Sunset Avenue Accept improvements Police Facilities Building Accept improvements to Police Facilities APPROVED Building - Fry & Fry, Inc. - and authorize release of Anchor Casualty Co. contract bond No, 16-160161 in the amount of $6,328.00. Deputy City Clerk: There is a correction to be made here. We are only going to release the Con- tract Performance Bond in the amount of $6,328.00 and retain the Material and Labor Bond, Mr. Williams: We will adopt a new procedure not to release the Material and Labor Bond. The City has no right to release that bond at least until the time to claim or file suit on material and labor, and when that time expires the bond itself has already expired. It is a self-expixing bond. Mr. Dosh: About a month ago I received authoriza- tion to have these plans and specifica- tions prepared. At the time there was, one person who didn't want to participate; however, today he agreed to it. I would like to have these plans and specifications approved. Motion by Councilman Pittenger, seconded by Councilman Barnes and carried that we accept the recommendation of the City Engineer on Project C-54 and approve plans and specifications, also to authorize City Engineer to call for bids. ANNUAL REPORT OF STATUS OF Motion by Councilman Mottinger, seconded REIMBURSEMENT DISTRICTS by Councilman Heath that the report be ACCEPTED accepted and authorize the payment of reimbursement funds. South Hills Realty APPROVED REQUEST: Adoption of Precise Plan of Design. Mayor Brown opened the public hearing. In Opposition Sam Ciraulo'• I understand that this garage will be 3223 Calvados Street put'in here under C-2 zoning; however, Covina - I checked and I find that sales agency is not complete without tune-up stalls, . etc., which is permitted in C-3. I don't think this is the place for a car agency. It will depreciate the residential property value since it is backing up a residential C. C. 5-25-59 Page Eight !' PRECISE PLAN.OF DESIGN NO. 182 - continued . Mr. Ciraulo - continued: area. I also think that considering the fact there is another car agency a few blocks north, I don't feel that we need another. Also, - there are no sidewalks to the schools on Workman. Under these con- ditions, we should be given a little consideration on this. In Opposition R. H. Gray It is my feeling that this street on 3217 Calvados .Street which I live is a well -kept street, Covina a credit to the community. They have taken great pride in their property and bringing in a business of this kind will convert this to a slum area and the people living here are going to leave the area. They won't be satisfied with the conditions that will exist. I think that we deserve the consideration of a buffer zone between us and the property. In Opposition T. Sullivan I would like to ask a question,if I may. 3322 Calvados Street Are you permitted this type of commer- Covina cial property on a C-2 zoning, which I understand this is? Mayor Brown: Yes, it is permitted. There being no further testimony, the hearing was declared closed. The Deputy City Clerk read the P1a-uning,Commission Resolutions No.746 and No.756. Councilman Heath: The recommendation of the Planning Commission states that body work is supposed to be 100 feet away from resi- dential property. Where do they intend to do this work on this Precise Plan? Also, there seems to be some indecision by the Planning Commission about the height of these lights. First 6 feet and now 25 feet. Mr, Gerschler: I would like to clarify a point here. At the time of the hearing the archi- tect stated that the lights in question were for the purpose of illuminating the front of the building. After the hearing was closed,.,' he stated that they wished to display automo- biles in front of the building in which case the lights would have to be above. And now we feel that we have provided adequate protection for the adjoining residential area with the restrictions that we have made. �A Co Co 5-25-59 PRECISE PLAN OF DESIGN NO. 182 - continued Page Nine Councilman Pittenger: I think that the body shop should be shown on the Precise Plan as being 100 feet away from the residential property. Councilman Heath: Did I understand Mr. Gerschler to say that the applicants have agreed to moving the body and fender work to the easterly half of the property? Mr. Gerschler: That was their statement, yes, Councilman Heath: I would like to have that written in our minutes. Mayor Brown: Any further discussions? Councilman Pittenger: We have on occasion required a new Precise Plan spelling out these things. Now, I don't know why we didn't do it on this one. Mr. Gerschler: If you feel that the conditions speci- fied are adequate, we do require a.new plan when they come in for building permits. We can see to it when the permits are issued. Councilman Heath: I think Mr. Pittenger has a point with respect to body and fender work being limited to the easterly half. It would upset the plan completely if it were my plan. It would be too far away from the parts section and other bays.. Councilman Barnes: I would like to see a plan with this drawn in showing the body*and fender work to the easterly side and how this lighting would affect the property owners. Councilman..,Mottinger: It seems to me that the Planning Commission's Resolutions have pretty well covered the objections to the Precise Plan. I would concur with the Planning Director that if we spell out the corrections we would like in the Precise Plan that we would have complete control of the situation, Mayor Brown: and if we insist on a change expense to the developer. I will have to concur -with Councilman Mottinger that the Precise Plan that has been brought before you is a guide, being brought in there is an additional think this is getting to be a little too 0 40 a • C. C. 5-25-59 Page Ten PRECISE PLAN OF DESIGN NO. 182 - continued Councilman Pittenger: It is not necessary to put the developer to any expense. He comes in -with the Precise Plan to meet the requirements of the Planning Commission, if he moves this stall 100 feet from the residential property and also shows how they are going to put a light 25 feet high and not shine on the adjoining property. It is so easy for him to come back for.a building permit and say I can't make that work. Mayor Brown: I wonder if we want this project in the City. I personally do but if this is the type of treatment they will re- ceive, I can't quite see it. Councilman Heath: I would go along if we situplated it strongly enough in the minutes, Councilman Barnes: I think that the developer has agreed to all of these sWifications by putting the stalls over to the easterly side and setting the lights so as not to shine on the residential property; however, I would like to see it spelled out so as we are sure that these things are carried out. Motion by Councilman Mottinger, seconded by Councilman Barnes that Precise Plan of Design No. 182 be approved subject to the Planning Commission Resolution 746 and the amendment to Resolution 746 con- cerning the positioning of lights with the additional restriction that tune-up stalls and body and fender work operations be restricted to the easterly half of the property. Also, that outdoor lighting be so located and shaded as to prevent it from shining on the adjacent residential property. Also, permit to construct and operate a 7-story hospital facility in Zone R-A., Council requested Zone Variance to be included in hearing on above item. Mayor Brown opened the public hearing. In Favor Mr. Jerry C. Nichols Our presentation will be very brief. 253 S. Bandy Avenue We have tried to pick the piece of West Covina property in ,town that would be close to other uses of a similar nature. We picked a place next to a school administration office and in between two schools. We picked the location that on one side has an 80 foot proposed street and another 100 foot major for the City and County both. We had a study made on traffic which was presented to the Planning Commission hearing and we wanted 7 stories although we agreed on 5 stores through some change in the architectural plans and have had our first meeting on fund raising. These funds have to be raised by December 1, 1959, and we are high on the priority list - we are third. There would be no con- troversy with any other hospitals in the area, and we are ready to go ahead. The architect is here tonight to answer any questions that may be on your minds. There being no further testimony, the hearing was declared closed. The Deputy City Clerk announced the receipt of a letter from Harold Johnson, Civil. Engineer, pointing outithe desirability of the proposed hospital. The Deputy City Clerk read the Planning Commission Resfl:utions Nos. 738, 739 and 749-C pertaining to Unclassified Use Periii-t No. 33, Precise Plan of Design No. 161 and Zone Variance No. Z69, respectively. Mr. Gerschler. The Planning Commission Resolution regarding the continuation of the streets on the northwesterly and north- easterly sides of the property would be required only if the streets are accepted for public use. Motion by Councilman•Mottinger, seconded by Councilman Barnes and carried that Unclassified Use Permit No, 33 and Precise Plan of Design No. 161 be approved subject to the recommendations of the Planning Commission,with the, one correction.that'should the future streets be • required for public use that they be dedicated to ,the City. DISTRICT A°11-57-1 Hearing of protests or objections to HEARING OF PROTEST the confirmation of assessments to Sanitary Sewer District cover the installation of sanitary Assessments sewers in the Merced Avenue and Lark Ellen Sewer District. Set for hearing this date in the "Notice of Filing Assessment and Diagram" dated April 30, 1959. Mayor Brown: Mrs, Preston, do you have the affidavits relative to this hearing? Rosco Re Hess, Attorney for Merriweather Investment Co. Mayor Brown: Does anyone wish to speak in behalf of written protest?. No one spoke, No other person desired to be heard. Mayor Browne Is there some explanation of the sodifference in the front footage? • C..C. 5-25-59 Page Thirteen • DISTRICT A111-57-1 --continued . Mr. Thompson. I think you might be interested in the map here. The law provides that an assessment must be levied on a benefit basis. When you get'into a Cul-de-sac it is difficult to'arrive at exactly the assessable frontage. These two lots at the top of the Cul-de-sac here, we thought some consideration should be made, so what happened these were assessed at 80 and these at 70 feet, and it makes a difference of $50.00. That is a matter of opinion and,maybe they are right, but we feel that some consideration should be given to these. Our plan is to make these assessments as equitable as -we can. I don't believe anyone can exactly measure right to the foot, Councilman R"th. How do you take care of a corner pro- perty? • M • Mr, Thompson. We only take the short frontage. - We think we have done a pretty good job here, but can't do it perfectly and I think maybe the neighbors feel they are not assessed enough.,, Councilman Heath. Is there any bearing on this, where there is a Cul-de-sac, that it is quite possible that the people on the end lots are going to carrytheir own line further to get to the street? Would it balance out the same? Mr. Thompson; We can't take into consideration how much building has to be done on- a piece of property, The attorney's letter has merit. The easement line was used to figure the assessment and the 10 feet along the street was treated as a separate parcels This has been corrected and modified. When would this: be paid? Well, they are being charged for a sanitary sewer. The bills will.be sent out in the next few days and they will have 30 days in which to pay in cash. In the event not paid ih cash, at end of 30 days a bond will be issued against the individual,'s piece of property bearing interest at 6% payable in ten equal installments and may be paid any time during the life of the bond. Each November the City Treasurer will mail to property owners a bill for 1/10th of the.bill plus interest payment. Each Maylst the City Treasurer will mail bill for July interest. .Motion by Councilman Mottinger, seconded by Councilman Barnes that 'the City Engineer and Street Superintendent be directed to modify and correct the assessment roll and diagram for Sanitary*Sewer Dis- trict A111-57-1 in the manner as desc-kibed in the following schedule of modifications and corrections, and that all other protests be overruled and denied. He also stated: that he would like to write to them on Senate Bill 57, and also the Municipal Bond and Life Insurance Company tax bill, House of Representa!!- tives No. 4245. OFFSET . to Sacramento for final decision. ,- EMPLOYEES' RETIREMENT Mr. Aiassa: No doubt the Council has been receiving copies from the employees on the retirement. It is starting up for elections pretty soon. They have covered all the departments and I believe the persons are going to try to have the elections somewhere around the latter part of the month. Mr. Willipms and I have received a copy of the agreement of Occidental Life Insurance Company and I be- lieve we will have to do a little research. The progress report is that we are still trying to work this thing out. CITY CLERK REPORTS • PROPOSED ANNEXATION NO. 165 LOCATION: North side of Holt Avenue, HELD OVER east of Oregon Avenue. Lots 7, 8, 9 & 10 of Tract 10330. Deputy City Clerk: The Council have received copies on this proposed annexation. There are three separate petitions and it was suggested by the Planning Department that this matter be put into one annexation district and I think the matter should be referred to the Planning Commission to proceed on it. Mr, Gerschler: The next move would be to submit it to the County Boundaries,Commission and then it would come back to you. Councilman Heath: Are they working on.that incorporation over there? Mr. Aiassa: I haven't heard anything since. Mayor Brown: I think we should wait until we see what action is taken by them, Mr, Aiassa: We are not sure what they are going to submit. • Councilman Mottinger: I don't think that we should wait in- definitely on it, but if they can't get the strength that they need there is no reason why we don'It.go ahead. We have been trying to fight this incorporation proceeding for a long time. Now wd have asked for annexation and I - don't know why we should wait for these peop to file again when our petition has been in much before they filed.againo Mayor Brown: I.think at.onf time there was some dis- cussion as to whether or not' the City of West Covina wanted your property without other property with it. With a City 9 annexation is strictly a business. If it does not pay there is no need for us.to take it on as a further responsibility. Mrs. Helfrick: I understand, but since I filed my peti- tion a good ipany people have also petitioned and I understand that the area that was filed was the entire area south of the Freeway north of Holt Avenue and east of Oregon Avenue, where Holt Avenueameets the ,Freeway again, and since then I understand that a third petition has _ ,come in for people south of Holt Avenuei, Mayor Brown: There are three small annexations. If we take them we should take all three together. We, Mrs. Helfrick, have to live with these people whether' they incorp- orate or not, and I don't believe we should stand in their way if they want their own governing body if they•so desire. Councilman Heath: Do we know that it is not self-supporting? Mayor Brown: Yes, the last time it was established that it was'not self-supporting, Councilman Heath: I can see Mrs. Helfrick's point. Mrs. Helfrfck: I realize that we weren't a large enough areal ' before e h�jwever, most of the highlanos.have askgd to go along with the annexation and since then I understand there are several people. on the north side of Holt Avenue. Mrs. Helfrick: Personally, I can't see why -we should` have to wait. As I understand it from the Board of Supervisors that they can't file for another year and it was September last when it fell through, Mayor Brown: Actuary,, we could take action on this tonight. Myself, I would have to vote against you coming into the City. I only look on annexation as to what it can do for the City, not what it can do for the property owner, Councilman,Pittenger: Why do you want to come into the City of West Covina? Mrs. Helfrick> Because I didn't want to be incorporated first of all. I think West Covina is a growing city. I don't think that a population of 520 some odd people makes a large enough city. If I am • going to have to pay increased taxes, I don't want to pay it to a small area, I don't think they are capable of handling my taxes wisely. Ican't see paying taxes into a small incorporated area. They have no businesses or income at all. Councilman Mottinger: I think it would be in order for us. to wait until the next regular meeting and then to take action including the adjacent area suggested by the Planning Commission. Councilman Pittenger; I don't see any urgency in the matter. Councilman Heath: I do in some respects. I think the People are entitled to an answer. This thing has been hanging since last October that I know of. If we are going to do something we ought to do it. I think we owe them the courtesy of an answer. I would like to'refer it to the Planning Commission for them to study the entire area petitioned to be annexed and I would like to see an answer back in a relatively short time one way or another. STAND Deputy City Clerk: As you know, gentlemen,I got this . information from Mr. Whitlock to study., He sent some of these books and the Chamber of Commerce has sent a letter in respect to this. (Deputy City Clerk read the letter from the Chamber of Commerce). Mayor Browne I. believe there are a few questions that havenft been answered. Where does"this Association meet? Mr. Whitlock Temporarily in my home. We have 903 S. Shasta attempted to make arrangements`to West Covina meet permanently in West Covina. One of these meetings was-held"in West Covina regarding sonic booms. We had a very excellent speaker. We made this available to the public through the local newspapers. Our records and business meetings are usually held in my home until we can arrange for a permanent meeting places one that we can essentially-. say is our office. Mayor Brown: Do you have regular meetings? - Mr. Whitlock: The third Wednesday of every month at 8:00 P. M. in my home unless other- wise notified. We have regular monthly mailing. We are at liberty to cancel a meeting and reschedule a meeting at some local place. We have air power education for adults. Anyone can belong to the Air Force Association. They are not closed meetings. The only restriction is that in order to hold office or to be a voting member you must have been a member of the Air Force at one time or another. No one can belong who is on active duty. Mayor Brown: Mr. Whitlock: Mayor Brown: Mr. Whitlock: Councilman Barnes: Mr. Whitlock: Is this Association chartered by Congress? We are chartered by Congress. I have the charter with me. (He handed this document to the Mayor) This doesn't say Chartered by Congress.. I thought we were. However, we -do have the backing of the United States Air. Force. What is the number of your post? We don't go by "post", we go by squadron name and number. Mr. Ray L. Sullivan I was the first commander of the Air 17357 E. Grove Center Force Association in the Covina Valley.... Covina Doolittle was Commander in 1946. I am a chartered member. The Air Force Association only has twe primary func- tions. One is the continued association of former members of the Air Force and the second is the promotion of sufficient air power for the United States under the conditions that we live today. They are the • motives we have. Donald Stillman was a former Commander just before Whitlock. It is a National Air Force Organization. Ordinance as.to a veteran's organiza- tion, Mr, Williams: I don't have it here. Possibly the Deputy City Clerk has it, Mayor Brown: The fact that this group meets at'a residence isn't exactly legal either. You said that anyone could join but cannot become officers? Mr, Whitlock: Anyone, and besides not being able to become officers they have no voting power. We have many magazine subscribers that pay the $6.00 which is our yearly dues. In fact, most of the firms that are in the industry buy, as many as 50 subscriptions a year, Councilman Heath: I'feel that the active members in this organization are veterans. I feel that the organization is doing some good both for adults and children. I think that they are endeavoring • to establish themselves and get a permanent place in west Covina. It is an active organization from the information we have. It is not a profit -making organization. It is the active members who are veterans, and I think that we should acknowledge them. The Chamber of Commerce does. Mayor Brown: That is your thought on it. Councilman Pittenger: I am inclined to go along with Mr. Heath. Our Ordinance doesn't specifically exclude auxiliaries;._ be -- cause they have associate members they could be interpreted as auXil- iaries. I think we have weakened the.Ordinance so that this type of thing is allowed. Councilman Barnes: I would like to ask Harry a question. These genalemen stated that some of their ass9piates work for aircraft companies. They promote aircraft. These can also be members but they can't be voting members. I wonder if Harry could clarify if this'could. come under our Ordinance. Mr...Williams: My interpretation is that the Associa- tion is restricted to Air Force men and former Air Force men, and the fact that they have an honorary membership isn't really membership at all. • They are eligible to give money and in return have membership. 'I feel this organization will conform with that require- ment. I would be in favor of granting permission'to sell fireworks. Mayor Brown: How long have you -been meeting within the .City of West Covina? Mr. Whitlock: I would say approximately 34 month. Mayor Brown: Zow come this is called Covina Valley ,Squadron? Mr. Whitlock: It is because we have people coming from all over the Valley. Mr. Robert Cistra I belonged to the Armed Forces and 1718 Mardina have been in West Covina since 1951 West Covina and I have never heard of this organi- zation before until this present day. • From what I understand, they have been. meeting in Pomona and in Covina. No meetings have been held other than those, and they said they have members as far as Cucamonga. I know for a fact that we have ten members in our organization that were in the Air Force and are veterans and none of these fellows have ever heard of the Air Force Association. Mr. John W. Hayes I would be the last person to talk 1714 Mardina againt a veterans' organization. West Covina There are two major organizations who' invest their time and money to handling three or four Cub Scout packs and donate various things. They are the V.F.W. and the Legion and the only thing that has helped us in our activities was the sale of fire- works. If a legitimate organization comes in I am all for them. How- ever, I firmly believe that if they have been meeting all over then to cut in on the established practice of the people that have been here, without contributing anything prior or possibly afterwards, is not right. Mr. Whitlock: I would like to say that we have never_.. met in Pomona, which was one of the statements made. I have been in the squadron since it was formed. This still leaves one vacancy in the'Recrea- tion and Park Commission that will have to be'fillede COUNCIL COMMITTEE REPORTS Councilman Barnes: I attended a meeting at Santa Anita on the 13th with Councilman Heath and Mayor Pro Tem Mottinger, Chairman. Roy Anderson introduced Mr, Finley Laverty of the Los Angeles County Flood -Control District who was the speaker for the evening. Mr. Laverty illustrated with maps the three main basins: The East Covina Basin, Mountain Area Basin and the Raymond Basin. He explained that a survey was made in 1948, and at that time 15,000 acre feet of water was flowing over the Whittier Narrows Dam to the sea. He also stated that for all practical purposes additional dams in the mountain area to the north would not be feasible. Mr. Laverty then introduced Mr. Brewington of the MWD who gave a brief talk on present and future . spreading grounds in the San Gabriel Basin. Mr. Anderson then asked for a report from Jim Nicklin, City Attorney for E1 Monte and Arcadia; • C i C. C. 5-25-59 COUNCIL COMMITTEE REPORTS - continued Councilman Barnes - continued: Page Thirty -Seven Mr. Nicklin stated that a group of seven attorneys had'selected the firm of Surr & Helyard of the City of San Bernardino to -represent' --the, district in defense of the Long Beach suit. Mr. Anderson' -then asked Mr. Mottinger to make a statement in regard to West Covina's feelings in joining the Upper San Gabriel Valley Municipal Water District and I think Mr. Mottinger should be commended on the nice speech he made that night. A motion was made by Mr. Clemens,of S. E1 Monte, to form the Upper -San Gabriel Municipal Water District excluding West Covina from the District. Thiswas seconded by Mr. Whiteside. The vote was unanimous. Mr. Anderson then took over the meeting again as Chairman and stated that any time West Covina felt that they would like to come_ into the District that they would be more than welcome, and if there were any questions that we would like to have answered he would be more than happy to get the answers for us. Also, we would be welcome to attend their meetings. I would like to have Mr. Mottinger elaborate and possibly Mr. Heath. Councilman Mottinger: Briefly, I told them our sentiments on, the matter, told them that we weren't_ mad and we hoped that we would be invited to .their meetings, and in the meantime we weren't decided. Councilman Heath: I am a little bit concerned about how we let the Army Engineers concrete the Walnut Creek Wash where we get a lot of seepage. SCHOOL UNIFICATION Councilman Mottinger: There is a lot,, n; of activity iWest Covina with regard to school district unification. Some time ago we passed a resolution indicating that�the City Council of West Covina was in favor of the formation of a Unified School District approximating the boundaries of the City of West Covina. Motion by Councilman Mottinger, seconded by Councilman Pittenger and carried that we reaffirm our resolution supporting school district unification in any way that it will eventually result in a school district approximating the City limits. Is that going to come before the Council pretty soon? Mr, Aiassa: It is on your lists You can call it up. Councilman.Heath: You mean it changes the highways and we don't even see it? I would like it brought up. Deputy City Clerk: This has been set for June 83, 1959. Councilman Heath: Also, I would like Application for Zone Change No. 140 and Precise Plan of Design No. 180 to be concurrent.'. . Councilman Heath: July 16, 1959 - League of California Cities - Hollywood Park, Councilman Pittenger: West Covina Beautiful has suggested that we discuss this and the City Attorney give an opinion about the possibility of the West Covina Beautiful sending a letter to people about how they take care of their lawns, etc. They are wondering if they could send out letters under their name - no connection whatso- ever with the City at all - to clean up, paint up, fix up, etc., which would get the message across. It would be very much in order this month, Mr, Williams: Councilman Pittenger: Mayor Brown:... Mr. Aiassa: There is no legal connection here. If someone wants to tell someone else to mow his lawn it is up to them, Oe K., that is what I wanted to know. As long as they don't get the City involved, This might help. It would really serve as a friendly reminder. It might do the trick. C..C. 5-25-59 Page Thirty -Nine Mrs..Van Dame asked Mr. Aiassa just what the U. S.-Bureau of Census was doing. Mr. Aiassa stated that they do a detailed block study on the occupants' type of houses and they put this into a national record book so that any promoter that would want statistics concerning occupants, nationality, etc., would refer to this record book. Mrs. Van Date once again suggested the use of a loud speaker to enable the people in the rear, of the chambers to hear the Council. Mrs. Van Dame also stated that she believed the agenda are getting - too long and suggested shorter meetings but more often. Mrs..Van Dame stated that she has never seen the Chamber of Commerce sign. Mr. Aiassa mentioned that it was in the West Covina Center. Mrs..Van Dame offered objection to the way in which the Recreation and Park Department get their workers. The children's names are taken at the Easter vacation where it was her feeling that the vacancies should be advertised in the local newspaper, and although these children might not all be hired it would give everyone in West Covina a chance to have their names on record. Mrs..Van Dame suggested that instead of a four year term for the Recreation and Park Department, that they be appointed for a period of two years and should they qualify after that time they could be • reappointed.
