Motion passed on roll call as follows: Ayes: Councilmen Heath, Pittenger, Mottinger, Barnes, Mayor Brown Noes: None Absent: None PRESENTATION OF GAVEL Mayor Brown: We have a few minutes TO COUNCILMAN MOTTRNGER to spare before the hour of 8:00 61-clock, at which time our hearings' take place, so I would like this opportunity of saying that it has always been my desire to have a Mayor who is going out of office presented with a gavel to remind him of a few of the "hard knocks" while holding that office. So now, with the full expression of members.of Council, I would like to present this gavel to Councilman Mottinger in appreciation of his services rendered as Mayor during the past year and as a member of Council, Councilman Mottinger: Thank you, Jay, and members of Council. This is a surprise and a very nice one. As Jay.says, you get some "knocks" as Mayor but it is a real honor and a privilege to serve the City in that capacity and I thoroughly enjoyed my term as Mayor. Thank you very much. SCHEDULED MATTERS HEARINGS ZONE VARIANCE NO. 280 TIE VOTE - NO ACTION AMENDMENT TO PRECISE PLAN OF DESIGN NO. 81 (Ray L. Anderson) REFERRED.BACK TO.THE PLANNING COMMISSION WITH RECOMMENDATION LOCATION: Southeast corner of Azusa and Garvey Avenues. Request for Service Station Use and Adoption of Amendment to Precise Plan of Design in Zone C-1 approved by the Planning Commission, their Reso- lutions Noo 768 and 769. C. C. 7-27-59 Page Five Z. V. NO. 280 AND P. P. NO� 81 - continued Hearing requested by Council. Held on July 13, 1959, testimony heard and hearing closed. Addition of 20-feet to existing building granted by Council. Decision on balance of application held over until regular meeting on July 27th. Mayor Brown: J. Councilman Mottinger: Mr. Alassa.". . The hearings were held on this matter and it is.now up for the decision of Council this evening. Is there any further information to be placed before Council relative to. this matter? There is a report in Council's folders relative to signalization of this area. Councilman Pittenger: This report would possibly have some- thing to do with future zoning but not immediately. I can't see any relation to the.problem at hand relative to the traffic count. Councilman Barnes: I do not think that is entirely correct as there may be possibly some significance at the present time in regards to traffic and safety hazards on the frontage road. I spoke to Mr. Haglund in regards to this. He felt there wa-s a definite point here if traffic becomes heavier and 8 lanes of the Freeway are to go through the City. That possibly this would affect the develop- ment of this property in that the traffic might have to cross over into oncoming traffic to get into this location. This traffic.study was made and only just recently completed. I asked for a copy as I felt it might give us pertinent information'that we did not have. Mayor Brown: I still do not quite see the effect at this time. Councilman Barnes,, I think there is, so far as safety 'is concerned. There is a possibility of accidents, if you have traffic coming from the west on the frontage road and traffic coming off Azusa onto the frontage road. At peak hours this traffic is heavy and I feel there is a safety hazard there. Mayor Brown: This is true and the 8 lane Freeway might --change the whole matter but I do not think we can look at it from that angle. 0 0 C. C. 7-27-59 Page Six Z. V. NO. 280 AND P.P. NO. 81 - continued Councilman Barnes. There is a chance of widening and changing the off -ramps. Mayor Brown: Definitely there will be changes there, but when? I do not think it should have any effect on the man's use of the property at this time. Councilman Barnes. I think we should be aware of this in- formation relative to this matter. There are many points where there are traffic problems and possibly this is one of them. Councilman Mottinger: I think the principal problem before us, and which was discussed at the last meeting, was whether or not there was justification in giving a variance for a service station to exist in the middle of this property. There are certain qualifi- cations that must apply when a variance may be granted and the ques- tion we have to answer is - does this application satisfy the require- ments for a variance? That was the summary of what Mr. Gerschler had to say at the last meeting and on the basis of that sort of d ' e- termining, namely; that these hardship situations do exist and that the Planning Commission approved the granting of this variance. In other words, a service station in a C-1 zone. It does seem., and it could very well be construed, that these conditions do exist and that it might be incumbent upon us to grant a variance for a service station, Councilman Banres: Before we go on with this I think I would like Mr. Williams to read the .Zoning Ordinance relative to obtaining a variance. I believe there is a reference to traffic relative to variances. Mr. Williams read the four points of the requirements for obtaining variances. Councilman Barnes: I thought there was some reference to traffic. Councilman Pittenger: There are two points here under which I can't agree with the necessity for a variance. If we do this on a piece of property that is in C-1, what is to preven * t any service station orany property owner from coming in to us and saying "there is a service station granted on that corner in C-1, a use which now requires C-2, and I want to enjoy the same privilege in the middle of the block". C. C. 7-27-59 Page Seven Z. V. NO. 280 AND P. P. NO.-81 - continued Councilman Pittenger - continued: I do not think this is the best use and I do not think we are not granting this man proper use if we do not grant this thing. This will be a traffic hazard. Traffic going west will have to make a "U" turn in front of traffic coming off the Freeway to enter this property and it will also be adding a further traffic burden to that street. There has been in the neighborhood of a 50% increase in traffic since 1957. I think that under these two points we can deny this variance. I certainly think of the situations we may get outselves into, in the consideration of other property in which C-1 abutts C-2 use, when it wasn't necessary a year or two ago to get a variance in C-1 for such use. We changed this for good and sufficient reasons, so now let us stick to our guns., Councilman Heath: I talked with the people in the gas station.on the corner and they didn't seem to have any objections whatsoever to this other station going in. It has been expressed that this is competition and free enterprise. On the other hand, I feel the way Councilman Pittenger does, in that we are possibly setting a precedent by allowing these two stations to go in adjacent to one another. In reading the variance condi- tions it says "The sole purpose of any variance shall be to prevent discrimination, and no variance shall be granted which would have the effect of granting a special privilege not shared by other pro- perty in the same vicinity and zone". This is all one piece of property. I am a little worried about the fact that if someone should have C-1, 500-feet square, and we permitted a gas station in one corner possibly you could be required to give gas stations adjacent to one another around a complete block. I think we could have something of that nature "snowball". Mayor Brown: On this piece of property, although this is for the center of the property, I think this piece of property is different than most commercial zonings in that it has Freeway off and on ramps directly in front of it and is potentially a corner. In my opinion, I think this is a proper use for the term "variance". We can control it, to a large extent, by a variance. We can't � Justify it on an anticipated traffic count and 8 lanes on the Free- way some time in the future. Councilman Heath: property against another. I am wondering if we are interpreting this variance zoning properly? If there were two pieces of property concerned, possibly a variance should be required on one part to bring it up to adjacent property, Here we are talking about one piece of property. Mayor Brown: Do we have the right interpretation of a variance in that gas stations be by variance only? Councilman Heath: Yes, because it says it must be re- quired in C-1 zone. Councilman Pittenger: That change has been made. Mayor Brown: You can use one piece of property to equal another piece of property. He had one piece of property zoned so why can't he have this zoned to. have it equal,,with other piece of property? Councilman Pittenger: We zone C-1 with R-3 or R-P. Why couldn't the same single zoning be wanted on all of it? If we have this piece of property qqual to that piece we would have no reason for doing it and there would be no justification to turn anyone down on a variance. Councilman Barnes: This property was all C-1 and the first variance was granted for, the privilege of a filling station on that corner inthat it was C-1 and without it he couldn't install the gas station, and that particular corner has a variance. Mayor Brown: I do not think there is a variance on the existing gas station. Mr. Dosh: Across the street is a gas station under variance but I do not associate this Shell Station with a variance. Councilman Mottinger. I think one thing we are overlooking, and I continually forget it myself, is that at the time we changed the Ordinance,-afid I did as much stumping for getting service stations out of C-1 as anyone else, was to avoid just this sort of thing - we were getting too many in C-1 zones. Zone Variance No. 197 was granted for the Shell Gas Station. C. C. 7-27-59 Page Nine Z. V. NO. 280 AND P. P. NO. 81 - continued Councilman Heath: Do you feel that taking gas stations out of C-1 was a good move? Councilman Mottinger: Yes, I thought it was a good move and I would go after it again, Motion by Councilman Pittenger that Zone Variance No. 280, as it pertains to the Service Station, be denied failed for the lack of a second. Councilman Heath: There are a lot of facets to this thing. As you can see from the feel- ing here there are possibly four people, at least three, who are indefinite on this. Would it be in order to hold this and study'it further? Mayor Brown: Councilman Heath: Mr. Williams-. decision 40 days after hearing. would be delaying the man. Councilman Barnes: study it or the maps. I wou Id next regular meeting. It would probably be in order but it would be delaying the man. Do you have to act on this now before it becomes effective automatically? This would not become effective auto- matically and there is no particular deadline except the di rective of However, as Mayor Brown indicated, it I asked the City Manager for this report. I didn't see it until tonight and haven't had the chance to like to see it held over until the Councilman Mottinger: In this particular case there is quite a bit of indecision and on the basis of the study that the Planning Commis - Sion has put into this matter and their recommendation that it be approved,�I would like to make a motion relative to the matter. C. 7-27-59 Page Ten Z. V. NO. 280 AND P. P. NO. 81 - cont -inued Mayor Brown indicated that the motion failed to carry due to a tie vote. Mr. Williams indicated this was not a denial in the motion's failing to carry and that it could be revoted upon now or at a later time if Council saw fit to do so. Councilman Pittenger: A good portion of this.,plan is the station. He has changed the Precise Plan once from the original use. I would like to ask Mr. Anderson whether he has any other contemplated use for the easterly portion,- building on easterly portion? Mr. Anderson: Yes, we have a McDonald's Hamberger Stand that would go in place imme- diately. There are also plans for the 19,000 square foot future building immediately. I would ask that the Precise Plan be given consideration in that there is no reason for not considering that. Councilman Mottinger-. Apparently, if we were to approve this.Precise Plan, deleting the service station use, then he could, in the area where it is designated as a service station, put a Hamburger Stand and comply with C-1 zoning. Mr —Williams.- You could hold this portion of,the Precise Plan in relation to the Service Station and let him take out the pump islands and indicate dimensions and parking for the Hambur- ger Stand without filing a new plan and simply make that amendment, and show it to the Planning Commission without further hearing, approving as changed. Motion by Councilman Mottinger, seconded by Councilman P ' ittenger and carried that Amendment to Precise Plan of Design No. 81 be referred back to the Planning Commission with the recommendation that the Service Station be deleted from the plan and the plan be resubmitted with some other use stated. Mr. Anderson: Mayor Brown: Mr. Anderson: Mayor Brown: I still think Council must give * reason for denial of the variance. It was not denial, no action has been taken and that is really where it stands. What is the next thing to do if I still seek a variance? I believe this would be a matter best discussed with the City Attorney rather than Council. Councilman Heath: This went through the Planning Commis- sion and it was passed. Due to our action it was stated that it was just as if we had not heard this. Doesn't the Commission action still stand and the thing is passed? Mr. Williams: Under the action taken it is still considered pending before you. You could vote on it at the next meeting of the Council. Mayor Brown: There would have been no action on the variance but when it was brought before Council for hearing and action, that automatically over -rode the Planning Commission action. Mr. Williams: What it actually does is that having it before you for action suspends the action of the Planning Commission until Council actually rules upon it. Mayor Brown stated that all those desiring to present testimony should rise and be sworn in by the City Clerk. There being no testimony presented, the hearing was declared closed. Ryder This letter, read by the City Clerk, indicated the placing of recreational facilities in this development and submitted such a tentative proposal on Lots 17 and 18 and other pertinent facts. RYDER - continued Councilman Mottinger: Mr. Gilbert: Mayor Brown: Councilman Mottinger: Mr. Williams. - Page Fourteen This is to take the place of the R-1 property to the south? That is correct. It might be a better use for that particular spot than the R-1 would be. I believe this would be a revision in the Precise Plan and should go to the Planning Commission. Is this Precise Plan pending? Councilman Mottinger: It has been approved. Mr. Williams: This matter should be taken care of by filing a request for amendment. All Council can do is possibly to indicate whether they would be generally responsive to this idea. Mr. Gilbert-, I would want some indication from Council as to how responsive Council would be because in planning our apartments and in getting our loan commitments this would have a bear- ing on the loan we would receive,, as well as planning recreational facilities. Councilman Heath: Would this plan be developed simul- taneously with the apartments? Mr. Gilbert. Not until half of the apartment development has been completed, and this brings out a matter that has come up since the letter to Council. We feel we would need some clarification relative to approval in order to proceed with the development. I discussed this with Mr. Dosh and I found it would be necessary for someone to clarify it in order to be able to proceed. Mayor Brown: To change it, it would have to go back to the Planning Commission. We can't say "go ahead and do it" even if we were in complete accord. You are changing the Precise Plan on the property. In fact, you are changing the zoning, actually, from R-1 to recreational, use. Councilman Barnes: I believe there was a stipulation on this that R-1 be developed first and this change might have some bearing on that stipulation. S 0 C. C,, 7-27-59 T. T. RYDER - continued Page Fifteen Councilman Heath: That is correct and that was my reason for asking the question as to whether this change to the recreation area would see it developed first. Mr. Gilbert: We do not feel it would be economical to develop it first with only 16 apartments, However, when 50% are completed we will have a recreational area put in. Councilman Heath., I am no t asking for testimony, just clarification. If these 16 apart- ments are installed how long would it be before the next group of apartments would be built? Mr. Gilbert: They would be started upon the com- pletion of the 16. Councilman,Heath: Immediately? Mr. Gilbert., I can't answer that as on these 16 apartments we are dealing with owner- ship and not rentals and it would depend on the sale. Councilman Pittenger: It still depends on economic conditions. Mr. Gilbert: This is an entirely new venture in this City and the 16 apartments will show us how right we are. Councilman Heath: If you do these 16 apartments and they do not go over,there is the possibility the rest would.not be built. Mr. Gilbert: 'We would then build the remainder for rentals and not for sale which would change the design of necessity since they would not be as large or as elaborate. Councilman Mottinger: It looks as if it may be feasible to work out something acceptable in this recreational area insofar as Council is concerned, if it is reviewed by the Planning Commission and proper qualifications are put on it, and not until then are we in any position. to act upon it. The only thing we can do is indicate that much and have it go to the Planning Commission for study. Councilman Barnes: I feel this might be one way of R-1 lots. RYDER - continued Page Sixteen Mayor Brown: I like this recreation there, but this was done- by variance without Council ever seeing it. There was no provision in the past for recreation purposes. Councilman Mottinger: When I said "proper qualifications from the Planning Commission" I assume that Mr..Gilbert cannot know if it would be economically sound to develop a recreational area first, but if a bond was put up before subsequent buildings began for this use then we would have our assurance. Something 'like that could be worked out through the Planning Commission, Councilman Heath-,. I think it could be possible that these 16 units could be built and then they find they were not profitable and then the remainder might be held up say 1, 2, 3 or 4 years. In the meantimeadjacent property might develop, people will buy homes and then up pops a swimming pool in back of them and it could lead to bloodshed. Mayor Brown:. There are ways that might be taken care of. The property could be posted -rislative to a future recreational site, Councilman Heath- Perhaps there could be a stipulation set up whereby the buyers of homes in the area adjacent are advised this is going to be here. Councilman Mottinger: That would show in the variance and it is a matter that could be checked upon by the buyer. Mayor Brown: I believe, Mr. Gilbert, at this point all we can do is say we cannot act upon it and that it will have to go through the Planning Commission first. Mr. Gilbert: Would I be correct in assuming that we can widen the street up to Lot 15 the northerly end of Lot 15 - without going any further? That is, put all the improvements on Lots 15 and 16 which would be the 16 units. Councilman Mottinger: Mr. Dosh: It seems this is an administrative problem. Proper bondscan be posted. CITY -COUNTY AGREEMENT two written reports on this matter. AUTHORIZATION TO NEGOTIATE This is for sale of 1.7 acres for A WRITTEN AGREEMENT the proposed County Regional Library. The offer from the County for this 1.7 acres is $46,200.00. I checked with the Department of County Land Appraisal and we cannot put any restrictions.in the Deed of Sale but we can negotiate a con- tract in relation to.the library facilities, etc. There are several items they agreed to fulfill: (1) Break ground approximately in or near May, 1960; (2) County Library would agree to City's option to purchase during life of building; (3) They agreed on 20,000 square feet factor and I think we should spell out the provision of the square feet minimum area and develop three -branches, maintaining at present the Vine Street Branch. They agreed to these items at our joint meeting. Mayor Brown: Couldn't this escrow be cotingent on the factor of them not breaking ground in May, 1960? C. It could be done in the manner suggested by Mayor Brown or have the provision. that the City may buy it back for the same amount of money unless'the -building is built within a certain time. Mayor Brown: I feel that it is important that .,this building be built on time and not delayed. Mr. Aiassa: -I feel that to be fair, and we have had some delay on our part concerning appraisals, etc., and recommend that we give the County until June'30, 1960 to start construction. Councilman Mottinger: If it is within the fiscal year I think the time limit would be all right. Mayor Brown: They could start construction before the first of July which is within the fiscal year. COMMISSION FOR HEARING We have two people present in the audience who have a tentative map predicated on realignment of Merced Avenue which doesn't,meet the requirements of our Master Highway Plan as adopted. To make their tentative map effective, we will have to amend our major highway plan which shows Merced Avenue with a curve in it. I have submitted reports to the County Planning Department and the State Division of Highways. The County wants to maintain the existing alingment as outlined in our Master Highway Plan, but after reviewing it with the State Division of Highways they suggested that if we use gas tax monies we would be able to make a much better align- ment with the maps here attached. They appointed a committee of two to go over and measure that property to see if they could get a regulation Ball Diamond on it. Another thing is that the Recreation Department has asked the Recreat.-ILon Commission.for a policy change in the 'handling of children under 8 year's of age. At present they have no authority to send these children home from the recreation program and children under 8 years of age are a parttcular hazard on the school grounds as they usually have no guardianship and the Parks people have to do what practically amounts to baby- sitting. If they had more authority they could send these children home, with a letter, in relation to someone being with them who might be responsible for the child or children while at the playground. The Commission has approved the policy change situation and believe this is something that is needed. The West Covina Pony League won yesterday and goes to Ontario. The West Covina American League won two games and they play Glendora Thursday night at Barranca School. Both teams have moved right along very nicely. I understand you have more top brass than you have patrolmen. There are so many things happening and we need wore men. Mr. Aiassa: In meeting with other City Managers, Mrs. Van Dame, it seems we do not stand alone in this problem. It is like a wave going on in Southern California at the present time. Mayor Brown-, We have far less happening in West Covina than in many other areas -around, Mrs. Van Dame: Are you ever going to have lights on this area of the Freeway? Mayor Brown-. I would doubt it unless we put in a terrific tax increase to get them and to tax the people of the City for that, I am much opposed to it.
