pinpoint who is at fault or who is responsible for any corrective measures. Motion carried. DESTRUCTION OF CERTAIN POLICE DEPARTMENT RECORDS RESOLUTION "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA APPROVING THE DESTRUCTION OF CERTAIN RECORDS." Mr. Wakefields The Report from the Chief of Police requests authority to destroy crime reports and inci- dent reports covering the period from 1965 to 1972, and arrest records prior to January 1, 1969. The existing provisions of the Government Code provide that the City Council may authorize the destruction of certain records that are not required by law to be maintained subject to the adoption of a resolution and with the approval of the City Attorney, all been microfilmed. Mayor Shearer asked if these records have Mr. Wakefieldo Some have and some have not, I purpose of the destruction of records is simply to avoid the microfilming. think. The these particular necessity for Mayor Shearer indicated he was under the impression the records had been microfilmed, therefore they were to be destroyed. - 8 - CITY COUNCIL December 9, 1974 Page Nine Mr. Wakefields If that is true, then no action of the City Council is necessary. In other words, once they have been microfilmed, a record is maintained and the original record may be destroyed pursuant to the statute. Mr. Aiassa noted that some of the cases have gone to higher cases and the duplication is made already. The Council asked that more information be supplied to them on this matter. Motion made by Councilman Chappell, seconded by Councilman Browne to hold this matter over until the next regular meeting of the City Council. Motion carried. AT 8r00 P.M. THE MAYOR RECESSED THE COUNCIL MEETING FOR THE PURPOSE OF CONDUCTING THE REDEVELOPMENT AGENCY MEETING. COUNCIL RECONVENED AT 8805 P.M. ORAL COMMUNICATIONS George Carr Sometime back, we were here to discuss 1240 S. Sunkist an alley with you people one night. West Covina At the time you were going to redevelop the ground behind us. At the time I brought up the question of water drain- age. It seems to have been ignored. The other night we had quite a bit of rain and we had water in my buildings - about 5 inches deepf we had to throw away a lot of things. I had the assistant something from over here out there and he couldn't tell me if water ran uphill or downhill. So, we are here to see if we can get something done about water drainage on our side of the grading. What you have done there is charge the contour of the ground. We want drainage put in there like it should have been: Councilman Brownes Were you relating to a time that you appeared before the Council and spoke in opposition to some project that was coming into the City? George Carr+ Yes, I am, sir. Councilman Brownes What is the location? George Carr: 1240 S. Sunkist. Councilman Brownes And, what project is it that went in adjacent to it? George Carr: Nichols. Councilman Browner I believe there are certain conditions on that development relative to drainage. g Are there not, Mr. Miller? Mr. Miller: I would think so. - 9 - CITY COUNCIL December 9, 1974 Page Ten Councilman Browner If you spoke in oppostion to this at the time it came up for a Public Hearing, there were certainly conditions relating to this development requiring compliance for drainage. But, we would have to have a copy of the resolution passing that. George Carrs I do have that. There is no provision made in there for drainage on our side. Councilman Brownes I don't think the minutes would reflect that, Mr. Carr. Mayor Shearers What Councilman Browne is talking about - that would be on the plan. Is there someone on Staff, Mr. Aiassa, that is familiar with the drainage problem and could shed some light, or is this something that would have to be looked into? Mr. Aiassas Mr. Zimmerman, could you comment on this? Mr. Zimmermans We would be very glad to meet with Mr. Carr and investigate it on the grounds. We are not prepared at this time to comment on the situation; and be happy to report back to the next Council meeting, if Council should so desire. Mr.Aiassas And, also check on the development plan to.see if a drain was provided, Mr. Miller. fully for The area in question was described more Councilman Tice. Mayor Shearers I think you will find that the provisions of most approvals for precise plans require that provisions be made for adequate drainage. It is also a matter of law, I believe, that certain things such as diversion, blockage of flow, etc. is prohibited . If any of these things have taken place, I am sure there is some recourse either through the courts or through the City, depending upon whether it is a matter of the precise plan or whether it is a matter within the law. We would not be in a position, I don't believe this evening, to say what is the proper course of action. I would request Staff to look into this post- haste, before the next rain, if at all possible, and make recommendations to us if there is something that the City should be doing. George Carrs I believe that Mr. Wakefield has a little answer for you, too. Mr. Nichols told him that he would not sell us that alley until he found out if he needed it for drainage. Mr. Wakefields Yes, I remember, Mr. Carr. We discussed this with some previous problems. The last communication I had with Mr. Nichols involved the title to the property - a 24 foot strip which you have referenced. Mr. Nichols was originally under the impression that he owned the 24 foot strip. The deed on file with the City indicated - 10 - 1 r1 CITY COUNCIL December 9, 1974 Page Eleven that was not the case, that it belonged to the previous owner of the subdivision area. However, in a series of correspondence between Mr. Nichols and myself, he was able to pursuade the title company that the title company had made a mistake in the prepara- tion of the original deed. That mistake was corrected. The supple- mental deed was obtained to the 24 foot strip investing it to Mr. Nichols. At his request I prepared a deed conveying the 24 foot strip to Mr. Carr and suggested that Mr. Nichols execute the deed a nd deliver it to him directly. I have had no further conversa- tion with Mr. Nichols since that time. This was about 4 weeks ago. Mayor Shearer: I take it the deed has not been executed and delivered. George Carr: It amazes me how he could get a deed to an easement, Mr. Gilbert I am new here, been here since October 1234 Sunkist 1st. I do know this rain brought down West Covina clay from the fill at the end of my backyard. I had a good 6 inches of water in my yard. A Mr. Green was supposed to come out and look at it, but he has not come yet. Mayor Shearer: Who is Mr. Green? Mr. Gilbert: In the City Building Department, or something. Mayor Shearer: As we have indicated, to discuss this this evening would serve no purpose Two of us on the Council are familiar with this problem in another veins the drainage is a new aspect of it. Staff has been requested to look into the matter and report on the subject of drainage at the earliest possible date. Mr. Martin Mr. Mayor, I have just one more thing 1220 S. Sunkist to add to this - the easement that belongs West Covina to the Edison Company. I have a pole directly at the rear of my property and it seems as though with this new building project going in back there, that there is absolutely no access to the easement coming in on their side. I would like, at the same time they check this out for Mr. Carr, that they check out the easement and find out if it lies on both sides of the property or on one side of the property. If they have to access to the heavy pole back there, running their equipment through my yard, somebody is going to be tearing up my driveway. Mayor Shearers I would think that the matter of an ease- ment is a matter between you and the Edison Company. Frankly, with all due respect, sir, I don't think this is a matter for the City to be determining whether it is on your property or not. That is a matter between the property owner and the owner of the easement, in this case, the Edison Company. Is that correct, Mr. Wakefield? Mr. Wakefield: That is correct. which you have to probably indicate I think that the deed your property would the extent of the ease- CITY COUNCIL December 9, 1974 Page Twelve ment. If you have a 6 foot easement, then I would assume that half is on your property and half on the adjoining property because normally those easements are wider than 6 feet. Mr. Martins This is the way I understood it. It is a serious problem they have created back there though. I have just as high an embankment as Mr.,Carr, but did not have floods with the last rain. Mr. Wakefield: Mr. Mayor; this is really all a part of the overall drainage problem, and when that is resolved, I think the ease- ment problem will be also. CITY MANAGER , PUBLIC EMPLOYEES UNION, Re Replacement Grievance - Fire Department A DIVISION OF TEAMSTERS LOCAL 986 Mr. Aiassa reported that after discussing this matter with the representatives of the Union and also of the Fire Depart- ment, the City Manager would like to recommend that the City Council adjourn to December 16 1974 at 4830 and set this up as a Public Hearing to hear the grievance, Councilman Tices Was this grievance before the Personnel Board? Mr. Wakefields Both the current Memorandum of Under- standing and the previous year's Memorandum of Understanding between the Firemens Association and the City provided that grievances would go directly (that were unresolved at Staff level) to the City Council rather than to the Personnel Board. For that reason this matter has not been before the Personnel Board. The particular type of grievance that is provided for in our salary resolution and personnel procedures relates to grievances that involve individual employeest maybe either an individual's working condition, his assignment, or maybe disciplinary action that has been taken. This is a matter which involves really a matter of interpretation of the provisions of the Memorandum of Understanding as interpreted by Staff and members of the Fire Department. It is not an individual grievances it is a grievance of the representative association. of Mr. Aiassa. The Council agreed to the recommendation REGIONAL PLANNING COMMISSION Mr. Millers The Staff Report indicates ZONING CASE NO. 6091-(1) the Staff comments that were trans- mitted to the County Regional Planning Commission on this particular matter. The applicant is asking for unlimited C-3 Zoning on the Southeast corner of Azusa and Temple. Staff indicated it would be far better to limit that to C-2 or C-1 Zoning. This would still allow the uses that are already on the site, but would eliminate many uses that would not necessarily be the most conducive The City of West Covina, the adjacent St. Martha's church and other residential in that area. - 12 - CITY COUNCIL December 9, 1974 Page Thirteen This is brought to Council attention because it was referred to us by the Council and, if you have any strong feelings that you want us to convey to the County Regional Planning Office, we stand ready. The Public Hearing was continued from December 4th to December llth, so we do have time to make additional comments, if you feel it is warranted. Mayor Shearers What type of uses are allowed here, as an example, that would not be in the best interest of the church or West Covina? Mr. Millers Fairly heavy body and fender, types of uses that are related to heavy automotive works bars and things of this nature that could be located within the confines of this property. One point, and it is quite apparent, that while we are dealing with a certain amount of acreage (about 5). a vast majority of this land has already been developed with a Seven -Eleven type of store and a service station. However, it would mean that if at some future date one of these particular facilities were to be vacated, it would permit a much heavier type of use to come in. The C-3 in the County is quite similar to the old C-3 that the City of West Covina had as far as uses, and this allows some pretty heavy uses. Mayor Shearers Would the uses in that area that are already developed - the motorcycle shop across the street, the trailer home sales, Marie Calanders, and Thrifty Drugstore, be allowed under C-1 or C-2? Mr. Millers Yes, it would take a C-2. Mayor Shearers So, we are talking about something,possibly, that is far beyond what is already in the neighborhood. Mr. Aiassas For Council information, the Plaza is originally C-3, and I think the new Longs Drugstore is C-2. Councilman Ticer It would seem to me that it would have some effect on the residents in the area. Councilman Brownes Are we going to have a Staff member repre- sent the City at the Public Hearing? Mr. Millers Yes sir. Councilman Browner If you recall, this particular area was subject to a study of annexation by the City of West Covina approximately two and Home Site was developed. one half years ago, at the time the Mobile One of the considerations at that time was the Sphere of Influence. That is directly in the Sphere of Influence of the City of West Covina. If at a future date, we are to consider annexing this particular portion, I would certainly stress this matter. We would want the zoning contiguous with ours. - 13 - CITY COUNCIL December 9, 1974 Page Fourteen I don't think that they would want to put any heavier industry in that areal however, you never know. I think this ought to be stresseds if they want to place this within our Sphere of 00 consideration. Influence, we certainly should be given Mayor Shearers According to the report, the property in question is less than half an acre. Is there any particular useage proposed that you are aware of, Mr. Miller? Mr. Millers There are no additional uses being requested at this time. Councilman Browne: Do you have any idea what prompted the request for the zoning change? Mr. Millers We have no idea at this time. Mr. Aiassa: They do not have precise plans in the county. Mayor Shearers I would recommend that we take a position to authorize the Planning Director or the Staff be present at the Public Hearing in opposition in the absence of information to what is being proposed there. Motion made by Councilman Tice, seconded by Councilman Chappell to authorize the Planning Director or the Staff to be present at the Public Hearing, according to the recommendation of Mayor Shearer. Motion carried. Mr. Aiassas I think there is one thing the Council should be aware of. Once the County Planning Commission approves this, there is no limited time before it goes to the Board of Supervisors. So, we really don't get much notice that this case will be reviewed and approved by the Board. Councilman Chappells We have taken the position that West Covina has no flooding problems, and I think the last rain we had gave us a good opportunity to uncover any problems that might have developed in the City. 1 I am fully aware of one problem. The regrading of Citrus Avenue and partially closing the drainage ditch between Christ Lutheran Church and part of Cortez Park caused the church to flood. Considerable damage was done. As you know, the basic Fire Policy does not include flood coverage. There are also probably many other areas of the City that we are not aware of. - 14 - CITY COUNCIL December 9, 1974 Page Fifteen Mr. Aiassa: I have the background on that. The channel used to run south of the church and when they gunited the channel, they actually put it to the north of the church and then they filled in the area and also where there was a wooden bridge. I believe the party that was involved was the Los Angeles Flood Control. I think Mr. Zimmerman and myself could check back with the Flood Control records. The Council directed Mr. Aiassa to look into the matter. Four members of the City Council spent two very interesting evenings and one afternoon interviewing 16 people who expressed an interest for this one position. Needless to say, by its very number it was difficult, particularly. when you consider that all 16, I am sure, could have done a good job. But, unfortunately, there are only five positions, and four of them are already filled. It has been the decision of.the Council, after considerable discussion, to appoint Mr. Jim Clopton to the Recreation and Parks Commission. Motion carried. - 16 - CITY COUNCIL December 9, 1974 Page Seventeen COUNCILMEN'S REPORTS/COMMENTS Councilman Millers I would like to bring to the attention of the press to do all they possibly can in regard to the Community Develop- ment Workshop that will be here this Saturday between 1000 A.M. and 4s00 P.M. to help set up goals for the use of the federal money under the Community Development Act of 1974. Mayor Shearers Further information on that would be available from Mr. Salazar. Councilman Tice: I have been in contact with Supervisor Kenneth Hahn's office and also the Air Pollution Control District on the Retrofit Knox Smog devices for 1966 to 1970 automobiles. From the information I have been able to obtain on the effectiveness and cost - it is one of the biggest "rip-offs" that has ever hit the American public. Councilman Tice read various facts and figures to support his statements. Councilman Tices Just recently the State Senate and Assembly requested the State Highway Patrol not to cite individuals for not complying with this law until after a suit that will be heard some- time in mid -January by the Board of Supervisors against the State is settled. The other members of Council agreed with Councilman Tice and discussed their knowledge of the device. Motion made by Councilman Tice, seconded by Councilman Chappell to prepare a letter to Assemblyman Lancaster on the Retrofit Knox Smog device. Motion carried. Councilman Tices I want to ask Staff if they have any background information on recycling centers. The City of Covina has one at the corner of Hollenbeck and Puente. I would like to know how effective these are, or if they are self-sustainings whatever information is available. Mayor Shearers I would like to recognize the City Manager of Covina, Don Russel, and his lovely wife. Also, we do have a vacancy on the Personnel Board as a result of Councilman Tice's election. We have received four responses to an article in the paper.
