CITY OF WEST COVINA, CALIFORNIA
JANUARY 26, 1970.
The regular meeting of the City Council was called to order at 7.30 P.M-.,
in the West Covina City Hall by Mayor Leonard S. Gleckman. The Pledge
of -Allegiance was led -by -Councilman Thomas Gillum. The invocation was
given by Dr. Henry.,.Kraus,-Temple Beth Ami of. West Covina.

his years of service to
the City as

on the Human
Relations Commission.
Mayor Gleckman: Mr. Shrader, this only expresses to you some of
the things that the City could put. .in print

it is. We, on the Council, know of the-man.y.serv.i.ces you have given
to the City over the years.. And L might say that within the next few
monthsI hope to see you again giving service to the City.
Mr.. Shrader expressed..his thanksand.appreci-ation for the privilege
of .working -on a Commission and hoped his' work would allow him
sufficient time to come back -.and .work.w.ith the.City again..in...;the near
future.

in aiding the Police -Department by obtaining and reporting the. -license

Mr.. Wakefield,. We have had a series of meetings with
City Attorney Mr. Cable, representing the L.A. Airways, in
connection with the f.i.nalAzat.i.on of the p.ropos-
ed contract. The .last draft: prepared and which
was submitted to L.A. Airwaysgwas based upon certain recommendations.
•of. the Department of Aeronautics of the State of California concern._
ing'the nature of the use of the heliport and was designed so the
heliport when established would qualify as . a pub.l.i.c airport for certain.
subsidies and grants both in construction and. maintenance I was
advised this afternoon by Mr. Cable that, his firm would be unable to
enter into the agreement .in that form and he would be here -this even-
ing to explain the_situat.ion to the City Councid-
I might indicate that there have been prior
drafts of the agreement, one prepared by -L.,A. Airways, wh.i.ch was
essentially a type of agreement which l.i.mi t,ed the use of the a.i.rport.
to L.A,, Airways Helicopters and such other craft as :it might: consent
to use the heliport, This, we were advised by the representatives of
the State,,was in their opinion not the ki-nd of.an agreement that would
be acceptable as,.i.t. established a closed airport, for the exclusive
use of L., Ao Airways.
We have reached an .impasse in the negotiation's
and the matter is now presented to Council for your resolution and
determination. I think with certain appropriate findings either form
of the agreement could legally be entered into by the.City. But the
basic question of whether the hel.i.port. .is to be open for general
public use or reserved exclusively for use by L,,A, Airways is -for
.the City.Council to decide.
Roger Cable We have been at this now :for several months and
.L„A, A.i.rways it is unfortunate that we have reached this

..Los Angeles can be easily explained as fa.r. as L.A. Airways' -
position is concerned. As you may recal,.l. at
the very first.appearance I made before you I .asked.that..West. Covina
l.00k at the possibilities of establ.ish,inga heliport - fo.r the ability
of L.A...Airways :to provide scheduled serviceto the community and we
have proceeded with :that to the point where we have the design of the
heliport, approval of the Federal authorities and. State as. to its
abil..ity,to operate as a commercial heliport, And,, unfortunately have
now reached the point .to where we wish to c1.ask.:fy .it as a public
heliport.. L.A, .Airways is .certainly not wishing in anyway to stifle
the establishment of thisf.aci.l..ityo We are concerned withth.e safety
of the passengers and public.
I have worked very hard with Mr. Aiassa and
Mr,, Wakefield,and our officials and we can see no way that we can
insure the safety of the flying public,, as well as the safety of those
on,the ground
.,with an airport that can be open to.anyone that wishes
to use it and not be .under strict control,-,: We have not been .able to
do this .in the past. We have been requested many times by the.
communities we serve and,after thorough eva.luation9.it has been our
determination that our first outlook must be to the safety of the
,public that we are carrying, As a company with some 2000 stock h.old
ers we cannot . jeopard.i.ze their position in company by opening -up
the liability of operations from a hel.i.po.rt that could cause the
endangering of lives .in -the transportation of our passengers.
Our first lease wassubmit.t:ed to the City of.
West Covina in the first week"of September, long before we went out
to bid. At that time the lease included the normal provision that
we have had with every other heliport we operate from. This i.s the
provision that we must have control over the heliport to....assure safety.
That is the point we are at now. If you have any que.stions,I will be
glad to try and clarify our position or answer them for you.

Councilman Gillum: Mr. Cable, on your other .installations are they
on private or public property?
Mr. Cable- Almost all are on public property. The.Pomona
facility belongs to the Parking District,-, the
facility in San Bernardino belongs to the Orange
Show Grounds,wh.ich is a semi-public facili.ty-, the Downey heliport is
on City of Downey ,property; Whittier on City of Whittier property, etc.
Councilman Lloyd: I think we have arrived at. the point where we,
as a Council, will. have to make a decision as
to whether or not this type of activity will be
of the greatest benefit. to the City and we are faced with some rather
d,iffi.cult. problems, Mr,, Aiassa has already spoken 'to me on the
telephone today and, he has ,i.ndi.cated.'that he doesn't see that,as a
City Administrator, he can go .forward on th,.i.s Is that true
Mr. Aiassa?
Mr. Aiassa- With the present lease„ as prepared by
City Manager Mro .Wakef.i.eld,, I have no objections, but it
appears that L.A. Airways wants an exclusive
usage, which will make it almost a private
heliport and will exclude us from getting any State or Federal funds,
which we have already made approaches to andwhich would be available
to us if it were a public heliport,
Councilman Lloyd: That .is a good point. As a matter of .facts when
-we commenced the project it was the hope that
we might be able to get Federal or State fund-
ing to help defray the cost, ..However, at that time we anticipated
also a 2 year stand at least, and in good. faith we really believed that
to be so.. Now we no longer have the possibility of 2 years of use
if we continue this and enter into negotiations with L.A,, Airways and
we would no longer have the opportunity for those funds and the burden
falls on this Council to say that the funds needed approximately
$50,000, is now committed to the possibility of the taxpayersl'money.
I am favorably disposed -to this because I think
we need this type of transport.at.i6n, but. I think .it would be well to
review strongly by the Council., to see where we want to go with, -the
taxpayers dollar. The situation. we are Looking at is,in essence, if we
don't do it now 'somebody else will. move and at that point m once .it
is done and the .fact .it is not here ,- well. we don't ge't. it. You are
not talking about a second shot.
I realize that L.A„ Airways is.not the only
commercial. helicopter firm operating .but at the present moment,
fairly or unfairly, they are protected pretty well by Federal pro-
vision by their license. Simply stated, no one else.can operate
against them the way it stands,_, I think these things will eventually
change, but.by the time they change I don't think we will be afforded
the. opportunity that comes now, so we must weigh very careful'ly.,
without getting into the moral equities of whether this .is fair'or
unfair, as far as .L.A,, Airways is concerned,. I think we have to look
at what isbest for the City. Of course I am motivated,and I think
I have made my position clear regarding the necessity of a Transporta-
tion Center. I think the key to the growth of this City is going to
be the tying to a Transportation Center. I think we are going to
have to have a ground Transportation Center, which may come .in the
form of a rapid transit system of some sort, and with the .many
freeways coming in�Azusa Avenue will begin to look like a main north--
south-thorough.fa.re, and .I think .we have t.oconsider strongly a ,
Transportation Center. Granted, $50,000 - .if all. you --were doing is
spe:ndi.ng .it..out.. of ._a cash income basis, $50,000 is a lot of money,
but wehave to look very carefully particularly in these days when
the tax dollar doesn't go as far as it used to and when additional
revenues are being called for in every walk of life in our community.

So we have to trade that of-f . now from. a business point of view and
say, will this type of Transportation Center generate .i..n .a period of
time say 18 months time, and I think once you have.this type of
activity it will work well and act as a revenue producing _enterprise.
This then begs the question of where will we put, it when the freeway
•is ultimately widened on that land that is committed to the underpass
at Walnut Creek Parkway, and then we will have to find someplace
else. We must weigh these intangibles and not very strong base
against what L.A. Airways -can do. We are not the only freeway city
and while we say we are the hub of this areas if someone puts a good
strong base in somewhere else)we may find our tax producing capability
will decline. Frankly, inmy opinion I don't see where we are going
to have a l arge.industri.al park, I think the only tax base that we
can look to is business, commerce, our stores, and a vi.ta.l.part of that
is indeed . transportati.on and the ability to move within this 1.5 mile
radius. I ask the�counc.ilmen to weigh and.judge heavily that against
the $50,000 we are talking about spending. If the time, period were
greater than the year and a half we are talkingabout I would have
very little hesi.tat.ion, but the time period is not great and the
monies that have to be spent - well we could find that they are
literally wasted. Yet. we do have to.look into the future 1.0 years
hence., and I don't want anyone to say to me/back in 1970 when you
could have made this decision to make this the Ce-nter. you failed to
do so. I think this is one of the things we are facing. I invite
my fellow.counci.lmen to offer whatever discussion or arguments they
may have
Counc.i.lman. Chappell: When we originally'started discussing this
there was some comment of perhaps federal funds
being derived. from this project„ but all, the
time that I have been studying it and looking at it I never found
this to be fact. It was something we were. hoping for, but in my
original statements of wanting''to develop more of a Transportation
Center, of which this was to be, the f.i.rst, link, it, didn't really hit
me that federal funds were going to be applied to this $50,000. I
would like to know if Mr. Wakefield -or Mr. Aiassa would. know .that.
these other heliports..around that..L,A..A.i.rways have developed, have
they derived any federal funds with the type.of agreement we are asked
to sign tonight?
Mr. Wakefield: Not to my knowledge. As I understand it this
City.:. -Attorney would be the first so-call.ed public heliport
within this general area, insofar as the State
of California is concerned.
Councilman Chappell: When we'use this, word "public" are we referring
to it as.M.r, Cable did or that just -anyone. .
could come .i.n.and land any type of helicopter
or aircraft or plane . do we mean strictly commercial?
Mr. Wakefield: What the basic form of the agreement provides
City -Attorney for is that. L.A.:, Airways will have exclusive
use of the heliport .1.0 minutes before and during
its arrival and departure and 10 minutes after
for the exclusive'use of. their helicopters. At other times other
helicopters whether privately owned or publ.icl.y,cou.ld be authorized to
land at the heliport. This would .include publicly owned helicopters
that might -be utilized by.a city or neighboring city for police
surveillance, or rescue use.,_and-it would, .also include. the privately
owned helicopter that transports business -executives from one office
to the othero.Dmept f cr the times I .indicated :i.t could be usedby other
helicopters. There would be no storage facilities, the heliport is
not really large enough so that a helicopter could land and be stored
on -the ..ground. So what. we are talking about really is the use -of the
hel.i,port for landing and take off operation.-

Councilman Lloyd: In answer to your question Councilman Chappell,
I might add, as a publi.cl.y operated heliport
any licensed operator may request.permission to
land; it would not be restricted to the exclusive use..of.L,,A. Airways.
However, it is possible .under the degree and terms of the contract
• envisioned, for L.A. Airways to grant permission for other people to
land here on written notice or some type of notice -.is that correct.
Mr. Wakefield?
Mr. Wakefield: Yes, the original agreement provided that with
City Attorney the consent of L.A. Airways the airport could
be used by other helicopters. .
Councilman Lloyd: I would be quick to say that on the face of it,
:.:and from a logical stand, I don't see the total
necessity of L.A. Airways to have the exclusive
right to operate, but that isn't the question at.h.and. They are asking
.for. that .in orderto operate, and so then it becomes a question of am .
I willing to forego the possibility of federal and state funds in order
to have these operations emanating from West Covina and establish
West Covina as a Transportation Center. That is the question we are
asking ourselves. Maybe Mr. Cable can tell us why .it is absolutely
,essential to have it exclusive to them. I don't understand either.
Mt. Cable: I certainly would be more than happy to. I
thought I made it essentially clear. Our
problem is not that we wish the exclusive use of
the land. As stated in our agreement,we .are more than willing to
grant the use of the heliport to anyone that we can determine can
operate safely among our heliport operations. If it is a public
heliport, no matter what you put in your lease or your ordinance,
it will be .ind.i.cated. as apublic heliport by its markings by the mere
fact the State of California will require this and it will be listed
as a.public heliport and you .cannot -refuse access to..anyoneo_
If our flight is more than 10 minutes landing from the public
scheduled time and a guy is chopping off in his helicopter and'we
don't know he is, we feel it inflicts -danger upon the passengers we
are carrying for hire..and.that ,is .our entire problem.
If the City of West Covina is willing to put a
full-time controller at the heliport, then.we have no objection. This
puts it on an 'equal -par., with the airports we..are flying .in and out
of now with our hel.ico.ptersa but an uncontrolled -public he.l.'i.port is
.in our opinion an unsafe.operation,and we could not opera-te from it.
That is .our total and absolute .reason for it, it's, safety.
Councilman Nichols: -I can understand the position of'.L.A, Airways.
It was very lucidly presented just now and I
canalso understand the position of the City
ManagerU but what I can't.under.st.and.is how we could have several
months of ne goiations•and.this obvious -impasse has never reached
us in all these months..until. now. It is obvious that the first con. -
tract presented by L.A.._Airways,. according.to Mr..Cable, .incorporated
this limitation, and it._.is ..a.lso .appa.rent .that this limitation is not
now and was not ever acceptable to the City. Yet we have gone all
this time of drawing tentative plans, charts, issuing bids, etc.,
and now we find we havean i.mp.asse.
I accept the recommendation. of the City..Manager.
I believe I am obligated:to. accept that.. He states ifwe.accept the
heliport now it would not be .a.-.publi.c facility and cannot recommend
the use of funds for that. I agree,it would-be a. -different picture
if a proposal was here. to .creat.e. a .f,a-c..ili.ty..-that the City would build
and the lessee would amort.i.ze.over a.pe.riod.-of.two...years, but. with a
$47,0.00 to $50,000 � largel.y,unrecoverab.le investment:I feel as an
elected councilman.I.have very little choice other than accept the
recommendation of the City Manager.

Councilman Chappell., One point - when we originally started this
and we.had.the homeownersthat lived near this
proposed site .in here, I.was led to believe that
this was not an airport that would be used like a bus depot. We were
concerned about the noises, safety, etc., and in my thinking there was
no time that I thought thi.s would be an airport that would be used
constantly. The fact that they get an exclusive.doesn't bother me
too much, because it lookslike they.would be the :only ones using it,'
'rather .than so-called am,at-eur pilots,, The fact that we may have
thought, we were going to get some money from the. Federal Government
and now we know we will not.g is really not the issue here.
Councilman Nichols: I have a question. It .is probably not so
much that it will or will not be widely utilized
or that other vehicles will not beyfunctionally
speaking able to use it, but the question raised tonight is the
propriety of the City giving up its right as to making the determina-
tion whether it could be used by other facilities such as -a police
helicopter. There is a--questi.o.n ...inherentin the lease that is raised when
you abrogate your right._ as_ a munci.pali.ty to.determine whether..or not
it will be used by other ve.h.i.cl.e.s. ..I.n.o.ther words.you appropriate..
the money and then turn .over. the. use..to....the..- lessee and-. thereby..cr.eat.e
certain. ethical. and legal. questions, per.haps, that don't ar.i,se when ..you
retain the right of determination as to who would u-se .it. So I- was
alluding only to that issu4rather than the functional result. In all
probability the City might indeed exclude everyone from using .ite bu,i.
it is, surrendering that right to a private carrier wheii'.i.t i.ncorpor..ates.....
that in the lease, and it is an .is.sue we have to. resolve.
Councilman Lloyd: In response, we do have the control; the key i.s
we would have to put in. a.controltower. operation
For the period of time whe-re-in it -,was -operating
you could possibly, operate it from 8..a.m.. .to. 6. pomo
as a public airport and beyond'that.'operate exclusively for L..A..
Airways°needs, but you .woul.d.have .to have -a tower operator there. That
is all they are asking- ,.for... .This i.s • not -beyond-.the...real.m..of ..poss.ib.i:lity
either. We have $50,0.00 that we. have to .come up..wi.th_.i.f..L.A...A,irways
operates out of there .for .a year and- a half - Mr. Cable what kind of
revenue would y.ou anticipate,.- ju.st. off. .the top of -.your. -head?
Mro_Cable: As I recall our projections were over 21 months
of operation -that we would return to the City
something like $9,600.
Councilman Lloyd: All right;, .let ° s arbi,t:ra..ri.1y say it is $5, 000, and
if it were. a publ..i-c airport what. kind of .funds
doyou think we .might get to apply ag-ai.ns.t._.the
operation - Mrm.Aiassa?
Mr. Aiassa: There are two figures available. I believe we
City Manager have`the possibility of obtaining approximately
$25,000.m
Councilman Lloyd: We have the possibility of $25,000 .and. the .income
of $5,000 and that leaves us $20,000 to back up..
As Mr. Cable_ pointed...out when. we f.irst-..went ..into
this thing,we were talking .of-$45,.000 that ..the. City was ..go,ing....to .g.o.... .
after. In additional revenue -producing areas1we..have the.pos.s.ibility
of ,put.ting .in services such .as sof.t..drinks, the rental of cab .stands.,
etc., which would still be exclusive :to the.. City, so I think -.:we.would
be able. to realize another $5, 000, so. you are now talki.ng..about. $15,.000
that the City would pay.. In -addition to that.. you would. ,have, -.to .hire
on a 12-hour operation .at .leas:t.=.3 con.tr..ol:men,.plus:. your. ..r..ad.i..o. •, and: tower

but you are .in operation and .yo.u-mainta.in;.the.control.that.Council-
man Nichols was talking about, and in addi.t.ion to 1 that you have a
little bit of your cake. I would like to think it i.s not unreasonable.

However, in this day of short money, when you are -talking $50,000 we
have to.be, cautious because $50,000 is a lot of money. I think
what we have to talk. about '`i-s a 10yearperiod of time $5,.000 a
year -for 10 years is not a.unrealistic investment for the City. We
have -a lot of investments and I am one of theguysthat stands up
here and says we have to take the leadership role, and that .is
,exactly what I am saying again. I think we might take this attitude
and.put in a small mobile tower and get three operators. Mr. Cable,
in your opinion would it be possible?
Mr. Cable. Our estimates .are that it would probably.cost,. .
for the 21. months of• operation, .ap.proxi,mate.l.y....
$65, 000 and that .is based on 3 operators and
the cost of the tower installation. That .is the reason .we struck
that possibility completely out. We felt .it would not be of any
advantage to your.City to put in another $60,000 to get possib.ly.10
to 15 usages a month.
Councilmen Lloyd. When he says "usages" he is -talking. about.land-
ing fees, etc., from other helicopters, and . ..
that ..i.s not the initial thrust. The thrust is
to mainta.inyas Councilman Nicho.l.s.has spoken -about, some semblance of.
control in the City ° s hands and still have the operation . . I. am.....
certainly not going to dispute Mr....Cable°s-word about the actual cost;
I am sure he know infinitely more about it. than I do. 'I do.say. that_
we should weigh this very carefully before making our decision.
Councilman Gillum: Mr. Cable, is L.A, Airways still involved in - 'a
labor dispute? (Answer ---Yes; we are) What
are the possibilities. -on -that?
Mr. Cable: We- are. in mediation. at the. pre -sent -time ..and I
am very.. hopeful that we wil.l... have ..a .resolution
of that- ' n the next 10 days. I think .it .is
nearing .a conclusion,- they have been out of work
for 15 weeks.
Councilman Gillum: Mr. Ai..ass.a, what would bethe time schedule to
developthe..p.ad..and the heliport once the con-,
tract, was .-Let?, -
Mr. Zimmerman. After approval by City Council.for.the award,of
City Engineer contract, it will take about 10 weeks before it
is 'actually completed.
Councilman. G.il.lum: If we decided to go in this direction tonight,
we would have an .additional two and -a-_.half .
months..bef.ore .we ..could . s.tart --opera-t.i.ono
Mr. Aiassa indicated August. -of ..1.971 .as-.ab.out -the-- time they would start
freeway construction Wi..th..-the..time-.we. have.-h.ad. to..delay this .for a
number of reasons and adding -.two _ .and..-a....hal-f.. mo.nths or .longer, , we. have
cut down the time of revenue r.etur-n--_to.....the..C.i.ty at thisl.ocat.ion and.
are faced much sooner with..t.he.-. problem... of..hay.ing.- to .find a .perma-nent
location. I agree with. what. .has been--.sa:id, and i_n the .past I was one
of the biggest supporters of...th.is because-I.be-lieve it.is necessary
for the community to establ..ish..a .T.r.anspor.-tati-on .Center,. but I am
torn now between two --things -the ..expe.nditur.e. of..publi:c: funds. on
something that would. be. private, ye;t- -I .can- under -stand. ,Mr. -Cable Is
concern. It is difficult ..enoug.h..to..get.-into...a-.radio-contralled

the Chamber of Commerce had been working in the area of finding other
facilities° has there.'been any contact.with them with regard to,find-•
ing a permanent facility?
Mr. Aiassa: No -• we were .in contact with the Chamber today
"City�Manager and their Committee has f avorably'supported this

heliport, but as yet no ..permanent location has been found.:. .I.would
like to make a point known that everyone staffwise,includ`ing the City
Attorney, has tried every feasible way to make this possible. And to
answer Mr. Nichols' que.s.tions/ some- of the delays .were caused by the
fact we were dealing .directly. with the State and Federal. agencies to
Ibfind out what would be acceptable and what would not, and there were
slight delays in communi.cating.o..and we .wanted to develop a plan that
would be functional -and not deprive us of benefits .in the future,
not only this one but, for..a .permanent f.aci d,ty, and also we have
the maintenance and,. upkeep. -factor that..wou,ld..continue from here on
after it is built.' :• .1 did raise -...the. fees _w .th-.L..A. Airways.. and....: he did

This week I closed down three facilities. If

to put .in this facility and not have one to.
use. I would hate in 3 months -to see the
facility built .and no helicopters coming' in because of L. A. Airways
not having settled their own differences in their'own company. I am,
not saying that will happen, but I would hate to authorize public
funds without knowing we are going to have somebody there.
Mr. Cable: I must say Mr. Mayor that L.A. Airways has not
been asked this question previously. L.A. Airways

Councilman Nichols: I think that is the. key.. Had .we. had the
original 2 year period discussed, or even 20
months of it- but all.of these estimates of
income have been predicated on a 24 month period; so the effect of the
start-up period on revenues is not as significant over a 20'to 24
month period as it is over a 12 to 15 month period. I felt at the
very beginning that,when we talked about expending a great deal of
public monies for a trial period ,that 2 years was about the bare .
minimum of getting any kind of a trial program and we talked about
that as the absolute minimum. But, as the chair has mentioned -by no
choice of ours, we have thinned and thinned on this estimate'until
now we are talking about 15 to 16 months but we are still talking
about this same large expenditure of public funds. 'I would go back
to only what.I said before;I have had to rely from the outset on the
city staff to investigate carefully and weigh all aspects of it,and
the City Manager has come up with a staff position that the staff will
not recommend this as a.'project for the worthy expenditure of $50,000,
and I don't have the kind of certainty that would enable me to over-
rule the staff°s recommendation. It is ,just as simple as that.
Councilman Gillum: Mr. Cable stated it would take a certain amount
of time to build up the number of passenge.rs,so
we know it is going to take sometime to
establish and,again,this cuts down the number of months we would be
receiving whatever the estimate of return is. It cuts even the
minimum of 13 months down. I am'afraid at the present time,. as much
as I realize how importantit is to the community, I am..sorry ..that,
we have reached the point where we don't have the time to spend that
amount of funds. I feel it is very .important to the community, and I
wish we could find some other way or area, of having L.A. Airways
start servicing the City of West Covina and start our Transportation
Center, but with the time left I am sorry I cannot support it.

I don't think whether it is public or private would have anything to do
with getting the funds but.,because of the shortness of time, unless we
were guaranteed 24 months of operation, I don't see how we can
amortize $50,000 over a period of 15 or 12 months, t}�e same as we could
over a 24 month period. Tt just doesn't figure out that way. Again,
if I am willing to lose $20,000 from the standpoint of what might be
best for the community, it doesn't mean.I would be will.i.ng to go along
with $30,000 or $40,000, unless we have the time element that could
give us the return for our investment; so I would have to go along
with staffs recommendation.
Councilman Chappell: One thing we may have lost sight of. The mere
fact that this 2 years was going to be a trial

operational or not -at the'.time but of the concessions. that we seek
to put in there.. I wasn't talking. .about $2O0.00 a month.but in the
area of $1,000 or $1,.200.a month .because as.far as I.am concerned
.that is the only.way..-we.are going to get:any return.on our invest-
ment. And any leases we might.have are going to bepredicated on the
operation of L.A..Airways,.and not on the idea of the.field being
built. So I would like -to see somebody offer a substitute motion
that the particular figure be worked out by staff and.brought back
to Council in two weeks,,so we .would ..have some -sort of guarantee and
then it is up to L..A. Airways. If. they banked- $.200, 0.00 ,to come
to the City. of West. Co.v.in:a,_.-I_am sure talki-ng about.. $.1.20.0 .a month is
not going to scare them off providing they are. ,in operation. And
with their investment of $200,000 they may -be. -better equipped to
guarantee that than .we.,are.

:project a motion to award a contract to a firm
for the construction of this. Correct me if I
am wrong - have.we n-o-t-asked this man to hold off once before, from
December.3.,and guarantee the prices he has quoted, and now we are
going to delay two more weeks and are we going back to the lowest
bidder and ask.him to guarantee his prices two .more weeks?
Councilman Lloyd: I think Mr. Gillum has a fine point there, but
I also think each -of the Councilmen are aware
of the fact that we will. have to allow the
bids to go back and..we.m.ay have to renegotiate, and I would accept
that if .nothing else can. -be .done. We .are- in the area of negotiation
and we have to do that which is best., at the 'moment; and if these
people want to participate in the construction1probably they will be
back in with their bid.

Mayor Gleckman: I believe the -way the code is proposed the
Council can take that action, but I believe that
prerogative remains with the City Clerk. Am I
correct, Mr. Wakefield?
Mr. Wakefield: There is a certain priority prescribed by the
City Attorney statuteunder. which the City Council selects
certain of the articles prepared; but if the
Council designates a member or members to prepare an argument,
either for or against, then that argument has priority over the others
•in the selection ultimately made by the City Clerk. For example, after
the designation is made by the Council,.comes the proponents of the
proposal, then associations within the community, and finally
individuals. If the Council chooses to designate a member or members
to prepare an argument, either for or against the issue, that
argument will have priority of choice over the others.
Mayor Gleckman: But what we are doing right now is authorizing
all members or certain members to file a
written argument for a City measure.
Councilman Chappell: Is it a blanket thing?
Mr. Wakefield: The Council must.indicate whether.they are
City Attorney authorizing all or only certain members to
prepare the argument.
Councilmam Nichols: Mr.,.Mayor,I am somewhat confused. The statement
here is authorizing certain of its members to
file a written argument for a city measure® are
we talking about the referendum that is on the April 14th election•?
Mayor Gleckman: Yes,, but we are talking about an Ordinance the
City Council has adopted.

more may not wish to join in preparing the argument in support, and that

I think it is only right and proper that the.
Councilmen who voted to enact the Ordinance
should have the right, if they desire, to inform the voters as to
their reasons why they feel the voters should support the Counc.i.l°s
action. I also think the Council should -give the same prerogative
to the two Councilmen on the Council. who chose to vote against the
Ordinance. I think it is a, two --way street and I would hope that
the Council would grant authorization to its members to prepare
arguments, either for or against.
Mayor Gleckman: That is the prerogative of Council; howevery
any action taken by this Council is taken as a
whole by the Council .and not as an individual-
as to how he feels or doesn't feel. Now if Council would'so chose
to authorize members of this Council to write arguments against,
that would be up to the members of Council.. In other wordssif Council
decided that all five members would join in writing arguments for a
City measure,it would then be the prerogative of the 'individual
Councilmen to request removal from that assignment. It would then
behoove the Councilman, if he so desires, to request of the Council
that he or they desire to write the arguments against the measure.

want to negate their authority to do something,
since they were the ones to initiate the action
against the City measure. We are shutting them out.
Mr. Wakefield: The situation will be.if this Resolution is
City Attorney adopted,.that members of the City Council
will have the first right to prepare and file
an argument in opposition to the Ordinance on the ballot. If no
such argument is filed -within the time the City Clerk will fix, but
an argument is filed by the proponents of the initiative, then -the

Councilman Gillum: I would like to bring to the attention of the
Council that I have had a number of phone
calls from individuals in the area with regard
to the 3-way stop at the intersection of Ferntower Avenue and Quinnell
Drive. At the tme.I had no idea whether the Traffic Committee would
accept or deny the request or what the recommendation would be. The
people that spoke to me felt the Traffic Committee was not really
aware of what exists,and they made the request that if there was a
denial they would like to discuss it with the Chief of Police and
the Traffic Committee, because they felt they were not aware of the
situation as it exists with the traffic flow and number of children,
etc.
Mr. Aiassa: If it is the wish of the Council,we can hold
this matter over and refer -it back to the

positions to redo under the classification of
Senior Clerk. We met with Kr. Gold and it
will take about three or four trips to study this position. We
would like authorization from the Council for an expenditure of
$300.00. We have this money in the Contract Services budget of
the Personnel Department, earmarked -for these purposes.

Council authorize the expenditure of not more than $300.00 from the
Contractural Services budget.of the Personnel Department to be paid
to Mr. Gold, consultant, for a study on the positions of Senior
Clerk.

Mr. Gold at a cost.of $300.00? Can°t we
rewrite the job descriptions with our own
people?

that are now filled and in the process of

ingagent to purchase the required furniture as recommended by the
consultant for the Council bay, and determining that competitive
bidding is impractical, and authorizing him to proceed on the basis
of negotiations; and the money to be expended from account PB 6400.

Mr. Aiassa: As Council knows;we are closing the program
on Fire Station No. 5. We have now con-

Savings.& Loan, to open and close escrow.

Mayor Gleckman: We have a letter from Julius Stern, public
auctioneer, requesting authorization to sell
the store fixtures at auction on Wednesday,
January 28, at 10 : 30 a.m. , of Mr. Norman Fond of Scotty Lee' s.
Mr. Stern is a licensed auctioneer in the City and County of
Los Angeles and meets the code under 6236. I would entertain a
motion that permission be granted.

COUNCIL COMMITTEE.REPORT.S-
Councilman Gillum: Last Friday evening the Employees' Association
held a meeting here which was well attended,
and discussed the proposedretirement plan.
They had representatives from the State Retirement, Social Security,
the actuary, and our City Attorney - Mr.,,
r. .Wakefield. .All were present
to answer' -questions. The bailots,were,sent'out today to the
employees and we hope .to have them` back by Thursday. If they
indicate positively they want to go to State,. then the material
will be put together by the Retirement Committee and submitted to
the Personnel Board at their first meeting in February, for their
consideration and recommendation to Council.
Mayor Gleckman: I also had a request to.proclaim West Covina
Youth Hockey Week Celebration,and if there are
no objections I.would so proclaim. (No
objections.)
Mayor Gleckman: I would also like to request'of Mr. Aiassa
to set up a meeting to resolve the water
situation. (Mr. Aiassa acknowledged.)
