MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
CITY OF WEST COVINA, CALIFORNIA
July 14, 1958
The meeting was called to order by Mayor Mottinger at 7:30 P. M.
in the West Covina City Hall. The Pledge of Allegiance was led -by
Councilman Barnes, with the invocation given by the.Reverend
Howard Nickel of St. Timothy's Lutheran Church of West Covina.

Preliminary Report
APPROVED LOCATION: East of Azusa, north of
Walnut Creek Parkway west of Hollen-
beck, and south of Garvey Avenue.
A preliminary map for this district was presented and it was stated
that signatures on the signed petition have been validated against
the last tax roll and represent 64.84% of the area. of the district.
The preliminary estimate of the cost for this project is $88,100.00,
or approximately $400.00 per lot. This includes construction costs,
engineering and incidental expenses.
Recommendation was that the map be approved and filed with the City
Clerk, and the City Engineer be instructed to request the health
officer to investigate the sanitary conditions of the district and
that the City Engineer be instructed to proceed with preparation of
final plans and specifications for the project.
Motion by Councilman Brown, seconded by Councilman Pittenger a,nd
carried that the preliminary map and report on Sewer Assessment
District A-11-58 -B be approved and filed with the City Clerk and

DISTRICT A/11-57--7 Vincent Avenue and Puente Avenue
Revised Preliminary Report Sewer District.
APPROVED
LOCATION: Vincent Avenue between
Puente Avenue and Casad Avenue, and
on Casad Avenue between 300' ?� west
of Vincent Avenue and Vincent Avenue.
A preliminary map for this district was presented and it was stated
that signatures on the signed petition have been validated against
the last tax roll .and represent 61.44% of the area of the district.
The preliminary estimate of the cost for this project is $200,900.00
or $365.00 per lot. This includes construction costs, engineering
and incidental expenses.
It was recommended that the map be approved and filed with the City
Clerk, and the City Engineer be instructed to request the health
• officer to investigate the sanitary conditions of the district and.
that the City. -Engineer be instructed to proceed with the prepara-
tion of final plans and specifications for the project.
Mr. Dosh indicated that .in relation to the first preliminary report
given on this matter there had been less than the ,required 60% of
the necessary signatures on the signed petition of the area of the
district, but that signatures presented in this report had one over
the 60%.
Motion by Councilman Pittenger, seconded by Councilman Brown and
carried that the preliminary map and report on Sewer Assessment
District A111-57-7 be approved and filed with the City Clerk, that
the City Engineer be instructed to request the health officer to in-
vestigate the sanitary conditions of the district and that the City
Engineer proceed with preparation of final plans and specifications
for the project,

this district.
This Department has made an inveoti-
gation of the Ardilla Avenue and
Ituni Street Sanitary Sewer District,
A'i1=58-2, City -of West Covina, as shown on the attached map. During
the course of this investigation 45 house -to -house calls were made
Of this number 15 occupants were not at home or did not answer the
door. Of the 30 property owners or tenants actually contacted, 14
or-46-2/3% reported, that they had experienced trouble with their
individual -subsurface sewage disposal systems. They complained that
the seepage pits filled up,.causing raw sewage to back up into the
house plumbing fixtures or to overflow on to the surface of the
ground,.also that .frequent pumping and cleaning out of the systems
was necessary.
The soil within the area of this proposed sanitary sewer district
consists mostly of fine, silty sand. This fine sand sifts through
the spaces between the brick lining of the seepage pits and causes
them to either fill up with sand or cave in.
In view of our survey, 1, the undersigned Health Officer of the
County of Los Angeles, having been officially designated by the
City Council of the City of West Covina, to perform public health
services for the City of West Covina, do hereby recommend that pro-
geedings be instituted at once for the construction of sanitary
sewers in the Ardilla Avenue and Ituni. Street Sanitary Sewer District,
A'11-58-2, City of West Covina. This recommendation is made as an
improvement necessary to the protection of public health and pursuant
to the provisions of Section 2808'of the Streets and Highways Code."

Councilman Barnes and'Ma.yor Mottinger questioned the percentage of
property owners contacted as indicated in the Health Officer's re-
port and whether more signatures should not be obtained. Councilman
Pittenger felt this matter could be approved and be proceeded with
on the basis of the report because of the health menace. Mr. Dosh
indicated he felt this=matter could proceed on that basis although
an attempt could be made,to obtain more signatures.

Mayor Mottinger stated that on the basis of the Health Officer's
report he felt that the matter should proceed but that it might be
well -to get a better survey just; to know that we (City) will not
encounter any difficulties in this matter.
Motion by Councilman Heath, seconded by Councilman Barnes and
carried that the report of District A`11-58-2 be accepted and the
City Engineer be instructed to proceed as indicated.

Request authorization to for the Cortez Street, Hollenbeck
employ firm of Ted M. Walsh Street and Va.nderhoof Drive Sewer
APPROVED District.
Mr. Dosh presented and read the report on this matter and stated
copies of this report had been presented to members of the Council.
It was the recommendation to Council that authorization be given to
the City Manager to engage the firm of `Fed M. Walsh to prepare the
final plans and profiles for this sanitary sewer district
Mr. Walsh-. I would like to clarify the estimated
cost In the matter of this proposal in
that it would not be a permanent
figure as there is now the problem of house connections which may
involve a little more time and bring the cost from one -tenth to
two -tenths (of one percent more. We did not figure we would have
to find out where everyone wanted their house connection.

Mayor Mottinger: As a. „point of record, Mr'. Walsh, you
feel there should be an additional one -
tenth to two -tenths (of one percent)
more for figuring in house connections?
Mr. Walsh- That is correct, if we are to locate
them.
Motion by Councilman Brown, seconded by Councilman Barnes and
carried that the City Manager be authorized to employ the firm of
Ted M. Walsh for the Engineering work on Sanitary Sewer District
A'11-57-5 at not to exceed 4.1% of the construction cost.
ACCEPT SEWER FACILITIES - TRACT NO, 17637 - On Agenda in error.
LOCATION- Valinda and Cameron Avenue.
Accept sewer facilities and authorize release of Seab®rdand Surety
Company Bond No. 521776 LA in the amount of $5,500.00 for sanitary
sewers.
Mr. Dosh indicated this should be deleted from the Agenda.
ACCEPT SEWER FACILITIES LOCATION: Francisquito Avenue and
Tract No. 18277 and 21185 California Avenue.
APPROVED
Motion by Councilman Brown, seconded by Councilman Heath and carried
that sever facilities in Tracts No_ 1827.7 and 21185 be accepted and
authorization be given for the release of Glen Falls Insurance Company
Bond No. 551937 in the amount of $32,000.00 for sanitary sewers.
ACCEPT SEWER FACILITIES LOCATION: South of Vine Avenue and west
Tract No. 24051 of Hollenbeck Street.
APPROVED
Motion by Councilman Pittenger, seconded by Councilman Brown and
carried that sewer facilities in Tract No. 24051 be accepted, and
authorization be given for the release of General Insurance Company
of America Bond in the amount of $8,800.00'.
ACCEPT SEWER FACILITIES LOCATION: Southwest corner.of Merced
Tracts No. 20682 and 20993 and Azusa Avenues.

City Manager: There. is a portion of two frontage
roads on which the City has been doing
some maintenance and which is not in-
cluded in this contract. I would have Council's acknowledgment of
that. I am going to work on that matter to see what car.. be done -in
regard to this controversial problem, which has been discussed in-
formally with Council.. On the basis -of this'agreement I will attempt
to have, an agreement in relation to the portion of the two frontage
roads.

Perhaps this item should not be taken
up until Council has discussed a few
items prior to this, Items 18 to 20
on the Agenda. Prior to
this time we have accepted grant deeds
without requiring title
search before accepting grant deeds. How-
ever., on Vincent Avenue
we have requested that title search be done
and the City Manager feels
every time before accepting
it is something that'should be done
a grant deed. I have not received them
on Items 18, 19 and 20
and 21 of the Agenda which are items that
apply to this project.
However,_possibly the contract could be
awarded, subject to the
clearing of these titles on these properties.

I have reviewed this matter with Mr.
Johnson and we feel that any city should
be protected in that all liens are
cleared and city is assured of any easements. Unless title search.
is done there can be no
such assurance.
Mayor Mottinger: Mr. Aiassa, you would recommend accept-
ance of bid subject to title search?
Mr. Aiassa: That is correct.
Motion by Councilman Pittenger, -seconded by Councilman Barnes that
t`he award of bid for street improvements on a section of Walnut
Creek Parkway., between a point 55' easterly from the center line of
Cilifornia Avenue and a point 417' easterly go to Cox Bros. Con-
struction Company, as the lowest responsible bidder, in the amount

Maps were presented by Mr. Gerschler and Resolution No. 612 and 616
of the Planning Commission were read.
Mayor Mottinger opened the public hearing and stated that all those
desiring to present testimony would rise and be sworn in by the
City Clerk.
There being no testimony presented, the hearing was declared closed.
Mr. Aiassa.: I met with the applicant and Mr. Grant
(attorney) and went over the entire
street alignment. There is a serious;
problem on Walnut Creek Wash and Mr. Johnson has arranged a meeting
with Mr. Hedger to review the entire parkway proposed alignment. We
• want some assurance of any basic alignment program and if there is
any, we want to tie,.in with that so that we do not propose this and
then have it chopoed off.
We have delayed our report on this street alignment until that meet-
ing, which will be some time this week.
Mayor Mottinger questioned as to whether action should be taken on
this matter at this time and the City Attorney indicated that.he be-
lieved it should be held until next regular meeting so this matter
could be completely checked out.
Motion by Councilman Pittenger, seconded by Councilman Barnes and
carried that Application for Reclassification No. 128 (1405) be held
over for further study until next regular meeting of Council.
ZONE CHANGE NO. 124 LOCATION: Northeast corner of Azusa
VA Insurance Agency - and Garvey Avenues:

tric current and maintenance for certain street lights in this City.

Mr, A. Munch of 1611 East Puente Avenue., West Covina, stated as
follows:
I have no protests or objections but after reading the posting I
still do not know exactly what it means and would like to have the
matter clarified, as to what it means to me as a resident of the
area.
Mr. Rosetti, speaking for Mr. L. Jo Thompson who prepared the
assessment and could not be present at this meeting, stated as
follows:
The City furnishes its own energy and maintenance for street light-
ing in the City and hires an assessment engineer to spread an
assessment for the cost of lighting the system throughout the City.
However, this is only where there is lighting in an area. The cost
is spread over a district according to the type of lights used and

broken up into zones. Each year new installations go in and you
have to enlarge the district, and that is what is happening here.'
Some cities pay through taxes whether there are lights or not, but
here it is only assessed when you have lights in an area.

Resolution read that this North Prospero
Drive be brought up to City standards?
Mr. Gerschler: No, I do. not believe it was stated in the
Resolution, but I believe the Commission
was of that opinion.
Councilman Pittenger: Why°take it in unless it'is brought up
to City standards regarding improvasoent?
Dons this'letter on the record for Area
III mean it would become part of the action when giving the Ordinance
its first reading?
City Attorney: This action would have no particular
effect on the zoning so if you wish to
zone it -you should request the Planning
Commission to initiate whatever steps you would want to take toward
zoning.
Councilman Pittenger: If we accept this would it come as
Area IV?
City Attorney: I believe that was the recommendation
. of the Commission but hearings would have
to be held and if this (ordinance) was
initiated it would leave area district open.
Councilman Pittenger: The Commission was evidently trying to
specify this as a certain area and I do
not want to prejudice that.
City Attorney: You might have to hear this matter but
rather than make application you can
suggest making it Area District III or
IV so it can be so stated at hearing.,
Councilman Pittenger: I.would like to see the improvement as
a.condition of annexation.
Councilman Barnes: Would.iiea III be compatible to the
area around this proposed annexation?
Mr. Gerschler: On.one side of the property, yes, on
the other side no.
Councilman Pittenger: Perhaps -.we should withhold action on
this until we are clearer on the recom-
mendation of the Planning Commission.
We may run into difficulty if we take sub -standard streets in.
Mayor Mottinger: If there is a subdivision map that comes
through, that could be clarified after
the property has been annexed. That
has to be part of the Precise Plan and development of the area but
not necessarily part of the annexation,

Councilman Pittenger: That is true, but the other way, as
part of annexation condition, there is
no chance of missing it.
Councilman Brown: None of this discussion of conditions
have been stated for the applicants
since they are not at this hearing.
However, I think the property owners should be notified that we
would only consider annexation without any responsibility to the
City for improvement of the street. You could'have first reading
but I would prefer also to hold it over.
Mr. Gerschler: It is a, private street or drive.
City Manager; If it is accepted by the City we would '
have all the rights to demand improve-
ments.
City Attorney: The annexation would not constitute
an acceptance of a private street. They
would have to make an offer of dedica-
tion which you would have to accept.
Mayor Mottinger: There is no responsibility to the City
should .the area be annexed unless they
.ask it (street) be accepted by the
City and then we could ask for proper improvements.
City Attorney: That is correct. You could introduce
the Ordinance and then tell them
(applicants) that the City won't pass
it until certain conditions are met and also at the. same time indi-
cate to the Planning Commission.that the ordinance has been intro-
duced and asking them to start zoning hearing to be effective if and
when adopted.

to go through a more detailed analysis of this subject. .

DENIED
The City Clerk stated that a letter
...had been received this evening, dated
July.14, 1958 asking for consideration
of the use of the Cortez Park Building
by the Ladies Auxiliary of the Pony -
Grad Baseball Team. Purpose is to hold
a breakfast to raise money to enable
payment of various outstanding debts
of the team. Further request was for
possible waiving of nominal fee charged
for use of said building.
Mr,. Gingrich stated, in relation to fee for use of facility, that he
did not believe this was contained in an ordinance but that there
h.ad been an establishment of policy by Council in relation to such
matters.
The City Attorney stated that if there is no ordinance the fee could
be waived if Council desired to do so but that if the fee was estab-
lished by ordinance there was little could be done,
Mayor Mottinger indicated that there was no desire of Council to cur-
tail such helpful activities in any way, but that'a precedent had been
established in -that these charges were required of other groups, to
use these building facilities.

CORTEZ PARK BUILDING USE - continued
Councilman Brown indicated that although he knew this was a fine
group it was.his opinion this was one time when a matter of this
type should be denied in that if this is done for this goup it
would have to be done for every_ group who made -such a request.
Councilman Pittenger stated that he agreed with Councilman Brown
in
that if the bars are let down.in this case every group would ask
for the same consideration and would have the right to have it.
If
there is to be no charge, everyone should know.
Councilman Barnes stated that since this was a recreation group,
and
they seemed to be in such financial straits, he felt that perhaps
something could be done to help the children and team in relation
to
this request.
It was indicated by Council, however, that they felt this was a
matter that could have been handled administratively by Mr. Gingrich
without presenting it to Council.
Motion by Councilman Brown, seconded by Councilman Pittenger and
carried that the request for waiving of the fee for the use of the
Cortez Park Building for the Pony -Grads Baseball Team be denied,
. Councilman Barnes stated he would go along with the decision since
a policy appears to liave been established, providing no other.group
of this type asks for and receives any special privileges and that
there be a follow through on the cost of this use all the way, with
no deviation from it.

I, would like to see this Resolution
made restrictive to the fiscal year
of 1958-1959. I am not fully convinced
that the City wants to go into the business of competing with private
recreational use agencies. I am not convinced that adult recreational
dancing is something the City g4hould provide. I am not convinced
that it is the city's or any governmental a.gency's place to provide
recreational activities for some adults or to;,compete with private
groups who will take care of needs.
Councilman Barnes: Do we have the facilities to accomo-
date these type of requests?
Mr. Ginrich, Parks and Facilities are a problem now, and
Recreation Director: although these various activities
listed are being conducted we have to
limit classes because of lack of more facilities. Although these
are, admittedly, marginal activi't_ies we have been attempting to make
them as self-supporting as possible.

the law firm of Beloud and Hayton be
authorized to handle the City of West
Covina's case in relation to the damage
caused to City Police Motorcycle indi-
cated as Gareis vs. Mack.
Mr. Williams indicated that he would be absent on vacation, from
the Council's meeting of July 28, 1958 and that Mr. Sorenson could
not attend since he had to be present at another city's Council
meeting the same night.
The City Attorney indicated that he would request another attorney
be present at that meeting so that if any irregularities do occur
Council could be guided by legal opinion.
CITY MANAGER REPORTS
• INSPECTION OF BRIDGES, Mr.,Aiassa indicated that there should

Citrus -Street and that it had been sug-
gested to Mr. Johnson to also proceed with photographs of the under -
structure of these bridges showing their condition. Mr. Aiassa re-
quested authorization by Council for the expenditure of $60.00 for
inspections of these bridges by the County Road Department.

authorization be given for the expenditure of $60.00 for inspection
of bridges (at Hollenbeck and Citrus Streets and Azusa Avenue) by
the County Road Department.

carried that the Mayor, and City Clerk be authorized to sign contracts
with the West Covina and Covina School District (with the stipulated
change as indicatea by the City Manager) relative to the recreation
program.
LOWER SAN DIMAS-BADILLO The commugAcation of Mr. Harold L.
DRAINAGE PROBLEM Johnson relative to this matter was
read.
Indications were that Council should make one more attempt in rela-
tion to a cooperative program,, regarding this problem, with the
cities of Baldwin Park and.Covina in an attempt to solve it and if
not, to proceed on the sugge.sted'.alternative solution to provide
relief of drainage problem of the westerly area of the City.
Councilman Pittenger: I have attended two meetings on this
matter with another meeting this Thurs-
day afternoon with Mr.. Bonelli. I do
not think that Baldwin Park and West Covina, see eye to eye on what
is required. I know that West Covina has a problem and Baldwin Park
also has one, but not as much as_Weet Covina has. They (Baldwin Park)
would wait another year for solution if it would be possible to get
the County to do the job but I do not think the County will change
its policy at all but I will go along and pursue this thing as far
as we'could. I think this meeting Thursday will probably be the
end. I will report back after this meeting as to whether there
might be further references on this matter.

Mr. Aiassa indicated possible construction of slab floor, water line
installation at estimate total cost of $3,100.00, but this request
was only for purchase and moving of the structures which could be
put on piling until some later time.

DIRECTIONAL SIGNS FOR Council reviewed this matter and Mr.
BUSINESS CENTERS Aiassa stated that he had a meeting
with the merchants group and it was
his opinion that, agreement had been reached in relation to two
sites of placement for these signs.
It was consensus that the City Manager proceed on the basis of the
discussion in that the solution seemed satisfactorv.
ADOPTION OF BUDGET Mr. Aiassa read a'memorandum from
ADOPTED AS TEMPORARY Mr. -Walters which stated that the re -
TENTATIVE BUDGET vised budget total is $2,085,340.22.
This is an increase of $18,677.70 over
the original document due to minor mathematical discrepancies which
were discovered in double checking the changes in the budget. There
still remains an excess of receipts over disbursements in the amount
of $38,342.78. Total budget income is $2,123,683.00.
Motion by Councilman Brown, seconded by Councilman Pittenger and
carried that submitted budget be,.adopted as a temporary, tentative
budget in the amount of $2,085,340.22 and subject to any revisions
made by Council.
PROVISIONS FOR I went through the.variances and special

of beautification and found no such
provisions made.
This is a requirement that should be made mandatory', It apparently
..has.not bee so in these cases and the City is stuck with it. It
appears we have accepted the parkway as it is and there should have
been something in writing. There have possibly been verbal commit-
ments and discussion but nothing in black and white that "so and so
is responsible for'improvements. According to records the City has
accepted this as it is. There were two, possibly three, precise
plans submitted and they should have had recommendations that specific
improvements be made but there have been none.
I would like to proceed on -this matter of the possibility of correct-
ing curbs and entrances first as we have a,traffic factor. I would
also then review the possibility of black topping with possibly
some planting of trees, but will come back to Council in relation to
that.
Motion by Councilman.Pittenger', seconded by Councilman Rath that
the City Manager be authorized to proceed with curb construction
and/or removal as needed and correct driveways in frontage road
along Garvey Boulevard in front of West Covina Center, with /labor
cost not to exceed $1,200.00, labor to be provided by the City.

MRS. VAN DAME
ELIMINATION OF REST Mrs.. Van Dame stated she had heard
ROOMS IN TWO CITY PARKS there was a proposal to eliminate
rest rooms in two of the City Parks
and it was her opinion this should mot be done as it was very .
important to have them in the parks..
WEEDS Mrs. Van Dame stated that the weeds
were still very unsightly and that
there is a, great deal of rubbish
being dumped into them.
• INCREASE OF SALARY FOR Question was asked as to how much
MRS. MERRY increase in salary Mrs. Merry was
given and the Mayor indicated there
was an increase in mileage of $5.00 per month.
FIRE DEPARTMENT Mrs. Van Dame questioned as to cost of
PUMPER Fire Department Pumper and it was indi-
cated.about $20,000.00. Further ques-
tion as to repairing of one of these pumpers but it was indicated
that pumping has to have.a certain consistency with some basic
.reserve and that there is greater demand for protection to the City
in going from the Board.of Fire Underwriters of the Pacific to
National Board of Fire Underwriters, and that the fire insurance
rate had dropped appreciably and that fire protection must continue
to improve to maintain the rate.
Mrs. Van Dame stated that she felt there should be a uniformed man
at the police desk and not a civilian employee. It was indicated
there was some plan to have the person at the police desk in some
type of uniform;
Mrs. Van Dame stated thatshe felt that 80% of the City needed
street lights,.and also that Council should go back to its starting
time for meetings to 8:00 P. M. rather than 7:_30.
It was Mrs. Van Dame's opinion that Council salary should be in-
creased to $40.00, at least, a meeting.

these private recreation ideas that are coming in.
