ADOPTED The City Clerk presented: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 'BEST COVINA APPROVING FINAL SUB- DIVISION MAP OF TRACT NO. 18378, ACCEPT- ING THE DEDICATION THEREIN OFFERED, ACCEPTING AN AGREEMENT BY THE SUBDIVIDER AND SURETY BOND TO SECURE SAME," (Howard Bartheola) LOCATION: Camila Road, south of Service ,and North of Margarita. Mr. Flotten stated, prior to the reading of the Resolution, that the Tentative Map of Tract No. 18378 had been approved by the Planning 4F Commission and the City Council in April. of 1957, subject to the recommendations of the City Engineer. The estimated cost of the work to be done was in the amount of $1,139.00. We have the signed agree- ment. Contract awarded to John Barr, No changes had been made in the final map. PRELIMINARY REPORT OF LOCATION: Maplewood Avenue and Burwood THE CITY ENGINEER Avenue Sewer District designated as Distract A911-57-7 A111-57-70 Sanitary Sewer District APPROVED The City Clerk presented and read the report which indicated all signatures had been validated against the last tax roll and represent 65% of the area of the district. The preliminary estimate of the cost for this project is approximately $305000 per lot. This includes construction costs, engineering and incidental expenses. � Co C. 10-27-58 DISTRICT A111-57-7 - continued Page Three It was recommended in the report that this small district be added to the already approved district A'11-57-7,, as it is immediately adjacent thereto, and which would increase the estimated cost of the combined district to $207,000.00 with the percentage signature remaining approximately the same. It was fu-rther recommended that the combined map be approved and filed with the City Clerk, and that the City Engineer be instructed to proceed with the preparation of final plans and specifications for this project. Councilman Pittenger: Will this hold up the rest of the district? Mr, Dosh: No, I do not believe so as it is just the preliminary. Councilman Barnes: Will the other part of the project go forward first or will this be one of the later parts or not? Mr. Dosh: I spoke to Mr. Nollac about this other tract that we approved specifications for and I believe this is correct. Per- haps Mr. Williams can bear me out, in that you can't connect part of the sewer job unless the whole thing has been accepted, so no matter how you work it, it would all be going in at the same.time. It would all have to be acceptable and the entire district would have to go in simultan- eously. Mr. Williams: Mr, Aiassa: Mr. Dosh: this small addition to the Mr, Williams: Councilman Heath: I think that is probably so, although I am not absolutely sure. Do we have the Health Officer's Report on this particular new section to be added to the original district? We have that report on everything but these 20 lots. I do not know if we have to have that Health Officer's Report for district. Is that necessary? I think it is necessary and I think you should check with Mr. Sorenson on that. How do you know if we are getting a fair bid on this small part? Mr. Aiassa.:,. This is only an estimate. It would be to the advantage of these little areas to be included in with the larger areas to obtain better bid estimate. u • C. C. 10-27-58 Page Four DISTRICT A111-57-7 - continued Motion by Councilman Pittenger, seconded by Councilman Barnes and carried that the Preliminary Report of the City Engineer be accepted and the small district be added to the approved district A111-57-78 that the combined map be approved and filed with the City Clerk and the City Engineer be instructed to proceed with the preparation of final plans and specifications for this project. PRELIMINARY REPORT OF THE CITY ENGINEER District A111-58-1 Sanitary Sewer District HELD OVER FOR REPORT LOCATION° Thackery Street and Coral Drive Sewer District designated as A111-58-1 Mr. Flotten presented and read the report which indicated that all signatures had been validated against the last tax roll and represented 67% of the area of the district. The estimated cost for the project is $22,055.00 or approximately $475.00 per lot, which includes construction costs„ engineering and incidental expenses. . It was recommended that this small, district be added to the already approved district A111-58-1, which would increase the estimate cost of the combined district to.$50,655.00 with the percentage signature remaining approximately the same. It was further recommended that the combined map be approved and filed with the City Clerk and that the City Engineer be instructed to proceed with, the preparation of final plans and specifications for this project. Mr. Flotten° Here again are additions to the original assessment district and we have the Health Officer's Report on only the original area involved in this distract. Mayor Mottingero How can we make these additions to a district so far removed and make it to the advantage of those getting into that district? Mr. Dosh. From the point of view of getting the contrast, the districts should have been timed together and this should have been in with this district, but we did not have the petitions in in time and we did not feel we could hold up the district until we had received them. Councilman Pittenger.- Is the district to the west contiguous to the completed sewer district? Mr. Dosha It is attached to this one. 0 t C. C. 10-27-58 Page Five DISTRICT A'11.-58-1 - continued Mr. Aiassa: If this was not included they would have to wait until they have a (sewer) district .in that area again, Mayor Mottinger: Does that increase the cost of the installation on one little spot? Mr. Aiassa: It is still a great deal cheaper than an individual small (sewer) district for this area alone. Councilman Barnes: That small area. is part of mine and I do not know of any objection to it and I do not think the people on Lark Ellen did object. I am wondering, myself, why it did not go into the larger district. Mr. Dosh: That I do not know. Councilman Barnes: I'm going.to have to talk to Mr. Nollac on this. What was the price per lot? Mr. Flotten: Estimate was $475.00 per lot. Councilman Brown: Does the whole district go $475.00 per lot? Mr. Aiassa: I believe it is just this added small district - only an estimate, Councilman Heath: These annexations.won't hold up the original? Mr. Aiassa: I do not believe so. The plans are being readied and this will go along with them. The only item of concern is the Health Officer's Report. Councilman Brown: Adding these pieces onto a district after it has been started does set sewers bask, sometimes three to six months in some cases. Mr.,Aiassa: We could leave them out, but it does put a greater burden of cost on the people in the smaller area. Councilman Brown: I think it is up to the people to request. to go into a, district, but I also think the Sanitation Department should notify people they are adjacent to a district being formed, • . C. C.. 10-27-58 Page Six DISTRICT A'11-58-1 - continued Councilman Heath: I was told the County would start in December and the City in January. The people have been given that understand- ing of the date and if this will hold it. up I will vote against it. Mr. Aiassa.: We can make a condition at the time of construction that the principal district get first construction. We can specify that in the specifications of contract, Councilman Brown: We have been told that one section couldn't hook up and use it until the whole district could, Mr. Aiassa: I believe if the areas were actually divorced from one another it might be done but Mr. Dosh, I believe, might have been referred to one whole continuous area which one part couldn't use the sewerage installation until the whole district installation is checked. Mayor Mottinger:. Isn't the work that has to be done on these small districts going.to delay the final. matter? Mr. Aiassa: It is difficult to establish these small sewer districts on their own and it would penalize them badly on unit cost sufficiently to almost make such installation prohibitive. Councilman Brown: At the same time should we penalize those that have worked and petitioned for sewers before? Councilman Barnes: Why wasn't this included in this large district at the time it was formed? Mr. Dosh: Without going into the files., apparently it might have been that the people did not want to petition or did not have the sufficient number to do so. Councilman Barnes: I know differently, because homes facing Lark Ellen.Avenue are some of the oldest in the City and they were having a great deal of trouble three years ago and those people were more than anxious to go in on this quite some time ago. Councilman Heath: Why are these two small items on a district just being drawn up, rather than on one three-quarters supposedly complete? P C. C. 10-27-58 . Page Seven DISTRICT A'11-58-1 - continued Mayor Mottingero Mr. Aiassa, I think it might be practical to review these two new districts in relation to the situation as to final completion and report back to us. It seems to me that the consensus is that we (Council) do not want the original districts to be penalized by the addition of these small districts to them. Mr. Aiassa:- Mayor Mottinger> We can table Items 2 and 3 on the Agenda, pending a report. sary to do so after the report on Item 2 or else act on both We have voted on Item 2 of the Agenda. However, you can report on Items 2 and 3 of the Agenda and if it is found neces- is presented we will rescind our action of them at the next meeting of Council. ACCEPT SEWER FACILITIES LOCATION° Montezuma Way from Cameron Tract No. 19192 Avenue to 555' 4 southerly. APPROVED • Motion by Councilman Heath, seconded by Councilman Pittenger and carried that sewer facilities in Tract No. 19192 be accepted and authorization be given for the release of the remaining portion of the cash deposit in the amount of $228.56. ITEM NOT ON AGENDA Mr. Edward Reese I am representing those people on West Covina North Orange Avenue. Two years ago we were here with petitions to do something a.bout the flooding in that area. Shortly afterward Orange Avenue was resurfaced and supposedly lowered to take care of some of that flooding situation. However, after this past Friday night's rain we believe the condition is even more serious than in the past. I had water in my garage and my yard and Friday I called for sandbags and couldn't get any, so Saturday and Sunday I spent cleaning up the horrible mess. It looks like we are going to have to start another petition to get something done on Orange Avenue. - Mayor Mottingero We of at been working on this thing since in accomplishing its purpose of into the Big Dalton Wash. can let you have a copy of the report two of our Councilmen which was made our last meeting. The Council has last year but have not been successful a drain down Badillo Avenue to empty r 0 C. C. 10-27-58 ORANGE AVENUE - continued Mr. Mottinger - continued: Page Eight You can petition, but we know of this matter and have worked on it as much as we can. We were turned down by our neighboring city in our anticipation of getting rid of the water, which is our biggest problem. Councilman Pittenger: I appreciate your plight. We have tried everything in every way that we can. The water should go to the west on Badillo to Big Dalton Drain and an inlet is being built into it for just that purpose. The County and the Engineers recognize this should be done but to get the water there it must go through 1300 feet of the City of Baldwin Park and we must get an easement or right-of-way from them to permit an open ditch through that territory, but they refuse to give it to us. They (Baldwin Park) say that in the November election there is a bond issue to cover flood barriers in this district, and that if it is passed, sooner or later we will get that built. However, we feel it will be two years or so before it is done even if the bond issue is passed. We have kept on trying to get an open ditch as a temporary measure and would spend money beyond our share to get this accomplished. We have met with everybody and anybody who would meet with us on this matter. We have submitted nine different plans, all by the City of West Covina Engineering Department. We have met with cities and County, - worked many hours on it and when it was ended we had not accomplished very much. I personally felt that they (Baldwin Park) took a hedge in waiting until this bond issue is passed or defeated, but that was a way out. They didn't want to spend money on a ditch through the City and said they would wait for the bond issue. I do not know what to tell you except we exhausted all the means at our command. We can't go into another city and spend money if they won't permit us and the only thing we could do is to go down Orange Avenue, but that would take more money than we have, Mr. Reese: Since the resurfacing the street is worse. Councilman Pittenger: This water originates in the County and in Covina and it is not actually our problem. Unfortunately, the law says if you are downstream you accept the water and that is what we are doing. It is possible you do not get more water, that it spreads over a bigger area, but there is more land that has been built up, up above, there are more driveways and more roof tops cutting down on the percolating area so there may be more water. C. C. 10-27-58 Page Nine ORANGE AVENUE - continued Councilman Pittenger - continued: However, the flood control says there may be some help to this situation in that there has been a diversion channel built from lower San Dimas Gash to the Big Dalton 'dash which is to be completed in January. They think that will cut down a great deal of water, although not being an engineer I would not know. However, they say it would be cut down from 800 second feet to 400 second feet which would be half of the water diverted when the diversion ditch is in, However, I do think you should get sandbags when you want them. Mr. Robert Fa Lane Before they fixed the street I had no 413 N. Orange Avenue water in front of my -home, now we do. West Covina There is a pool there now and even lawn watering in the area now brings water in there. I called the Police Department at ten minutes to six Friday night for sandbags. They stated these would have to come from the Street Depart- ment but that they had no authority to call them until a man in a prowl car reported in that the area was flooded. At six o'clock I called in again and told them it was flooding and at the same time I could hear issuing from their loud speaker, apparently a man reporting in from a prowl car, that the area needed sandbags right now. Quite some time later the City street pick-up truck came along, but by that time it had stopped raining and he told us we didn't need sandbags. We asked him to bring some and leave them there, but he told me we had no water in the back yard and then went off. Apparently the desk sargeant had received the call and contacted the Street Department, but it would also seem that when the call comes through for sandbags a check has to be made first to make sure the call for sandbags was warranted: When they call the Street Department they evidently do not bring sandbags they just send the superintendent around to see if the Police were correct. Mr. Aiassa: Department and We will.try t you desire to used them only future use. 0 Mr. Lane: I believe they wanted to check on how many sandbags were needed. I spoke to Mr. Dosh prior to the call. to the Police they were getting set to put the sandbags in the truck. o stagger sandbags along the area prior to rains and if we can place them on your property° However, if you for an hour or two they would be just destroyed for them they would just rot and be No, I wouldn't case to have them on the property because if they sat for two or three days and there was no need for of no use when they were needed. 0 • 0 C. C. 10-27-58 ORANGE AVENUE - continued Page Ten Mr. Aiassa: I checked on this situation on Orange Avenue myself during the rain,and when the future rains come you will be the first area sandbagged and it will be done then immediately, Mr, Lane: The Police also stated that they couldn't stop traffic completely on the street. However, I counted 85 cars in a. half hour going the entire length of Orange Avenue who apparently were not residents in the area, Mr. Aiassa: I think we could barricade the street and allow only those through that live in the area and I believe that is the usual procedure in such cases. Mayor Mottinger: Perhaps there should be a different program set up on this thing and notify these people so that they know what procedure to follow in case they are in trouble before the City forces realize it. Mr. Reese: There are children who walk to school along this street and there are no sidewalks there and that could be a problem too with the heavy rains. Mayor Mottinger: That is the problem faced in a lot of places in the City. Perhaps the people in the area should get together to determine whether they want sidewalks and then have them put in. The City could not very well spend general fund money on one street or area at the expense of the rest of the City, but it could be done under 1911 Act, Certain areas now going in are required to have sidewalks but there is nothing we can"do in areas already developed. Mr, Lane: I lived in an area with no sidewalks and a safety feature was accomplished by putting in a white line area within which the school children walked and which drivers understood as a walking area along the street, Councilman Barnes. I live on North Morris and can appre- ciate your stand on this. Councilman Pittenger and I worked with the County, Baldwin Park, Covina and every part of the County district trying to get this problem alleviated on any basis that we might possibly do so. We submitted nine plans and didn't seem able to come up with one that Baldwin Park would approve and be willing to put financing into. • • 0 C. C. 10-27-58 ORANGE AVENUE - continued Councilman Barnes - continued: Page Eleven I think what they wanted was a covered drain which would cost about $300,000.00, and at this time we had no such money to accomplish this but we were willing to put in a temporary drain until the bond issue, if passed, would enable this work to be done and then the County would put in a covered drain. However, we felt this would be at least two years away. We tried everything we could think of to get a satisfactory answer but we never did receive any, nor receive any commitziient of money for this project. We could get the right-of-way to their (Baldwin Park°s) property but I do not think it is legal to spend money from West Covina in Baldwin Park, although we would like to get this water off our streets. Possibly another petition would help this situation. In 1952 there was a petition in relation to the whole area, involved with this water problem and last year another petition covered all of the flood area. Perhaps we should keep pounding away at this thing. I believe the County recognizes this problem in that the Big Dalton Wash has been provided with an inlet for Ba-dill.o to empty into that wash and it was upon the insistance of the City of West Covina they put the inlet in. Mr. Aiassa: There is also a. strip of "no mans territory" involved which is neikther Baldwin Park or West Covina. It is under the territory of County which adds to the problem if we decide to reduce the existing berm on Badillo. SALE OF CHRISS TREES Mr. Flotteno We sent notices to all those who sold trees within the City last year and have received 8 applica- tions, with no applications coming from the American Legion or Veterans of Foreign Wars. We have received proper clearances on these applications as to zoning from the Planning Department, with the exception of the requests made by two churches. These are not in the proper zoning for this use. Mr. Gersch.l.ero This is a similar situation as on the circus and carnival use. The Ordinance does not contain provisions for allow- ance in the particular zone for the selling of these trees, even under special permit. If the Council feels they would desire to permit this there would have to be an amendment to the Ordinance. Also, the matter of the selling of fireworks might be taken up at the same time. E C. C. 10-27-58 Page Twelve SALE OF CHRISTMAS TREES - continued Mr. Williams: You made an amendment under circus and carnival and this could be further amended by expw.nAing this to indlude sale of Christmas trees and fireworks. Mayor Mottinger: T.believe we should instruct the City Attorney to draft such an amendment to the Ordinance. Mr. Williams: I do not think this could be done under an emergency ordinance and this year the matter Mould have to abide by the proper zoning. I believe it would be too late to do this selling if the Ordinance needs go through the proper procedures. Mayor Mottinger: I think the matter might be adequately met if the Ordinance amendment was given its first reading at the adjourned meeting next Monday night. Motion by Councilman Brown, seconded by Councilman Pittenger and carried that the applications for permission to sell. Christmas trees in the City of West Covina be granted, subject to necessary departmental clearances. Mr. E. H. Gillis Mr. Gillis requested Council to act Jewish star Veterans as final Judges in relation to the West Covina Post 1776 essay contest which had been embarked upon last year by this organization. This was a program establishing, for the next fifteen years, a way of awarding an annual scholarship of $100.00 to first place winner, with prizes for placing second and third, through essays written by West Covina. High School students. Mr. Gillis stated that ample time would be afforded for Council to judge the essays and vote on them, and explained the manner in which it would be accomplished. It was consensus the matter of final judging would be acceptable to all members of Council in relation to the essay contest, as indicated. RECREATION AND PARK Councilman Heath: I attended the Recreation and Park Commission meeting the other night and carried to them Council.°s feelings in relation to the concrete slab placement discussed regarding the Teen -Kan -Teen. 0 C. C. 10-27-58 Page Thirteen RECREATION AND PARK - continued Councilman Heath - continued: This is all that I have to report except one thing, which would be to remind Council, or suggest to Council, that we now have a program going on swimming pools in the City and the hope is that we would bring in the Recreation and Park Commission as much as we possibly can to work as closely as possible with these outside organizations. I do not think they should be forgotten in this matter and should be, at least by 50% or more, responsible in relation to this project. Mayor Mottingero Possibly you are referring particularly to the Youth Council who is fostering these pools. I believe they understand that the planning of where pools should be and what they should consist of is the basic responsibility of the Recreation and Park Commission and I believe they are going to work with them very closely. GENERAL MATTERS • ORAL COMMUNICATIONS None WRITTEN COMMUNICATIONS COUNTY OF LOS ANGELES Mr, Flotten presented and read this BOARD OF SUPERVISORS IN communication which in essence conveyed, RELATION TO MONROVIA FIRE by an order so authorized, the thanks and appreciation of the people of the County of Los Angeles and members of the Board of Supervisors for specific assistance rendered or supplied by the City of Vest Covina., COUNTY BOUNDARY.COMMISSION No protests will be filed, COMMUNICATION Revised Easterly Annexation No. 22 (Proposed) City of Azusa COMMUNICATION FROM Re., Tree removal along the northerly LARK ELLEN HOSPITAL border of the hospital properties border- ing San Bernardino Road. 0 Mr, Flotten presented and read this communication and stated that Mr. Dosh would have a, written report on this for Council at a later date, • C. C. 1.0-27-58 Page Fourteen LARK ELLEN HOSPITAL - continued Councilman Brown. Since this matter has been brought up, it has been insinuated by Dr. Mintz that I promised, at the time of annexa- tion, that the City would remove those trees, 'At the time of the annexation I was authorized to make certain commitments to him (Dr. Mintz) in relation to removal of trees, which we have done, but no promise was made of any trees to be removed by us in County property. The trees to be removed were along Lark Ellen Avenue, which is within the City of West Covina and which Council was definitely committed to remove. However, in relation to the trees on County property, it was only indicated that the City would give what help it could to get the County to remove the trees that were in County territory. COUNTY PROPOSITIONS Mr. Flotten presented and read a A, B and C communication from the County of Los Angeles, office of the Sheriff, in re- lation to County Propositions A, B and C to appear on the November general election ballots It explained the need for these detention facilities and the need of support for these measures. RECLASSIFICATION Mr. Flotten presented and read a APPLICATION NO. 128 communication from Mr. Dubrove, dated Jack Io Dubrove October 23, 1958, requesting Council TO BE CONSIDERED AT NEXT to act on this matter at the meeting of REGULAR MEETING October 27tho The communication further stated it would be satisfactory to leave the street alignment in abeyance'for the period of sixty days, as suggested, so that the City engineers would have ample time to prepare recommendations. I made contact with the parties to be and have been given assurance they will provide us with a new deed with new signatures. I will submit this matter to Council. at their November meeting. • FREEWAY LANDSCAPING AND I believe Council has written copies in LANDSCAPING ON AZUSA AVENUE r.°elation to this matter. Originally, the City of Covina called our Mayor, or rather Mayor Leggett called him, and suggested landscaping a portion of the islands of the new improved Azusa. Avenue. However, they neglected to contact us and pro- ceeded with their landscaping plans and did not advise us of their plan. I reviewed the situation as to what could be done and obtain cost figures for landscaping which will be done on State Highway, and we are presently having difficulties with State on the landscaping of the San Bernardino Freeway. The City of Covina is anticipating spending $2, 525. 00 to plant 64 Indian Laurel. Trees and to install water line to these islands would be an additional $.1.,925o00, plus cutting rings in the black top and planting trees. We have an odd situation in that we have approximately 300 feet that belongs to the County on Azusa. Avenue and that between us and Covina and 150 feet of the island split in the middle with half in the County and half in the City. We could prepare an improvement of landscaping of the entire piece and then negotiate with the County to share the cost. If we do not do anything the plans and specifications are to put black top on the islands. We have checked the matter, and it is not too late, however, to accomplish this landscaping, but would have to be done by the City of West Covina and which would be improving State Highway. • C. C. 10-27-58 FREEWAY LANDSCAPING - continued Page Twenty Councilman Brown. There has been nothing submitted to the State Division of Highways and do not know if they will. accept the improve- ment. I do not know if the City should plant trees on a strip when we need so many other things. Mayor Mottinger: Mr. Leggett stated that Covina was to landscape in the middle of this highway and asked how we might feel about it, whether we would be willing to support them on the matter. Possibly it was erroneous, but my understanding was that they were going after the State Highway Department to get them to give improve- ments and on that basis I stated we would be happy to support them, and since they had initiated some investigation I suggested they carry the ball and as soon as they were ready for us to give assistance to let us know. It wasn't until the other day that I knew black -topping was going through and yet nothing had transpired, so I felt we should wait. I had no intention of spending City money on this. Councilman Brown: The City of Covi.na's idea seems to be to plant it, water it and maintain it and do the whole thing. I don't think the City should be involved in this at all. Councilman Pittenger: Even if we wanted to, could we spend money on State Highway? Mr. Williams: If you wanted to you could do it. Mr. Aiassa: This matter was brought to the Council's attention to enable them, if they desired, to do something similar to the City of Covina before actual construction of b.la.ck-top is placed in the center planting strips. Mayor Mottingero It would seem that the consensus is that if there is no possibility of having landscaping done by the State Highway Department we are not interested in spending money on landscap- ing it. PROPOSED.ANNEXATION Mr. Gerschler presented to members of NO. 161 Council tentative plot plan of proposed street. Mr. Williams read what he believed would be the feelings of Council in relation to this annexation and proposed street which was indica- tive of what would go into a Resolution regarding this matter. • • C. Mr. Williams indicated that he felt Council could adopt the Ordinance, which would take thirty days to go into effect., at this time and present the Resolution at the next meeting.
