03-31-1958 - Regular Meeting - MinutesMINUTES OF THE ADJOURNED REGULAR MEETING OF THE CITY' COUNCIL • CITY OF WEST COVINA,'CALIFORNIA March 31, 1958 The meeting was called to order by Mayor Kay at 7:25 P.M. in the West Covina City Hall. ROLL CALL Present: Mayor Kay, Councilmen Barnes, Brown, Pittenger Others Present- Acting City Manager and Public Works Director, City Clerk, City Attorney, City Engineer Absent- Councilman Mottinger PUBLIC WORKS DIRECTOR'S REPORT Street Progress Charts wea,,e presented to members of Council by the Public Works Director. TIME EXTENSION Public Works Dir.: There is a contract O Project C-63 between the City of West Covina and the McKnight Constr. Co. McKnight Construction Company in relation APPROVED to work to be done on Project C-63. The work has been held back. due to the inclement -weather and I would recommend a time exten- sion of the contract ag.reement for 1.20 days. However this only actually gives 42 calendair .4 days. Motion by Councilman Pittenger, seconded by Councilman carried that a time extension of 1,20 days be approved on Brown and the contract period between the City of West Covina and the McKnight Construction Company in relation to Project C-63. REQUEST TO POST BOND LOCATION: Northeast corner of Barranca IN RELATION TO SEWERS Street and Garvey Avenue. .Zone Variance No. 225 1 REQUEST,-, Permission to post a. bond to insure installation of sewers and connection of sewers when sewers are available. Mr. J. Olivier of 1605 Lashburn, Whittier, representing Tidewater Oil Company, stated as follows: Variance No. 225 was approved by the City Council in February of this year and provisions were that we make all improvements on said land before obtaining building permits. We have endeavored to fulfill the wishes of the Council and have submitted plans to the City in connection with improvements to be made on subject site, but we have -1- 0 0 C.C. 3-31-58 ZONE VARIANCE NO. 225 - continued Page two bogged down on the sewer proposal. We had plans drawn on that matter but the sewer connection amounts to some $60,000.00 as a rough estimate. We have endeavored to meet with the adjacent property owners and also with the City in this matter, On March 24, 1958 we wrote a letter requesting permission to post a bond of $2,000.00 which would insure the installation of sewers and the connection of sewers when the sewers were available, if this could be done we could proceed with the work. On March 26, 1958 Mr. Johnson, who is also one of the engineers on this matter, suggested that the amount of the bond be for $2,500.00. We feel. we could meet this bond, if it is alright with the City, to insure connection of the sewer lines when available. If this is done we could proceed with the construction and for the present time use a, Septic Tank. Mr. Johnson When we established our Sewer Department (Public Wks. Diro) we had an agreement between the City and County where we would have a cooperative reimbursement agreement back and forth in the area to the north and east of Barranca. -There is a great deal of County area involved here which was,the reason for it. There is also considerable area outside of the City involved in designing an extension of a. trunk there. I do not believe that one party ca.nlcarry the ball' on this kind of. money for such construction. Two or three, of these people turned out to be clients of mine so I suggested the proposal and also worked on the matter in order to give some idea of the kind of money cost we are talking about. There are many agencies involved in this, such as the County, City, State Division of Highways, etc., and I feel it is not something that can be worked out in five minutes. There was also some feel- ing on the part of the County Sanitation Department that the size of the sewer should be made larger to bring in an even larger district. I feel this is a matter that would take at least 60 to 90 days to work on because there are so many people and so much area involved. However, I think there should be a letter on file with the City that these people making this request this evening agree to pay their share if it should amount to more than what is covered by the bond, in accordance with our reimbursement agreements. Motion by Councilman Brown, seconded by Councilman Pittenger and carried that (the applicants of) Zone Variance No. 225 be given permission to post a, $2500.00 bond in lieu of putting in sewers at this time and that a letter is to be filed with the City Manager and Sanitation Division that in the event the cost runs over the bond amount the applicant will pay the cost of same. -2- 0 0 O 0 C.Ca 3-31-58 ZONE VARIANCE NO. 225 -- continued Page three City Engineer-, In addition to this $2500.00 bond for sewers we have approved and amount of $3500.00 for street improvements to go with this development. Perhaps both of these amounts could be contained in one bond. Councilman Brown: I do not believe that would be possible as the one bond (for sewers) may be held for quite a long time while the other bond (for street improvements) may not be held any length oftime. City Engineer-, Then we can have the two bonds and accept them both in one resolution. RESOLUTION NO. 1317 "A RESOLUTION OF THE CITY COUNCIL OF THE Gas Tax Allocation for CITY OF WEST COVINA, ADOPTING A BUDGET Major City Streets: AND APPROVING THE FIRST SUPPLEMENTAL ADOPTED MEMORANDUM OF AGREEMENT FOR THE EXPENDITURE OF GAS.TAX ALLOCATIONS FOR MAJOR CITY STREETS." Mayor Kay: Hearing No objections, we will waive further reading of the body of the Resolution. Motion by Councilman Barnes, seconded by Councilman Pittenger that Resolution No. 1317 be adopted. Motion passed on roll call as follows: Ayes-, -Councilmen Barnes, Brown, Pittenger, Mayor Kay Noes: None Absent: Councilman Mottinger TRACT NO. 16876 The City Clerk stated this refers to a request for Council to consider some dis- cussion with respect to this particular tract. It was consensus this matter be presented at the adjourned meeting April 7, 1.958 at 7,30 P.m. PARKS &RECREATION COMMISSION .Parks & Recreation Director I would request authorization from (Mr. Gingrich) Council to purchase playground equip- ment which has been included in the budget for this fiscal year. Items are needed on three playgrounds to get them up to minimum standards, O and they have the recommendation of the Parks and Recreation Commis- sion. The amount would be $2962.34. 1 have a breakdown of just what is going into these parks, if Council would desire.to hear them. -3- C.C. 3-31-58 Page four • PARKS & RECREATION COMMISSION - continued Councilman Brown questioned as to whether this amount is covered by what is in the budget and Mr. Gingrich answered this was slightly over. It was suggested that an attempt be made to keep it at the budget figure. Mayor Kay: Unless Council requests this be read at -this time you could submit this to us in writing. Councilman Barnes: Before a motion is made on this, wouldn't such an, amount have to go to bid? Mr. Gingrich- There are two manufacturers involved here and the problem of bids in playground equipment is that each makes a different type of equipment piece. If we want a certain piece of equipment only, one company makes it • and you can't duplicate it from another company to get identical equipment,in other areas. There is a question of whether this could go to bid or not. .Mayor Kay: I believe the City Attorney has ruled it does not have to go to bid. Councilman Brown. I do not believe the City Manager knows anytying of this matter and I think it Might be a. mistake to have this come before Council and acted UPOD 'without the City Manager looking at it. Mayor Kay: Present this at the adjourned Council meeting next Monday evening at 7:30 and have recommendations in writing to M.r. Johnson in time so that be can look : Lt over 'and, have it presented at the meeting next Monday. CITY MANAGER REPORTS City Manager: Has Council.'looked over the Federal Works matter enough or would Council desire more time to think a-boUt it? Mayor Kay: I thought you were going to go ahead and prepare applications for two or three planning projects. City Manager: I would need a resolution before I could do that to make me a designated representative. Mayor Kay: I believe there -would be no harm in getting the resolution in, perhaps by the adjourned meeting, so that we can go ahead on it. ME C.C. 3-31-58 Page five • RESIGNATION OF Mr. Horace Greeley has submitted his DEPUTY DIRECTOR resignation as Deputy Director of Civil OF CIVIL DEFENSE Defense. 0 E 0 CONSULTANT FOR THE CITY IN RELATION TO THE FIRE DEPARTMENT Mr. Ralph Hardin APPROVED Councilman Brown- Fire Chief Hardin's retirement as Chief is effective as of tomorrow, April 1, 1958. 1 would like to make a motion that he be hired as a. City consultant to the Fire Department, effective upon date of retirement as Chief. Motion by Councilman Brown, seconded by Councilman Pittenger that Ralph Hardin din be hired as a, City consultant to the Fire Department, effective April 1, 1958, on a. cantractural basis at a. salary of $715.00 per month. Motion passed on roll call as follows: 'Ayes: Councilmen Barnes, Brown, Pittenger, Mayor Kay Noes: None Absent: Councilman Mottinger Councilman Brown: I believe that the City Attorney should be instructed to bring in resolutions express- ing the City's appreciation for services .rendered by Mr. Hardin and Mr. Greeley. Councilman Barnes: At our meeting a week ago tonight the hearing was held in relation to a church site for the Classis of California (Reformed Church of America). This presented some problems and we told.those people that we would meet with them two weeks from that night. A Mrs. Ralph Conway called and asked if there had been a. formal meeting with_ the -Ministerial group. Council- man Mottinger was appointed chair man and he is now on vacation and I was wondering if this should be set for a later date so all of us that are on the committee could attend. Mayor Kay: I think we should try to go ahead with this matter and if possible get the meeting in this week. Councilman Barnes, perhaps you could act as the Chairman and Councilman Pittenger sit in on this committee. Councilman Barnes asked if the City Manager would contact Commis- sioners Green and Getches for a meeting in relation to this matter at Saturday noon, April 5. -5- C.C. 3-31-58 %, Page six The City Attorney stated that he had a, resolution to present to Council in relation to the establishing of an industrial develop- ment commission and describing its powers and duties. However, it was indicated this resolution was not quite completed and it was consensus this matter bepresentedat the adjourned meeting of April 7. There being no further business, the meeting was adjourned until Monday, April, 7, 1958, at 7:30 P.M. 0 • •
