APPROVED Denied by Planning Commission Resolutions No. 826 and 827 on December 2, 1959. Letter of appeal received from applicant on December 4, 1959 and set for hearing this date. Maps were presented and the Resolutions of denial by the Planning Commis- sion were read by the City Clerk. Councilman Heath: I believe the Planning Commission Reso- lution should state that it is bounded on the east by -Azusa Avenue and not bounded on the west by Azusa Avenue, as indicated. Mayor Brown opened the public hearing and stated that all those desiring to present testimony should.r:ise and be sworn in by the City Clerk. IN FAVOR Mr. A. Jett I represent the applicant and I would 905'Sa.Gl'end6ra Ave, like to request that the Council not con - West Covina sider the request for the Variance, When we made this application there was a variance and zoning involved. They were actually two separate matters. The variance was for automotive uses for the service station site and the variance was denied by the Planning Commission for reasons indicated by them and that is all right with us because'as things developed in this matter there were things indicated by the Commission relative to it and we approved of ourselves. We would appreciate your considering our request only for the C_-1 zoning and not include the variance request. City Attorney Williams: Was there an appeal from the variance? • Mr. Jett: They were tied together so that both of them were automatically appealed, but we are now asking only for the C-1 zone change. The Planning Commission approved the Precise Plan, they seemed pleased as to the drawing presented, and by eliminating the automotive uses originally asked for in the variance we are now making an entrance off of Workman giving us a driveway coming into the rear of the property and the C-1 uses that we have. There is no entrance to Fleetwell, that is to be fenced off completely and we will landscape all the area along Fleetwello C.o Co 1.2-28-59 ZONE CHANGE NO. 148 - continued Mr.Ao Jett - continued: Page Five We have two tenants that are waiting for us and if we receive approval we are ready to start building for them. They are good uses for the area and are a need in the community. IN OPPOSITION Mr, Robert Snead Out objection to the C-1 is that from 1731 E. Shamwood what we understand the tenants are to West Covina be a layovers' office and a music shop but that in the event either or both of these go "defunct" anything else in C-1, something that could be obnoxious to the neighborhood, could move in and this we are against. Although it was denied by the Planning Commis- sion they felt they could approve it for residential -professional uses and possibly Mr. Jett could have a special request for a music shop alone if he desired to do so. There being no further testimony, the hearing was declared closed. Mayor Browne There is a problem in my mind. It was stated the Commission approved the Precise Plan but denied the zone change and zone variance. This would seem a little irregular to approve a plan and deny.the zone change.' Councilman Pittenger- They adopted the position of the present driveway and the wall to serve as a buffer and landscaping but didn't approve the zone change and the variance request has been withdrawn. Mayor Brown- I think it puts Council in an odd posi- tion. The Precise Plan was approved over 10 days and now we are hearing a zone change denied for the same Precise Plana I think that in the future, from Council level, that -if something such as this does happen again the Precise Plan should be held and brought along with the hearing of the zoning at Council level. We are asked to approve something here we have no right to appeal since the deadline has run out on use City Manager Aiassa; Actually, the Commission has indicated that the Precise Plan be effective only upon the reactivation of R-P or C-1 zon- ing on the property. Mayor Brown- Then we should look at the Precise Plane Councilman Heath- It seems that the Commission in saying they approve the plan, approve the commer- cial, and yet on the other hand they disapproved the commercial. Do they or don't they approve the commercial? Councilman Pittenger. They approve the commercial uses as given on the Precise Plan but do not approve all commercial uses there. They approve the music studio and lawyers' office and the rest R-Pe Councilman Heath- They would approve restricted C-l? .0 Co Co 12-28-59 ZONE CHANGE NO, 148 - continued Page Six Councilman Pittenger: I would assume that was what they indi- cated. Councilman Mottinger: I think that it would be in order to grant a variance for these particular C-1 uses under the present zoning rather than changing the zoning to C-1. That seems to be the principal objec- tion. I can see that objection as a point of view because once C-1 is put on this property anything in C-1 uses can be permitted, whereas a variance under R-P. these.specific uses, other than R-P, could be used, Councilman Heath; I think you are then restricting the owner to having that one and only that one business in that building. Councilman Pittenger: That was the objection of the applicant at the time. Councilman Heath: I think that is restricting too much. If you have a music store now from here on out you have to have a music store, Councilman Pittenger: I think we should consider that the pro- perty to the north has C-1, directly across the street is firm C-3 or C-2 and kitty-corner across is C-1 use and service station and there is a block wall behind this service station. They will continue the block wall and the property south ig potential R-P which is close to the Freeway. That would be a buffer between residential and commercial if that were developed R-Po However, as long as in the center we are trying to establish R-P buffer between commercial and potential R-P, I do not think that is consistent with the rest of the development of the cor- ners. I think we should give firm C-1 on this property, particuhrly in view of the wall and landscaping required. Public Service Director Dosh: I would point out that I believe one reason the Commission adopted the Precise Plan was that'in case you disapproved their decision on the zoning you wouldn't have to refer the Precise Plan back, Councilman Heath: I would like,to know the feelings or reason why the Planning Commission denied commercial on there. They might have had some good reason that would lead me to look differently on it, Councilman Barnes: The only objection have to it is that it isn't in the plan of the City. It was my feeling there would be a study made of the HJ C plan of the City and very possibly this should be C-lo It is a very good location for C-1 because of being across from the C-2 and there is also C-2 to the north. We have a buffer of R-P to the south of this and I think this is very good. Mayor Brown: I think it should be C-1 and no zone variance. Or put in a music store and professional office and expect a man to build a building and amortize it over a certain period of time, he couldn't come out even with it. Motion by Councilman Pittenger, seconded by Councilman Heath and carried that Zone Change No'. 148 be approved, subject to the recommendations of the Planning Department and Planning Commission and Precise Plan No, 201. • • Co Co 12-28-59 ZONE CHANGE NO. 148 - continued Page Seven Mayor Brown; The Planning Commission adoption of the Precise Plan says it's to have proper tree planting and screening. Who or what indicates proper tree planting and screening? City Manager Aiassa: The Planning Commission has indicated ;.this be in accordance with approved landscaping plan, subject to the approval of the Recreation and Park Department. Mr. Jett: We submi.tted.a landscaping plan that was approved for the entire area. It was indicated by the City Attorney, relative to the query whether it was necessary this matter be referred back to the Commission, that the Ordinance had been amended so that this was not necessary if there was no material presented to the Council that had not been presented to the Commission,as then it would be only a matter of a report being made on the same things the Planning Commission had already heard. Mr.. Williams indicated there had been nothing new presented before the Council that had not been presented to the Planning Commission. DISTRICT A°11-57=7 Hearing of protests or objections to Installation,of Sanitary forming 1911 Act Assessment District to Sewers cover installation of sanitary sewers in Vincent Avenue and other streets. Set for hearing on this date by Resolution of Intention No. 1707 passed by the City Council at their regular meeting of November 23, 1959. Mayor Brown: This is the time and place for hearing protests or objections against the improvement of Vincent Avenue and other streets in the City of West Covina as described in Resolution of Inten- tion No. 1707. Mr, City Clerk,do we have the affidavits of Publication, Posting and Mailing relative to this'hearing? City Clerk Flotteri: We have the affidavits. Motion by Councilman Mottinger, seconded by Councilman Barnes and carried, that the affidavits of Publication, posting and mailing be received and filed. Mayor Brown: Mr. City Clean, have you received any written.protests or objections against the proposed improvement? City Clerk Flotten: We have received no written protests or objections. Mayor Brown: Is there anyone present in the.audience who would like -to present any protests or objections to this proposed improve- ment? Since there are no written protests or objections, and none from anyone present In the audience, I will entertain a motion that the hearing be -closed. Motion by Councilman Barnes, seconded by Councilman Pittenger and carried, that the, hearing of protests and objections against the improve- ment of Vincent Avenue and other streets be closed. • i C. Re: Proposed Annexation No. 7 of the City of Baldwin Park Proposed Annexation No. 53 of the City of Industry. RESOLUTION NO. 3834 OF Re: Protesting the spending of funds by CITY OF TORRANCE the,L6s_Angeles._.Board of Supervisors to conduct rubbish disposal survey, with a request that the.City of West Covina adopt a similar resolution concerning this matter. Mayor Brown: I would agree as this only includes the unincorporated areas of the County and the City of Los Angeles and we will help pay the bill and the benefits won't extend out this way. I understand the County will actually do the survey. Councilman Mottinger: I would certainly object paying for services not helping our City. I will agree with them on this. Councilman Heath.' I do, too. I think the City Attorney should draw up such a similar resolution. Councilman Barnes: I would agree, also. COMMUNICATION FROM Re: Hearing before the Board of Super - MR. BONELLI visors on January 20, 19.60 regarding the reorganization of the Municipal Courts. Councilman Heath: Perhaps th'pre should be something in writing to present at this meeting. Mayor Brown: This is a special meeting and it could be presented in writing or have a repre- sentative from Council. I will attend the meeting. Co Co 12-28-59 Page Nine COMMUNICATION FROM MR, BONELLI - continued • Motion by Councilman Heath, seconded by Councilman Barnes, that the Mayor be authorized to attend the meeting regarding the reorganization of the Municipal Courts with some type of written document indicating the Council's feeling on this matter, Councilman Pittenger° I think the motion should be withdrawn and the matter tabled until our next regular meeting. We will have another regular meeting before this hearing takes place and it will give us a chance to look the report over. Mayor Brown: We are on record as being against this sudden switch. However, since we have the time it might be well to read this report as to why this sudden switch has been made and then take the matter up at our next regular meeting. The motion of Councilman Heath and the second of Councilman Barnes was withdrawn pending study of the report with action to be indicated at the next regular meeting of Council. Motion passed on roll call as follows: Ayes: Councilmen Heath, Pittenger, Mottinger, Barnes, Mayor Brown Noes: None Absent: None Said Resolution was given No, 1724 CITY MANAGER REPORTS • CORTEZ LIGHTING STUDY Motion by Councilman Mottinger, seconded by Councilman Barnes and carried that Plan No, 3 be adopted and that the Lighting Department be directed to proceed, SALE OF STATE SURPLUS The City Manager indicated that in PROPERTY conversation with Mr. Davidson, Sr., the R/W Agent, indications were that a por- tion involved at Puente Avenue, by Mr. Cook"s property, and a portion involved on the south frontage road, by Charter Oak Wash, were to be sold as they do not involve the widening Co Co 12-28-59 SALE STATE SURPLUS PROPERTY - continued Page Ten . of the Freeway which is now being conducted, The City Manager indicated that although he felt the area near Mr. Cook's property involved no problem, the one area at the south frontage road by Charter Oak Wash did present a problem if it was disposed of. Motion by Councilman Barnes, seconded by Councilman Mottinger and carried that a protest be made to delay the sale of State Surplus Pro- perty Parcel No. 1147, off the south frontage road, and part of Charter Oak Wash, until the formation of 8 lanes of the Freeway and a decision on the frontage road is adopted. SERVICE AVENUE REALIGNMENT The report read was as follows: 1) Based upon revised estimates, the costs of the three alternates are comparable. The original cost estimate prepared for Alignment Study No. 1 considered only work shown on plan. Further study of the grades indicated that it would be impractical to utilize exist- ing improvements as indicated due to a four foot difference in eleva- tion between existing improvements on Service Avenue and the porposed bridge. 2) The curve radius, as shown by Studies 2 and 3, most nearly conf.oisn to our minimum standards. •3) The right-of-way acquisition required for alignments 2 and 3 are approximately the same, 4) Although the 10% skew as shown in Alignment No. 3 would provide an easier movement for the eastbound traffic on Service Avenue, it has the following disadvantages: a. Decreased storage capacity for the westbound left turn traffic at Sunset Avenue of approximately 12 vehicles. bo Increased cost of bridge. co Increased difficulty of left turn traffic for west- bound traffic at Walnut Creek Parkway, Service Avenue intersection. It is our recommendation that the alignment as shown by Study No, 2 be adopted. Councilman Heath: We have discussed this traffic problem here and I think this is going to create a monster. This Walnut Creek Parkway is going to be heavily traveled and the man on Service will never get out. City Manager Aiassa: • Councilman Heath: City Manager Aiassa: You will have signals at some time and then you will have free left turn, I wouldn't want a three-way stop on Walnut Creek Parkway, You will signalize it with the main one on Walnut Creek Parkway and Sunset Avenue and that will gain some freedom to Service at the same time. Councilman Heath: I do not think you can signalize its Co Co 12-28-59 SERVICE AVENUE REALIGNMENT - continued Page Eleven • Councilman Mottinger.-. I think in view of the fact that Plan No. 2 gives a bridge which will be at right angles to Walnut Creek channel I think this plan should be given preference even though a larger radius of turn may be a bit more preferable. Councilman Barnes.- I feel the same way, Mayor Brown: How much more for the bridge on Plan 3 than on Plan .2? Public Service Director Dosh.- About 5% although either way it would be cheaper than directly across the Wash. Councilman Heath: I am convinced this area will have to be signalized and if so if you brought Service Avenue in straight it would be easier to do it and have a better approach.. Councilman Mottinger: It would be a very expensive bridge, then. Councilman Heath.- We planned on having it straight across, Mayor Brown: Not at this points Councilman Mottinger: Why was No, 2 recommended over No. 3? Public Service Director Dosh: We had a 2 tv 1 vote on that on the committee. It was a toss-ups There is not a great deal of difference and the cost isn't too much different. No. 3 was better from eastbound and No. 2 from westbound traffic. Councilman Mottinger: I would like to see traffic come in at direct right angle, Motion by Councilman Mottinger, seconded by Councilman Barnes and carried that Service Avenue realignment Study No. 2 be approved. Councilman Heath and Mayor Brown noted "No". RECREATION AND PARK REPORT Councilman Barneso find this location would be Is them, City Manager Aiassa: A motion was made by the Commission relative to the north- west corner of Cameron Park being established as a Softball Field. The Girls' Softball League has been at Cameron Park prior to this motion but at a different location. However, they less detrimental to property owners around Motion by Councilman Pittenger, seconded by Councilman Barnes and carried, that the recommendation, by motion, of the Recreation and Park Commission to establish the northwest corner of Cameron Park as a Soft- ball Field, be approved. Co Co 12-28-59 Page Twelve REVIEW OF EXISTING City Manager Aiassao Through a motion RECREATION AND PARK from the Recreation and Park Commission, • MASTER PLAN it was recommended that the Planning Department initiate a review of the existing Recreation and Park Master Plano Councilman Mottinger.- 'there are quite a number of sites that have been -changed and affected and it was felt this should be brought up to date so as to know just what they are working with. Motion by Councilman Mottinger, seconded by Councilman Barnes and carried, that Council concurs with the recommendation of the Recreation and Park Commission and that the Planning Department be requested to initiate a review to be made of the existing Recreation and Park Master Plano AIPE AND CRS Motion by Councilman Mottinger, seconded CONFERENCES by Councilman Barnes and carried, that authorization be granted to the Recreation and Dark Commission for their representatives to attend the AIPE Con- ference at Pasadena and the CRS Conference at San Jose, subject to prior submission of expenses to see if they fit into the budget. TREES are 70 that might is a possibility which has a tree School. District° There are some trees located behind the City Hall which were donated to the City some time goo Out of about 220 there be considered useable by the City. We felt that there the remainder might be used at Puddingstone Dam.; planting project going, and the West Covina Elementary Councilman Barnes.- There are about 30% of these trees that can be used in our parks if they are approved by the park director. The schools asked for any additional trees that we had but we did not feel they would be good for schools if they would not be satisfactory to the Parks, and that perhaps those that could not be used by the Parks or the school could be placed at Puddingstone, especially since Pomona, Laverne and other cities in the area are donating trees for that area. Motion by Councilman Barnes, seconded by Councilman Pittenger and carried, that the City give to the Planting Committee for Puddingstone Dam all of the trees that the City Parks and 'Schools cannot use for their planting program in return for the removal of the trees at their own expense, ANNUAL SUMMARY REPORT DIGEST OF MINUTES Motion by Councilman Pittenger, seconded by Councilman Barnes and carried, that the report be accepted and placed on file. City Manager Aiassa.- We have attempted to reduce the volume of pages of the Minutes and have given Council copies of both the complete and condensed Minutes, in order to get their opinions on the matter, I have my reservations relative to the condensed Minutes where it pertains to money expenditure granted by Council and policies established. City Clerk Flotteno We have been running into a problem on the Council Minutes relative to retyping 30 or 40 pages of them from each meeting and then mailing them out to various organizations and individuals. This is costing the City a.lot of money. The condensed Minutes reflect only the action of Council as such. It improves the service to Council, will lessen the cost and work a great.deal if all the conversation is not included in those Minutes sent out to the public generally. A great many things occur which do not necessarily concern the public although they do the Council. City Attorney Williams: Most cities only reflect the action taken, or if no action, what was before Council, but they do not contain the discussion. City Clerk Flotteno There are some pertinent remarks by the Council and public that should remain in and also, if desired, Council may change the wording but not the meaning of Council's individual statements. Councilman Heath: I am quite against this brief form for many reasons. These Minutes are a record of what went on in the Council or in the Commission meetings, Many times we want to refer back to these Minutes to try to get the thinking back of the action taken. If we refer back to the abbreviated set of Minutes it doesn't give you a background of what went on before. If we are going to weigh these prob- lems and give a fair decision we should know what went on at any pre- vious meeting of the Council or Commission. They are a record and as a record they should reflect the feelings and reasons at that time. If we are having a problem of too much paper work I think that perhaps distribution of the Minutes should be limited. I. would propose - making a real brief record, siml,lar.to what the Planning Commission now does, on possibly one page, showing the subject taken up and the disposition and make that available to anyone who wants to come to the City Hall and get a copy. I think there should be a complete record for Council and Commission in the ,long form, keeping in mind the Commission also reads this in long form to get their explanations of why Council goes a certain way and vice versa. We read and study the Planning Commission Minutes to determine why they went a certain way in their decision. You could have an abbreviated copy of the action for anyone who wants to come to the City Hall to pick it up and a long form for use of Council and Commission. C. 12-28-59 Page Fourteen Mayor Brown: Some time ago we ran into some dig- cussio.n about the intent behind the motion which was not very clear in the Minutes so we had to go along with *-hat the majority didn't like, This has happened twice and when we referred back to the long form of the Minutes we were able.to establish what the intent was. We had people who got church zoning and then put in a school and it was shown that questions were asked directly about school possibility and it was established what had -taken place by the long form which a digest form would not have. I do not like to see it chopped, Councilman Pittenger-,. I would see no objection to abbreviations. where possible on resolutions and other such matters, but not on public hearings and other possible controversial items of the Council and Commission. It would save a lot though, not to go through such rigamarole on resolutions, ordinances, etc, Mayor Brown: I think public hearings should be as detailed as possible, Councilman Barnes: I thought the City Clerk indicated Council and Commission received full detailed Minutes and the digest form would be for the public only, Mayor Brown: If the full, Minutes don't go into the folder you can't approve those Minutes, Councilman Heath: Councilman. Pittenger felt perhaps time could be sabred relative to resolu- tions,'street improvements acceptance, etc., but even those sometimes raise questions from members of Council that should be indicated. It doesn't take much more to bring out such points., although they very seldom do arise, but when they do it wouldn't take much more to include them and you have a better record, Councilman Mottinger: I would make the suggestion that since the comments have been made pro and con that the City Clerk study the matter further and perhaps further discussion can be done at a study session and he would have further suggestions to make. Perhaps some improve- ments could be made to shorten them somewhere, Councilman Barnes: So far as mailing these in full form, that could be cut down, Mayor Brown: Perhaps it could be noted they will be made available at the City Hall, City Attorney Williams: In some cities the action is shown on the Agenda after the meeting in various colored ink and that is sent out to the public. Mayor Brown: We want the long form until we adopt something different. It was noted that there had been a skeleton staff at the City Hall as well as some other City workers the afternoon of December 24th, Mayor Brown: Perhaps those that worked that half day before Christmas should be per- mitted the half day off before New Year's. Councilman Pittenger: Leave'it to the City Manager to have a skeleton crew a half day before New Year's. Councilman Heath: I do not think the half day is justified before New Years, but I do think it was before Christmas. We will have two reports for you, possibly at a work session the first Monday in January. It was consensus no work session on the first Monday, which was the 4th of January, and the City Manager indicated he would then mail the necessary information on this matter for Council to study. COUNCIL COMMITTEE REPORTS Councilman Heath: Don Brown of the Tribune is leaving us to go to Colorado. We have had good associations since he has been with us and on behalf of the Council.I would like to wish him good luck and say that we're sorry to see him goo The sign at the east end of the City needs painting and straightening out. I think there should be flowers planted in back of the sign. Anyway, something is wrong, perhaps we should have better signs, Councilman Barnes: Couldn't we find a better place for that sign coming in from the west? The Recreation and Park Commission ha-s referred the matter of naming Orange- Merced Park Site to a committee. They are going to have a committee from the school submit names and are going to study the matter to obtain a better name for the site. Councilman Barnes: The East San Gabriel Valley Recreation Committee,.of which our Recreation and Park Commissioner, Roberta Blood, is Chairman, is going -to have t ee planting ceremonies at Puddingstone Dam on January 23rd atl K. Me I understand the Girl Scouts have asked for a separate day as they plan to.plant some 1200 trees. They, the Recreation Committee, would like to have,a representative from Council present on the 23rd for the Planting ceremonies.
