M. in the West Covina City Hall. The Pledge of Allegiance was led by Councilman Brown, with the invocation given by Councilman Heath. R.nT.T. PAT.T. Page 2 - Paragraphs 1 and 2 Mayor Mottinger stated that Council had requested, with regard to conforming to Fire Department requirements, that the title of the Government Code be listed. Such an indication by Council was listed in the second paragraph of this item as to what was wanted, but the title of the Government Code is not included. Council re- quested this be done. CITY CLERK'S REPORT PUBLIC SERVICE DIVISION ACCEPT STREET IMPROVEMENTS LOCATION; Southwest corner of Yarnell Tract No. 19497 Street and Orange Avenue. Numerous Corporations - Don Wilson, President The City Clerk stated as a point of APPROVED information that the City ha.s on record the Inspector's Final Report of Street Improvements, slated July 24; that street trees and signs have been installed and that sanitary sewer facilities have been accepted and bond released, as authorized, on May 12, 1958. C. 8-11-58 Tract No. 19497 - continued Page Two Motion by Councilman'Barnes, seconded by Councilman Brown and carried that street improvements in Tract No. 19497 be accepted and authoriza- ti6n be given for the release of Seaboar'd Surety Company Bond No. 552158 LA, in the amount of $60,000.00, subject to receipt of survey tie notes to monuments. Councilman Brown- This has never been part of the final tract map before. When was this started? Mr. Dosh, The engineer, when he signs the record map, states that he will do this -- that ' the survey tie notes will be in the City office at such and such a date. We feel this is a method of introduc- ing and making sure these notes get to the engineer in that the developer is responsible for engineering and improvements. Mr. Williams is working on a. monument bond form which will require tie notes for monuments to be put in and to bond those monuments 'to be sure They will. be put in. ACCEPT STREET IMPROVEMENTS LOCATION: Badillo Street and Phillips Tract No. 23537 Avenue, Louis D. Cummings APPROVED The City Clerk stated as a point of in- formation that the City has -on record the Inspector's Final Report of Street Improvements dated July 22; that street trees and signs have not ,been installed to date and that sanitary sewer facilities have been accepted and bond released, as authorized May 12, 1958. Motion by Councilman Heath, seconded by Councilman Barnes and carried that street improvements in Tract No. 23537 be accepted and authoriza- tion be given for the release of Hartford Accident and Indemnity Company Bond in the amount of $12,000.00, subject to the receipt of survey tie notes to monuments and the retaining of a deposit in the amount of $100.00 for street trees and signs not installed to date. Ap M Ca C. 8-11-58 Precise Plan No. 34 - continued Page Three Mr. Flotten`: This matter is subject to receipt of Inspection Fee in the amount of $40.680 The Inspection Fee was included in the bond of $3,000.00 and before releasing that bond it is necessary to insure the necessary fee amount required is received. Councilman Brown: What is the inspection fee for? Mr. Dosh:- It is for $1,000.00 worth of street work on Workman and Azusa Avenues. The total. bond was for $3,000.00 and included, originally, work on Azusa. Avenue, $2,000.00 for street improvements, three electroliers, inspection fee and fire hydrant. However, street improvements cost $1,000.00 so we asked for an inspection fee of 4% of the cost of improvements. Councilman Brown. I believe this involved the Legion pro- perty and Danny's Coffee Shop which come under tkne State and doesn't come under the City and I wonder how the City receives an inspection fee for it? Mr., Dosh: I stand corrected, The $1,000.00 is for Wori;,man Avenue only, which is 1.40 feet of frontage. Azusa Avenue is not included,, Councilman Brown: I understand it was recommended the fire hydrant be moved, perhaps it has been done already. However, $150.00 was put up .for the fire hydrant Mr. Dosho Do,you feel we should retain that amount for the moving? Councilman Brown: I think the $150.00 should be refunded on the Precise Plan as it has been moved. There is no benefit, now, to the applicant and he has made the $150.00 deposit for it. Mayor Mottinger: I think this matter should be held over and the Engineering Department investi- gate the matter and come up with the necessary information on it. It was consensus this be done. 4P C. RECREATION AND PARK ELECTION OF OFFICERS The City Clerk presented and read a RECREATION & PARK communication from the Recreation and COMMISSION Park Department, per Re S Gingrich, Mrs. Roberta Blood, Director, that at the regular meeting Chairman of the Recreation and Park Commission Mr, Lawrence Bunch, on duly 31, 1958, Mrs. Roberta Blood and Vice Chairman Mr. .Lawrence Bunch had been elected as Chairman and Vice -Chairman, respectively, to serve for the 1958-59 fiscal year and that the Chairman had appointed the Director of the Recreation and Park Department as Secretary to the Commission. This matter was heard and approved by the Planning Commission at their Special Meeting of August 8, 1958. It was consensus this be placed on the Agenda and designated as Item 10-A. Mr. Dosh: There was a discussion before the Com- mission in the matter of whether the sanitary sewer could Pe connected. It appears this will. work and if it did not work pumping would still be more economical. For this reason we would recommend that the words "if practical" as shown on recommendation No. 4 be deleted. Motion by Councilman Brown, seconded by Councilman Heath and carried that Metes and Bounds Subdivision No. 135-149 be approved, subject to the recommendations of the Planning Commission, but that the fourth item of the recommendations, relating to sanitary sewer connection, be amended deleting the words "if practical.", in that this actually should be sewer d. Mr. Flotten-, As a point of information to Council, this is the area involved in Annexation No. 1599 • Mayor Mottinger opened the public hearing and stated that all those desiring to present testimony should rise and be sworn in by the City Clerk° Mr. Powell-, Before testimony is.offered I would like to.have rclarification of the exact status of this property at this time. Is this annexation completed, in active process of being completed, or has it been "killed'.'? Mayor Mottinger- It is in -the form of an Ordinance which has been given its first reading., It has ' not been completed pending the devel- opmeht of the property with regard to zoning the property. The owners have asked the second reading behelduntil the use is deter- mined. Mr. Powell: If the property is not admitted to the City of. West Covina do.we have jurisdic- tion to determine the zoning prior to the time it is in the City? I believe we ate determining County rather than City property. Mayor Mottinger.' We can determine what'. the property zoning is if the annexation isclosed.. So far as being in the County we do not have jurisdiction on that particular basis, but if.the annexation is closed we could have jurisdiction as determined here at this time. Garvey, attorney torney for theapplicant, of 274.East Rowland Avenue, stated as follows-, It may spring to the mind of Council as to why we come back with a zone application which has received critical statements, and why we bring an appeal from the Planning Commission decision which Council has heard read to them.;. The explanation of why we come before you again is this. First, we have. made some changes. Whether substantial. or not we feel they dd present a somewhat different aspect. Secondly, we brought this matter beforethe Commission because the Commission did not have the benefit of Eisner and Associates report, who were retained as c(,�nsialtants.. I would explain to this body that this appeal was not done in brashness because you have heard it before, but that this, is a new Council body. Two have heard this, but one sits as a new member of Council. and two members were absent the last time it was before you. We are concerned with a, long strip of property which is�1300 feet, in length and 300 feet deep located at the northerly intersection of of Lark Ellen and Francisquit.p'Avenues bordering the City of West Covina - We proppse combination zoning to give rea,71, meaning tn.. the use of the property, taking into account tho,,---,e things lacking and to supply this area of the City with something that is -not here at the present time. This is a certain amount of neighborhood shopping area proposed, buffed at the west ' with. apartment buildings 140 x 300-feet in depth. It is a lot taken by itself under separate.ownership from other pieces, and.,by itself it would.be diffi6ul-t-as a development under what would almost amount to estate size lot. We proposed a small supermarket of 20,000 square feet, not the usual 30,000 square feet such as Market Baset, etc'., supported by service stores. We have provided adequate parking in accordance with the ordinance. We.have provided ingress and egress and have shielded the.su-rrounding neighborhood area by providing planting. area so that the residents on McWood Street will not be ' bothered by a direct view of unloading and loading. 'We have proposed here . a series of landscaping, including both shrubbery and walls, to separ- ate the residential area behind this from proposed combination area. It is true that on the south side of Francisquito Avenue there are single family residences, one story and a, half in height, but this proposed use is not A violation of g9od-planning as it has been 4b decreed by the Supreme Court that streets provide an adequate buffer .on change of,zones . C. C. 8-11-58 Page. Ten Zone Change No. 127 - continued Mr. Garvey continued. We have proposed in lieu of the gas station to provide a medical use, supported by a pharmacy, This backs up against private property and by R-P with medical zoning, adequately shrubbed, shields the property to the north. Below that a good auxiliary use is the professional type of pharmacy located in the C-1 zone. Thus we have provided a, series of geographical patterns for C-1 uses, buffed out with medical area and apartment area, Is there a justified need for this use in this area? Need has a meaning which does not mean I personally would need it but the need of the neighborhood and area, The area known as ' the southeast portion .of the City of West Covina has a'great deficiency of commercial uses of any type. East of Glendora and south of Garvey there is One commercial aspect in the area, -- the corner of.Walnut and Francisquito Avenues. That is nine -tenths of a mile from this proposal. No other market is within a mile of this proposed prope'rty. In fact, so that you will be aware, and I do not intend to hide anything from you, there Are 9 possible com- peting markets but they vary from nine -tenths of.a mil6 to three and four -tenths of a. mile, which is Hirams with thd:--next'one being the • Alpha -Beta Market in Covina. There is a small Ranch Market at Glendora and Vine and a McDa,nie,ls Market at the beginning of the Glendora strip. We find in the Eisner report a statement that a neighborhood center, which we intend to provide, provides for the sale, with convenience, of goods built arpunda super -market, drug store or major tenant. If I recall the study of the San Gabriel Valley area, as made by the Regional Planning Commission, 1-1/2 to 1-3/4 miles were looked upon as a -reasonable distance between shopping areas. A point has.been frequently raised in regard to the.driving situation by many single.family residents. I believe the City Fathers are looking toward a walking trade in that all of the new subdivisions l provide sidewalks to make foot traffic.possibi e.. North on Lark Ellen you do not have sidewalks and if they are put in it will depend upon those people already there to form such districts and sidewalks will not result from future development. A trading area map has been prepared by Mr. Eisner's'office. While it may look to be artificiallystretched, it is not. It takes into account that there are.some residences and proposed residences that are unable to have service in this area. The lengths shown are graded according to the greater population density. The next map indicates the various shopping areas of this type -.in the atea- C. C. 8-11-58 Page Eleven Zone Change No. 127 - continued Mr, Garvey - continued, While some of the trading areas may tend to overlap if they were superimposed with simi.lar.ciftl.es on them they are not within walking distance of the trading area which we have. Trading areas tend to overlap different stores but each store carries different brands and products. No matter how such uses are located there would be a, certain amount of back and forth in relation to certain brand sales. The arguments that this use would take away from another area is not realistic„ If it should occur it would only mean that there is a ".Live wire" use in'the area who can draw these buyers. However, this tends to extract dollars which amounts to sales tax to the City, and this comes not only from the City Limits but extends out to other areas of Baldwin Park and other.unincorporated areas in the County. It is said we are a nation of wheels and particularly so in Califor- nia. However, take those away and we are in trouble. This use answers both problems. It provides a place to shop at those times' when the wheels are lost, particularly when there is only one car in the family, and provides a new objection to which people could go on wheels from other areas, as well as providing additional business for the City of West Covina, The Commission raised the point that studies are being made at this time, but that is a type of study that gets into a problem of years before all things are solved and various aspects are superimposed upon each other for Council to come to some conclusions. There is within this area in the City relatively few acreage sites well adapted or sufficiently large to provide this type of a center. This is one of ,them. It is well situated in relation to competing market areas and will not impeach upon the neighbors but will serve an area not served. I have felt it was worthwhile to again bring this matter to your attention and to ask, not withstanding long range studies in relation to other locations in the City, that your attention be directed to this and the possibilities for good that can be done in the area. The need is not necessarily made of people in the.immedia.te adjoining area or the south side of Francisquito, or McWood, but in this, parabolic area which can be reached by automobile and in an area not served by such a use. The need today is a deficiency of services. We need a, supply that serves by filling that vacuum. I ask consideration of Council to reverse the decision of the Planning Commission. l C. C. 8-11-58 Zone Change No. 127 - continued Page Twelve Mr. C. Powell of 1313 McWood Street, West Covina, spoke in opposition. In listening again' to Mr. Garvey'.s discussion of this particular use this evening. it is but a repitition of what has been previously said with statements that are immediately denied by Mr. Garvey. We need this because it has a walking area and we need this because we have to.p;rovide .for wheel trade. If we did not have wheels per- haps we would need it, but we do have wheels. We have prior decision of both Commission and Council denying this just a matter of a few months ago. .Along with that I would point out that the people definitely concerned with the problem were over- whelmingly against this zone change in the area.. Now it has also be- come a matter of record that the City Engineer and Planning Commission, stated it again be denied this time. Regardless of what has been said by Mr. Garvey, there is no change in this. He has presented figures gathered first by one group of individuals then he went to a'second group of individuals. Both groups are experts in the field but.so far as we have found out they are experts in two things. They are a firm which has a method of counting, but that method does not have to agree because neither figures agreed. Secondly, they have -the mutual agility to lea.p,to conclusions from what those figures provide. In both cases, though the figures were totally different, it provided the experts with the platform from which to Leap in conclusion. They say a certain number of people, consumers,,.live in a given area and this is necessary for a. certain consumption of goods and then you have the mutual agility to leap from that platform to conclusions. I think such conclusions are unwarranted in this case. The experts jump to the conclusion that such statistics prove a need. Mr. Garvey has made much over the fact that the individual has no right to express his viewpoints as to need, that the need is not according to wants or desires. I say the need of the neighborhood is personal with individual families and the community as such and when the community expresses itself overwhelmingly as being negative so far as a need is concerned, then it is a personal need denied and _ the need has been denied and has been denied continuously. We might point out these same statistics to prove these needs could just as easily prove numberless locations in this map of West Covina as places in which there was a, definite need for a market just as here. It seems to depend on the idea, that so many people live in an area. and therefore need a market. If we had nothing close, this matter might be different. However, we do have such uses close to us some a matter of only two minutes away. C. C. 8-11-58 Page Thirteen Zone Change No. 127 continued. Mr. Powell - continuedz I would suggest that actually in many locations the experts might apply this same thing to better market location from the standpoint of accessibility to traffic, It has been shown that traffic would be difficult at this point as it is not easy to come from the free- way or to get on the freeway in relation to Lark Ellen Avenue.. Lark Ellen is a posted street and the bridge would have to be improved. Thereare also many locations not as upsetting to school pedestrian traffic, and this is a particularly heavy feeder street.for school students whi.ch.this,'use would only aggravate. We feel this is not a sufficient area, to work with to have a really good market. We do not think the need exists here. Such a need is beyond the process of logic.. I would point out that the need might be deter- mined by the use of present shopping facilities and unless I am very much mistaken there are a number, of C-1 zones in an area close to us on which business has not found it necessary to build markets or centers of service. If we need them use the C-1 zone first. Why have something 1-1.ke this in a residential area? I cannot understand how these experts can pronounce they know us as people and not just as numbers, that they know how we want to live and that we no longer desire to have the City protect us with its zoning. It is possible by your vote to establish a glue factory or slaughter house here but if you did such a thing you would break faith with all of,us here tonight. The thing is, you do not break faith just a little bit or a lot, you just break faith and the zone was called residential in this area, and.to propose to make this piece into C-1 zone changes the entire property in our minds. We are people living here for quite some time and who were promised it would remain residential,. We possibly could have lived in any one of the areas in the County of Los Angeles, and have been closer to our work, but we wanted a, protected residential area. We feel these experts can only make their, reports by knowing us and asking us and not just as numbers in a report. They know we feel it is important to be asked about our needs but they have refused to ask our opinions or to have us state what we need or want or what we think would be good. We contend that since I we live. . in this area we should be asked. If these property owners want. to join the City, fine, but when they want to bargain. with the City to become a part of it only if this becomes a commercial zone to reject them or be afraid of them cbfning in is not being a "zenophob". We have 344 people who signed against this particular petition, and this is not the first time but the second time. We have this petition with Mr. Gerschler of the 344 people who live in the parabolic area of the map owned by Mr. Garvey and they have signed against this and have paid taxes into West Covina these many years, Fj • C. I have tried to explain -about need but have not rejected the desire. These people do not desire what we desire but I have tried to show there is a need within the area. Mr- Powell argues very well about the Lark Ellen Avenue traffic problem. He says that I argue both ways in that this would provide a means for people who could walk or it would provide a, means for people who can.come from other directions on wheels. He brings in �schools and.there is no place where there isn't a. school to inter- fere with traffic patterns. We feel these trucks can get in and out by other means and not disturb the traffic',pattern.. This is a need for such facilities -versus -the natural desire ' against it by those it may have some adverse effect upon, but that is like looking for housing where there is no schools, jobs or shopping areas. I think the viewpoints of the opposition are well put but this is a study of whether or not there is a need. There 'being no further testimony presented, the hearing was declared closed. Councilman Heath, It seems a lot of this discussion has been based upon the need of a shopping area in -this location. Since the first hearing the Commission and Council had a joint meeting with a differ- ent planner than, Mr. Eisner -- a Mr. Bennett. Mr. Bennett indicated that we definitely need a shopping area, although not necessarily at this spot, but in the southeast or southerly part of the City. There are two planners, independent of each other, who recommend shopping area in that area. I do not say this is the best spot but it is the one in front of us and it may be the only one that will come before us. Another point to bring out is that we have in our discussion, and just recently so, intimated or formally stated that we would like to make a straight boundary at the southern part of the City, namely along Francisquito Avenue. Some day we would like to have this area, in the City, whether now or later,.but some day itshould be within the City. Councilman Barnes- Mr. Garvey, I noticed you have provided more parking area, in this location than has been i noted on the previous map. Did you cut the size of the building from 35,000 square feet to 20,000? C. Co 8-11-58 Page Fifteen Zone Change no, 127 - continued Mr. Garvey: Yes. The original plans called for 35,000 square foot building but Mr. Eisner rearranged the grouping and picked up additional parking spaces and made a smaller market. He did not feel the area would support a 35,000 square foot market. -Councilman Brown-. I will have to go along with Councilman Heath. This may not be exactly the area but our planning consultant stated there should be a shopping area in this portion of the City. There Is no shopping area from Francisquito Avenue to Valley Boulevard,"' and as far as Mt. San Antonio College, and it would be very detri- -mental to the City to discover we had let slip a shopping center only to have it come up on theCounty line and we would receive nothing in taxes. Mayor Mottinger stated that Council cannot approve this zone change without getting recommendations from the Planning Commission since it would be a reversal of their decision, and it was indicated this should be sent back to the Commission with recommendations. Mr, Aiassa.a I discussed this matter with Mr. Dubrove on the telephone today and reviwed the overall problem with him and also out- lined the discussion we had with Mr. Hedger of the Los Angeles Flood Control District. Under the proposed potential design of Walnut Creek Parkway the new bridge is to be tied into the approach of Walnut Creek Parkway road. I reviewed this thoroughly and I would recommend to City Council to make another study of the proposed Walnut Creek Parkway alignment. I believe the present design is a little bit difficult to develop because we are fronting against the • Wash boundaries and also there is a potential that if there is a redesign of a. new road alignment it may be more advantageous to the adjoining property owner because then the properties adjoining the street right of way can be developed on both sides, whereas now the north side of the proposed street alignment can be developed with frontage to the street. Also there is another difficult problem, that of putting a street intersection at the direct approach of the. bridge. There are two bridges involved in the present proposed alignment. I have contacted Mr. Johnson and for an estimated $100.00 he will give us a summary study of a possible solution under a, plan of realignment of the proposed design. We have this scheduled and to be worked out with three members of the City staff, Mr, Gerschler, Mr. Pontow and Mr. Dosh, to sit with Mr. Johnson to review the over- all study of the problem. Zoning, engineering, etc., could be studied and consummated at the same time by this committee. Mr. Dubrove felt it important to check out this feasibility. Mayor Mottingek: I think it is feasible that Mr. Dubrove advise you in writing so that we can proceed with further study but that it is being done with his consent. CITY MANAGER REPORTS SAN GABRIEL VALLEY This agreement has been turned over to HUMANE SOCIETY AGREEMENT the.City Clerk. I have reviewed the Authorization for Mayor 1958-59.proposa.l which provides for 20% to sign agreement to come to the City of all fees with no book work involved. This report is a comparison between the County and the San Gabriel Valley Humane Society service. I would like to continue with the San Gabriel. Valley Humane Society for,another year predicated on the basis that the County has opened • a new dog shelter in Baldwin .Park. I would like to see how well the County operations will provide in the ensuing year and next year we will definitely know whether to make a recommendation to use the County services or the the San Gabriel Valley Humane Society. Motion by Councilman Brown, seconded by Councilman Heath and carried that the Mayor be authorized to sign the agreement with the San Gabriel Valley Humane Society service for year 1958-59. COMIDA PARK I had a meeting with the property owners City Manager authorized of property adjoining Comida. Park and to carry on negotiations the appraisal should be ready within a week. I am meeting with owners again and I would like to have a member of Council to sit with me in negotiation proceedings. Mayor Mottinger appointed Councilman Brown to sit in with Mr. Aiassa on this matter. C. 8-11-58 CITY MANAGER REPORTS -, continued RIDGE RIDERS Authorization for expenditure of allotted money to fulfill contract obligations of the City of West Covina Page Twenty-one On .Iuly 1, 1058 the City Manager's Office sent to members of Council a memorandum on the Ridge Riders contract. Submitted in this memorandum was the suggested re- quirements to complete the contract obli- gations between the City and the Ridge Riders which amounted to $880.00. At a. meeting with lair. Gingrich and a. representative of the Ridge Riders it was indicated that there was $750.00 in this year's allo- cation of budget and frankly we were attempting to do as much as possible with the funds allocated. Although it is not my basic recom- mendation I would suggest, to relieve us of follow-up for future items, to expend the $750.00 and try to fulfill contract obligations with the Ridge Riders. Mayor Mottinger: That doesn't take care of dust alleviation? Mr. Aiassa: No. Mayor Mottinger: That is the only complaint heard in re- lation to that property. I believe these • people.know of this problem and they may be bringing it to the attention of the group on their own, and although it can be solved by them I think we should be sure that something is done as it is quite a nuisance. Councilman Barnes: I would like to know the total amount spent on this, over and above the $750.00 in this year's budget, for the Ridge Riders on that particular property. Mr. Aiassa: The figure shows that $506.02 has been expended on material. Mayor Mottinger: It isn't expenditure with Ridge Riders only, we have an agreement that half of this area be for a riding ring and the other half to develop into park uses and ball diamond. Councilman Barnes: I would like to ask for the total amount of money expended on this particular property by the City. Mr. Aiassa: That would require some research because Ridge Riders have done some work and the City of West Covina has completed some work. A report will be provided for City Council review. C. 8-11-58 Page Twenty-two RIDGE RIDERS - continued Councilman Heath: I understood a while back that in the park at Coronado we couldn't put grass seed in there because the property runs under lease purchase agreement; that we weren't allowed to spend money until it belongs to us. Mr. Williams: You can spend money for grass raising but not put up buildings of a, permanent structure on a leasing plan. Is this one where City contracted to complete the purchase? Mayor Mottinger: No, it is contract purchase. Ridge Riders is the contract lease. Mr. Williams: Where contracted to purchase you can spend money for anything, but where leasing as discriminating from obligation to purchase you cannot spend money on permanent improvements then, which would convert lease into a compulsion to buy. Mayor Mottinger: If improvements are such it can be pro- perly amortized. Mr. Williams: Whatever is normally amortized and you get full use of during the lease you can do, but if you cannot get full use it consti- tutes compulsion to purchase. - Councilman Heath: If we are not getting the benefits of that purchase can we put in a sprinkler system for the benefit of leasing the property? Mr. Williams: This is a short term lease and that might be all right. Councilman Heath: Is that legal, spending money for a speci- fie group rather than for the citizens of the City? Mr. Williams: This original agreement had benefits flow- ing both ways,.some to City some to them. We agree to do things to their advantage to get certain benefits under the agreement. That is proper. If, let us say, we are doing something we are not compelled to do under agreement, which would only benefit them and not the public, no you couldn't do that. It would be spending money for private benefit. Mayor Mottinger: The Ridge Riders group use the riding ring. twice a month and the rest of the time it can be used for public riding. The City would usually do this work actually it is small patching jobs but I called for informal bids. I have four informal bids, the lowest being in the'amount of $1,232.72 submitted by the Harvey Construction Company. Cox, Warren -Southwest and done Crowell & Larson also bid on this. This work,was usually one by City forces but I would like to do as many of these small projects under contract. It is less than $2,000.00 and you do not have to call for formal bids but I did call for an informal bid. I have a figure in the amount of $204,,00, which would include installation with six additional microphones;, there would be seven all told, with one basic Page System Amplifier and four loudspeakers. However, we should -keep in mind the possibility of relocating the Council Chambers and that it would incur a double expenditure if this was accomplished, There are three ways of developing this system.and I obtained the figure stated so as to have something to work from. It would depend on how good and how effective a system you would want. The average low cost runs between $175.00 and $20,G.00, and the best system from $900.00 to $1,200.00. This.item is nat in the budget and in case you decided to purchase this item there would be need of some reallocation (of funds). Mr. Aiassa- I have collected additional information on library developments which will be useful. in our next Monday's meeting. REFUND REQUYREMENT FROM He (Mr. Hurst) is not going to develop J. HURST IN RELATION TO the subidiVion (map) filed with the City SUBDIVISION (MAPY FILED and certain fees have been paid to the WITH CITY City towards the full development of these plans'. The land has been sold, subject to escro' w, and the new developer will sustain these fees. I have requested that he (Mr. Hurst) submit a letter outlining the project and at the time the new owner files we will refund those fees that he has referred to. RESOLUTION RELATING TO We.have,a Resolution on the proposed PROPOSED SALARY CHANGES salary changes. I believe there are three employees involved. The matter has been discussed with'Council and I would like to have the City Attorney read the Resolution and if there are any changes I will sus- tain those changes in our own report. RESOLUTION NO. 1423 The City Attorney presented and read Amending Resolution "A RESOLUTION OF THE CITY COUNCIL OF THE No. 1277 relating to CITY OF WEST COVINA AMENDING RESOLUTION salaries and classes, NO., 1277 RELATING TO SALARIES AND • ADOPTED CLASSES." Motion by Councilman Brown, seconded by Councilman Barnes that,said Resolution be adopted:. Motion passed on roll call as follows: Ayes, Councilmen Heath, Brown, Barnes, Mayor Mottinger Noes: None Absent.- Councilman Pittenger Said Resolution was given the number 1423. Mr.'Aiassa: This shall be applicable to all full time employees, not part time. Councilman Heath:-. I didn't understand it that way. Mr. Aiassa- This item I would like.to have clarified. Councilman Heath.. You have some part time employees in the City Hall.- They will be included. I think the cost of living has gone up for every- body and this should be applied to part time employees;on*the City payroll, but not to hourly rate of Recreation Department. Mr. Aiassa..- I would like to have this clarification as I am not in a, position to determine policy decision and decide who shall receive the cost of living increase of 3%. It was consensus that All regular salary employees and part time salary employees on the City payroll be included. (See page.30 for additional remarks regarding this matter). Co. CHIEF OF POLICE City of West Covina, the City Manager REJECTED and the Chief of Police is hereby rejected. CONFIRMATION OF APPOINTEES Motion by Councilman Heath, seconded by TO METROPOLITAN GOux"ERNMENT 'Councilman Barnes and carried that STUDY COMMISSION Councilman Dale Pittenger be appointed as Official Representative to the Metro- politan Government Study Commission; Mr. George Xjii.assa be appointed as Alternate, Official Representative to this Commissli(an and Mr. Joe Hurst be appointed as Citizens Representa- tive to this Commission, It was indicated that final -decision of the appointment of the alternate for the Citizens Representative to the Government Study Commission would be made at study meeting of Council. Mr. Flotten stated that letters of appreciation had been received from Senators Kuchel and Knowland in relation to the Resolutions passed by Council in the matter of their help to the City. C. 8-11-58' Page Twenty-nine CITY TREASURER None MANOR®S REPORTS Mayor Mottinger: I attended the Civil Defense meeting Fri -day evening and as a. point of informa- tion it was indicated they are enlarging beyond their document from the California Disaster Office.This should be in relation.to chain of command and all minute details. However, it has not been officially adopted as yet. COUNCIL COMMITTEE REPORTS Councilman Heath: Saturday,.Councilman Barnes and I were honored -guests on a tour with the Recrea- tion and Parks Commission. We,made a tour of the park sites and to sum the matter up briefly we have a lot of work to do in our parks. Councilman Barnes: I had a call from Mr. Pinkney Randal, Jr., former Civil Defense Director, and he asked me to say that although he greatly • desired to do so he was unable to attend Council meeting tonight, Gouncilman Brown: I brought in a tax bill from a party living on Halinor Street who is paying into the Baldwin Park Recreation District. What has become of that matter? Mr. Aiassa, This matter is not completed but we are getting it.done. Mrs. Van Dame: What is the $750.00 earmarked for the Ridge Riders? What is done with that? Mayor Mottinger: This is for improvement work on the area used by them and the City as.a part. it is in relation to a -contract signed with_. them quite some time ago in -relation to development of the area. Mrs. Van Dame: I believe Council said that the Ridge Riders use a certain portion on two Sundays of the month, otherwise the pub- lic can use it. Is that correct? C. They have a riding ring and have horse shows twice a month, Any other time the public can go ahead and use the ring without requesting any special permission Mrs. Van Dame; Can't Council say anything about how the schools are being run? The graduating classes this year have to'use the old Covina High School, they can't even go into the West Covina High School, and their hours are very bad. Mayor Mottinger: We have no jurisdiction over schools at all. We can help out, as individuals, by voting at the bond election. Mrs. Van Dame: Couldn't you make that 5% across the • board on cost of living raise instead of .3%? Mayor Mottinger: Not and stay within our budget. Mrs. Van Dame: Across the board should mean everyone in • the City. Councilman Brown: We were talking mainly about summer fill-in help in Recreation and Parks Department. Councilman Heath: That is the only ones that will not receive this raise in pay. Mr. Aiass a: I think there should be a point cleared in that some of our recreational people are placed in job classification. I think they are going to get that 3% cost of living increase. Question is are they under our job classification plan, and if they are they will derive the benefit even though they are paid on an hourly rate.in monthly payment breakdown.
