The regular meeting of the City Council called to order at 7:30 P.M., in the West Covina Council Chambers by Mayor Chester Shearer. The Pledge of Allegiance was led by Doug Watson and Richard Chesler of Cub Scout #423, Den I; and the Pledge of Allegiance was given by George Zimmerman, Public Service Director. APPROVAL OF MINUTES I received word from Councilman Lloyd that he will be late this evening. We will pro- ceed and I will ask that Councilman Chappell them down to Councilman Browne to counter - May 13, 1974 Councilman Chappell: Mr. Mayor, I will move the approval of the minutes with corrections as follows: In the area of the Independent Cities' dues structure the minutes stated they would be raised from $500 to $120 and it should read $720. The dues structure is based on population. City Clerk: Mr. Mayor, the Resolution on Page 34 should read "Resolution No. 4880." •Motion to approve with corrections seconded by Councilman Browne and carried. (Accept and file) Joanne East Mr. Mayor, I would like to discuss No. 1-h, 1438 East Portner St., pertaining to the West Covina Independence West Covina Day Parade Permit application. It states we chosen a new parade route and presented •have our parade permit. I would like at this time to introduce our Dispatch Chairman, who has worked on this - David Erickson. (Mr. Erickson displayed a map of the new proposed parade route and explained it in detail; further stating the route has been approved by the Police Department.) Joanne East: Do you have any questions or comments? Mayor Shearer: I have a comment. I am glad. The other route was very long and hot and I am sure for the parade participants it is a very fine move. Joanne East: Thanks very much. I am very proud of my committee for coming up with this outstanding route. Councilman Chappell: One thing in regard to the parade. I still have visions of seeing American flags handed.- out along the parade route and this might be the year if funds can be raised with the help of the Chamber and other citizens in the community. I think this would be a real affair if • every one had a little flag as the parade marched down the road. Joanne East: Mr. Chappell, we would be very happy to talk to you about it and get your thoughts on it - this is the first we have heard of it and we are happy to hear about it. I am a mem- ber -of the Key Club of Workman and LaPuente and Los Altos High School are going to help us in running a Bike-A-Thon. We were advised to come here and ask •permission to do this. We are doing it to help Beverly Manor raise some money which Ellen Agerbee will explain. Ellen Agerbee: I am Director of Volunteers at Beveraly Manor and since working there I felt the people there didn't have anything of their own so I asked my Administrator if we would build an aviary and he said it was okay but we had to raise the money ourselves. We felt the volunteers weren't strong enough to do it by themselves so I went out and asked three Key Clubs to help us and they said they would. So we planned it and got our sponsors and everything and I would just like to know if we can have the Bike-A-Thon. (Explained the proposed route, stating it seems pretty safe except for one part on Azusa Avenue where con- struction is in progress). Mayor Shearer: I have a suggestion to make, if I may. I also noticed on the map the route going up Azusa Avenue and the portion which is presently under construction, especially under the freeway where it appears a little dangerous and I would suggest that you give consideration to revising that going north on Lark Ellen and utilizing the pedestrian overpass which is presently on our posted bike route and was selected because it was much safer and it would not add or take away any from the distance. (Explained further.) Would you agree to making that change in your requested route? (Applicants agreed to change. Mayor Shearer asked Mr. Aiassa if that •change can be made in the applicantion,'and Mr. Aiassa advised it would be taken care of and worked out with the Police Department, further suggesting that the applicants get in touch with Mr. Clarence Markham in the City Manager's office, and he would direct them to the proper departments involved, etc.) Mr. Wakefield: Mr. Mayor, could the recommendation on Item 4-c be changed to "Deny and refer to the City Attorney." This particular claim is improperly directed to the City and will appear upon the Redevelopment Agency agenda.) Mayor Shearer: Yes, we will change that recommendation. I would like to have Items 1-b and 1-e removed. Motion by Councilman Chappell to approve Consent Calendar items 1 through 7 with the exception of Items 1-b, 1-e and 4-c as modified by the City Attorney. Seconded by Councilman Browne and carried on roll call vote as follows: AYES: Browne, Chappell, Shearer NOES: None ABSENT: Lloyd, Nichols • ITEM 1-b Mayor Shearer: Regarding the Notice of Southern California Public Hearing, there Rapid Transit District are going to be two hear- ings, I believe, and this letter only talks about one on the 6th of June. (Mr. Aiassa answered "yes") I will be unable to attend on the 6th. Any other Council member is of course welcome to attend. Mr. Aiassa, do you want authorization to represent the City on the three items we discussed previously? • Mr. Aiassa: Yes, I would like to have the Council authorize yourself and a staff representative attending sanctioned to represent the positions that Council previously took. So moved by Councilman Browne, seconded by Councilman Chappell and carried. ITEM 1-e Mayor Shearer: I asked for withdrawal Request of of this item because it Sponsorship was marked for Council action. I feel that requests of this type regardless of how justified or warranted on an individual matter does not really come within the prevue of the city function to help support an individual to take a trip, in this case, to Japan. I think this should be done on a volunteer participation basis. So unless I have two people who disagree with me what I am going to do is turn this request over to Mr. Klemp of the San Gabriel Valley Daily Tribune and ask him to perhaps run a little article on this, if he sees fit, and perhaps get some publicity for this young man, or do whatever he would care to. Councilman Browne: out of the realm of the •also ask Mr. Klemp if he publicizing this and in Mr. Mayor, I agree with your thoughts. However, I have consideration for the young man but this is a private enterprise and is city and the taxpayer's function. I would would go along with your request in that way helping the young man. Councilman Chappell: We have so many things coming up at present that our best effort here would be to support it with announcements and publicity in anyway that it can be done but so far as financing we would be hard pressed to justify the financing of even worthy projects like this. But, we should certainly encourage the young man to seek counselling from his School Board and officials of his high school that he attends and I am sure they will help provide some method of helping him raise funds. Mayor Shearer: Mr. Aiassa, will you please send a letter to the young man advising him of our action and of course if any Councilman would care to send him some money I am sure it would be appreciated. ORAL COMMUNICATIONS Mayor Shearer: We have with us this evening quite a large representation from the All City Band - John Hoover, Director; has requested an audience. John Hoover Good evening Mayor Shearer and Councilmen, Director it gives me great pleasure to be here W.C. All City Band tonight to inform you what the West Covina • All City Bandhas been doing to represent our City since the beginning of the calendar year. First, I would like to introduce our Drum Major -Janette Bezaro. On June 12th Janette attended the local Drum Major competition and received first -place -Drum Major. On March 23rd, being eligible, she attended the State Drum Major Competition and received 4th Place. As for the band you will recall on February 5th we had a little birthday party for you, birthday cake and all. On March 17th we played a benefit concert for the West Covina Band Shell Association and on March 23rd we travelled to Los Angeles to the Shrine Auditorium where we played with thirteen additional bands in the Youth Band -Festival. Each band performed individually and then enmasse for a finale conducted by Dr..Winslow of U.C.L.A. On April 9th the band toured Disneyland for the Annual Easter Parade. On the 19th the band had another concert at Cameron Park for the local citizens as a kick off for our Yucca Valley trip which we took this weekend. . I It gives me great pleasure to inform the City Council that the band entered their first actual band competition receiving the highest score of all bands in the parade and bring home the First Place Trophy which we would like to present to Mayor Shearer so the Council can see it. (Janet presented Trophy to Mayor Shearer) • Mayor Shearer: I think that is very nice and thank you, John and all of your band on behalf of the City. I am sure we will see more of this to come. Mr. Hoover: I would like to inform the Council the funds for this trip were completely raised by the band students. The blue jackets you see on quite a number of the band students were also raised by the band - 7 - CITY COUNCIL ORAL COMMUNICATIONS - Cont'd. Page Eight 5/ 2 8/ 74 students. They wanted to have jackets that represented their band. On Sunday the 26th we played a concert for the City of Yucca -Valley in turn for the Chamber applying three of our meals.and the Metaphysics Retreat up there supplying housing for • the band. So .we played a concert for the community up there which was very.well.received and they appreciated the fact that we came that distance and represented the City. We did get the plaques and it was a big treat to both the church and the Chamber of Commerce to receive these City plaques and my appreciation and thanks to you, the City Council, for allowing us to take these two plaques. Mr. Aiassa: Mayor Shearer - I think John should also say that the All City Band out did the Marine Band. Mr. Hoover: Yes - and it was very hot up there, as I understand it was here also on Sunday. Mayor Shearer: Just adding a bit to what I said earlier, I think we have a fine organization and I think it is demonstrated this evening by their enthusiasm and I am sure marching in a parade at 120 degrees takes a little extra that perhaps some of us could share if we could get some of it to rub off on us. So, John, congratulations for a job well done. Mary Lou Wessel Mr. Mayor, I just have a'few words to say to you about the Band Shell. We are really finally moving in a very positive direction. The only thing that is a bit of a stumbling block is the fact we •still do not know where our band shell is going to be located. The question comes up quite frequently as we travel around and make our different pitches throughout the City - we are constantly asked "where are we going to place it?" So we are definitely waiting for some word. from you, the Council and the Recreation and Parks Department. We have a big fund raising thing coming up in the next month, which you.will.hear about in the next few days, and we hope we will get enough money to start something. We all feel a little frustrated at the moment, we want to get enough money together to put the shovel into the ground and get things rolling, so we are really working on this. I understand our All City Band had a band shell to play in at Yucca Valley and I certainly think we ought to have one for them when they play for us next. Thank you. Louie Reynolds I would like to speak to Item G-6, BKK 444t Pollencrest Sanitary Landfill. I understand it is a es ovina hearing item coming up and I can defer speaking until some later time, if you desire. I am not too sure of the procedure here. Mayor Shearer: Let me advise you, and then you can take your pick and either speak now or wait. The public hearing is scheduled before the • Planning Commission on June 12th, to determine whether or not there have in fact been violations and whether there are still violations of the Unclassified Use Permit. Council will not have a hearing tonight on this but of course, Mr. Reynolds, you are free to say what you wish, although I think it would be more appropriate at the time of the public hearing. The action we are recommended to take this evening due to the fact we have the hearing scheduled before the Planning Commission is that we defer Council action on the CITY COUNCIL Page Nine Oral Communications - Cont'd. 5/28/74 Revision of the Use Permit until such time as this matter is resolved. Mr. Reynolds: Thank you, I think I will defer my comments .to the June 12th hearing. • Mayor Shearer: Mr. Wakefield - just in case the Planning Commission finds that there are violations and are still violations and recommends sus- pension or whatever, would the Council also then be required to hold a hearing? Mr..Wakefield: Yes, Mr. Mayor. The final decision in the matter rests with the City Council. The action of the Planning Commission would simply be to recommend to the City Council that whatever action seems appropriate be taken with reference to it. Mayor Shearer: Would we be required to hold a hearing or can we take action on their recommenda- tion and our feelings? Mr. Wakefield: It would require a hearing by the City Council. Mayor Shearer: One further question. Let's say the Planning Commission finds in their opinion that there are no violations, could the Council call it up anyway for further consideration,if we so desire? Mr. Wakefield: Yes, the Council could if they so desire. Mayor Shearer: So a minimum of two hearings would have to take • place before the permit could be cancelled. Mr. Wakefield: That is correct. Joanne East: I would like to speak on Section G, Item 7, 1438 East Portner St., San Gabriel Valley Humane Society. In the West Covina renewal of this contract I should hope that the responsibilities of the San Gabriel Valley Humane Society are made very clear because I understand the citizens do not always receive the service they are supposed to receive. I, myself, had occasion to receive I thought rather poor treatment in this area because of so-called weekend or holiday situation and was told I could not receive service, and in contacting Baldwin Park in sheer frustration, the man informed me what my rights were. He said quite often their Humane Society receives requests from citizens of West Covina because they are not getting the service they deserve and he said our contract should be looked into and thoroughly clarified so our requests and our needs can be met and are not turned down. I had to make very vociferous demands through the Police Department in order to get any help at all and I was intimadated, not by the Police Department, but by the Humane Society in the fact they just didn't want to bother and I didn't know what my rights were and they evidently • were not going to fill them if I didn't know what they were. So I suggest and wish before it is renewed that perhaps some clarification between the Council representing the citizens and the Humane Society can be reached. Councilman Chappell: Mr. Mayor - I heard "intimidated" and I think we should look into something like this. They are supposed to give us service on week - =sue CITY COUNCIL Page Ten ORAL COMMUNICATIONS - Cont'd. 5/28/74 ends according to our contract, and to intimadate a citizens, well I think the City Manager should be asked to investigate.that and find out what it is all about. I don't think that is right in any situation. • -Mayor Shearer: I think this is of course kind of late, I don't know how long ago the incident occurred, and I don't mean to be critical of this, but I think the key here in the investigation of alleged intimadation is timeliness, especially if this took place several months ago it would be extremely difficult to tie it down to verify such a situation. So I would urge if anyone here has trouble with the Humane Society get in touch with the City Manager immediately. And I will make the offer at 1past for the next ten months, get in touch with me because he has an unlisted phone number and I know what it is and my number is in the phone book. Councilman Chappell: We have a statement in their first paragraph "We have enjoyed our relationship and per- formed a superior and beneficial service to all citizens in the community." So that doesn't sound like that is exactly a true statement. Mayor Shearer: We will be discussing this a little later so I would suggest that we wait until we have one more Councilman present, hopefully. Are there any further oral. communications? Mrs. Audrey Lindberg The reason I stepped up was I wanted to 1311 Golden Vista Drive inform the Council we had a meeting of all West Covina the Homeowners' organizations residing around the hillside area. Even though there is a coalition of the groups they will re- main as a separate entity. The reason it came about was because of the condominiums that are going to be developed in the hills and the dumpsite situation which creates an odor in our area. We certainly don't want to see this man put out of business but a solution to the problem. We don't.receive the odors in this area as we do in the hillside area but I do want you to be aware that there is concern among the presidents and they will have delegates who are willing to work with you people and if a proper solution doesn't come about through this I am afraid you will have some very interested people down here at the hearing. This is in regard to the dump, the condominium problem has been resolved, and it has been through the Planning Commission and Planning Staff that this was all brought about and this was just in the last two weeks. If an inspector cannot be a resident inspector on the job full-time investigating the products going in;- - I would suggest that the gentleman is dumping quantities of whatever it is that brings a very sweet nauseating odor and should be restrained or required to take it out - I don't know what the solution to the problem is but I think there must be a.aolution. I talked to.Mr. Browne and Mr. Lloyd about the problem already so they are fully aware of what is going on. I am just bringing you this information so you can work with US. Thank you. Councilman Browne: Mr. Mayor, may I respond to Mrs. Lindberg's statements? There have been members of the City Council, members of the Planning Commission and part of our staff, all have been meeting with the people who represent the BKK operation; we have visited.sanitary landfill operation which is comparable to the site here in West Covina and we have volumes of information regarding the proper operation of a dumpsite: The people representing BKK have indicated - 10 - CITY COUNCIL ORAL COMMUNICATIONS - Cont'd. Page Eleven 5/ 2 8/ 74 they are receptive to negotiating through this period of time and I am sure we will be able to resolve all of these problems. Councilman Chappell: I think a further point of interest on that, Mr. Mayor, is the fact - I accompanied • Councilman Browne to one of these inspections at a Class I Dumpsite and at one time the site was 70' away from residences and there were no odors. So it is not the fact that odors have to be there but just the fact they must be properly controlled. These are some of the things we will be bringing out when we start studying it on Council. It is not necessary to have these smells and as I said, 70' from a Class I Dumpsite are homes and they received no complaints on odor and I think we can do the same thing in our situation right here. Ed Dugan We have been having a problem in our 1323 Roxbury neighborhood for the last couple of weeks. West Covina I have had bullet holes in my block wall,,. clothes torn off the line, my Volkswagon rear window smashed and the other morning when going to work I found the gas line had been pulled out and gas spilled over the area. There are some bad elements that have moved into our area. They spray painted buildings, they threatened one man with a knife, spray painted cars, and this woman that is with us has been robbed twice. There are prowlers around at night and you call West Covina Police and they are always busy, it takes an hour or two hours for them to come down. When they do come they say there is nothing we can do about it, they make out a report and file it. One officer, Ward, we sent a letter to the •Chief of Police commending him, when he did come on one call he went to the house and laid it down the way .it was. Now this officer Strollo he told my wife - did you ever think of moving? Now we have lived here 15 years and we have a business here - do you think that is right to move because of these elements when you pay for police protection and you can't get it? Mayor Shearer: Is that a question? (Mr. Dugan answered "yes") I would have to answer "no, I don't think that is right. Mr. Dugan: Several citizens feel if the Police Depart- ment can't do it..... We want to be law abiding citizens, yet if we lay a hand..on one of these persons we go to jail and they aren't all black .people. It is all the white people that are being picked on. We have elements from Greenbrier and that area that come into our area. On the way over tonight we saw three police cars had this one that I have seen around at 10 and 11 at night. Actually what we need down there - and we have checked and sometimes we don't see a police car for a week, they say they come through periodically which they doh't because we have been slitting out watches at night to protect our own houses because we don't get protection from the Police Department, and I have to get up at 4 A.M. to go to work. This problems is in the area where I live - I live at Roxbury and Shadydale, 1323 Roxbury. Mayor Shearer: I hardly know how to respond to that. I think an allegation that one of our Police Officers said ' have you considered moving - as far as I am concerned is unacceptable. Even if he thought it, it was unacceptable to state it. I will state here and now with all due respect to our Police Force I think that type of comment on the part of any civil service employee is uncalled for and unwarranted. _M� CITY COUNCIL Page Twelve ORAL COMMUNICATIONS - Cont'd. 5/28/74 I would suggest, Mr..Aiassa can you designate someone to meet with Mr. Dugan to see what if anything can be done in the way of police patrols? If there is any validity in the statement that it takes two hours to get there; I heard Deputy Chief Meacham say the other day the •average response time in West Covina now is four minutes - this doesn't ring quite true with the statement just made. Also look into the general situation in the area and with the statement that a car doesn't come in but once a week. I think these are rather serious allegations. I would like them looked into and a report made back to US. Mr. Dugan: Mr. Mayor - this week that I have been sitting out there, the day after the car was spray painted - and we don't bother anyone, it is just my wife and I now, but they come up about 10 at night and put a hose into the screen door and turned it on full and it flooded into our living room and it warped the door. We called and that is when Officer Ward.16aamepi—Land- he was an awful good officer, but it was over an hour before they came, he explained to my wife they were very busy. This other officer Strollo says they only have 12 units at night in West Covina and they try and stay centralized and it is impossible to have controls all around. He was the one that suggested we come up here and state our problem to the Council because that is the only way we will get help as far as having cars patrolling the area. Between 9 and 11 at -night seems to be the worst time. Mayor Shearer: I think any citizen has a right to come up before us. Mr. Aiassa, I would also like a report on the alleged comments of Police Officers - that we can't do our job I suggest you go to the City Council - I think that is a very serious inference. Item A, the license for unspaded animals $7.00 - is that the County's practice to elevate the fees? Mr. Wakefield: Mr. Mayor and members of Council, last year the State law was amendedto provide in effect that the license fee for neutured and spade animals was to be fixed at 50/ of the license. fee for unaltered animals. So this ordinance simply reflects the statutory requirement that the fee be 50/ for spade and neutured animals. Mayor Shearer: Is there any other discussion? In view of what was brought up during oral communica- tions, this along with Item G-7 - they go hand in hand, one is to raise/lower the fees depending on whatever condition your animal is in, and the renewal of the contract, I think they go hand in hand and I don't believe it would be out of line to discuss them together - would it Mr. Wakefield? Mr. Wakefield: No, Mr. Mayor. Mayor Shearer: Mr. Aiassa, when does our current contract with the Humane Society expire? Mr. Aiassa: June 30th. Mayor Shearer: So that is the need for the urgency of the ordinance changing the fees. Mr. Wakefield: Mr. Mayor and members of Council, our license fees are fixed on an annual basis, the renewal period becomes effective July 1 and in order for the altered fees to be effective for the new license period it is necessary that the ordinance be effective before the first of July. I think • at the most if there is any fee remaining that fee interest is now in the County of Los Angeles. In any event the Title Company quoted a figure of $500. for a preliminary title report to ascertain whether the City had any interest in the property. The cost of the title report is probably costing more than the value of the property. The May Company is offering $100.00 to the City to defray its expense for the quitclaim deed. My recommendation is if we do undertake the program of the Risk Management Audit I would like to have Councilman Chappell act as liaison for the Council, because I feel he has quite a bit of experience and knowledge of this type of thing. Mayor Shearer: Where is this firm located? Mr. Eliot: The firm's address is 200 Center Drive, Newport Beach, California. Mayor Shearer: I would like to hear from Councilman Chappell on this matter. Councilman Chappell: Yes, Mr. Mayor. I think that it is time that we do have an audit of our insurance programs and needs. We not only have the City Council but the Redevelopment Agency and the Parking Authority and all of these units take on certain liability risks and exposures. We don't have a professional insurance man on our staff, very few cities of our size do, if any, and from time to time agencies such as ours have to sit down and review their insurance portofolio to see that they are properly insured, and to see that we carry the correct amount of coverage. When I first went into the insurance business the City could get away with $500,000, bi4 cities even a million dollars liability exposure, but today these figures are no longer true. In fact I have many accounts in private industry that.are insured for more than that because of the type of situation we have in California with law suits and not only the suits themselves but the awards certain juries and judges award. So I feel that it is in the best interests of the City that we have this study made. In the area of pointing out or determining whether we should be self -insured, this is certainly not an area that I would like to have looked at at this time because our City is just not of that size. The tentative cost for this study would be between $41000 and $6,000 depending on the time it takes to put the informa- tion together. This, as I understand it, is the first time the City has gone into this situation and we do have a,number of policies - 16 - CITY COUNCIL Page Seventeen CITY MANAGER AGENDA 5/28/74 and with various.agents, which is not always a good way to go to cover any loopholes .that might. exist. In my mind this is timely and I will move,(to get it on the table) the recommendation of staff to approve the hiring of the services of Warren, -McVeigh, Griffin & Huntington, risk management consultant firm, to conduct a.risk management audit for the City of West Covina at a maximum cost of $61000. Seconded by Councilman Browne. Mayor Shearer: I have one question. In -your opinion does the City stand a reasonably good'chance of recovering in a not too distant.future the cost of such a report through perhaps better rates or better coverage? Councilman Chappell: We may not recover the $6,000 as such in dollars but we could plug a loophole that may have been overlooked that could cost several thousand dollars in a lawsuit. Cities are very.vulnerable to suits. Since I have been on the Council we have had.all types of suits filed against the Cityand a number of them have been awarded -quite sizable sums. In my mind the way Cities buy their insurance programs - and offhand we have three or four agents that we are dealing with and neither one of.them accept the liability to say to us that your City is properly insured -because all they are insuring is either the liability, or the life insurance portion, or the fire insurance portion, .and in the instance of the State the Workmen's Compensation - none will assume any sort of a liability to say West Covina you are properly insured. In the type of arena I operate in I can say that if I have all theirbusiness but when I have a client that is splitting his business with other agencies I say "hey you are only covered for what I am selling the insurance to you for . and if you have any loopholes and.you are not letting me be your insurance consultant I can't be responsible, I -can only cover you in the areas I have a policy on." I.think our insurance people operate along the same philosophy because they can't be liable or study our policies that they are not receiving a premium on. I sat down.with our staff and we reviewed the policies. I do attempt to stay out of the insurance picture per se in the City because there is always that chance of conflict of interest charges which are injurious to a person in my position, just the charge itself, but I will be happy to act as liaison for the Council in this area but I just do not want to assume any liability or responsibility as to whether it is correct or incorrect. .Motion carried on roll call vote as follows: AYES: Browne, Chappell, Shearer NOES: None ABSENT: Lloyd, Nichols Mayor Shearer: Do we also need a motion to designate Councilman Chappell as Council liaison? We had a seizure of bicycles where they took the whole rack, so I think we now have to work something out to hold the racks down. Chairman Lynn Giles and I had a meeting this afternoon and what I am going to request from the Council is a motion, which may seem rather simple, but I think at times we need to give positive direction to our Youth Advisory •Commission, and the motion is that we authorize and encourage the Youth Advisory Commission to supply input and become involved with the planning, along with the Recreation and Parks Commission and staff in the multi purpose building that we proposed and discussed two weeks ago. Councilman Chappell: May I ask a question - I noted at their last meeting they didn't have too many people in attendance - something like three Commissioners and two alternates and this doesn't look 'really too good of a turn out of the seven Commissioners and seven alternates that we have. I hope they will be encouraged to all come out and participate and provide some real information to assist the City Council in operating the City. Mayor Shearer: Any other comments on that? Mayor Shearer: One other item that I almost forgot and I apologize to Mrs. Wessel for waiting until • she was gone. Mr. Aiassa, will you instruct someone from staff to follow up on her request on a decision as to where the band shell should be.. My understanding was.that there wasn't even complete agreement on the part of.the Band Shell Committee as to where the shell should be and in my opinion that is probably one -of the first things that ought to be resolved and if they can't do it not pass it to us because I don't want to get into a hassle over it with a volunteer Committee. So I think we should communicate to them that the City's position is that we would like a recommendation from them for the Recreation and Parks Commission and staff to review for recommendation on to us. Do I have concurrence in that? Councilman Lloyd: May I make a recommendation to you, Mr. Mayor? I think,. number 1, that Mr. Aiassa's people should see where they think it is feasible from the point of view of land availability, parking facility, traffic flow and things of that sort. I don't know how much traffic flow it would create but if you had a concert with four or five hundred cars.and that is not an unreasonable amount of cars, I certainly think that Mr. Thomas's people would want to make at least some sort. of an .observation with regard to the band shell. And number 2, I think Mrs. Wessel and the Band Shell Committee should make a recommendation in conjunction with the • staff recommendation. I personally am not prepared to say it should be at Cameron Park or wherever. I think they have some place in mind. Mayor Shearer: I have seen a couple of reports and I think I sense basic disagreement between certain people on the Committee and members of staff, Police Department, etc., and I don't want the matter to be - 19 - • • • CITY COUNCIL MAYOR'S REPORTS Page Twenty 5/28/74 dropped and suddenl-y.the Council has to make the decision of where to place the Band Shell and we make everybody unhappy. I think we should communicate back that there is an obligation for them to provide input to us for a final resolution by us. I was going to mention that to Mrs. Wessel but it slipped my mind, so will you communicate that to them that we urge the Committee to resolve that amongst themselves and make one final recommendation, hopefully in a majority and not a minority report either. Councilman Chappell: It appears in their fund raising capabilities that thesite not being picked yet seems to be, at least from her conversation, hampering them in moving ahead and raising funds_, so we should ask that they make a recommendation very soon, so we can have a site tentatively picked so when someone asks where is it going to be they can tell them. That might make them give more money or a little less money depending on the location of the band shell. I haven't.heard that they have enough funds yet to even start thinking about it, but it appears to be deterring their fund raising activities. COUNCILMEN'S REPORTS/COMMENTS Councilman Lloyd: I would like to give a short oral report on Transportation. I think I made myself very clear to the SCAG people that whatever else we wanted as far as the City was concerned, and I can't speak for all the Councilmen, but I think it is very important that we come to an understanding on this with regards to RTD's structuring of the alignment of service. There have been considerations whereby rail service, for instance, might go in along the San Bernardino Freeway, or along Foothill - so serious consideration is being given to the final alignment of the facility and it might bypass West Covina. I would remind Council and those involved that for many years we have put up with the indignities of a street level freeway cutting right through West Covina which was the major east/west highway for all of Los Angeles and now when the "goodies" are about ready to come along they are talking about going somewhere else. I think every effort should be made to.have that alignment, particularly in light of the redevelopment project and the commercial developments we have here. I think it is critical at this point that we make some presentation to RTD and SCAG particularly, in their aligning of these routes that it should incorporate West Covina. They are going to be making these decisions right now and I think we should take a firm stand on it. Councilman Chappell: We will kicking it in posal in with tion back on hearings? Mr. Aiassa: Mr. Mayor -.it was sent to all three. Councilman Chappell: Let's find out the status at this time then. Mayor Shearer: I think that would be well, however, I am sure the response back will be - we noted your comments and consideration will be given, etc. Councilman Chappell: I think we have a little more rapport with Remy - we have had him here at our meetings back in the days when everybody was not in support of SCAG and West Covina was in the forefront in working with that organization. I think we have some rapportthere that may get us an answer or two. Mayor Shearer: Mr. Aiassa, will you see then if you can determine from the two agencies involved what has been done and I think Council's official position was in support of Councilman Lloyd's comments and Councilman Lloyd is chairing one of the Committees and he has our backing in that regard. Councilman Chappell: At the last meeting I asked the City Council to give me some direction in voting on the Independent Cities increase in dues from $500. to'l/o of our population which was at the present time $728. The meeting is tomorrow night when we vote on this and I would like to have some instructions from Council as to how they want me to vote. Councilman Lloyd: Mr. Mayor - I will move that we commit to the increase based on population not to exceed $750. Seconded -by Councilman Browne and carried. Councilman Chappell: I think we have discussed our trip to the Palos Verde landfill but if anyone wants to be briefed further I am sure either Browne or myself will be happy to inform them. Staff is preparing a report. Councilman Browne: Along these lines relative to the meetings we have held with the representatives of BKK and the attorneys, I think it would be in line for Council to take formal action to have the Mayor and myself sit in and represent Council in the negotiations. Mr. Aiassa: Yes, this will give it legislative representation. Councilman Lloyd: You are not making any commitments? Councilman Browne: No, we are just trying to resolve the situation and I will so move - if Council has no objections.
