The meeting was called to order by Mayor Kay at 8.10 P.M. in the West Covina;
City Hall. The invocation was given by Rabbi Silverstein of the Citrus Valley
Jewish Center.

Motion by Councilman Brown, seconded by Councilman Pittenger that the bid on

City Engineer. Of the six bids received for this particular project the
lowest responsible bidder was the Harvey Construction
Company and I would recommend the award of the bid be
made to this Company on the basis of the low bid in the amount of $55417.70.
Upon the recommendation of the City Engineer, motion by Councilman Brown
seconded by Councilman Barnes that the award of the bid on Project C-64, Street
Improvements on a section of Vine Avenue from 160 feet east of Hillward Avenue
to Hollenbeck Street go to Harvey Construction Co. as the lowest responsible
• bidder in the amount of $5,417.70 (with all other bid bonds returned to the
unsuccessful bidders). Motion passed on roll call as follows.

PUBLIC HEARINGS
ZONE VARIANCE NO. 223 LOCATION° West side of Irwindale Avenue,
William H. & Rosalie Lockett between Workman Avenue and Rowland Avenue.
REFERRED TO THE PLANNING COMM.
REQUEST: Multiple dwelling use in an R-A
Zone.
EXISTING ZONE: R-A
Denied by the Planning Commission at their meeting of November 61, 1957. De-
cision of the Planning Commission appealed by letter from the applicant.
Maps were presented by the City Engineer and Resolution No. 550 of the Plan-
ning commission, denying this Zone Variance was read.
• The Recommendations of the City Engineer are as follows.
1) That all street improvements outlined in Section 49, Ordinance No. 225,
including utilities be installed accordingly and meet the approval of
the City Engineer. This to include street lights, sidewalks and sanitary
sewers.
• 2) That all necessary street widening of Irwindale Avenue shall be deeded to
the City of West Covina.
3) That adequate water supply and fire protection be provided as required by
Ord. No. 237 and Ord. No. 451.
4) That all excavating and grading work conform to provisions of Ord.'No. 384.
• 5) That all bonds, fees and deposits for improvements be posted before
building permits are issued.
6) That a 6-foot masonry wall be constructed along the southerly and westerly
property lines.
7) That provisions for 20 foot alley be made to connect with either Irwindale
Avenue or Del Norte School parking.lot.
Mayor Kay opened the public hearing and stated that all thos desiring to pre-
sent testimony on this matter would please stand and be sworn in by the City
Clerk.
William Lockett, applicant, of 321 North Irwindale Avenue spoke in favor.
The reason we appealed the decision of the Planning Commission was that we did
not think that they actually understood the history of the property and the
• unusual situation of the property;,'
The property was purchased 8 years ago when West Covina was, more or less, of
a rural city. Times have changed and now we have this piece of property with

a school right next to it.
Mr. Lockettz The school has a parking lot that completely covers the.
north side of our.property line. There is an alleyway
that abutts up against our property which dead -ends there.
This property was purchased for the subdivision before the alley was put in and
at that time the City had no Planning Commission and there was nothing we could
do about it at that time. The subdivision went in and and there we stood.
The reason we have appealed is that we believe that such improvement of the
property as we are re questing would be good, it is an eyesore as it now stands,
• and it is also dangerous to the children that have to go to the school and a
lot (of school children) come through our property rather than walk down the
narrow roadway. It would be quite an improvement if the zoning is granted.
The main reason for opposing was, it seemed to me at the time, the alley way,
but there will only be 10 houses served by that alley and I can see no reason
why that would hold up,the zoning.
• Mr. D.. Copenhaver of 320 No. Hollow Avenue, West Covina, spoke in opposition
and presented and read a petition signed by some 40 people protesting this
variance. The petition stated the reasons in opposition to this as follows:
1) The existing alley between Irwindale and Hollow Avenues accommodates 10
garages and we feel the proposed garages, which would be using the same
alley would overload this narrow alley.
. 2) Irwindale and Workman Avenues would suffer an increased traffic load because
of increased use of said alley.
3) We feel that multiple dwellings, for rental purposes, would put a commercial
element into this residential vicinity.
4) It is also felt that multiple dwellings may be a detrimental factor on the
resale of the surrounding homes.
This petition in protest was accepted by the City Clerk to be filed for the
record.
The City Clerk presented and read a communication from Mr. and Mrs. Woodman of
Corona Del Mar protesting this variance on the grounds it would be detrimental
-to their property located at 1333 North Hollow Avenue and they requested this
-not be approved.
• There being no further testimony, the hearing was declared closed.

What is the size of that propertyg about 150 feet?
The lot contains 272300 square feet and has a 125 foot
frontage.
Is there any way that access could be made along the
north side of the property?
Planning Comm. Secey: That is a parking lot for the school district.
Mayor Kayo Can't there be a cul-de-sac?
Planning Comm. Sec°yo That is a matter that has been studied and it would give
very sub -standard lots in doing so.
Councilman Mottinger: I believe there was some study in regard to reducing the
number of residences to four and thus making the number
of square feet per residence approximately that of R-1
zone.
Planning Comm. Secey: That was in the Planning Department Remarks, allowing the
same number of dwelling units allowed in an R-1 Zone.
Mayor Kay: The only way you can do that is by a variance for Rm2 or
R-3 purposes.
Planning Comm. Seely.* You may allow variance for two dwellings on one lot on a
hardship basis without changing the zoning.
• Councilman Mottinger: It would seem that we would be serving the purpose of
the area and not upsetting the balance of Area District
I by accomplishing something like that I would be
opposed to reducing the area with 5 residences on one lot. It seems as if the
smaller amount would have some merit.
Mayor Kay: You are proposing this be sub -divided into two lots with
two residences on e ach.lot?
Planning Comm. Secey: That is correct.
Councilman Brown: What about access to Irwindale Avenue?
Planning Comm. Seely: It was proposed in the recommendations of the City
Engineer that provisions be made for a 20=foot alley
to connect with either Irwindale Avenue or Del Norte
School parking lot. We felt that would clear up any possible detrimental effects
• that now exist and give a clear -access.
Councilman Pittenger: If you did that you would leave him a little piece (of
land) 20 x 50 on the side of the alley.

Planning Comm. Sec'y: It was suggested that this area be used for garages
or to bend the alley and bring it up to Irwindale
Avenue. One of the two.
Councilman Pittenger: I think that we are going to have some pieces like
this around the City., where old ranch houses have
been left in the midst of subdivision and it does not seem fair that a man should
take the whole piece of property and put one house on it. I think that some
study should be made in regard to puttingfour houses on it. I do not think we
could get five. I would make a motion that this be referred back to the Plan-
ning Commission to see if something cant be worked out on that'basis. Council-
man Brown seconded the motion of Councilman Pittenger and the motion carried
unanimously.

GENERAL MATTERS

TRACT NO. 21617 Mr. John G. Myers of 3704 Montezuma Avenue, Alhambra
stated as follows:
• I am here tonight on a matter affecting Tract No. 21617.. This tentative map of
this tract was first approved in 1956 in January and at that time the tract con-
tained some 30 acres. We submitted this tract map to the Commission and Council
and had their approval of the subdivision. However,, in the meantime the Covina
School District started condemnation proceedings and we finally wound up with 15
acres left, instead of the 30 acres originally submitted. At that time, after
condemnation, we again submitted a revised subdivision map on the 15 acres and
• this map was also approved by the Commission and Council both.
In connection with the improvements in this tract we are concerned with the
water shed of the flood control channel traversing across the property in a
regular manner and entering the property at Cameron Avenue and leaving it at
the northwest corner of the proposed subdivision. It then follows along the
channel through to Cortez Street under Cortez Street and continuing to Cortez
Park on Citrus Street and then into Walnut Creek Wash.
In our original approval by Council and the Commission it was required that both
sides of the relocated Wash,. and we planned at that time to relocate the Wash
and have it follow lot lines as near as possible., be protected from erosion by
construction of an approved double mesh fence revetment. That was our original
approval and we have never submitted a design based on this approval because of
the condemnations. However, we submitted a later map for 15 acres and there
was some change in what we were required to do in so far as the channel was con-
cerned in that on January 25, after the word revetment., the following phrase
• was added., "or an equal facility, subject to the approval of the City Engineer."
In October, 1956, after this condemnation was settled, we started to submit our
drawings or designs for both the subdivision and this channel. That was some

14 or 15 months ago and having spent some $49000.00 or more in design of this
storm drain and we find that we are no closer to meeting the requirements of
the City of West Covina than back in October of 1956. In the approvals given
by Council in both instances., the original and revised, there are no provisions
that we would be bound by anything in connection with what the Los Angeles
County Flood Control might require, other than under the Subdivision Act in
which we are subject to a flood control report for the benefit of the Real Estate
Commissioner of the State of California. This is the report from the County
Flood Control District and it is something that we need because if we do not
have it the Real Estate Commissioner will not pass the subdivision. However,,
we are not bound by any requirements so far as the method or manner of improve-
ments are concerned. We are here to maintain, on the basis of the map we have
• submitted to this Council and to the Engineer, that we can without any improve-
ment meet a flood control report. That report could be good or bad but if it
is good the Real Estate Board will pass the subdivision. We maintain that we
are not concerned with improvements in so far as the Los Angeles Flood Control
District is concerned. We are only concerned with what the City Council., or
City Ordinance, calls for with respect to flood control improvements and with
approval of your City Engineer, Director of Public Works or both.
We have submitted 8 or 10 designs and we have approvals, .in a sense committments.,
from the Engineer Department, City Engineer and Public Works Director in that
they have told us what we can do. Then when we bring this design back to them
they say °that is fine' but tell us, 'you have to go to the Los Angeles Flood
Control and get their approval'. We maintain that if we come in with a design
to carry water that comes down that Wash., down stream, that it is up to the
City of West Covina because that is the only entity that we are doing business
with. It is up to them to pass that design and up to. this point they are un-
able to do it.
• This °ditch° has been here for a good number of years. So far as any personal
investigation I have been able to make I find there has never been any trouble
in regard to it carrying off flood waters. In no case have I seen more than
10 or 12 inches of water in the ditch. The ditch carries the water and there is
nothing accomplished in improving this ditch so long as the land remains as it
is. It is 36 wide and 40 inches in depth in various places and in others not
over 24 inches and yet it carries all the water that comes in there.
There has been a subdivision to the east of us that has been completed by Myers
Brothers. That has the same ditch traversing it, although it is a little up-
stream and carries a little bit less water and we might pick up 10 inches of
water as it reaches our land. However,, the City and Engineering Department
has permitted the construction of a gunite ditch on that area. It starts at
the easterly side of the street entering that tract, with a floor of 24 inches
wide and with side walls of perpendicular height of 24 inches. The extreme
width at the top is six feet., or 72-inches. This water traverses through this
• ditch and comes through the street and entering at the street there is a con-
crete culvert going under the street and all the water passes through that
culvert., which is 36minches wide and 30=inches high then it turns into an
open gunite ditch., This ditch.is 36minches wide with a perpendicular height

of 30®inches, an overall dimension at the top of 96minches, 8-feet. The ditch
traverses to the westerly boundary of this tract and empties into an open dirt
ditch and passes along for some 50 :to 100 feet and comes to a private road
where it goes under the road through a 24-inch corrugated metal pipe. Then it -
flows to open area on the golf course in a northwesterly direction to the bridge
at Cameron Avenue, which is 9-feet wide and 7-feet high and then it enters to
our property.
Water passes through an open ditch on our property, through an open ditch on
property to the north, where it meets the undercrossing on Cortez Street. It
passes under Cortez Street in a 60minch corrugated metal pipe and then it
passes into an open ditch and snakes through property until it reaches Citrus
Avenue. It then passes under Citrus Avenue in a concrete culvert and then in-
to an open ditch and then winds around until it hits Cortez Park. It passes
through the Park in an open turf ditch, with no improvements whatsoever, and
then passes into Walnut Creek Wash.
So far as I know there has been no damage ever done by this wash and very little
water passes through there, at least little enough so that it doesn't upset
the turf in the Country Club or Cortez Park.
iWe have submitted various plans of a design to improve this ditch in accordance
with our original approval by Council. We have worked with the Engineering
Department on an open ditch five feet wide with double wire revetments and dur-
ing that time it was suggested by the Engineering Department that we might go
into a pipe situation because of the fact that this property was in a high class
section and that a pipe would be covered up and would be an ideal improvement
there and that if such a thing could be done economically it would be good.
I instructed my engineer to work on that matter and that is where we stubbed
• our toe, and nothing has developed yet.
The County Flood Control has requirements in so"far as design based on their
figures of 50, 10 or 25 year storm cycles and we did it on the basis of the 25
year storm cycle and I believe the flood control says that we can go on the
basis of the 25 year storm cycle figures which are 494 cubic feet per second.
That figure is based on the ultimate capacity of this ditch and based on the
absolute density of improvements on 490 some odd acres laying south and east
of our property.
You know this property and you know it is never going to be developed into four
lots to an acre and you know the Country Club -will be there longer than us and
there will be no improvements there whatsoever. The Country Club could be sold
to a subdivider,'although it is only a conjecture,'and I believe the Board of
Supervisors has a ruling that any golf course before it is subdivided, must be
offered to the County before it is sold.
The figures we get of 494 cubic feet a second requires an open gunite ditch
20mfeet wide and requires a base of 8-feet. The County Flood Control District
maintains a 1=1/2 to 1 slopes on the size of this which brings it out to 2.0m
feet, but the flood control goes further they say °we want a R.O.W. to run

through'. 'We want 15=feet additional feet, or a total of 35=feet, alongside
this lot'. I can't see 35=feet going down this sub -division. It is not in
Myers subdivision, nor the City Park so I do not feel that is a just request.
We feel we have submitted many designs, I do not know whether Ted Walsh is
a good or bad engineer but I have been in this business a long time and have
been on a lot of subdivisions in West Covina, I have done business with Ted
Walsh a number of years, yet on this deal we brought in a consultant from one of
the largest engineering companies in California,
With our design we had a meeting with your City Engineer, Director of Public
Works- and the City Attorney and we got no where.
• We want to improve this property, there is no question about it, but we can't
afford $51,000.00 for a storm drain improvement for 15 lots. It isn't reason-
able for the .Los Angeles Flood Control to expect us to do it. I know you are
flood control conscious, but you can't ask for things that are unreasonable
or discriminatory and you must allow us to use our land and this is stopping
us from using our land.
• We have submitted, and we have been turned down within the last two or three
weeks, a plan we, are willing to allow 18mfeet of R.O.W. through this property.
We would go in and run a 12=foot lined channel down there with concrete block
walls on either side to confine this water,,with walls approximately four feet
high. What we are willing to put in is better than double the ultimate capacity
that the County wants. They want 494 cubic feet a second, this will take down
over 1000 cubic feet a second.
I am making an appeal to get something done here. I want you to consider this
• thing and if we are right in our proposals and if our engineering firm has
ability you should consider this. We are faced with a situation in that we
.can only go ahead if the improvements come within reason. We have figured this
on the basis of $2200 a lot on overall subdivision and it can't be done.
We submitted in August 1957, a suggesting using concrete pipe. In this de=
cision we were approached by a salesman for No -Joint Pipe Company which is
a concrete pipe that is cast in place. This pipe is used in 48 cities in Cali-
forniag even Los Angeles uses it, and it was suggested by your Engineering
Department. It was referred to us, we did not know this outfit. We talked on
this matter with the Engineering Department, we submitted on it and we were
turned down by the Engineering Department because they said the Los Angeles
Flood Control District would not approve it.
The thing that is being forced on us is the fact that at some later date the
City is going to ask flood control to take this ditch over for maintenance.
This may be the concern to the City but I do not believe it is any concern of
ours. You have a ditch east of us, in Myers tract, which does not comply with
• what the flood control would accept. Anything north of us would not comply
with flood control, nor would the pipe under Mrs. Stark's property. We do
not know how you expect flood control to take over this 1300 feet of a two or

three mile ditch. If you had asked for improvement on all of it. O.K.. but our
section is only a very small section of it,
Mayor Kayo What was the objection of a 4 x 12 channel?
Mr. Myers. It does not meet the requirements of the Los Angeles Flood
Control District, They want 15-feet of service road
alongside of it.. We maintain that if you start at Cameron and take the inner
street that you can take a wheelbarrow and come back 150-feet in either direction
and keep the ditch clean. without putting in a 15-foot roadway, It could be
cleaned by hand work without having a 15-foot R.O.W. You have an open ditch
clear to Walnut Creek without any improvements and subdivision to the east where
you'd get no trucks in.
Mayor Kayo What happened on Tract No, 12292 when it was passed and ac-
cepted in 19463
Public Wks. Dir.. The requirements were this. There was another subdivision
ordinance which has since been modified and on that map.,
in accordance with that act, natural drainage courses were
• required to be. shown as traversing the lots. They were not required to .improve
those channels at that time, but they were not given to the City of West Covina,
they go with the property.
My Myers. We would be glad to maintain ownership here. One of our
requirements was to give you an easementg but if you do
not want the easement we will keep it.
Councilman Pittenger. How could we enforce them to clean this?
City Attorney. You might be able to do it by some sort of tract restric-
tions on the subdivider to do it. It makes a difference
whether the City is going to accept this and be responsi-
ble for it.
Mayor Kay. Is there any reason why we have to accept this?
Public Wks. Dir.. No. you did not require under the original conditions that
it be granted as an easement to the City of West Covina.
You did say that all easements would be improved and in
the event they are not presented to the City then Section 31 of the Sub -division
Ordinance would apply in which certain indications have to be shown on the map.
Mayor Kay. If he gets a bad flood control report on the area it would
be shown on the map. If the subdivider is willing to keep
this he should be allowed to until it comes to certain re-

quirements.
Councilman Pittenger. Something should be stated that restricts and enforces
them to take care of it so it .be kept clean and the water
coming `down freely.

City Attorney° It can be done on paper but I have seen several of these
things in operation and eventually the City seems to have
to go in and acquire it and keep it cleaned out.
Mr. Myers. I have put in a number of sumps that were passable and perm
missibleo
Councilman Pittenger. Who cleans thatupin say 10 years? Do you have some way
to set this up so that this is kept clean?
Mr. Myers. If it developed into a nuisance then I believe the City
Police Power could step in.
• Mayor Kay. I do not think this should be a City problem, nor are we in
a position to require improvements above and below this
subdivision and I believe it should be up to Mr. Myers. If
it is not safe for the property to be sold the flood control will mark it on the
map accordingly.

visions -of Section 2808., Division 41, Street and Highways Code, the Special
Assessment Investigations Limitation and Majority Protest Act of 1931. The re-
port of the Health Officer stated as follows°

• ANALYSIS° This Department has made an investigation
of the Marianna Street, Cabana Avenue and
Roseway Street Sanitary Sewer District A°
11-57-29 City of West Covina., as shown.'on the attached map. During the course of
this investigation 63 house -to -house calls were made. Of this number 23 occupants
were not at home or did not answer the -door. Of the 40 property owners or tenants
actually contacted, 25 or 622% reported that they had experienced trouble with
their individual subsurface sewage disposal systems. They complained that the
• seepage pits filled up, causing raw sewage to backup into the house plumbing
fixtures or to overflow on to the surface of the ground., also that f re que nt
pumping and cleaning out of the seepage.pits was necessary.
The soil within the area of this proposed: sanitary sewer district consists mostly
of loam and clay. This type of soil is not.conducive to the proper function-
ing of any type of .individual subsurface sewage disposal system.
In view of our survey, I, the undersigned Health Officer of the County of Los
Angeles, officially designated by the City Council of the City of West Covina to
perform public' health services for the City of West Covina, do hereby recommend
that proceedings be instituted at once for the installation of sanitary sewers
in -Marianna Street., Cabana Avenue and Roseway Street Sanitary Sewer District,
City of West Covina, This recommendation is made as an improvement necessary
to the protection of public health and pursuant to the provisions of Section
2808 of the Streets and Highways Code,

Covina of the City of Industry°s proposed Annexations No. 10 - Located at the
• N/E corner of Valley Blvd. and Pass -Covina Road and No. 13 - Located at the SA
corner of 8th Avenue and Valley Blvd., opposite West end of the City of Industry,
and No. 14 extending from the west end of the City of Industry almost to Five
Points.
The City Clerk indicated these annexations do not affect the City of West Covina.
PETITION FOR SANITARY SEWERS Petition requesting that necessary
• steps be taken to provide sanitary
facilities in the Service Avenue Sewer District.
The City Clerk stated that the petition had 41 non -validated signatures repre-
senting a total of 45% of the district. However, the City Clerk further stated
that this petition did not have the required percentage of signatures but
there are plans to possibly combine this with District A-11-57-6, making this
fact unimportant.

that the petition be referred to the Sanitation Department for recommendation.

BOARD OF FIRE UNDERWRITERS The City Manager stated that a written report had
been received., copies of which had been presented
to Council., which confirms the reclassification
and verbal report given at the last meeting of Council.
RECREATION PROGRAM The termination arrangement has been approved by

we will be having our own recreation program.
The personnel of the district carrying on this program, other than the director,
and known as the Play or Recreation Leader will be absorbed into our program
with the recommendation of the same rates of pay. I'have this report for you
for the record and would recommend it on the basis of our, findings at budget
time that we establish a classification of Director of Parks and Recreation
with Salary Range 43.
The Director has been appointed, a Robert Gingrich of Newport Beach, at an
entering salary of $575,00 a month and a stopping salary of $115.00 a month.
He has been appointed at a salary of $641.00 a month.
We need a Recreation Supervisor at $2.00 per hour .and a Playleader at a start-
ing wage of $1.66 per hour to go to $1.93 per hour, in four steps.
