M. in the West Covina City Hall. The Pledge of Allegiance was led by Councilman Barnes, with the invocation given by Mayor Pro Tem Mottinger. ROLE. rAT.T. APPROVED Mayor Brown opened the public hearing and stated that all those wishing to give testimony should rise and be sworn in by the.City Clerk. Frank Bandy I don't have too much to say at this time. I am sure this doesn't clear up the problem on this property. It's irregular in shape. This won't leave me a profitable piece of pro- perty at all. We have to conform to street alignments and at one time this left my property in good shape but not now. There being no further testimony, the hearing was declared closed. The City Clerk read Planning Commission Resolution -No. 754 and No. 755 and a memorandum from the Planning Commission,as an addition to Item 3, on page 2 of Resolution No. 755. After Discussion among the Councilmen, motion by Councilman Mottinger, seconded by Councilman Heath and carried that.Zone Change No. 140 and Precise Plan ofDesignNo. 180 be approved subject to the recommenda- tions of the Planning Commission. Mayor'Brown opened the public hearing apd requested that all those wishing to give testimony should rise and be sworn in by the City Clerk. Inopposition Frank Bowker Mr,.Gerschler, do l understand that this does include the extension of .Walnut Creek Parkway from Vincent to Glendora? Mr, Gerschler: Yes, that is right. Mr. Bowker: I Thought it did. The property I have is east'of'the Vincent Avenue extension and it would practically take all or most of it. We will have to work a deal out on that. It would crucify my property. Mayor Brown: I don't feel we have to have any further discussion on this since we only secured these maps last Friday. There being no further testimony, I think we should close the hearing. Councilman Heath: This needs quite a bit of study. I have looked at some of these and I cannot understand the reasoning on them. Maybe there is -something here that I can't see. I think we should study this. Councilman Pittenger: I would like to do that too. I would like the Planning Commission in on this, too Motion by Councilman Heath, seconded by Councilman Pittenger that the decision on Proposed Amendment No. 30 be held over and set up for a study meeting with the Planning Commission for further study. Are these all consolidated in one now? Mr, Aiassa. Yes, as shown on the map. Councilman Pittenger: We certainly couldn't take any action on this at this time. Councilman Heath: Well, can't we have the hearing on this? Mayor Brown: This is not the time or place for the hearing at this time. • Mr, Williams: You wouldn-It want to have a hearing .--tonight, would you? C. (From audience) Mrs. Hammer: In the Wednesday night meeting it was recommended that I talk with Mr. Dosh or Mr. Gerschler. Mr, Aiassa:. We might ask how many in the audience are interested in the, annexation. Mayor Brown.-. (Asking for those.living-within the Pro' posed area who were in favor of annexing to please stand - then after this he asked for the ones who were against or in opposition to annexing to please stand) Approximately 13 to 6 was the count in favor. Mayor Brown stated there would be no public hearing at this time but he would open the matter up for discussion. C.. C. Cheeseboro ® 19542 Arroyo Avenue. The place where I live is or will be the southeast corner of Grand Avenue and the Freeway when Grand Avenue is put.. through. I have lived there 12 to 14 years and we have been in the County and we have been satisfied with the way everything has been going. - Now in recent years there is a number of "johnny come latelys and. stuffed shirts" that have moved in and they have been trying to incorp- orate. It seems every time you turnaround you have to fight these people on this incorporation deal and it just makes one sick and tired. We have beat them three or four time and after the last time we beat them they filed again in September of last year. Their_ request for incorporation was beaten by a larger vote of property owners. They were not satisfied with that and one week later they filed a notice of intention to incorporate again. You fellows know what they think of the people in West Covina and I certainly don't feel that way and I never have. Now at that time some of us had petitioned for annexation to West Covina, that was in September of last year, and I think, we should be getting some action on that request. Mr. McDoud I live on the south side of Holt and I ._have heard Cheeseboro before. I would like to take exception. The incorporation matter has never gone up for vote..... Mayor Brown.reminded the audience that this was not a public hearing. • Mrs. Hammer: Well, I talked with Mr. Gerschler and I told him...,, Mayor Brown again reminded the parties that this was not a public hearing. C. C. 6-8-59 PROPOSED ANNEXATION NO. 165 - continued Page Eleven Mrs. Helfrick: I have been here before-- It is true that most of us want to annex. Mayor Brown again reminded the parties for and against this -issue;;:that- - this was not the time nor the place for a public hearing. From all -indi- cations he felt it would be feasible to study the situation -and proceed from that point. You will be notified by mail and the newspapers as,well if and when we decide, and the notice of the time and place of the public. hearing will be mailed to you and it will also appear in the daily news- paper. There will have to be a petition circulated before we can straighten anything out on this. - Mr, Gerschler: There are informal petitions on file. Mayor Brown:, There would have to be new petitions circulated, ZONE VARIANCE NO. 217 Communication from Mr. Ned Gilbert dated Precise Plan of Design June 2, 1959 requesting permission to "No. 168 (Ryder) build R-3 first instead of R-1. fihe City Clerk read the communication from Mr. Ned Gilbert. Mr. Aiassa: R-ls are to be in first, aren't they? Mayor Brown: Or concurrent. What is your thinking, Mr. Barnes? Councilman.Barnes: I heard the Planning Commission recommen- dation. The reason that the R-ls were to be developed first was that at some later date they couldn't come back and ask that these R-1 lots be zoned R-3. They didn't feel we should developeR-3 unless R-ls were developed first and I agreed with them. Councilman Mottinger: I have the same opinion. We should go along with the recommendation as passed. Mayor Brown: I can go along with R-1 on Larkwood Street but the second, I see no necessity of building those prior to the apartments. Motion by Councilman Barnes, seconded by Councilman Pittenger and carried that the request contained in the communication from Mr. Ned Gilbert on Zone Variance No. 21? and Precise Plan of Design No. 168 dated June 2, 1959, be denied. The Engineering report was read by Mr. Dosh, Assistant Public Services. .Director. Motion by Councilman Mottinger, seconded by Councilman Barnes that the contract for Project No. C-93, Citrus Street Traffic Channelization, be awarded to Crowell & Larson and approved in the amount of $1,213.83. REIMBURSEMENT AGREEMENT #25 LOCATION: Montezuma Way south of Cameron Avenue Motion.by Copncilman Mottinger, seconded by Councilman Pittenger and carried that the City approve the request of the City Engineer to accept the report and that the Mayor and the City Clerk be authorized to neogkitate the agreement. RECREATION AND PARK RESOLUTION -NO. 1414 The City Clerk read the recommendation. Youth Club Activities from action taken by the Recreation and. Fees and Charges Park Commission at its regular meeting,. on May 28, 1959, that "Youth Club Activi- ties" be added to Resolution No. 1414.. Motion by Councilman Barnes, seconded by Councilman Pittenger and carried that Resolution No. 1414 be amended to include Youth Club Acti- vities. The City Attorney was. instructed to prepare a resolution on said amend- ment to Resolution No. 1414. The'City Clerk presented the Policy for cooperative development and maintenance of baseball facilities in cooperation with other agencies. and the list.of various recommendations was read -to Council. Motion by_Councilman.Mottinger that the City adopt this policy to be followed in the future. For lack. of a second the motion died. Councilman Pittenger: How does this compare with what we have done in .he past?. I would like to know just what we are letting our- selves in for. Councilman Barnes: I feel that we should study this. It is quite involved. C. C. 6-8-59 Page Fourteen COOPERATIVE BASEBALL FACILITIES - continued • Mayor Brown: It could be quite expensive for the City for the few that benefit. Motion by Councilman Heath, seconded by Councilman Pittenger and carried that the policy for cooperative development and maintenance of baseball facilities in cooperation with other agencies be held for further study. GENERAL MATTERS ORAL.COMMUNICATIONS HUNTER & BURTON Mr. Burton: Approximately three months quit claim deed ago my partner and I made application - for a building permit and about one month later all conditions were complied with. Our builder came down to get the permit and was instructed that the permit could not be picked up at that time. Now I have just received this letter from Mr. .Williams, your City Attorney. Laughingly,I will have to say, that six weeks ago we agreed that if our building permit could be issued we would make.the dedication that is referred to and that we would close the present openings along. the service road and the main part of Glendora Avenue. (Discussion continued) The City Clerk read a written communication directed to Mr. Howard C.. Erickson and signed by Harry C. Williams, regarding Hunter & Burton quitclaiming the service road to the City along the entire frontage of their property on the west side of Glendora south of Garvey, including the existing building, but excluding the two feet or more or less which the building encroaches upon, install electroliers along the entire frontage and close the present openings between the service road and the main part of Glendora Avenue. Mr, Aiassa requested the quit claim deed be delivered and he would have the building permit issued. Mr. Burton felt that this position.,.: was not one which he wanted to place himself in as he did not desire.. to make the dedication of the land which he had already told the City, . would be dedicated and which he intends to dedicate anyhow, a requisite for the issuing of the building permit. _After further discussion, Mayor Brown recommended to Mr. Burton that`he prepare his own quit claim deed and deliver it to the City and the building permit would be issued. Ordinances 563 and 564 which regulate the use of -signs in the City of... West Covina. FIREWORKS STAND The City Clerk read a resolution signed Air Force. Association by the. American Legion, Veterans of Foreign Wars, Jewish War Veterans and. Disabled .Veterans, directed to the City of West Covina requesting the permit issued.to the Air Force Association to sell fireworks be revoked, Mayor Brown opened the matter for discussion. There was much discussion among the Council members regarding various phases of this resolution as to whether or not the Air Force Association had been holding regular meetings or temporary meetings and whether or not they should reconsider letting the Air -Force Association sell fire- works in the City of West Covina, It was brought out that they had been turned down in Baldwin Park, that there was not sufficient information furnished to let Council members know the status of the organization'.at. the present:time, and generally the situation did not lend itself as being a favorable situation for the City to consider this year, Mayor Brown suggested that the Ordinance which had been read to them=du`ring.: the course of this discussion be studied and.that it was now time that the ordinance be checked to see that it stated exactly what it was in- tended to state at'the time it had been written. That he felt that with this situation existing and in order to adhere to the ordinance°'the.City would not be able to let the Air Force Association sell fireworks in West Covina this year. COUNCIL COMMITTEE REPORTS CIVIL DEFENSE TAX MEETING RECREATION AND PARKS Councilman Heath reported on the Civil Defense meeting he had attended. Councilman Heath reported on a tax meeting which he had attended at which he learned that -County taxes are going to be raised l61o..'. Councilman Pittenger met with the Recreation and Parks Committee. SIDNEY PINK Mayor Brown reported that Planning Commissioner Pink had submitted his resignation which he would like effec- tive immediately, but since he did not have a written resignation that it would..be irhpossible to -present it in the form of a formal resigna- tion until such time as the letter on same was received. However, it was decided that the Mayor would talk with Mr. Pink and request that he stay on the Planning Commission until the next meeting at'which time they would consider..his resignation to. be effective. Mayor Brown also discussed a Personnel Meeting of the Council that. would take place on Wednesday, June loth, and that they could proceed with'the selection of .a member to replace Mr. Pink but would have to 'wait for voting on-same,until the formal resignation had been received. MRS..VAN DAME Mrs. Van -Dame mentioned previous meetings when a Policeman was always in attendance.. She requested that that again be- nstitu.e.d, not only for Council meetings but also for Planning Commission meetings. She didn't feel that it was necessary for the entire meeting but until the audience participation was com- piked. -After discussion with Council members, it was decided that a 'dote would be in order.
