The Rev. John Gunn of the First Baptist Church gave the Invocation. City Clerk- There is'a change indicated to be made in the Minutes. -of February 24, 1958 as shown on page 3 in relation to the Public Works Director's Report on removal of trees an North Lark Ellen Avenue,, It was out of the actual removal cost of 'these trees that we were able to purchase a chain saw for the Street Department. The Minutes would seem to indicate that the purchase was made out of the difference between the estimated cost and the actual cost figures to remove these trees that the chain saw was purchased. Mayor Kay- I believe that the word 'difference' as shown in the original statement should be deleted. Motion by Councilman Brown, seconded by Councilman Barnes and carried that the Minutes of February 24, 1958 be amended as in- dicated by the statement of the City Clerk, PUBLIC WORKS DIRECTOR'S REPORT MONTHLY PROGRESS REPORT This report, which has been presented ON STREETS AND SEWERS to you,'has been revised so that it • will -be a more graphic and understand- able. I have presented Council with a report regarding recommendations for projects to be submitted to the Los Angeles County'Flood Control for the proposed County Wide Storm Drain Bond Issue and would request approval, by Council, of theserecommendations. Badillo Drain - West Covina pro -rated share, pro- -'$290,000.00 viTe_._d___&i-her agencies submit their pro-rata shares. 1)(Alt) Project No. 47-1 01, Orange Avenue Drain 290,000.00 The plan contemplates the construction of a reinforced concrete pipe storm drain in Orange Avenue from the. Walnut Creek Wash northerly, extending under the San Bernardino Freeway, to 100 feet south of Grovecenter. 2) Project No. 47-1,03, Vincent Avenue Drain 132,921.00 The plan contemplates 'the construction of a rein- forced concrete pipe storm drain in Vincent Avenue from the Walnut Creek Wash northerly, extending under the San Bernardino Freeway to join the ex- isting westerly channel on the north side of the Freeway, 3) Project No. 47-105, Lark Ellen Avenue Drain 182,282.89 The plan-cantemplates the construction of a: rein- forced concrete pipe in Lark Ellen Avenue extend- ing from the westerly channel of the north side of the San Bernardino Freeway northerly to Puente Avenue. 4) Project No., 47-B-01, Merced Avenue Drain 569,720.00 • The plan Contemplates the construction of a rein- forced concrete box in Merced Avenue from the Walnut Creek Wash southeasterly to California Ave.; the construction of a reinforced concrete pipe in California Avenue extending northeasterly from Merced Avenue approximately 1300-feef; then easterly in a 30 foot easement, -part of which lies in future Vine Avenue approximately 1250 feet to Glendora Avenue. They are going to assist in obtaining.the Right-of-way. MAP I would Point out�the new aerial map on the wAll,behind the Council table. This map was partly purchased (by the City) and partly donated by a, local aerial (photography) firm for our recent trip -to Sacramento. I feel this photograph could be of great assistance to Council in the future. SAFETY PROGRAM RECORDER We now have Posted in the Council Chambers, in'relation to our Traffic Safety Program, an indicator to show the number of hours worked without lost time accident, which will be kept up -to date. City Engineer: I.have presented copies of this report to members of Council which reads as follows: "In making a tour of several, new City Hall facilities in this area, the City Engineer and the Chief Building Inspector were both impressed with the convenience and efficiency of the Whittier City Hall design. The building is based on an open plan which requires a minimun of hall- way, ventilating ducts, and partitions and doorways. It is our rough estimate that the ultimate floor area requirements for the West Covina City Hall would fall in the neighborhood of 30,000 sq. ft. if a similar plan were utilized. (The above estimate -does not provide for basement area, or Police and Fire Department -dministrative facilities). The estima,te,of Albert C. Martin and ssociates for, the City Hall floor area is 40,000 sq. ft., including provisions for public utilities. It would seem that the Fire Department's suggestions 'should be seriously considered in any rearrangement of existing facilities. Inasmuch as their present occupied space of Station No. 19 1,500 sq. ft., would perhaps accommodate present needs of Planning Section, Building Department, and Chamber of Commerce which total 1,550 sq. ft. It is not our recommendation that these facilities be grouped in this manner. Some other groupings would possibly work just as well as the one we have suggested." I have broken this report down into various functions usually found in the City Hall. I have listed present square footage of areas now being use.. There is also listed the "three year" requirements that various departments felt they will need and we have listed the *ltimate requirements which we estimated would be needed, The .lice and Fire Department facilities are shown on the bottom of the report. Acting City Manager. I would like to go into this matter a. little further. We have a couple of other ,suggestions and would like to proceed with some further recommendations on this. Motion by Councilman Pittenger, seconded -by Councilman Brown and carried that this matter be referred back to the Acting City Manager for further report to be presented three weeks from tonight. TRACT NO. 18205 LOCATION: South of Merced Avenue, east of Casa Grande Building Azusa Avenue. REPORT APPROVED Report of City Engineer and Director of Public Works on request for refund. The City Engineer read the report as follows: -4- C.C. 3-24-58 Page f ive A request of E.A. Galster, Casa Grande Builders, dated February 24, 1958, has been referred to this department. The request was for a refund of $317.50 which involves deposits ordered held by the City when the City Council on May 25, 1954, accepted street improvements in Tract No. 18205. The deposits withheld at that time were as follows: 1. For street trees and street signs not installed $360.00 2. For 1 electrolier, not installed 145.00 3.* For street improvements, not installed 172.50 Since the street improvements were accepted on May 25, 1954, the street name signs have been installed by City forces at a cost of $125.00. We are holding $235.00 to cover cost of Mr. Galster's installation of street trees within the tract. *he remaining steel pole electrolier has been ordered installed and he Edison Company plans to make the installation in the near future. The.$172.5.0 deposit withheld under item 3 covered the cost of instal- lation of approximately 32 lineal feet of concrete curb and gutter and asphaltic pavement and base.on Azusa Avenue which could not be installed at the time Casa Grande Builder's contractor was Working on the project due to the fact that an existing.culvert had not been reconstructed and extended. These street improvements were later constructed in connection with the culvert project and paid for out of City funds, As soon as Mr. Galster completes all of his work in connection with the street trees and as soon as Edison Company bills us for instal- lation of the additional, electrolier, we will complete the escrow now being held on this tract and adjust the funds accordingly. There is no money available for Mr. Galster at this time. Ayes: Councilmen Barnes, Noes: None Absent: None REQUEST FOR REVISION OF REIMBURSEMENT AGREEMENT NO. 14 PRECISE PLAN NO, 11 APPROVED Brown, Mottinger, Pittenger, Mayor Kay Request of Babson and Associates in accordance with adjusted district boundary, City Engineer- Since the proposed installation of Badillo Storm Drain and existing installation of Metropolitan Water District line down the middle of Badillo Street, it becomes im- practical to service the southerly side of Badillo Street. This re- imbursement agreement would read just the existing agreement and eliminate that small area, from the reimbursement district. Motion by Councilman Brown, seconded by Councilman Mottinger and carried that the City Engineer and City- Attorney be instructed to draw up a new revised reimbursement agreement No. 14, Precise Plan No. 11, and to present this matter to Council at their next regular meeting. SCHEDULED MATTERS &ROJECT NO. C-63 Street improvements on a section of Cameron BID'AWARDED Avenue, between Fernwood Street and Azusa A-1 Contractors, Inc. Avenue. Improvements to consist of excavation, grading, removal of excess excavation and the construction of 21' asphaltic pavement on aggregate base and all incidental work thereto. The bids were opened as advertised at 10.00 A.M., March 24, 1958, in the office of the City Clerk and referred to the City Engineer for recommendation to the City Council at this meeting. Garvey, attorney -at -law and representing the applicants in Zone Change Noo 113 and Precise Plan No.,121, set for public hearing this date, requested continuance of this matter. It was stated by Mr. Garvey that his clients have retained a firm of con- sultants to make an economic survey of this area to backup testimony presented on this matter before the Commission. This survey had not yet been received at the present time by the proponents. *ayor Kay: Notifications have . been given on public hearing for this matter this evening. Since a public hearing has been declared I believe we might have to have .testimony presented tonight, but perhaps we can continue the hearing so as to receive such testimony at alater date. Mr. Garvey: I have no objection to those in opposition being heard but I do not have adequate testimony, without_ thissurvey report, to present on behalf of the proponents. Mayor Kay: I would suggest that you stay to open the case for the proponents if you are representing the proponents. 'This to include street lights, sidewalks and sanitary sewers. 2) That.all necessary street widening of Cameron Avenue and Va-linda Avenue shall be deeded to the City of West Covina. "On the fifth of February we were before the Planning Commission attempting to receive a variance on the parcel of ground at Cameron and Valinda Avenues. We were requested to be brief and factual and because many items relative to this matter were in the ha nds of the proper parties we went along with the request. However, I feel now that because of that briefness in presenting testimony the case was not presented as fully as it should have been for complete understanding, First I would indicate that this church is one'of the oldest churches in America. I make this statement because in contacting the people in,the area many indicated they had never heard of the denomination •and thought it was just a 'cult'- of some type.. We are also one of the oldest charter members of the Council of Churches and we have many prominent people, national and international that belong to this church. We have been for the last 11 years on the Comidy Council and it came to our attention that there was a growing city here in West Covina, and although it is not the only growing city in this area, it was a fact that we could not keep up with the growth and building of the •area so�that perhaps we are somewhat late to come into the City of West Covina. Although we have cooperated many times with the various schools we do not have the privilege to condemn property for churches as the school districts are permitted to do to obtain land for schoolsP Therefore, we have limitations as to where we can go. However, it has always been my understanding that in most cases in any City a church can go in most any zone, providing there is a public hearing and with all things being equal and the laws complied with. We came in November and went through this valley on the south side of the freeway because on the north we have established cities and churches and for the total growth of this city the church need was to the south. We also were thinking inking under the terms of a central location for the church to serve both those people from the north and south, and since there are no sidewalks we were of the opinion that almost everyone would be driving to the church destination and we felt that this particular area would be the most convenient to reach from all directions. Everyone has said there is a, need for more churches here and that opinion alsocomes. from the Comidy Council of which we are a member. .As we dealt with Comidy, real estate.people, ministerial association and various other groups we found this property to be centrally located and it was not prohibitive'(in price), There have been some ministers disturbed because churches were too close together and I was at the meeting of the Ministerial Association but it was indicated tome at that time that this meeting was some- -13- C.C. 3-24-58 Page fourteen ZONE VARIANCE NO, 224"- continued thing different and that I was not actually an invited guest. How- ever, the report was that Council., who was meeting with the associa- tion, was grateful for this meeting but had also indicated that there were so many things entering into the matter of churches that they could not be bound by set rules in relation to them. When I came before the Commission I was asked if we had looked over a, map prepared in.the placement of possible church use. My reply was that I had not because at the time we were looking for'such a. site the map was not then in existence. However, there has not been less than 1.5 or 25 parcels of land that we have checked on. it was noted ' by the opponents that there was enough property, other than this, for a church but I call attention to the fact that we are somewhat limited so as not to overlap other church sites and we do not want to'do that. We have an understanding with 11, other denomina- tioria: Comidy Council of Churches and we feel that we could not go any further towards Glendora because we have an understanding with , the Presbyterian Church. We have on record that this site was cleared with those * churches that are in.Comidy. 'There are also many churches who are holding their services in schools and unless we know who they are we have no idea whether we are infringing on them or not. We feel that the whole southeast section of West Covina is under- churched, and we have gone.up and down the area to find a. proper site. We have gone to a local realtor in this section and it was indicated that we would probably run into difficulty to find a site unless we went into County territory in the southeast so we felt we would go to the west because we want to work with the Methodists, Baptists and the Presbyterians because the whole southeast area. is underchurched. It has not been easy to find a parcel and we want to know if there is ,another site (in the City) to the southeast, but we have never received an actual answer. It was stated that there were developed homes on thre62 sides but I believe there is only'one house to the west. I have a letter from the Baptist Church and from the Southern Cali- fornia Council of Churches which are in favor of this, We want to cooperate in the placement of churches and we certainly do not want to steal any 'sheep' from any other' church flock. I contacted 60 people within the 300 foot radius area and almost .without exception they stated they were glad that our plan had enough parking and setback. Some 15 or 20 signatures of people were given voluntarily. Some had their own church and some had misgivings as to the traffic. Some were afraid of parking in front of their, homes. However, we tried to answer all their questions.". -14- C.C. 3-24-58 ZONE VARIANCE NO, 224'-'continued Page fifteen Mayor Kay stated that the proponents had taken 18 minutes, and the same amount of time would be permitted the opponents with five minutes for a rebuttal period to answer the opponents. Mr. Ralph Conway of 1029 E. Cameron Avenue spoke in opposition. Going back to about 1923 it seems that the original plan of the City was to keep this City a desirable place to live and to eliminate nuisances. .1 am not against churches, nor are my neighbors, but we are against two churches being side by side. Yesterday, at a quarter to twelve a count was taken at the Baptist Church nearby and the parking lot was full, with some 36 cars parked on the street., If this church goes in here there are 50 some homes affected within the 300 foot radius. We feel this use will. bring -some devaluation of our property and we do not feel that we can stand the loss that this might bring to our homes. It has been indicated there is other available property for'such use and we believe this church should investigate that to see if they c6ul.dn.'t find something more appropriate, • As near as I can ascertain in the neighborhood there isn't a. member of this church in the immediate area. We feel. this is an infringement on the rights of the people in the neighborhood and many people in -the area -are opposed to it. Mr. Houghton of 1051 Cameron Avenue spoke in opposition. • 1 am opposed to the church going in here. It is quite a traffic ordeal and I can't understand why we, as citizens and taxpayers, have to have all these zone variances and have matters like this come up two or three times. "We do not have anything against the church but we do not feel this is fair or treating this area. of the community right to put another church in hereo There are other areas where it is permissible to have a. church and I do not see why they should pick this particular spot so close to residential property, We have a Catholic church on Glendora, on the- corner of -Service we have a Lutheran Church, on Vine Street we.have a Presbyterian Church and just west of us is the -Baptist Church and I think that is plenty for that area. A resident of 745 Va.li.nda. Avenue questioned as to the traffic problem, and stated that she had called the Police Department in regard to that problem many times. -15- C.C. 3-24-58,* ZONE 'VARIANCE NO, 224 - continued Page sixteen "If Cameron becomes a secondary highway can we get Stop Signs?" Mayor Kay: Cameron Avenue is proposed to go east to west to connect with the Orange Ave. Interchange, The street will run clear through our City and will.be a heavy traffic artery. If and when traffic ' counts and the nature of traffic acitivity on it warrants it, the Police Department would then recommend -installation of Stop Signs, or electric signals, if they are warranted. The Police Department, or Traffic Engineer, would run necessary checks and as soon as there is a. basis for such requirements consideration would be given. Residents of 1035 Cameron, 1015 Cameron and 1009 Cameron all spoke in protest in relation to the traffic problem. •The Planning Commission Secretary read Communications from the Revered Gunn of the First Baptist Church dated January 15, 1,958 desiring to go on record as welcoming this church to the vicinity and having them as neighbors on the west and the possibility of meeting with the church board to discuss the taking of option on the remaining land not used or zoned for extra parking or else it .be used only for residential. A communication was also read from James T. Smith, staff director • of the Planning and Research Staff for the Southern California Council of Churches which was, in essence, an official clearance for the church at this site by the Comidy Commission, Dr. Van Dyke spoke in rebuttal. We checked out some 20 or 30 parcels. There was a suggestion of a. 50 acre site in the downtown area but cost wasprohibitive and we would have to cut through our own roads. There was a parcel close to Del Norte School but that was hardly an acre after the road would go through so there would be lack of parking spaces. On Azusa. Avenue we found the same problem and another area brought us too close to the Moravian Church.. To find an area has not been as easy as it may seem. It was my feeling that if we could zone this we would not, for the next six months, build but keep looking for a, better site. However, in the meantime we have bought this and we have a, man to take over the parsonage. However, we still have not'said we will do this and if there are other parcels'I would like them shown to me, but most of them have all kinds of problems involved. We feel that because of schools and churches on Cameron in this area it is more natural for traffic to slow up and I believe that traffic during the week is more heavy than it is on Sunday, We have made no committments but there are thos6interested in selling -16" C.C. 3-24-58 Page seventeen ZONE VARIANCE NO. 224 - continued part of this so the Baptist Church can have more parking area. it would be better, and also -there would be a buffer of homes so there is no danger of two churches going together in here. The tendency now is to put churches together in groups because of the problem of placing churches. Mayor Kay: Have you closed escrow and is the church tied to the land?. Dr. Van Dyke: No, although we have be,en.authorized to close escrow. There being no further testimony, the hearing was'declaxed closed. Councilman Mottinger: We realize the problems that confron this church and the neighborhood. We realize it would be a lengthy procedure for us to dig into the efforts that this church has made to find other locations. I wonder if it might be in order for us to have a study by a committee consisting of members of the Planning Commission or Planning Department and Council to review the locations which we may think we know but that may not be available as Dr. Van Dyke has said. I would like to satisfy myself it is not practical to have this church in another location. I would table this for study and future action. Councilman Pittenger: There were some preliminary studies made with the Ministerial Association. We began to set up a committee of the Plan- ning Commission, Council and the Association, although I think that committee has been slowed down somewhat. I would like to throve, this back at them and get this committee organized. We should study it and see if we can work outthis problem. Mayor Kay: I.believe three ministers were named for this com- mittee. If we supplemented that with two members of Council and two members of the Commission we would have agood study group to go over this thing. Mayor Kay appointed Councilman Barnes, Councilman Mottinger, Com- missioner Green and Commissioner. Getches to form this committee. Councilman Mottinger was appointed Chairman of the committee and it was indicated he should contact the Ministerial Association on this matter. I would like to review the request which I made earlier in the meet- ing to have this matter continued for reason that we have ordered an economic survey made of this area which has not, as yet, been delivered to use We ordered.this more than three weeks ago, approxi- mately the same time the appeal was filed. In order not to inconvenience those people who have turned out tonight I am perfectly willing to have those people speak and I will make a. preliminary statement but I would like to have this matter kept open as we consider this survey vitally important to present with this case, . Mro C. Powell of 1313 McWood Street stated that he was representing the opposition and had received a number of notes indicating opposi- tion to the extension of this hearing as proposed by Mr. Garvey. "These are several hundreds represented in opposition and we, as the opposition, were able -to prepare ourselves for this hearing and it is felt that the proponents have had sufficient time to do so also. We would like a decision on this, The first hearing before the Commission the proponents requested the matter be held over and actually all the meetings have been at their request, not at ours. We are getting tired of their requests for extension of time to present their case. The argument has been on their side all the way through and we feelthere is no reason for this to continue." Mr. Garvey: At the hearing before the Commission I produced an expert who testified to the economic survey. His • testimony was challenged on the theory it was pre- judiced because he was the architect employed by the firm who was to develop this property. Recognizing.a certain validity in that .argument my clients hired an independent firm of consultants to make a survey. We are just as anxious for an early decision on this as the opponents are anxious to have it denied, but I feel it would not be fair to my clients not to make the motion that I did because they have attempted -to prepare this survey. This was supposed to be ready for this time but they could not hsve it done. Decision is up to Council but if the hearing is not continued I would like permission to submit this data because we have incurred the expense and it has been considerable. Mr. Powell: We do not question the facts as presented by Mr. Garvey and his clients but we do question the conclu- sions drawn from the facts presented. • -19- C.C. 3 -24-53 • ZONE CHANGE NO. 113- continued Page twenty Councilman Pittenger: I think Mr. Powell has a point and that all the people have spent a great deal of time on this. At other times Mr. Garvey has come before us with what I believe he thinks is a true picture. I do not believe we should just hear one side and then have Mr. Garvey present his factoo I think we should continue the hearing, hear from both sides now and then let both sides speak at the next meeting, Councilman Brown: I think -it is unfortunate they have not received their necessary data to present tonight but I think this matter should be settled. Did we ever have the second reading on this annexation? City Attorney: No. Councilman Brown: I think it is a bad policy to consider granting zoning before property is annexed to the City. This sort of thing is just going to be a problem before us all the time. It is taking up the residents time,- and wasting the time of Council because we are going to continuously have feelers thrown at us for firm zoning. . Councilman Mottinger: 3;f we permit the proponents to admit further evidence later all of the people who are opposed will want to be here anyway to offer any rebuttal that would be in order. I would Like to see what the economic survey would be for this area. It might prove revealing in such a way that the proponents might even want to'pul.l out. Mayor Kay: I think we should see all the testimony available in making a decision on this and to consider the economic • conditions in the area. as to need or.demand would be a factor. I feel that type of information would be important to be included in the testimony. I feel the case should be considered only when sufficient evidence is presented from both sides. We can continue the hearing so that both sides are able to present their testimony and both sides hear the testimony. Councilman Brown: The pro's and con's have been made on this matter and I think the hearing should be tonight. Mayor Kay: I can't answer that as it is the first time before Council. Councilman Brown: It was before the Commission and this looks like a.feeler and now they are getting serious about it and want to get a survey on it. • -20- C.C; 3-24-58 Page twenty-one ZONE CHANGE NO, 11.3 -continued Councilman Barnes: I would like to see the facts presented but I think it should be held over and all the facts given from both sides at once. Mr. Powell: I would point out that proba.bl.y,all of these people have been at all these meetings on this matter and that it is an imposition to have then return again. These people are interested in their homes and they live in the area. At the first meeting before the Commission it was asked that the hearing be continued because of,an amendment and it was continued so the people who attended that hearing were made to return again. We have a good turnout to indicate our feelings in this matter and we feel. that Mr. Garvey has enough of 'a prepared statement in regard to the need here and we feel that we have counter statements to them. We feel it is unfair to have the opposition continuously jumping at the request of the proponents in holding this over because they are actually requesting this change, not use We feel Mr. Garvey has in- formation at his fingertips that he could present tonight, just as we do. . Mr. Garvey: The request to hold this matter over at the first hearing before the Commission was not as the request of the principle applicants. Mr. Hoke decided, after first not wanting to join with the other applicants, to go ahead and requested permission to do so, The applicant granted the request but we were surprised to learn that the entire hearing would have to be held over in order to make such an amendment. i We feel this study that we are doing would be of benefit to the City because it must be made of the entire area in order to get an opinion. I proposed to introduce the representative of the firm who is making this study and we do not desire to present a written report unless we have to do so. I do recongize the times the people in opposition have been before the Commission and now Council but we do not want to make them jump for us and would be very happy if they were rz.ome watching their television. If you deny the request made I will, go ahead with a presentation of the limited facilities I have at my command. Fire Chief at $755.00 a. month. the present Fire Chief gets $715.00 a month. Mr. Hardin is going to be kept on for two months to teach the new man his job. Well, I say that the new man must certainly be more efficient than that for someone to take two months to show him the 'ropes'. Two weeks would be suf- ficient. It is going to cost $2,940.00 for the two Fire Chiefs being together for that length of time. That is money you are taking away from the taxpayers and you shouldn't do it. Mayor Kay- Speaking as to the subject itself, and not any in- dividual case involved, it is my firm belief that• . if this City is to go to any great length to extend its boundaries for specific reasons and purposes and if we are doing so for A reason we need to back up that reason with action. Annexa- tion to other cities.is automatic 'M' zoning. We had a development plan studied and reviewed by the Planning Depart- ment, Planning Commission and City Council and 'so long as we reason- ably adhere to that, the interim zoning is the only practical mechanism to set up to initiate proceedings. If Council wants to bury its head and believes everyone is going to jump into the City to be taxed under R-1, Area District IV I think it would.be a mistake. Unless you.16ok at what is being done in the area, go after what we want and have it zoned for what we could satisfactorily use it for, Councilman Pittenger: The Annexation 158 is a lot different than this one piece of property. if we agree 158 is what we want that is something else. -31- C.C. 3-24-58 Page thirty-two • ORDINANCE NO. 565 - continued This amnexa.tion.is.not what we want and I would not 'shoestring' to get down there. We would be running into all sorts of problems with services if we 'shoestring' down there. When,we are re.ady to study the whole thing then there could be interim zoning on the whole thing and that is something else again. I feel we are making ourselves enemies in that annexation because of this action and that we might have considerably more trouble than we anticipate if we go ahead, It isn't fair to the rest of the people to pick out one man and state we will give you what you want and not to the others. -1 do not think we even want to leave outselves in this position. Councilman Barnes-, The others would have the same privilege. Mayor Kay: This was put in at the request of the others also. Two asked,for R-A zoning and at their request this 40 draft was made and ordinance was made. The third man asked for 'M' zoning. There are only four parcels involved in 158. Councilman Pittenger.- The man immediately adjacent wants to farm, he wants R-A and two others do also but if they want to change later..on and if you have 'M' zoning in here they would have no choice but to go 'M' zone. • Mayor Kay: We have three cases on interim zoning, not one case. Councilman Pittenger: I agree, but they are for R-A. That was the intent of ordinance so people could come in under that. If a man wanted to farm it he needed R-A or else be would be penalized, It was to give that particular type of zoning to these people. • Mayor Kay: 1. would suggest this "matter be continued until the joint meeting of the Commission and Council this Friday evening. I believe we could discuss it at that time. Councilman Mottinger; There a2re aspects of this situation not brought entirely to the attention of Council and I think that has caused some confusion. We made statements that we were going to give them an overall complete zoning program if we went into the area success - .fully and this.should fit in with that type of program and possibly does. It seems to fit pretty well. However, we should be sure we are not treading on anyone's toes and are not being premature. if it is necessary, it is one thing, but there is a question whether this is or not until it actually comes into the City. We can indicate it might fit into the overall picture but the area. does not belong to the City and we can actually do nothing with it. -32- C.C. 3-24-58 Page thirty-three • ORDINANCE' NO, 565 - Continued Councilman Brown: In this case it can't be used and I would be opposed to this interim zoning until it comes into the City because we are to be flooded with just the sort of thing we had here tonight. REPORTS, CITY MANAGER RECOGNITION OF EMPLOYEE The most important thing in human relations SERVICES- is the recognization of service and faith- fulness and I think this is especially true of employee's in government positions. They usually hear all the bad things about themselves and I would recommend that at the next and last meeting of this Council they institute and possibly award recog- nition to people in this City who have served the City for 5, 10 or 15 years and that this be made a regularly yearly procedure. Certi- ficates of Award could be presented at that time and possibly pins, or a suitable emblem be designed for that purpose. Motion by Councilman Brown, seconded by Councilman Mottinger and carried that the recommendations of the Acting City Manager be approved and that he be instructed to implement these recommendations. •PROPOSED CHANGE IN There are recommendations instituting a FIRE DEPARTMENT SHIFTS three (3) Platoon system in the Fire Depart- ment which is necessitated by the fact that we have additional, personnel employed. This would be at a cost of $1800.00 more annually although no further additional employee's would be needed, This has the recommendation of both the new Fire Chief and Chief Hardin,. Motion by Councilman Brown, seconded by Councilman Mottinger and •carried that the recommendation of the Acting City Manager for a three (3) Platoon System in the Fire Department be accepted.. REQUEST FOR RECLASSIFICATION We have a. report from the Director of OF Ray P. Sarver Finance, It indicates that a request was submitted by Mr. Percy Jackson for the reclassification of Ray Sarver to Senior Building Inspector. This classification has not been in use in the Building Department for approximately two years*, and the State Personnel Board was requested to survey the work being performed by Mr. Sarver to determine whether or not his duties met the specifications of that particular classification. It was the finding that Mr. Sarver has performed such duties and that the position which he holds should be reclassified. Before an appointment can be ' made it will be necessary for us to determine whether or not Mr. Sarvercan be appointed outright of if an examination will be required. However, there is no point in proceeding until Council's approval is obtained for allocating this -33- E 0 11 0. 3-24-58 REQUEST FOR RECLASSIFICATION - continued Page thirty-four classification to the Building Department in view of the fact that it is not included in our current list of classifications nor provided for in the current budget. It is any recommendation that the Council approve this position in view of the fact that such employee is performing said duties and is, therefore, entitled to the classification. If Council approves the City Attorney will then be consulted as to the proper course to follow in the matter of direct appointment or examination. Mr. Sarver's current salary range is 37 E, $516.00 per month. The recommended change in classification would place him in salary range 39 D, $545.00 per month. Councilman Mottinger-. This recommendation would be to establish a classification but not necessarily to permit Mr. Sarver to be promoted to this position. Acting City Manager-, If this recommendation is approved it would be creating the position of Senior Building Inspector and someone would fill the posi- tion but not necessarily Mr. Sarver. Motion by Councilman Brown, seconded by Councilman Mottinger and carried that the recommendation to allocate the classification of Senior Building Inspector to the Building Department be approved. Mayor Kay-. If this creates the position of Senior Building .Inspector we possibly would give examinations. Councilman Mottinger: This would not discontinue the position of an Inspector in the Building Department but would create a Senior Building Inspector in the Building Department. REQUEST FROM CHIEF SILL We have a request from Chief Sill in regard to Sgt. George Odle of the Police Department who is now convalescing from major surgery at the Park Avenue Hospital in Pomona. Chief Sill was informed by Mr. Walters that Sgt. vacation and overtime will have expired on April not be ready to return to duty at that time will City payroll. The officers for the time 40 that if there would.greatly Odle's sick leave, 5th and as he will then be off the of the department have volunteered to work a shift each necessary until. Sgt. Chief Sill requests is any way possible for this arrangement to be made it be appreciated. -34- C.C. 3-24-58 Page thirty-five • REQUEST, CHIEF 'SILL - continued I have talked to the City Attorney and it appears there is no legal way to accomplish this on the payroll. City Attorney: You could not pay Sgt. Odle while in the hospital because someone else does the work. However, you might authorize over- time and such donations might be made as is seen fit for his benefit, but you could not pay him for work done by others. With respect to salary, for those who wish to work on this basis, you can authorize overtime but it draws time and a half. Councilman Barnes: I believe the Sgt. would have approximately 30 days convalescence. Motion by Councilman Pittenger, seconded by Councilman Barnes that the City Manager investigate the possibility of men working overtime and donating that money, or whatever way they want, to the Sergeant.
